Legal Duty
Persons Conducting a Business or Undertaking(S19-26)
- WHS Act requires PCBU’s to ensure the H&S of workers, so far as is reasonably practicable.
Workers (S28 Act) - While at work, workers are required to take reasonable care for their
own H&S and that of others who are affected by their actions or omissions.
- Co-operate with any reasonable instruction, policy or procedure of PCBU to comply with WHS Act & Regs and to assist the PCBU to manage risk.
If the worker is required to wear HI Vis - The PCBU has the obligation to ensure it is worn
