What is Loss Prevention?

Loss - Worker injury resulting in lost time,

medical treatment and associated costs. Lost productivity due to real or perceived

threat of worker injury. Worker injury, property damage or

liability due to a lack of proper practices, policies and procedures.

Prevention - Identification and assessment of potential

losses. Actions taken to avoid identified potential

losses. Policies, procedures and practices aimed

at preventing loss.

What This Means to You As a Supervisor.

As a supervisor the health and safety of the workplace is your responsibility.

You make the work rules. Your attitude = worker attitude.

What Are Your Legal Responsibilities?

California Labor Code:

– 6400 - “Employers shall furnish safe employment.”– 6401- “Employers shall provide all necessary safeguards to

protect employees”.– 6401.7 - Injury prevention program.– 6403 - Requirements of employer & employees.– 6404 - Prohibition against unsafe or unhealthy work sites.– 6406 - Prohibits interfering with or neglecting to provide

safe or healthful equipment or practices.– 6423 - Defines “employer”, “supervisor” and penalties for

violations.

3203 - General Industry Injury and Illness Prevention Plan

1509 - Construction Injury and Illness Prevention Plan

Public agencies are now subject to monetary penalties. Serious Violation … $25,000.00 per occurrence! Failure to abate … $15,000.00 per day!!!

Worker’s Compensation,

Serious and willful non-compliance. Results in substantial penalties.

Penal Code …“Be a Manager & Go To Jail”

Concealing dangerous condition. Results in injury or death. Fines, imprisonment or both. May result in civil litigation.

Civil Responsibility

Civil Suits– County is not obligated to defend you.– County not responsible for penalties.

What Is a Supervisor? An empowered person. Department head to a temporary project

leader. An agent of the employer. Responsible as an employer.

What Is Your Role in Loss Prevention?

You are the “leader”.– Employees look to you for leadership.

– Your attitude determines their attitude.

You represent the commitment of the county.– The success of loss prevention depends on the

behavior of the employee.

– The employee’s behavior depends in great part on your commitment to loss prevention .
