`SEC.721.STATEMENTOFPOLICY.(42U.S.C.11431)`ThefollowingisthepolicyoftheCongress:`(1)EachStateeducationalagencyshallensurethateachchildofahomelessindividualandeachhomelessyouthhasequalaccesstothesamefree,appropriatepubliceducation,includingapublicpreschooleducation,asprovidedtootherchildrenandyouths.`(2)InanyStatewherecompulsoryresidencyrequirementsorotherrequirements,inlaws,regulations,practices,orpolicies,mayactasabarriertotheidentificationof,ortheenrollment,attendance,orsuccessinschoolof,homelesschildrenandyouths,theStateeducationalagencyandlocaleducationalagenciesintheStatewillreviewandundertakestepstorevisesuchlaws,regulations,practices,orpoliciestoensurethathomelesschildrenandyouthsareaffordedthesamefree,appropriatepubliceducationasprovidedtootherchildrenandyouths.`(3)Homelessnessisnotsufficientreasontoseparatestudentsfromthemainstreamschoolenvironment.`(4)HomelesschildrenandyouthsshouldhaveaccesstotheeducationandotherservicesthatsuchchildrenandyouthsneedtoensurethatsuchchildrenandyouthshaveanopportunitytomeetthesamechallengingStateacademicstandardstowhichallstudentsareheld.`SEC.722.GRANTSFORSTATEANDLOCALACTIVITIESFORTHEEDUCATIONOFHOMELESSCHILDRENANDYOUTHS.(42U.S.C.11432)`(a)GENERALAUTHORITY-TheSecretaryisauthorizedtomakegrantstoStatesinaccordancewiththeprovisionsofthissectiontoenablesuchStatestocarryouttheactivitiesdescribedinsubsections(d)through(g).`(b)GRANTSFROMALLOTMENTS—TheSecretaryshallmakethegrantstoStatesfromtheallotmentsmadeundersubsection(c)(1).`(c)ALLOCATIONANDRESERVATIONS-`(1)ALLOCATION-(A)Subjecttosubparagraph(B),theSecretaryisauthorizedtoallottoeachStateanamountthatbearsthesameratiototheamountappropriatedforsuchyearundersection726thatremainsaftertheSecretaryreservesfundsunderparagraph(2)andusesfundstocarryoutsection724(d)and(h),astheamountallocatedundersection1122oftheElementaryandSecondaryEducationActof1965totheStateforthatyearbearstothetotalamountallocatedundersection1122ofsuchActtoallStatesforthatyear,exceptthatnoStateshallreceivelessthanthegreaterof--

`(i)$150,000;`(ii)one-fourthof1percentoftheamountappropriatedundersection726forthatyear;or`(iii)theamountsuchStatereceivedunderthissectionforfiscalyear2001.`(B)IfthereareinsufficientfundsinafiscalyeartoallottoeachStatetheminimumamountundersubparagraph(A),theSecretaryshallratablyreducetheallotmentstoallStatesbasedontheproportionatesharethateachStatereceivedunderthissubsectionfortheprecedingfiscalyear.`(2)RESERVATIONS-(A)TheSecretaryisauthorizedtoreserve0.1percentoftheamountappropriatedforeachfiscalyearundersection726tobeallocatedbytheSecretaryamongtheUnitedStatesVirginIslands,Guam,AmericanSamoa,andtheCommonwealthoftheNorthernMarianaIslands,accordingtotheirrespectiveneedforassistanceunderthissubtitle,asdeterminedbytheSecretary.`(B)(i)TheSecretaryshalltransfer1percentoftheamountappropriatedforeachfiscalyearundersection726totheDepartmentoftheInteriorforprogramsforIndianstudentsservedbyschoolsfundedbytheSecretaryoftheInterior,asdeterminedundertheIndianSelf-DeterminationandEducationAssistanceAct(25U.S.C.450etseq.),thatareconsistentwiththepurposesoftheprogramsdescribedinthissubtitle.`(ii)TheSecretaryandtheSecretaryoftheInteriorshallenterintoanagreement,consistentwiththerequirementsofthissubtitle,forthedistributionanduseofthefundsdescribedinclause(i)undertermsthattheSecretarydeterminesbestmeetthepurposesoftheprogramsdescribedinthissubtitle.SuchagreementshallsetforththeplansoftheSecretaryoftheInteriorfortheuseoftheamountstransferred,includingappropriategoals,objectives,andmilestones.`(3)STATEDEFINED-Forpurposesofthissubsection,theterm`State'doesnotincludetheUnitedStatesVirginIslands,Guam,AmericanSamoa,ortheCommonwealthoftheNorthernMarianaIslands.`(d)ACTIVITIES-Grantsunderthissectionshallbeusedforthefollowing:`(1)Tocarryoutthepoliciessetforthinsection721intheState.`(2)Toprovideservicesandactivitiestoimprovetheidentificationofhomelesschildrenandyouths(includingpreschool-agedhomelesschildren)andenablesuchchildrenandyouthstoenrollin,attend,andsucceedinschool,including,ifappropriate,inpreschoolprograms.`(3)ToestablishordesignateintheStateeducationalagencyanOfficeoftheCoordinatorforEducationofHomelessChildrenandYouthsthatcansufficientlycarryoutthedutiesdescribedforthe

Officeinthissubtitleinaccordancewithsubsection(f).`(4)ToprepareandcarryouttheStateplandescribedinsubsection(g).`(5)Todevelopandimplementprofessionaldevelopmentprogramsforliaisonsdesignatedundersubsection(g)(1)(J)(ii)andotherlocaleducationalagencypersonnel—

(A) toimprovetheiridentificationofhomelesschildrenandyouths;and

(B) toheightentheawarenessoftheliaisonsandpersonnelof,andtheircapacitytorespondto,specificneedsintheeducationofhomelesschildrenandyouths.

`(e)STATEANDLOCALSUBGRANTS-`(1)MINIMUMDISBURSEMENTSBYSTATES-FromthesumsmadeavailableeachyeartoaStatethroughgrantsundersubsection(a)tocarryoutthissubtitle,theStateeducationalagencyshalldistributenotlessthan75percentinsubgrantstolocaleducationalagenciesforthepurposesofcarryingoutsection723,exceptthatStatesfundedattheminimumlevelsetforthinsubsection(c)(1)shalldistributenotlessthan50percentinsubgrantstolocaleducationalagenciesforthepurposesofcarryingoutsection723.`(2)USEBYSTATEEDUCATIONALAGENCY-AStateeducationalagencymayusethegrantfundsremainingaftertheStateeducationalagencydistributessubgrantsunderparagraph(1)toconductactivitiesundersubsection(f)directlyorthroughgrantsorcontracts.`(3)PROHIBITIONONSEGREGATINGHOMELESSSTUDENTS-`(A)INGENERAL-Exceptasprovidedinsubparagraph(B)andsection723(a)(2)(B)(ii),inprovidingafreepubliceducationtoahomelesschildoryouth,noStatereceivingfundsunderthissubtitleshallsegregatesuchchildoryouthinaseparateschool,orinaseparateprogramwithinaschool,basedonsuchchild'soryouth'sstatusashomeless.`(B)EXCEPTION-Notwithstandingsubparagraph(A),paragraphs(1)(J)(i)and(3)ofsubsection(g),section723(a)(2),andanyotherprovisionofthissubtitlerelatingtotheplacementofhomelesschildrenoryouthsinschools,aStatethathasaseparateschoolforhomelesschildrenoryouthsthatwasoperatedinfiscalyear2000inacoveredcountyshallbeeligibletoreceivefundsunderthissubtitleforprogramscarriedoutinsuchschoolif--`(i)theschoolmeetstherequirementsofsubparagraph(C);`(ii)anylocaleducationalagencyservingaschoolthatthehomelesschildrenandyouths

enrolledintheseparateschoolareeligibletoattendmeetstherequirementsofsubparagraph(E);and`(iii)theStateisotherwiseeligibletoreceivefundsunderthissubtitle.`(C)SCHOOLREQUIREMENTS-FortheStatetobeeligibleundersubparagraph(B)toreceivefundsunderthissubtitle,theschooldescribedinsuchsubparagraphshall--`(i)providewrittennotice,atthetimeanychildoryouthseeksenrollmentinsuchschool,andatleasttwiceannuallywhilethechildoryouthisenrolledinsuchschool,totheparentorguardianofthechildoryouth(or,inthecaseofanunaccompaniedyouth,theyouth)that--`(I)shallbesignedbytheparentorguardian(or,inthecaseofanunaccompaniedyouth,theyouth);`(II)setsforththegeneralrightsprovidedunderthissubtitle;`(III)specificallystates--`(aa)thechoiceofschoolshomelesschildrenandyouthsareeligibletoattend,asprovidedinsubsection(g)(3)(A);`(bb)thatnohomelesschildoryouthisrequiredtoattendaseparateschoolforhomelesschildrenoryouths;`(cc)thathomelesschildrenandyouthsshallbeprovidedcomparableservicesdescribedinsubsection(g)(4),includingtransportationservices,educationalservices,andmealsthroughschoolmealsprograms;and`(dd)thathomelesschildrenandyouthsshouldnotbestigmatizedbyschoolpersonnel;and`(IV)providescontactinformationforthelocalliaisonforhomelesschildrenandyouthsandtheStateCoordinatorforEducationofHomelessChildrenandYouths;`(ii)(I)provideassistancetotheparentorguardianofeachhomelesschildoryouth(or,inthecaseofanunaccompaniedyouth,theyouth)toexercisetherighttoattendtheparent'sorguardian's(oryouth's)choiceofschools,asprovidedinsubsection(g)(3)(A);and`(II)coordinatewiththelocaleducationalagencywithjurisdictionfortheschoolselectedbytheparentorguardian(oryouth),toprovidetransportationandothernecessaryservices;`(iii)ensurethattheparentorguardian(or,inthecaseofanunaccompaniedyouth,the

youth)shallreceivetheinformationrequiredbythissubparagraphinamannerandformunderstandabletosuchparentorguardian(oryouth),including,ifnecessaryandtotheextentfeasible,inthenativelanguageofsuchparentorguardian(oryouth);and`(iv)demonstrateintheschool'sapplicationforfundsunderthissubtitlethatsuchschool--`(I)iscomplyingwithclauses(i)and(ii);and`(II)ismeeting(asofthedateofsubmissionoftheapplication)thesameFederalandStatestandards,regulations,andmandatesasotherpublicschoolsintheState(suchascomplyingwithsection1111oftheElementaryandSecondaryEducationActof1965andprovidingafullrangeofeducationandrelatedservices,includingservicesapplicabletostudentswithdisabilities).`(D)SCHOOLINELIGIBILITY-Aseparateschooldescribedinsubparagraph(B)thatfailstomeetthestandards,regulations,andmandatesdescribedinsubparagraph(C)(iv)(II)shallnotbeeligibletoreceivefundsunderthissubtitleforprogramscarriedoutinsuchschoolafterthefirstdateofsuchfailure.`(E)LOCALEDUCATIONALAGENCYREQUIREMENTS-FortheStatetobeeligibletoreceivethefundsdescribedinsubparagraph(B),thelocaleducationalagencydescribedinsubparagraph(B)(ii)shall--`(i)implementacoordinatedsystemforensuringthathomelesschildrenandyouths--`(I)areadvisedofthechoiceofschoolsprovidedinsubsection(g)(3)(A);`(II)areimmediatelyenrolled,inaccordancewithsubsection(g)(3)(C),intheschoolselectedundersubsection(g)(3)(A);and`(III)arepromptlyprovidednecessaryservicesdescribedinsubsection(g)(4),includingtransportation,toallowhomelesschildrenandyouthstoexercisetheirchoicesofschoolsundersubsection(g)(3)(A);`(ii)documentthatwrittennoticehasbeenprovided--`(I)inaccordancewithsubparagraph(C)(i)foreachchildoryouthenrolledinaseparateschoolundersubparagraph(B);and`(II)inaccordancewithsubsection(g)(6)(A)(vi);`(iii)prohibitschoolswithintheagency'sjurisdictionfromreferringhomelesschildrenor

youthsto,orrequiringhomelesschildrenandyouthstoenrollinorattend,aseparateschooldescribedinsubparagraph(B);`(iv)identifyandremoveanybarriersthatexistinschoolswithintheagency'sjurisdictionthatmayhavecontributedtothecreationorexistenceofseparateschoolsdescribedinsubparagraph(B);and`(v)notusefundsreceivedunderthissubtitletoestablish--`(I)neworadditionalseparateschoolsforhomelesschildrenoryouths;or`(II)neworadditionalsitesforseparateschoolsforhomelesschildrenoryouths,otherthanthesitesoccupiedbytheschoolsdescribedinsubparagraph(B)infiscalyear2000.`(F)REPORT-`(i)PREPARATION-TheSecretaryshallprepareareportontheseparateschoolsandlocaleducationalagenciesdescribedinsubparagraph(B)thatreceivefundsunderthissubtitleinaccordancewiththisparagraph.Thereportshallcontain,ataminimum,informationon--`(I)compliancewithallrequirementsofthisparagraph;`(II)barrierstoschoolaccessintheschooldistrictsservedbythelocaleducationalagencies;`(III)theprogresstheseparateschoolsaremakinginintegratinghomelesschildrenandyouthsintothemainstreamschoolenvironment,includingtheaveragelengthofstudentenrollmentinsuchschools;and

(IV)theprogresstheseparateschoolsaremakinginhelpingallstudentsmeetthechallengingStateacademicstandards.

`(ii)COMPLIANCEWITHINFORMATIONREQUESTS-ForpurposesofenablingtheSecretarytopreparethereport,theseparateschoolsandlocaleducationalagenciesshallcooperatewiththeSecretaryandtheStateCoordinatorforEducationofHomelessChildrenandYouthsestablishedintheStateundersubsection(d)(3),andshallcomplywithanyrequestsforinformationbytheSecretaryandStateCoordinatorforsuchState.`(iii)SUBMISSION-TheSecretaryshallsubmitthereportdescribedinclause(i)to--`(I)thePresident;

`(II)theCommitteeonEducationandtheWorkforceoftheHouseofRepresentatives;and`(III)theCommitteeonHealth,Education,Labor,andPensionsoftheSenate.`(G)DEFINITION-Forpurposesofthisparagraph,theterm`coveredcounty'means--`(i)SanJoaquinCounty,California;`(ii)OrangeCounty,California;`(iii)SanDiegoCounty,California;and`(iv)MaricopaCounty,Arizona.`(f)FUNCTIONSOFTHEOFFICEOFCOORDINATOR-TheCoordinatorforEducationofHomelessChildrenandYouthsestablishedineachStateshall--`(1)gatherandmakeavailablereliable,valid,andcomprehensiveinformationon—

(A) thenumberofhomelesschildrenandyouthsidentifiedintheState,whichshallbepostedannuallyontheStateeducationalagency’swebsite;

(B) thenatureandextentoftheproblemshomelesschildrenandyouthshaveingainingaccesstopublicpreschoolprogramsandtopublicelementaryschoolsandsecondaryschools;

(C) thedifficultiesinidentifyingthespecialneedsandbarrierstotheparticipationandachievementofsuchchildrenandyouths;

(D) anyprogressmadebytheStateeducationalagencyandlocaleducationalagenciesintheStateinaddressingsuchproblemsanddifficulties;and

(E) thesuccessoftheprogramsunderthissubtitleinidentifyinghomelesschildrenandyouthsandallowingsuchchildrenandyouthstoenrollin,attend,andsucceedin,school;

`(2)developandcarryouttheStateplandescribedinsubsection(g);`(3)collectdataforandtransmittotheSecretary,atsuchtimeandinsuchmannerastheSecretarymayreasonablyrequire,areportcontaininginformationnecessarytoassesstheeducationalneedsofhomelesschildrenandyouthswithintheState,includingdatanecessaryfortheSecretarytofulfilltheresponsibilitiesundersection724(h);

`(4)inordertoimprovetheprovisionofcomprehensiveeducationandrelatedservicestohomelesschildrenandyouthsandtheirfamilies,coordinateandcollaboratewith--`(A)educators,includingteachers,specialeducationpersonnel,administrators,andchilddevelopmentandpreschoolprogrampersonnel;`(B)providersofservicestohomelesschildrenandyouthsandtheirfamilies,includingpublicandprivatechildwelfareandsocialservicesagencies,lawenforcementagencies,juvenileandfamilycourts,agenciesprovidingmentalhealthservices,domesticviolenceagencies,childcareproviders,runawayandhomelessyouthcenters,andprovidersofservicesandprogramsfundedundertheRunawayandHomelessYouthAct(42U.S.C.5701etseq.);

(C)providersofemergency,transitional,andpermanenthousingtohomelesschildrenandyouths,andtheirfamilies,includingpublichousingagencies,shelteroperators,operatorsoftransitionalhousingfacilities,andprovidersoftransitionallivingprogramsforhomelessyouths;`(D)localeducationalagencyliaisonsdesignatedundersubsection(g)(1)(J)(ii)forhomelesschildrenandyouths;and`(E)communityorganizationsandgroupsrepresentinghomelesschildrenandyouthsandtheirfamilies;`(5)providetechnicalassistancetoandconductmonitoringoflocaleducationalagenciesincoordinationwithlocaleducationalagencyliaisonsdesignatedundersubsection(g)(1)(J)(ii),toensurethatlocaleducationalagenciescomplywiththerequirementsofsubsection(e)(3)andparagraphs(3)through(7)ofsubsection(g);

(6)provideprofessionaldevelopmentopportunitiesforlocaleducationalagencypersonnelandthelocaleducationalagencyliaisondesignatedundersubsection(g)(1)(J)(ii)toassistsuchpersonnelandliaisoninidentifyingandmeetingtheneedsofhomelesschildrenandyouths,andprovidetrainingonthedefinitionsoftermsrelatedtohomelessnessspecifiedinsections103,401,and725totheliaison;and

(7)respondtoinquiriesfromparentsandguardiansofhomelesschildrenandyouths,and(in

thecaseofunaccompaniedyouths)suchyouths,toensurethateachchildoryouthwhoisthesubjectofsuchaninquiryreceivesthefullprotectionsandservicesprovidedbythissubtitle.`(g)STATEPLAN-`(1)INGENERAL-ForanyStatedesiringtoreceiveagrantunderthissubtitle,theStateeducationalagencyshallsubmittotheSecretaryaplantoprovidefortheeducationofhomeless

childrenandyouthswithintheState.Suchplanshallincludethefollowing:`(A)Adescriptionofhowsuchchildrenandyouthsare(orwillbe)giventheopportunitytomeetthesamechallengingStateacademicstandardsasallstudentsareexpectedtomeet.`(B)AdescriptionoftheprocedurestheStateeducationalagencywillusetoidentifysuchchildrenandyouthsintheStateandtoassesstheirneeds.`(C)Adescriptionofproceduresforthepromptresolutionofdisputesregardingtheeducationalplacementofhomelesschildrenandyouths.`(D)Adescriptionofprogramsforschoolpersonnel(includingliaisonsdesignatedundersubparagraph(J)(ii),principalsandotherschoolleaders,attendanceofficers,teachers,enrollmentpersonnel,andspecializedinstructionalsupportpersonnel)toheightentheawarenessofsuchschoolpersonnelofthespecificneedsofhomelesschildrenandyouths,includingsuchchildrenandyouthswhoarerunawayandhomelessyouths.`(E)AdescriptionofproceduresthatensurethathomelesschildrenandyouthswhomeettherelevanteligibilitycriteriaareabletoparticipateinFederal,State,orlocalnutritionprograms.`(F)Adescriptionofproceduresthatensurethat--`(i)homelesschildrenhaveaccesstopublicpreschoolprograms,administeredbytheStateeducationalagencyorlocaleducationalagency,asprovidedtootherchildrenintheState;`(ii)youthsdescribedinsection725(2)andyouthsseparatedfrompublicschoolsareidentifiedandaccordedequalaccesstoappropriatesecondaryeducationandsupportservices,includingbyidentifyingandremovingbarriersthatpreventyouthsdescribedinthisclausefromreceivingappropriatecreditforfullorpartialcourseworksatisfactorilycompletedwhileattendingapriorschool,inaccordancewithState,local,andschoolpolicies;and`(iii)homelesschildrenandyouthswhomeettherelevanteligibilitycriteriadonotfacebarrierstoaccessingacademicandextracurricularactivities,includingmagnetschool,summerschool,careerandtechnicaleducation,advancedplacement,on-linelearning,andcharterschoolprograms,ifsuchprogramsareavailableattheStateandlocallevels.`(G)StrategiestoaddressproblemsidentifiedinthereportprovidedtotheSecretaryundersubsection(f)(3).`(H)Strategiestoaddressotherproblemswithrespecttotheeducationofhomelesschildrenandyouths,includingproblemsresultingfromenrollmentdelaysthatarecausedby--

`(i)requirementsofimmunizationandotherrequiredhealthrecords;`(ii)residencyrequirements;`(iii)lackofbirthcertificates,schoolrecords,orotherdocumentation;`(iv)guardianshipissues;or`(v)uniformordresscoderequirements.`(I)AdemonstrationthattheStateeducationalagencyandlocaleducationalagenciesintheStatehavedeveloped,andshallreviewandrevise,policiestoremovebarrierstotheidentificationofhomelesschildrenandyouths,andtheenrollmentandretentionofhomelesschildrenandyouthsinschoolsintheState,includingbarrierstoenrollmentandretentionduetooutstandingfeesorfines,orabsences.`(J)Assurancesthatthefollowingwillbecarriedout--`(i)TheStateeducationalagencyandlocaleducationalagenciesintheStatewilladoptpoliciesandpracticestoensurethathomelesschildrenandyouthsarenotstigmatizedorsegregatedonthebasisoftheirstatusashomeless.`(ii)Thelocaleducationalagencieswilldesignateanappropriatestaffperson,abletocarryoutthedutiesdescribedinparagraph(6)(A),whomayalsobeacoordinatorforotherFederalprograms,asalocaleducationalagencyliaisonforhomelesschildrenandyouths.`(iii)TheStateandthelocaleducationalagenciesintheStatewilladoptpoliciesandpracticestoensurethattransportationisprovided,attherequestoftheparentorguardian(orinthecaseofanunaccompaniedyouth,theliaison),toandfromtheschooloforigin(asdeterminedunderparagraph(3)),inaccordancewiththefollowing,asapplicable:`(I)Ifthechildoryouthcontinuestoliveintheareaservedbythelocaleducationalagencyinwhichtheschooloforiginislocated,thechild'soryouth'stransportationtoandfromtheschooloforiginshallbeprovidedorarrangedbythelocaleducationalagencyinwhichtheschooloforiginislocated.`(II)Ifthechild'soryouth'slivingarrangementsintheareaservedbythelocaleducationalagencyoforiginterminateandthechildoryouth,thoughcontinuinghisorhereducationintheschooloforigin,beginslivinginanareaservedbyanotherlocaleducationalagency,thelocaleducationalagencyoforiginandthelocaleducationalagencyinwhichthechildoryouthislivingshall

agreeuponamethodtoapportiontheresponsibilityandcostsforprovidingthechildwithtransportationtoandfromtheschooloforigin.Ifthelocaleducationalagenciesareunabletoagreeuponsuchmethod,theresponsibilityandcostsfortransportationshallbesharedequally. (iv)TheStateandthelocaleducationalagenciesintheStatewilladoptpoliciesandpracticestoensureparticipationbyliaisonsdescribedinclause(ii)inprofessionaldevelopmentandothertechnicalassistanceactivitiesprovidedpursuanttoparagraphs(5)and(6)ofsubsection(f),asdeterminedappropriatebytheOfficeoftheCoordinator.

(iii)if,afterconductingthebestinterestdeterminationbasedonconsiderationofthepresumptioninclause(i)andthestudent-centeredfactorsinclause(ii),thelocaleducationalagencydeterminesthatitisnotinthechild’soryouth’sbestinteresttoattendtheschooloforiginortheschoolrequestedbytheparentorguardian,or(inthecaseofanunaccompaniedyouth)theyouth,providethechild'soryouth'sparentorguardianortheunaccompaniedyouthwithawrittenexplanationofthereasonsforitsdetermination,inamannerandformunderstandabletosuchparent,guardian,orunaccompaniedyouth,includinginformationregardingtherighttoappealundersubparagraph(E);and`(iv)inthecaseofanunaccompaniedyouth,ensurethatthelocaleducationalagencyliaisondesignatedunderparagraph(1)(J)(ii)assistsinplacementorenrollmentdecisionsunderthissubparagraph,givesprioritytotheviewsofsuchunaccompaniedyouth,andprovidesnoticetosuchyouthoftherighttoappealundersubparagraph(E).`(C)IMMEDIATEENROLLMENT-

(i)INGENERAL.--Theschoolselectedinaccordancewiththisparagraphshallimmediately

enrollthehomelesschildoryouth,evenifthechildoryouth—

(I) isunabletoproducerecordsnormallyrequiredforenrollment,suchaspreviousacademicrecords,recordsofimmunizationandotherrequiredhealthrecords,proofofresidency,orotherdocumentation;or

(II) hasmissedapplicationorenrollmentdeadlinesduringanyperiodofhomelessness.

`(ii)RELEVANTACADEMICRECORDS.—Theenrollingschoolshallimmediatelycontacttheschoollastattendedbythechildoryouthtoobtainrelevantacademicandotherrecords.`(iii)RELEVANTHEALTHRECORDS.—Ifthechildoryouthneedstoobtainimmunizationsorotherrequiredhealthrecords,theenrollingschoolshallimmediatelyrefertheparentorguardianof

(iv)homelessfamiliesandhomelesschildrenandyouthsreceivereferralstohealthcareservices,dentalservices,mentalhealthandsubstanceabuseservices,housingservices,andotherappropriateservices;`(v)theparentsorguardiansofhomelesschildrenandyouthsareinformedoftheeducationalandrelatedopportunitiesavailabletotheirchildrenandareprovidedwithmeaningfulopportunitiestoparticipateintheeducationoftheirchildren;`(vi)publicnoticeoftheeducationalrightsofhomelesschildrenandyouthsisdisseminatedinlocationsfrequentedbyparentsorguardiansofsuchchildrenandyouths,andunaccompaniedyouths,includingschools,shelters,publiclibraries,andsoupkitchens,inamannerandformunderstandabletotheparentsandguardiansofhomelesschildrenandyouths,andunaccompaniedyouths;`(vii)enrollmentdisputesaremediatedinaccordancewithparagraph(3)(E);`(viii)theparentorguardianofahomelesschildoryouth,andanyunaccompaniedyouth,isfullyinformedofalltransportationservices,includingtransportationtotheschooloforigin,asdescribedinparagraph(1)(J)(iii),andisassistedinaccessingtransportationtotheschoolthatisselectedunderparagraph(3)(A).

`(B)NOTICE-Statecoordinatorsestablishedundersubsection(d)(3)andlocaleducationalagenciesshallinformschoolpersonnel,serviceproviders,advocatesworkingwithhomelessfamilies,parentsandguardiansofhomelesschildrenandyouths,andhomelesschildrenandyouthsofthedutiesofthelocaleducationalagencyliaisons,andpublishanannuallyupdatedlistoftheliaisonsontheStateeducationalagency’swebsite.`(C)LOCALANDSTATECOORDINATION-Localeducationalagencyliaisonsforhomelesschildrenandyouthsshall,asapartoftheirduties,coordinateandcollaboratewithStatecoordinatorsandcommunityandschoolpersonnelresponsiblefortheprovisionofeducationandrelatedservicestohomelesschildrenandyouths.SuchcoordinationshallincludecollectingandprovidingtotheStateCoordinatorthereliable,valid,andcomprehensivedataneededtomeettherequirementsofparagraphs(1)and(3)ofsubsection(f).

thenumberofhomelesschildrenandyouthsenrolledinearlychildhoodeducationandotherpreschoolprograms,elementaryschools,andsecondaryschoolswithintheareaservedbythelocaleducationalagency,andshallconsidertheneedsofsuchchildrenandyouthsandtheabilityofthelocaleducationalagencytomeetsuchneeds.TheStateeducationalagencymayalsoconsiderthefollowing:`(A)Theextenttowhichtheproposeduseoffundswillfacilitatetheidentification,enrollment,retention,andeducationalsuccessofhomelesschildrenandyouths.`(B)TheextenttowhichtheapplicationreflectscoordinationwithotherlocalandStateagenciesthatservehomelesschildrenandyouths.`(C)Theextenttowhichtheapplicantexhibitsintheapplicationandincurrentpractice(asofthedateofsubmissionoftheapplication)acommitmenttoeducationforallhomelesschildrenandyouths.`(D)SuchothercriteriaastheStateagencydeterminesappropriate.`(3)QUALITY-Indeterminingthequalityofapplicationsunderparagraph(1),theStateeducationalagencyshallconsiderthefollowing:`(A)Theapplicant'sneedsassessmentundersubsection(b)(1)andthelikelihoodthattheprogrampresentedintheapplicationwillmeetsuchneeds.`(B)Thetypes,intensity,andcoordinationoftheservicestobeprovidedundertheprogram.`(C)Theextenttowhichtheapplicantwillpromotemeaningfulinvolvementofparentsorguardiansofhomelesschildrenoryouthsintheeducationoftheirchildren.`(D)Theextenttowhichhomelesschildrenandyouthswillbeintegratedintotheregulareducationprogram.`(E)Thequalityoftheapplicant'sevaluationplanfortheprogram.`(F)Theextenttowhichservicesprovidedunderthissubtitlewillbecoordinatedwithotherservicesavailabletohomelesschildrenandyouthsandtheirfamilies.

(G)Theextenttowhichthelocaleducationalagencywillusethesubgranttoleverageresources,includingbymaximizingnonsubgrantfundingforthepositionoftheliaisondescribedinsection722(g)(1)(J)(ii)andtheprovisionoftransportation.

(H)Howthelocaleducationalagencywillusefundstoservehomelesschildrenandyouthsundersection1113(c)(3)oftheElementaryandSecondaryEducationActof1965(20U.S.C.6313(c)(3)).`(I)Theextenttowhichtheapplicant’sprogrammeetssuchothermeasuresastheStateeducationalagencyconsidersindicativeofahigh-qualityprogram,suchastheextenttowhichthelocaleducationalagencywillprovidecasemanagementorrelatedservicestounaccompaniedyouths.`(d)AUTHORIZEDACTIVITIES-Alocaleducationalagencymayusefundsawardedunderthissectionforactivitiesthatcarryoutthepurposeofthissubtitle,includingthefollowing:`(1)Theprovisionoftutoring,supplementalinstruction,andenrichededucationalservicesthatarelinkedtotheachievementofthesamechallengingStateacademicstandardsastheStateestablishesforotherchildrenandyouths.`(2)Theprovisionofexpeditedevaluationsofthestrengthsandneedsofhomelesschildrenandyouths,includingneedsandeligibilityforprogramsandservices(suchaseducationalprogramsforgiftedandtalentedstudents,childrenwithdisabilities,andEnglishlearners,servicesprovidedundertitleIoftheElementaryandSecondaryEducationActof1965orsimilarStateorlocalprograms,programsincareerandtechnicaleducation,andschoolnutritionprograms).`(3)Professionaldevelopmentandotheractivitiesforeducatorsandspecializedinstructionalsupportpersonnelthataredesignedtoheightentheunderstandingandsensitivityofsuchpersonneltotheneedsofhomelesschildrenandyouths,therightsofsuchchildrenandyouthsunderthissubtitle,andthespecificeducationalneedsofrunawayandhomelessyouths.`(4)Theprovisionofreferralservicestohomelesschildrenandyouthsformedical,dental,mental,andotherhealthservices.`(5)Theprovisionofassistancetodefraytheexcesscostoftransportationforstudentsundersection722(g)(4)(A),nototherwiseprovidedthroughFederal,State,orlocalfunding,wherenecessarytoenablestudentstoattendtheschoolselectedundersection722(g)(3).`(6)Theprovisionofdevelopmentallyappropriateearlychildhoodeducationprograms,nototherwiseprovidedthroughFederal,State,orlocalfunding,forpreschool-agedhomelesschildren.`(7)Theprovisionofservicesandassistancetoattract,engage,andretainhomelesschildrenandyouths,particularlyhomelesschildrenandyouthswhoarenotenrolledinschool,inpublicschoolprogramsandservicesprovidedtononhomelesschildrenandyouths.

(2)DISSEMINATION.—TheSecretaryshalldisseminatethenoticenationwidetoallFederal
