Innovation – What does it mean?

• As per Wikipedia “Ever since the invention of innovation the number of definitions of innovation seems

to grow even faster than the number of researchers and practitioners in innovation.

What is more, the term innovation seems to refer to fundamentally different matters sometimes, which is the case if one colleague calls a new product an innovation while the other two consider an innovation either the process that leads to the new product or the products market diffusion.

Starting with the above mentioned minimal consensus on the elective affinity of the concept of innovation and the concept of the new, we will indeed soon find that new refers not only to time, but also to the object dimension (new compared to what?) and the social dimension (new for whom?)

• Legal provides Logistics Services legal advice and services in the areas of:– Public procurement

• Compliance with the Agreement on Internal Trade• Compliance with Procurement Policies

– Protection of confidential information– Development of Procurement Templates

– Provide advice on bidding and tendering law and general legal support for Logistics Services and facility procurement activities including drafting of public tender templates (RFQ, RFT & RFP)

– Assist the Contract Specialists with the drafting and negotiating of acceptable terms and conditions of purchase contracts, including agreements for the purchase of equipment, services & consumables

– Draft and negotiate information technology contracts, including software licenses, service level agreements, statements of work, outsourcing agreements, hardware purchases and leases, maintenance and support agreements

– Provide advice on bidding and tendering law and general legal support for Manitoba eHealth procurement activities including drafting of public tender documents

– Assist business units in negotiations with suppliers, partners and customers of Manitoba eHealth services

• The Legal Department plays an important supporting role in the Supply Chain

• The Contract Specialists are trained professionals who conduct our purchasing processes

• We provide valuable advice and guidance in the development of the processes and the conduct of those processes to ensure that the WRHA fulfills all of its obligations to the vendors

• Healthcare Service Delivery affected by: – Consumer expectations :

• Patient centered care• Reduction in boundaries• Quality service

– Monitoring, indicators, evidence based change

– Finite Resources:• Supplier Incentives

– Increased pace of change

• Legal Department of Logistics and eHealth are looking for ways to:– Speed up the procurement process– Allow for flexibility in procurement process:

• Joint/Multi Stakeholder procurements• Iterative process- allow for vendor provided

information to be part of the procurement (refined requirements)

• Common-Law, Statutory Law and Trade Agreements affect the advice that we provide and requires us to amend our documents

• Innovation also has an indirect affect on our agreements

• Innovation in technology and service delivery requires us to adapt our procurement processes and the terms and conditions of our agreements

• As a result, the Legal Departments of Logistics Services and eHealth have been working on new Terms and Conditions

• To be used initially for all Purchase Orders issued when no agreement exists for the goods or services ordered or after a RFQ process

Business Plan (12-18 months)

• The New Terms and Conditions of the Purchase Orders will be used to develop new agreements which result from our RFT and RFP processes

• The legal department will continue to educate itself on the latest development in the law of bidding and tendering and will adapt the terms and conditions

responsible for ICT needs throughout the province.• Manitoba eHealth is administratively housed within

the WRHA and is a separately funded entity.

they require, it is unlike all other health related entities.

• Approx. 100 RFR’s were issue last year.• Complex RFPs with multiple SOWs are the

norm.

Is responsible for managing all phases of capital and non-capital projects, including:

• Functional Programming• Feasibility Studies• Design• Bidding• Construction Contract Administration• Move and Occupancy Planning

Is responsible for procurement of professional services, construction, furniture and equipment in all projects for the majority of the Winnipeg Health Region

Provides leadership for master planning at each hospital site as well as assisting with the strategic plan for the WRHA

Assists other departments with RFP’s for major equipment or maintenance work, as requested
