AN ACT to amend Tennessee Code Annotated, Title 4; Title 54 and Title 55, relative totransportation.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Title 54, Chapter 5, Part 8, is amended bydeleting § 54-5-802 in its entirety and by substituting instead the following language:Section 54-5-802. As used in this part, unless the context otherwise requires:

If the Project is Qualified under Chapter 86,
TCA 54-5-804 effective September 1, 2003
For a Utility to be Eligible:
Project let for Contract Bid after September 1, 2003.
Utility must submit plans within the 120 to 165 days
Utility must have a permit for facilities on public ROW
Utility must execute a relocation agreement with the State
> Relocate Prior to the Letting
> Included in the State highway Construction Contract

Qualified projects are:
- Grade & Drain w/ROW acquisition
- Bridge replacement on State system
Projects which are NOT qualified:
Local Interstate Connectors (LIC)
Resurfacing (State or Federal funded)
State Industrial Access (SIA)
Minor intersection w/no ROW acquired
Bridge Repair
Safety
Maintenance
Signal Installation
Minor projects w/limited funding
