Dr. Custalow in his capacity as President of the above named corporation,entered a guilty plea with the understanding that it would have no effectupon him of a personal nature. A review of the files by the Office ofthe Commonwealth's Attorney in Hampton, Virginia evidenced that Dr.Custalow, in his personal capacity, was not charged with any crime inthis case. Dr. Custalow signed the plea agreement in this case as thePresident of the corporation and not in a personal capacity. Based onthis information, the Office of the Commonwealth's Attorney did notbelieve that there was a conviction of Dr. Custalow in a personalcapacity for which a pardon is required.
In determining that there was never an intent to convict Dr. Custalow inhis personal capacity in this matter and to the extent that the orders ofthe Ci rcut t Court of the Ci ty of Hampton that were entered on December20, 1989, and February 16, 1990, can be read to evidence a conviction ofDr. Custalow, that ambiguity was corrected by the Governor granting Dr.Linwood w. Custa1ow, M.D. an absolute pardon.

On June 26,1986, Halter T. Snyder, Jr., after having pled not guilty,was conv i cted of Rape, Cunni 1i ngus, Anal Intercourse, Aggravated Sexua1Battery, and Breaking and Entering. On October 14, 1986, he wassentenced to 45 years in prison.
In this case, DNA evidence that had only recently come to lightcontradi cted the strong case that was ably prosecuted by theCommonwealth's Attorney for the City of Alexandria and decided by a jury.
Virginia was one of the first states to recognize the credibility of DNAutilization as a means to identify criminal perpetrators. If;t can beused to cony; ct t 1t must a1so be used to protect the 1nnocent , Theclemency appeal 1n this case was also extraordinary because the HonorableJohn E. Kloch. the Commonwealthls Attorney. joined counsel for thepetitioner in asKing that the Governor grant a pardon.
No fau 1t coul d be found wi th the fi ndi ngs that were made by the jurybased upon the evidence that was available to it at that time. However,the evidence that had been presented to the Governor concern; ng the DNAtests that had been conducted only recently. placed a cloud upon theverdict and raised a doubt concerning the ultimate issue of whetherWalter T. Snyder, Jr. was guilty of the crime for which he was convictedin 1986. It was very possible that had DNA been perfected as a forensictool in 1986 and the jury had the advantage of the DNA analysis that hadrecently been accomplished, it would have reached a different verdict.
Based upon 1) the evidence in t~e case, 2) the DNA analysis performed byan independent laboratory. 3) the review of the DNA evidence by and theopinion of the Director of the Commonwealth1s Division of ForensicSci ence , 4) the fact that the Pet; ti oner cooperated wi th the pol i ce bysubmitting to a polygraph examination prior to trial. 5) the arguments ofcounsel for the Petitioner and the Commonwealth in support of thegranti ng of clemency, and 6) the unani mous recommendati on for clemencyfrom the Vi rg; nia Parol e Board t the Governor agreed that the use ofexecutive clemency was required in this case. As a result. the Governorgranted Walter T. Snyder. Jr. an absolute pardon on April 23. 1993.

A11 en Iverson was brought to tri ali n the Ci reui t Court for the Ci ty ofHampton and found guilty of three counts of Maiming by Mob. On September8, 1993t he received a sentence of five years on eaeh count for a totalof fifteen yearS t ten years of which were suspended.
Hi s counsel sought to have the trial court hear hi s argument that theparti cular wordi ng of his order of sentenci ng prevented him from be; ngc1assi fi ed into the systern of the Vi rgi nia Department of Correcti ons ,The failure to be classified prevented him from being considered for goodti me and conti nued to extend the ti me before he cou1d be cons i dered forparole in the same manner as other inmates. The trial judge refused tohear his plea on the grounds that he lacked jurisdiction and theDepartment of Correct; ons determined that the order had a11 the i ndi ci aof a fi na 1 order. After the Department of Correcti ons class if; ed AllenIverson, the Parole Board reviewed a request for parole from AllenIverson and has granted that request effective August 23, 1994.
The Governor found that while there was not sufficient evidence to grantthe extraordi nary re1i ef inherent ; n a tradi ti ona1 pardon t there wassuff; ci ent doubt to mer; t that Allen Iverson be granted 1i mi ted freedomand the opportunity to continue his education. The grant of ConditionalClemency was in the form of a Furlough. It was not intended to usurp thejurisdiction of the judicial system nor was it intended in any manner tocomment on the merits of Allen Iverson1s case on appeal or interrupt thatappe 11 ate process whi ch Allen Iverson was undertaki og. Inasmuch as theFurlough was in the form of a Condi ti ona1 Cl emency, however, it wassubject to Allen Iverson accepting several conditions.
On December 29, 1993, the Furlough became immediately effective and willcontinue until the effective date of his parole t August 23, 1994, unlessone or more of the conditions is violated prior to such date. On August23, 1994, the Furlough shall expire and Allen Iverson shall be subject towhatever conditions are imposed by the Parole Board and the Department ofCorrections.

Michael Richard Simmons was brought to trial in the Circuit Court for theCity of Hampton and found guilty of three counts of Maiming by Mob; twocounts of Assault and Battery by Mob; and, Disorderly Conduct. OnSeptember 8, 1993, he received a sentence of five years on each count ofMaiming by Mob, with the sentences for two counts suspended for 10years. He was a1so sentenced to twe1ve months in jail on each of theAssault and Battery by Mob charges, both of which were suspended for 10years. Finally, he was sentenced to six months in jail for theDisorderly Conduct charge, which was also suspended for 10 years.
His counsel sought to have the trial court hear his argument that theparticular wording of his order of sentencing prevented him from beingclassified in to the system of the Virginia Department of Corrections.The trial jUdge refused to hear his plea on the grounds that he lackedjurisdiction and the Department of Corrections determined that the orderhad all the indicia of a final order. After the Department ofCorrections determined that Michael Richard Simmons should be classifiedinto the State system, he submi tted a request for Executi ve C1 emencybased upon the fact that there was a reasonable doubt as to his guilt, hehad no prior criminal record, and he wished to be allowed to continue hiseducation.
After the Department of Corrections classified Michael Richard Simmons,the Parole Board rev; ewed the request for paro1e and the Board grantedthat request effective August 21, 1994.
While the Governor did not find sufficient evidence to grant theextraordi nary re 1i ef inherent ina tradi ti ana1 pardon, there wassufficient doubt to merit that Michael Richard Simmons be granted limitedfreedom and the opportuni ty to conti nue hi s educati on. Thi s grant ofConditional Clemency was given in the form of a Furlough. It is notintended to usurp the juri sdi ctlon of the judi cia1 systern nor was itintended in any manner to comment on the meri ts of Mi chae1 Ri chardSimmons' case on appeal or interrupt that appellate process which MichaelRichard Simmons was presently undertaking. Samuel Morris Wynn was brought to trial in the Circuit Court for the Cityof Hampton and found guilty of three counts of Maiming by Mob; two countsof Assault and Battery by Mob; and, Disorderly Conduct. On September 8,1993, he recei ved a sentence of fi ve years on each count of Ma i mi n9 byMob, wi th the sentences for two counts suspended for 10 years and twoyears of the fi ve years on the thi rd count suspended for 10 years. Hewas also sentenced to twelve months in jail on each of the Assault andBattery by Mob charges, both of whi ch were suspended for 10 years.Finally, he was sentenced to six months in jail for the DisorderlyConduct charge, which was also suspended for 10 years.

After obtaining such employment she must serve asa special education teacher for 5 years. If the conditions are breached,the pardon will be null and void. This pardon will not operate to erasethe fact or record of the above described offense.

Earl Washi ngton, Jr,., was brought to tri ali n the Ci rcui t Court of theCounty of Cul peper for the murder of Rebecca Lynn Wi 11 i am'S wi thpremeditation subsequent to the commission of a rape. He was tried by ajury of his peers and found guilty as charged and it fixed his punishmentat death. On March 20, 1984, the judge entered a final order imposingthe death sentence. Since that time, the defendant's case has gonethrough numerous appea1s both wi thi n the courts of the Commonweatl handthe Uni ted States. No court before whi ch an appeal has been presentedhas granted the complete relief sought.
A revi ew of the record of the tri a1 and of the appeals that were takendemonstrate that Earl Washington, Jr. received a fair trial and hisappeals were well presented and considered. Recently, newly discoveredevidence has become avail ab1e as the resu 1t of the i ni ti ati ves of theAttorney General IS Office. It is clear from precedent in past cases andbased upon discussions with the Attorney General's Office and counsel forEarl Wash; ngton, Jr. that there are no prcvi sions under Vi rgi nia 1awwhereby such newly di scovered evidence can now be considered by thecourts.
The newly discovered evidence was the result of DNA testing of biologicalsamples that had been taken from the body f the victim in the case. Theresults were discussed with the Director of the Virginia Division ofForensic Science. It was confirmed that DNA characteristics were foundwhich matched the victim, her husband, and Earl Washington, Jr. Inaddition, characteristics were found which matched none of those people.Even with the new evidence, however, questions continued to remainconcerni ng the independent va1idi ty and strength of other evidence. Areview of the trial evidence reveals that Earl Washington, Jr. hadknowledge of evidence relating to the crime which it can be argued onlythe perpetrator would have known.
Taki ng into con si derati on a11 of the foregoi ng, the Governor was of theopinion that the newly discovered evidence interjected an importantelement into the case which neither the jury that tried the case nor thecourts which have reviewed it since the trial have had the opportunity toconsider. Had that opportunity arose, the Governor was of the opinionthat their opinions as to the appropriate conclusion may have beendifferent.
On January 17, 1994, the Governor commuted the sentence of death for thecapital murder conviction to life imprisonment with the right of parole.Earl Washington, Jr.'s parole eligibility shall be determined by theappropri ate authori ti es. The commutation is condi ti oned upon hi smaintaining good conduct and cooperating with Department of Correctionsofficials. Should he commit a felony during his imprisonment, thecommutati on wi 11 be null and voi d and he wi 11 serve 1i fe i mpri sonmentwithout parole. Nothing in the commutation precludes Mr. Washington fromus; ng the new evi dence ina retri a1 shoul d the Genera1 As semb1y adoptsuch a provision.
