Judicial Review- They make sure the laws are

constitutional. Based on the Marbury vs. Madison Case

Requirements to be selected: No age qualification Citizenship/residency: no requirements Need to be nominated by the President and approved by the Senate when there is

a vacancy.

Length of term: they can serve for life.

Responsibilities: Can declare laws unconstitutional (Judicial Review) Can settle disputes involving the United States Can settle disputes between states. Chief Justice presides over impeachment trial of the president

Separation of Powers Separation of powers: is a model of

democracy that involves the separation of political power between three branches of the government:

1. The Executive 2. Legislative Branch 3. The Judicial Branch.

Each Branch has equal power Legislative Branch= Executive Branch =

Judicial Branch Each Branch has unique and separate

powers.

Checks and Balances A system where the three branches of

government have powers to limit the other branches so that no branch will become too powerful.

Each branch checks to make sure that the other branches are being fair and just.

Each branch has the ability to balance out the power by stopping (checking) the power of the others.

Who checks the Executive Branch?

Executive Leader- President The “Enforcer”

Executive Branch- President Responsible for implementing,

supporting, and enforcing the laws. Executive- enforces laws (PEEL) Executive Leader is the President. Can Serve 2 Terms (4 Years per Term) Can Serve a maximum of 10 years

Legislative Branch- Congress Makes laws The Legislative Branch consists of

Congress Congress has 2 parts:

1. Senate (2 per state)2. House of Representatives (#’s based

Judicial Branch- Supreme Court Interprets laws. The Supreme Court Makes up the Judicial Branch 9 members make up the court The courts attempt to resolve conflicts fairly in

order to protect the individual rights guaranteed by the Constitution
