A. Introduction1. Michiganhasatotalof147Delegatesand10Alternates.2. ThedelegateselectionprocessisgovernedbytheCharterandBylawsoftheDemocraticPartyofthe

UnitedStates,theDelegateSelectionRulesforthe2020DemocraticNationalConvention(“Rules”),theCallforthe2020DemocraticNationalConvention(“Call”),theRegulationsoftheRulesandBylawsCommittee for the 2020 Democratic National Convention (“Regs.”), the Rules of the MichiganDemocraticParty, theMichiganDemocraticParty’sRulesforVoting&Elections,andthisDelegateSelectionPlan.

3. Followingtheadoptionof thisDelegateSelectionPlanbytheMichiganDemocraticStateCentralCommittee,itshallbesubmittedforreviewandapprovalbytheDNCRulesandBylawsCommittee(“RBC”).TheChairof theMichiganDemocraticPartyshallbeempoweredtomakeanytechnicalrevisionstothisdocumentasrequiredbytheRBCtocorrectanyomissionsand/ordeficienciesasfoundbytheRBCtoensureitsfullcompliancewithPartyRules.SuchcorrectionsshallbemadebytheChairoftheMichiganDemocraticPartyandthePlanresubmittedtotheRBCwithin30daysofreceiptofnoticeoftheRBC’sfindings.

4. OncetheRBChasdeemedthisplancompliant,anyamendmenttothePlanbytheMichiganDemocraticPartywillbesubmittedtoandapprovedbytheRBCbeforeitbecomeseffective.

B. DescriptionOfDelegateSelectionProcess1. Michiganwilluseaproportionalrepresentationsystembasedontheresultsofagovernment-run

primaryforapportioningdelegatestothe2020DemocraticNationalConvention.2. The“firstdeterminingstep”ofMichigandelegateselectionprocesswilloccuronTuesday,March

10,2020.ThiswillbeheldinconjunctionwiththeMichiganGOPPresidentialPrimary.

3. VoterParticipationinProcessa. Participation in Michigan’s delegate selection process is open to all voters who wish to

participateasDemocrats.

(1) ToregistertovoteinMichiganyoumustbe:(a) AresidentofMichiganandthecityortownshipwhereyouareapplyingtoregisterto

voteforatleast30daysbeforeElectionDay(b) AcitizenoftheUnitedStatesofAmerica(c) Atleast18yearsofagebyelectionday(d) Notservingasentenceinjailorinprison

(2) Throughthe15thdaybeforeElectionDay(February24,2020fortheMarch10Primary),eligiblepersonsmayregisteratanySecretaryofStatebranchoffice;attheircity/townshipor countyclerk'soffice; atdesignatedstateagencies;orbymail.Eligiblepersonswhodobusiness with the Secretary of State regarding a driver's license (DL) or personalidentificationcard(PID),andwhoarenotcurrentlyregisteredtovote,willautomaticallybe

registeredunlesstheydecline.IndividualswhoupdateorrenewtheirDLorPIDonline,andwhoareeligibletovotebutnotcurrentlyregistered,willalsobeautomaticallyregisteredunlesstheydecline.

(3) Beginning on the 14th day before Election Day(February 25, 2020 for the March 10Primary)through8pmonElectionDay,eligiblepersonsmayonlyregisterinpersonattheircity/township clerk's office, and they must provide proof of residency inthatcity/township.Therefore, if a person registers in any of the following ways, theregistrationisnoteffectivefortheupcomingelection:mailregistrationpostmarkedwithin14 daysbefore Election Day;registrationduring the 14 daysbefore Election DayataSecretary of State branch office, designated state agency,orcounty clerk'soffice;orautomatic registrationduring the14daysbeforeElectionDay. Thepersonmustregister in person at their city/township clerk's office andprovide proof of residency inordertovoteintheupcomingelection.

(4) All registered voters can now vote early via absentee ballot without giving a reason.Registeredvoterscanvoteearlyfromhomebymail,ortheycanvoteearlyinpersonattheircity/townshipclerk'sofficebeginning45daysbeforeElectionDaythrough8pmonElectionDay.Absenteeballotsmustbereceivedbythecity/townshipclerkby8pmonElectionDayinordertocount;postmarkedbyElectionDaydoesn'twork.Aneligiblepersonwhoisnotyetregisteredcanregister,applyforanabsenteeballotandvoteitall inonetriptotheircity/townshipclerk'sofficebeginning45daysbeforeElectionDaythrough8pmonElectionDay.

(5) Inordertoregisterbymail,eligiblepersonsmustsubmitanapplicationtoaclerk’sofficeatleast15daysbeforeanelection.Inordertoregisterinperson,eligiblepersonsmustsubmitan application at a clerk’s office in the final 14 days before an election or at the pollinglocationonElectionDay.Eligiblepersonsmayalsoregisterautomaticallywheninteractingwiththestateregardingdriver’slicenseorstateIDcard.

(6) InordertovoteintheMarch10thPrimary,avoterisrequiredtoindicateinwriting,onaformprescribedbytheSecretaryofState,whichpoliticalpartyballotheorshewishestovote.

(7) PursuanttoMichiganElectionCode,votersarenotrequiredtodeclareapartyaffiliationasapre-requisitetoparticipatinginthePrimaryElection.Votersmuststatethepartyprimarytheywishtoparticipateinbeforereceivingaballot.

(8) TheSecretaryofStatecompilesalistfrommunicipalclerksthatcontaintheprintedname,address,andqualifiedvoterfilenumberofeachelectorandthepoliticalpartyballotselectedbythatelectoratthepresidentialprimaryelection.

(9) Within 71 days after the presidential primary election, the secretary of state shallmakeavailabletothepublic inanelectronicformatafileoftherecordsforeachpoliticalpartydescribedundersubsection(3).

b. AtnostageofMichigan’sdelegateselectionprocessshallanypersonberequired,directlyorindirectly,topayacostorfeeasaconditionforparticipating.VoluntarycontributionstotheParty may be made, but under no circumstances shall a contribution be mandatory forparticipation.

c. Votesshallnotbetakenbysecretballotatanystageofthedelegateselectionprocess,includingprocessesleadinguptotheselectionofDNCMembersorStateChairsorViceChairs,whoserve

asDNCmembersbyvirtueoftheiroffice,exceptthatuseofsuchvotingbysecretballotmaybeusedinaprocessthatisthefirstdeterminingstageofthedelegateelectionprocessandinwhichallindividualvoterswhowishtoparticipateasDemocratsareeligibletodoso.

d. NopersonsshallparticipateorvoteinthenominatingprocessfortheDemocraticpresidentialcandidate who also participates in the nominating process of any other party for thecorrespondingelections.

e. Nopersonshallvoteinmorethanonemeetingthatisthefirstmeetinginthedelegateselectionprocess.

4. Michigan is participating in the state government-run presidential preference primary thatwillutilize government-run voting systems. The Michigan Democratic Party has taken or will takeprovablepositivestepsto:a. Promote the acquisition,maintenance and regular replacement of accessible precinct based

opticalscansystems,whereverpossible.

b. Maintainsecureandaccuratestatevoterregistrationrolls,sothateveryeligibleAmericanwhoregisterstovotehastheirpersonalinformationprotectedandsecure.

c. Implement transparent and accurate voter registration list maintenance procedures thatcomplywithfederalrequirementsandensurethateveryeligiblevoterstaysontherolls.

d. Seekenactmentoflegislation,rules,andpoliciesatthestateandlocalleveltoensurethatdirectrecordingelectronicsystemsincludeavoterverifiedpapertrail.

e. Seekenactmentoflegislation;rulesandpoliciesatthestateandlocalleveltoensurethatbothoptical scan and direct recording electronic systems include recognized security measures.Thesemeasuresincludeautomaticroutinemanualauditscomparingpaperrecordstoelectronicrecords followingeveryelectionandprior tocertificationorresultswherepossible;paralleltestingonelectionday;physicalandelectronicsecurityforequipment;banninguseofwirelesscomponentsandconnectionsexceptwhererequiredtoprovideavoterwithadisabilityasecureandapprovedmeanstoaccessvotingmaterialsandexercisetherighttovote;publicdisclosureofsoftwaredesign;useof transparentandrandomselectionforallauditingprocedures;andeffectiveproceduresforaddressingevidenceoffraudorerror.

5. Theseprovablepositivestepshaveincluded:a. TheStateofMichiganmandatedtheuseofopticalscanvotingsystems in2002.TheStateof

Michigan does not use DRE systems. Currently, the State of Michigan is in the process offacilitatingastatewidebiddingprocesstoassistmunicipalitiesinupgradingtheiropticalscanvoting systems. Leftover funds from the Help America Vote Act are being used to replacemachineswhicharegreater than10yearsold.TheMichiganDemocraticParty supports thestepstakentoensurethisolderequipmentisreplaced.

b. Michiganelectionlawrequirescounty,city,township,orvillageclerktomaintaincustodyofthevotingmachines,furniture,andequipmentofthepollingplacewhennotinuseatanelection.AlltabulatorsandvotingmachinesarerequiredtobetestedpriortoElectionDay.Theoperatinglevelofvotingmachinesaresealedonceapollisofficiallyclosedandthesealcannotbebrokenuntiltheperiodforrequestingarecountisclosed.

c. TheStateofMichigandoesnotusewirelesscomponentandconnectionsintheadministeringofelections.TheStateofMichigandoesmakeavailableforusetheAutoMarkVoterAssistTerminal,

aballot-markingdeviceforpeoplewithdisabilities,inallprecincts.

d. The Michigan Bureau of Elections discloses on its website the software design and votingsystemsusedintheadministrationofelections.

e. Ifitappearsthatthereisadiscrepancyinthereturnsofanyelectiondistrict,theboardofcountycanvassersshallmakearecordofthenumberoftheseal,ifany,thenumberontheprotectivecounter,ifoneisprovided,andshallopenthecountercompartmentofthemachine,andwithoutunlockingthemachineagainstvoting,shallre-canvassthevotecastonthemachine.(1) Ifadiscrepancyremains,theclerkorauthorizedassistantoftheclerk,inthepresenceofthe

electioninspectorsandtheboardofcountycanvassers,shallunlockthevotingandcountingmechanismofthemachineandshallproceedtothoroughlyexamineandtestthemachinetodetermineandrevealthetruecauseorcauses,ifany,ofthediscrepancyinthereturnfromthemachine.Afterthecompletionoftheexamination,theclerkorauthorizedassistantoftheclerkshallthenandthereprepareastatementinwritinggivingtheresultofthetest,andthestatementshallbewitnessedby thepersonspresentandshallbe filedwith theboardofcountycanvassers.

(2) A candidate voted for at any election feels aggrieved on account of any fraud, error, ormistakeinthecanvassofthevotebytheelectioninspectorsorinthereturnsmadebytheelection inspectors may file a written petition for a recount with the board of countycanvassers.

6. InaccordancewiththeDemocraticParty’srequirementtoassessandimproveparticipationwithrespect topresidential preference and thedelegate selectionprocess,TheMichiganDemocraticParty is takingorwill take steps toestablish,withDNCassistance, year-roundvoterprotectionprogramstosupporteducational,administrative,legislative,andlitigation-basedeffortstoprotectandexpandthevoteandadvanceelectionfairnessandsecurity, includingthesixgoalsset forthbelow.Thesestepshaveincluded:

a. Expand access to voting, including by early voting, no excuse absentee, same-day voterregistration,andvotingbymail;(Rule2.I.1.a)

b. Ensurethatvotinglocationsareaccessible,fairlyplaced,andadequateinnumber,andhaveasufficientnumberofvotingmachines;(Rule2.I.1.b)

c. Speedupthevotingprocessandminimizelonglines;(Rule2.I.1.c)

d. Eliminateonerousanddiscriminatoryvoteridentificationrequirements;(Rule2.I.1.d)

e. Countandincludeinthefinaltotalballotsfromvoterswhoareeligibletovotebutcasttheirballotsinthewrongprecinct,forofficesforwhichtheyareeligibletovote;and(Rule2.I.1.e)

f. Facilitatemilitaryandoverseasvoting.(Rule2.I.1.f)

g. Increaseknowledgeofvoterdatesanddeadlines,suchas:

(1) Upto5:00p.m.,March6,2020ElectorsmayobtainanabsentvoterballotviaFirstClassmail.

(2) Upto4:00p.m.,March9,2020Electorsmayobtainanabsentvoterballotinpersoninthe

clerk’soffice.

(3) Upto8:00p.m.,March10,2020ElectionDayregistrantswithproofofresidencymayobtainandvoteanabsentvoterballotinpersonintheclerk’sofficeorvoteinpersonintheproperprecinct.

(4) Upto4:00p.m.,March10,2020EmergencyabsenteevotingforPresidentialPrimary.

7. As part of encouraging participation in the delegate selection process by registered voters, theMichigan Democratic Party is supporting efforts to make voter registration easier, includingsupporting:(Rule2.I.2)

a.Voterregistrationmodernization,includingonlinevoterregistrationandautomaticandsame-dayregistration.(Rule2.I.2.a)

b.Pre-registrationofhighschoolstudentssothattheyarealreadyregisteredoncetheyreachvotingage.(Rule2.I.2.b)

c.Restorationofvotingrightstoallpeoplewhohaveservedthetimefortheircriminalconviction,withoutrequiringthepaymentofcourtfeesorfines.(Rule2.I.2.c)

d.Same-dayorautomaticregistrationofvotersfortheDemocraticpresidentialnominatingprocess.(Rule2.I.2.d)

8. SchedulingofDelegateSelectionMeetingsa.Thedates,timesandplacesforallofficialPartymeetingsandeventsrelatedtothestate’sdelegateselectionprocesshavebeenscheduledtoencouragetheparticipationofallDemocrats.Suchmeetingswillbeginandendatreasonablehours.TheMichiganDemocraticPartyisresponsibleforselectingthedatesandtimesandlocatingandconfirmingtheavailabilityofpubliclyaccessiblefacilitiesforallofficialmeetingsandeventsrelatedtotheprocess

9. TheMichiganDemocraticPartywill consider any religiousobservations that could significantlyaffectparticipation

SECTIONII:PRESIDENTIALCANDIDATES

A. BallotAccess

APresidentialCandidategainsaccesstotheStatepresidentialpreferenceprimaryballotby

1. Notlaterthan4p.m.onNovember8,2019oftheyearbeforethepresidentialelection,theSecretaryofStateshallissuealistoftheindividualsgenerallyadvocatedbythenationalnewsmediatobepotentialpresidentialcandidatesforeachparty'snominationbythepoliticalpartiesforwhichapresidentialprimaryelectionwillbeheld.TheSecretaryofStateshallmakethelistissuedunderthis subsectionavailable to thepubliconan Internetwebsitemaintainedby theDepartmentofState.

2. Notlaterthan4p.m.oftheTuesday,November12,2019theMichiganDemocraticPartyChairshallfilewiththeSecretaryofStatealistofindividualswhomtheyconsidertobepotentialpresidentialcandidatesforthatpoliticalparty.ItistheMichiganDemocraticParty’sintenttoincludeallwidelyrecognized,legitimatecandidateswhomeettherequirementsofRule12.KoftheDNCRulesandArticleVIoftheDNCCalltoConvention.ThesecretaryofstateshallmakethelistsreceivedunderthissubsectionavailabletothepubliconanInternetwebsitemaintainedbythedepartmentofstate.In recognition of Rule 15. E of the DNC bylaws, the Michigan Democratic Party supports andendorseslegislativeeffortstomovethisstatemandateddeadlinetobenomorethan75dayspriortotheprimary.

3. Aftertheissuanceofthelistundersubsection(1)andafterreceiptofnamesfromthestatechairofeach political party under subsection (2), the Secretary of State shall notify each potentialpresidentialcandidateonthelistsoftheprovisionsofthisactrelatingtothepresidentialprimaryelection.

4. Therearenofilingfeesorpetitionrequirementsforcandidatesthatqualifyundersubsection(1)or(2)

5. Thenameofanindividualwhoisnotlistedasapotentialpresidentialcandidateinaccordancewithsubsection (1) or (2) shall be printed on the ballot for the appropriate political party for thepresidentialprimaryelectionifheorshefilesanominatingpetitionwiththesecretaryofstatenolater than 4 p.m.December 13, 2019. The nominating petition shall contain valid signatures ofregisteredandqualifiedelectorsequaltonotlessthan1/2of1%ofthetotalvotescastinforHillaryClintoninthe2016GeneralElection,or11,344signatures.AsignatureonanominatingpetitionisnotvalidifobtainedbeforeOctober1,2019.InrecognitionofRule15.EoftheDNCbylaws,theMichiganDemocraticPartysupportsandendorseslegislativeeffortstomovethisstatemandateddeadlinetobenomorethan75dayspriortotheprimary.

6. Michiganelectionlawhasnoprovisionsforwrite-incandidatesoran“uncommitted”designationonthepresidentialprimaryballot.

B. EachpresidentialcandidateshallcertifyinwritingtotheChairoftheMichiganDemocraticParty,thename(s)oftheirauthorizedrepresentative(s)byNovember4,2019.Deliverybymailoremailonly.Faxsubmissionswillbenotbeaccepted.

C. Eachpresidentialcandidateshallusetheirbesteffortstoensurethattheirrespectivedelegationwithinthestatedelegationachievestheaffirmativeactiongoalsestablishedbythisplanandareequallydividedbetweenmenandwomen.

SECTIONIII

SELECTIONOFDELEGATESANDALTERNATES

A. District-LevelDelegates

1. Michiganisallocated82district-leveldelegates.2. District-leveldelegatesshallbeelectedbycongressionaldistrictconventionsheldonSaturday,

May16,2020.Eachcongressionaldistrictpartyshallberesponsibleforprovidingfacilitiesforthedelegateselectionmeetings.Religiousobservationsthatcouldsignificantlyimpactparticipationshallbetakenintoaccount.

3. ApportionmentofDistrict-LevelDelegatesa. Michigan’s district-level delegates are apportioned among the districts based on a formula

givingequalweighttothevotefortheDemocraticcandidatesinthe2016presidentialandthe2018gubernatorialelectionsinaccordancewithRule8.A.2.Thismethodwaschosenasitisanunbiasedassessmentofourdemocraticelectorate.

b. Michigan’s total numberofdistrict-leveldelegateswill be equallydividedbetweenmenandwomensothattheoverallvariancebetweenmenandwomenwillnotexceedoneineachgroup.In the case of non-binary delegates, they shall not be counted in either themale or femalecategory.

c. Thedistrict-leveldelegatesareapportionedtodistrictsasindicatedinthefollowingchart:

4.District-LevelDelegateFilingRequirementsa.Adistrict-leveldelegatecandidatemayrunforelectiononlywithinthedistrictinwhichheorsheisregisteredtovote.

b.Anindividualcanqualifyasacandidatefordistrict-leveldelegatetothe2020DemocraticNationalConventionbyjoiningtheMichiganDemocraticPartyandbyfilingastatementofcandidacydesignatingtheirsingularpresidentialpreferenceandasignedpledgeofsupportforthepresidentialcandidatewiththeMichiganDemocraticPartyby5:00pmonApril16,2020at606Townsend,Lansing,MI48933.AnindividualcanjointhePartybycompletinganapplicationandsubmittingitbyhand-delivery,mail,e-mailorattheParty’swebsite.Anystatementofcandidacyormembershipreceivedafterthedeadline,regardlessofthereason,willnotmeetthisqualification.Adelegateoralternatecandidatemaymodifytheirsingularpresidentialpreferencebysubmittinganupdatedpledgeofsupportnolaterthanthefilingdeadline.Candidateformswillbeavailableonmichigandems.comstartingJanuary6,2020.c.Allcandidatesconsideredfordistrict-levelalternatepositionsmustmeetthesamerequirementsascandidatesfordistrict-leveldelegatepositions.Acandidatefordistrict-leveldelegatenotelectedtobeadistrict-leveldelegatemayrunforelectionasadistrict-levelalternate.

5.EqualDivisionofDistrict-LevelDelegatesa. To ensure the district-level delegates are equally divided between men and women

(determined by gender self-identification) delegate positions within each district will bedesignated by presidential preference beginningwith the highest vote-getting presidentialpreference.Thisassignmentofdelegatepositions,willcontinuewith thenexthighestvote-gettingpreferences indescendingorder,withpositionsassigned toeithermaleand femalealternatingbygenderasmathematicallypracticable,untilthegenderofeachpositionhasbeenassigned.Inthecaseofnon-binarygenderdelegates,theyshallnotbecountedineitherthemaleorfemalecategory.(Rule6.C.,Rule6.C.1&Reg.4.10)

a. TheMichigan presidential primary election is a “binding” primary. Accordingly, delegatepositionsshallbeallocatedsoastofairlyreflecttheexpressedpresidentialpreferenceoftheprimaryvotersineachdistrict.Thenationalconventiondelegatesselectedatthedistrictlevelshallbeallocatedinproportiontothepercentageoftheprimaryvotewoninthatdistrictbyeachpreference,exceptthatpreferencesfallingbelowa15%thresholdshallnotbeawardedanydelegates.b.Withinadistrict,ifnopresidentialpreferencereachesa15%threshold,thethresholdshallbethehalfthepercentageofthefront-runner.

c.ThepresidentialpreferenceofthepledgeddelegatestobeelectedatthedistrictlevelwillbedeterminedbytheresultsoftheMarch10thPrimary.1)TheChairoftheMichiganDemocraticPartyshallnotifyeachdistrictchairbyApril10,2020ofthedelegateandalternateallocationbypresidentialcandidateforeachdistrict.2)Inmakingtheallocation,theChairshallfollowthefollowingguidelines:a) Tabulate the percentage of the vote that each presidential candidate receives in the

8.DistrictConventionsa. DistrictConventionsofenrolledDemocratswillbeheldineachofMichigan's14

congressionaldistrictsonSaturday,May16,2020beginningat11:00am.

b. CertificationofEnrolledDemocratsTheChairoftheMichiganDemocraticPartyshallcertifytothedistrictchairthenamesofthoseenrolledDemocratsforeachdistrictby5:00pmonMay1,2020.

c. ParticipationinDistrictConventions1) EnrolledDemocratsshallbetheonlypersonseligibletoparticipateinthedistrict

conventions.EnrolledDemocratsincludeonlythefollowing:a) PrecinctdelegateswhoweredulyelectedattheprimaryelectionheldAugust7,2018

andDemocraticelectedofficialsassetforthinMichiganDemocraticPartyRules.Inordertovoteatthedistrictconventions,thesepersonsmustbemembersoftheMichiganDemocraticPartyonorbeforeMay16,2020.Theymaybecomemembersthatdaywhentheyregisteratthedistrictconventions.

b) MembersoftheMichiganDemocraticPartyatleastthirty(30)dayspriortoMay16,

Michigan2020DelegateSelectionPlan

2020orbyApril16,2020.Individualswhosemembershipsexpireinsidethe30daywindowareeligibletoparticipateiftheyrenewonorbeforeMay16,2020.

2) EnrolledDemocratswillbepresumedtoberegisteredMichiganvoters,orwillreach18yearsofageandregistertovoteinMichiganfortheNovember3,2020GeneralElection.

3) AnyeligiblepersonmaybecomeamemberoftheMichiganDemocraticParty,andthereexistsnorequirementforanyfinancialcontributiontothePartyinordertojoin.

d. AgendaforDistrictConventionsshallbeasfollows:1) RegistrationofEnrolledDemocrats

Inordertoregister,eachenrolledDemocratshallsignastatementofsupportforhis/herpresidential candidate indicating the county in which he/she is registered to vote andsubmitittotheCredentialsCommittee.

2) Calltoorderbydulyelectedcongressionaldistrictchair(ordesignee)servingaspermanentchair

b) UponadoptionoftheCredentialsCommitteereport,nofurtherregistrationshallbepermitted.

5) ReportoftheConventionRulesCommitteea) Acounty'sorportionofacounty's"StateAllocationofDelegateVotes"shallbeusedto

determinethenumberofvoteseachcountyorportionofacountyshallcastineachofthepresidentialcaucuseswithinthedistrict.

b) TheRulesCommitteereportshallcontaintheallocationofdelegatesaccordingtogenderamongthepresidentialcandidates.TheallocationshallbeprovidedbytheChairoftheMichiganDemocraticPartytothechairofeachcongressionaldistrictnolaterthanApril10, 2020. In assigning the delegate and alternate positions by gender the followingguidelinesshallbefollowedbytheChairoftheMichiganDemocraticParty:i. Theallocationshallstartwiththepositionsallocatedtothepresidentialcandidate

receivingthelargestnumberofvotesinthedistrictandthencontinuebyalternatingbetweenthemaleandfemaledelegatepositionsallocatedtotheotherpresidentialcandidates indecliningorderaccording to thenumberofvotes received foreachpresidentialcandidateinthecongressionaldistrict.Thefirstdelegatepositionshallbeallocatedtoamale,unlesstherearemorefemaledelegatestobeelected,inwhichcasethefirstdelegatepositionshallbeallocatedtoafemale.

6) RecessIntoPresidentialCaucusAftertheRulesCommitteereport,theconventionshallrecessintoseparatecaucusesofeachpresidentialcandidatepursuanttotheirsignedstatementofsupportforthepurposesofelectingtheirrespectivedelegates.

a) Election of permanent presidential caucus chair: Each presidential candidate (ordesignee)shallappointatemporarychairofthepresidentialcaucusforthepurposeofcalling the caucus to order andpresidingduring the electionof a permanent caucuschair,whoshallbefromthatdistrict.

b) Electionofdelegates1. The district chair shall provide each presidential caucus with a list of those

individualsapprovedbyitspresidentialcandidatefornominationasdelegates.2. All such individuals' names shall be read to the presidential caucus by the duly

elected presidential caucus chair and shall be considered nominatedwhen theirnamesareread.Noothernamesshallbeaccepted.

3. That number of male delegates allocated to the presidential caucus by theConventionRulesCommittee shall be elected according to theRulesonVoting&Elections of the Michigan Democratic Party, followed by female delegates, eachcategorybeingelectedasagroup,eachinamannerconsistentwiththoserules.Inthe case of non-binarydelegates, they shall not be counted in either themale orfemalecategory.

4. Inthevotingineachpresidentialcaucus,eachcountyorportionofacountywithinadistrictshallcastitsfull-allocatednumberofvotesaccordingtotheReportoftheRulesCommitteebythevoteofthedelegatesfromthatcountyorportionofacountyonly.Nocountyorportionofacountyshallbedeprivedofitstotalvoteunlesstherearenodelegatespresentfromthatcountyorportionofacountyinthatpresidentialcaucus. Therefore, if the actual number of delegates is less or more than theirallocatednumberofvotes,thetotalshallbeproratedtothevotesallocatedtothatcountyorportionofacountybytheReportoftheRulesCommittee.

7) ReconveningofConventiona) Attheconclusionofeachof thepresidentialcaucuses,eachpresidentialcaucuschair

shallreporttheresultsoftheelectiontothepermanentconventionchair.b) Theresultsoftheelectionshallbereadtotheconventionasawholeandanychallenge

tothoseresultsshallbeannouncedatthesametimeeitherbythepermanentconventionchairorbyamemberofthepresidentialcaucuswhoseresultsarebeingchallenged.

8) Adjournment.Immediatelyuponadjournmentofeachdistrictconvention,thedistrictchairandsecretaryshallcertifytotheChairoftheMichiganDemocraticPartytheresultsoftheelectionofdelegates,notinganychallenges.

e. RulesforDistrictConventions1) No less than forty percent (40%) of the enrolled Democrats registering at the district

conventionconstituteaquorumforanybusinesspertainingtotheselectionofdelegates.

2) Noproxiesmaybeused.3) Theunitrule,oranyrulesorpracticewherebyallmembersofapartyunit,delegationor

caucusmayberequiredtocasttheirvotesinaccordancewiththewillofamajorityofthebody,shallnotbepermitted.

4) Any individualor groupofDemocratsmay sponsoror endorsea slateof candidates for

conventiondelegates.Butnoslatemaybyvirtueofsuchendorsement,receivepreferentialtreatmentorapreferentialplaceonadelegateselectionballotorbepubliclyidentifiedasthe"official"slate,andallslatesmustmeetidenticalqualifyingrequirementsforappearingontheballot.

9.TheChairoftheMichiganDemocraticPartyshallcertifyinwritingtotheSecretaryoftheDemocraticNationalCommittee(DNC)theelectionofthestate’sdistrict-leveldelegatestotheDemocraticNationalConventionwithinten(10)daysaftertheirelection.

B. AutomaticDelegates1. AutomaticPartyLeadersandElectedOfficials

a. ThefollowingcategoriesshallconstitutetheAutomaticPartyLeadersandElectedOfficialdelegatepositions:

1) MembersoftheDemocraticNationalCommitteewholegallyresideinMichigan;2) DemocraticMembersoftheU.S.HouseofRepresentativesandtheU.S.Senate.3)DemocraticGovernor

b. ThecertificationprocessfortheAutomaticPartyLeaderandElectedOfficialdelegatesisasfollows:1) NotlaterthanMarch6,2020,theSecretaryoftheDemocraticNationalCommitteeshall

officiallyconfirmtotheChairoftheMichiganDemocraticPartythenamesoftheautomaticdelegateswholegallyresideinstate.

2) OfficialconfirmationbytheSecretaryshallconstituteverificationofautomaticdelegatesfromthecategoriesindicatedabove.

3) TheChairoftheMichiganDemocraticPartyshallcertifyinwritingtotheSecretaryoftheDNCthesingularpresidentialpreferenceofstate‘sautomaticdelegates10daysafterthecompletionofMichigan’sDelegateSelectionProcess.Adelegateoralternatecandidatemaymodifytheirsingularpresidentialpreferencebysubmittinganupdatedpledgeofsupportnolaterthanthefilingdeadline.

2. Anautomaticdelegatemayrunandbeelectedasapledgeddelegate.Ifanautomaticdelegateiselectedandcertifiedasapledgeddelegate,thatindividualshallnotserveasanautomaticdelegateatthe2020NationalConvention.

3. ForthepurposesofcreatingequaldivisionbetweendelegatemenanddelegatewomenwithinMichigan’sentireconventiondelegation(determinedbygenderself-identification),theentiredelegationincludesallpledgedandautomaticdelegates,includingthosewhoidentifyasmaleorfemale.

a. Individuals shall be eligible for the Pledged Party Leader and Elected Official Delegatepositionsaccordingtothefollowingpriority:bigcitymayorsandstate-wideelectedofficials(tobegivenequalconsideration);statelegislativeleaders,statelegislators,andotherstate,

AnindividualcanqualifyasacandidateforapositionasapledgedPLEOdelegatebyjoiningtheMichigan Democratic Party and by filing a statement of candidacy designating theirsingular presidential preference and a signed pledge of support for the presidentialcandidate with the Michigan Democratic Party by 5:00 pm on May 18, 2020 at 606Townsend,Lansing,MI48933.AnindividualcanjointhePartybycompletinganapplicationandsubmittingitbyhand-delivery,mail,e-mailorattheParty’swebsite.Anystatementofcandidacyormembershipreceivedafterthedeadline,regardlessofthereason,willnotmeetthisqualification.Adelegateoralternatecandidatemaymodifytheirsingularpresidentialpreferenceby submitting anupdatedpledgeof supportno later than the filingdeadline.Candidateformswillbeavailableonmichigandems.comstartingJanuary6,2020.

c. Failuretorespondwillbedeemedapprovalofalldelegatecandidatessubmittedtothepresidentialcandidateunlessthepresidentialcandidateortheauthorizedrepresentative(s)signifiesotherwiseinwritingtotheChairoftheMichiganDemocraticPartynotlaterthan5:00pmonMay26,2020.

4. FairReflectionofPresidentialPreferencea. At-largedelegateandalternatepositionsshallbeallocatedamongpresidentialpreferences

accordingtothedivisionofpreferencesdeterminedbytheMarch10thPrimary,providedthatnopersonparticipatingshallautomaticallyservebyvirtueofholdingapublicorPartyoffice.

b. Preferences,whichhavenot attained a15% thresholdon a statewidebasis, shall not beentitledtoanyat-largedelegates.

c. Withinadistrict,ifnopresidentialpreferencereachesa15%threshold,thethresholdshallbethehalfthepercentageofthefront-runner.

d. Ifapresidentialcandidate isnolongeracandidateatthetimeofselectionoftheat-largedelegates,thenthoseat-largeslotsthatwouldhavebeenallocatedtothecandidatewillbeproportionallydividedamongtheremainingpreferencesentitledtoanallocation.

e. Ifagivenpresidentialpreferenceisentitledtooneormoredelegatepositionsbutwouldnototherwisebeentitledtoanalternateposition,thatpreferenceshallbeallottedoneat-largealternateposition.

5. SelectionoftheAt-LargeDelegatesandAlternatesa. WilloccuronJune13,2020,ataStateCentralCommitteemeetinginthe7thCongressional

District,afterallPledgedPartyLeaderandElectedOfficialdelegateshavebeenselected.

b. TheStateCentralCommittee,inaccordancewithRule10.B,willselectthesedelegatesandalternates.Membersofthisbodywereelectedthroughanopenprocesswhichconformswiththebasicproceduralguaranteeshereinoutlined.MembersoftheMichiganDemocraticStateCentralCommitteeareelectedincaucusatspringstateconventioninoddnumberedyears.MembersoftheStateCentralCommitteewereelectedatcongressionaldistrictcaucusesinafairandopenprocessonFebruary2,2019.Eachcongressionaldistrictisallocatedanumberof delegates based upon turnout for the Democratic nominee for Secretary of State orPresident,whicheverelectionoccurredlast.PursuanttoArticle9Section16oftheCharterof the Democratic Party of the United States and Article 7 of the Rules of theMichiganDemocraticParty,delegationstotheStateCentralCommitteemustcontainanequalgenderbalancebetweendelegatesandalternates.

c. PriorityofConsideration1) In the selection of the at-large delegation priority of consideration shall be given to

AfricanAmericans,Hispanics,NativeAmericans,AsianAmericansandPacificIslanders,Arab Americans, members of the LGBT community, persons with disabilities, youngpeopleandwomen.

2) Theelectionofat-largedelegatesandalternatesshallbeused,ifnecessary,toachievetheequaldivisionofpositionsbetweenmenandwomen,andmaybeusedtoachievetherepresentationgoalsestablishedintheaffirmativeactionsectionofthisplan.

3.Themaleandfemalemembershipof[the/each]standingcommitteeshallbeasequallydividedamongmenandwomen(determinedbyself-identification)aspossibleunderthestateallocation.Inthecaseofgendernon-binarycommitteemembers,theyshallnotbecountedaseitheramaleorfemale,andtheremainderofthestandingcommitteemembersshallbeequallydividedbetweenmalegender(men)andfemalegender(women).

C.StandingCommitteeMembers

1.SelectionMeetinga. ThemembersofthestandingcommitteesshallbeelectedbyaquorumofMichigan’s

NationalConventiondelegates,atameetingtobeheldonJune13,2020immediatelyaftertheadjournmentoftheStateCentralCommittee.

b. Allmembersofthedelegationshallreceiveadequatenoticeofthetime,dateandplaceofthemeetingtoselectthestandingcommitteemembers.

2.AllocationofMembersc. The members of the standing committees allocated to Michigan shall proportionately

representthepresidentialpreferenceofallcandidatesreceivingthethresholdpercentageusedtocalculatetheAt-LargeapportionmentpursuanttoRule14.E.oftheRules.

d. Thepresidentialpreferenceofeachcandidatereceivingtheapplicablepercentageormorewithin the delegation shall be multiplied by the total number of standing committeepositionsallocatedtoMichigan.Iftheresultofsuchmultiplicationdoesnotequal0.455orabove, the presidential preference in question is not entitled to representation on thestanding committee. If the result of suchmultiplication is 0.455 but less than 1.455, thepresidentialpreferenceisentitledtoone(1)position.Thosepreferencessecuringmorethan1.455butlessthan2.455areentitledtotwo(2)positions,etc.

e. Where the application of this formula results in the total allocation exceeding the totalnumber of committee positions, the presidential candidate whose original figure ofrepresentationis farthest fromitseventualrounded-off totalshallbedeniedthatone(1)additional position.Where the application of this formula results in the total allocationfallingshortofthetotalnumberofcommitteepositions,thepresidentialcandidatewhoseoriginal figureof representation is closest to thenext rounding level shall be allotted anadditionalcommitteeposition.

f. Standingcommitteepositionsallocatedtoapresidentialcandidateshallbeproportionatelyallocated, to theextentpracticable, toeachof the threestandingcommittees.Whensuchallocationresultsinanunequaldistributionofstandingcommitteepositionsbycandidatepreference,adrawingshallbeconductedtodistributetheadditionalpositions.

3.PresidentialCandidateRightofReviewg. Eachpresidentialcandidate,orthatcandidate’sauthorizedrepresentative(s),shallbegiven

adequate notice of the date, time and location of the meeting of the state’s delegationauthorizedtoelectstandingcommitteemembers.

h. Eachpresidentialcandidate,orthatcandidate’sauthorizedrepresentative(s),mustsubmittotheChairoftheMichiganDemocraticParty,by5:00pmonJune13,2020,aminimumofone(1)nameforeachslotawardedtothatcandidateformembersofeachcommittee.Thedelegationshallselectthestandingcommitteemembersfromamongnamessubmittedbythepresidentialcandidates.Presidentialcandidatesshallnotberequiredtosubmitthenameofmorethanonepersonforeachslotawardedtosuchcandidateformembersofstandingcommittees.

4. SelectionProceduretoAchieveEqualDivisiona. Presidentialcandidatesshallusetheirbesteffortstoensurethattheirrespectivedelegation

ofstandingcommitteemembersshallachieveMichigan’saffirmativeactiongoalsandthattheir respective members are equally divided betweenmen and women determined bygenderself-identification.

b. Eachpositiononeachstandingcommitteeshallbeassignedbygender.Forexample,thefirstpositionontheCredentialsCommitteeofthepresidentialcandidatewiththemoststandingcommitteepositionsshallbedesignatedforamale,thesecondpositionforafemale,andtheremaining positions shall be designated in like fashion, alternating between males andfemales.Positionsforpresidentialcandidatesoneachcommitteeshallberankedaccordingtothetotalnumberofstandingpositionsallocatedtoeachsuchcandidate.AfterpositionsontheCredentialsCommitteearedesignatedbygender,thedesignationshallcontinuewiththePlatformCommittee,thentheRulesCommittee.

1) Aseparateelectionshallbeconductedformembershiponeachstandingcommittee.2) Themaleandfemalemembershipofthestandingcommitteeshallbeasequallydivided

amongthemenandwomenaspossibleunderthestateallocation;thevariancebetweenmenandwomeninanycommitteeoramongthethreecommitteesinaggregateshallnotexceedone.

3) Gendernon-binarycommitteemembersshallnotbecountedaseithermaleorfemale,andtheremainderofthedelegationshallbeequallydividedbetweenmalegender(men)andfemalegender(women).

4) There is no requirement that positions be assigned to gender non-binaries, but thedescribedalternationofbinarygendersmaynotbeusedtoexcludeagendernon-binaryfromconsiderationforaStandingCommitteeposition.

5) Thepositionsallocatedtoeachpresidentialcandidateoneachcommitteeshallbevotedon separately, and thewinners shallbe thehighestvote- getter(s)of theappropriategender.

5. CertificationandSubstitutiona. TheChairoftheMichiganDemocraticPartyshallcertifythestandingcommitteemembers

inwritingtotheSecretaryoftheDemocraticNationalCommitteewithinthree(3)daysaftertheirselection.

b. Nosubstitutionswillbepermittedinthecaseofstandingcommitteemembers,exceptinthecaseofresignationordeath.Substitutionsmustbemadeinaccordancewiththerulesandthe election procedures specified in this section, andmust be certified inwriting to theSecretaryoftheDemocraticNationalCommitteewithinthree(3)daysafterthesubstitutememberisselectedbutnotlaterthan48hoursbeforetherespectivestandingcommitteemeets.

A.Introduction

Michiganwillelect16personstoserveasPresidentialElectorsforthe2020PresidentialElection.EachcongressionaldistrictshallselectanelectorincaucusatstateconventiononSaturday,August29,2020.Twoelectorswillbeselectedbythestateconventiononthatsameday.Inthissection,theterm“elector”isusedtorefertobothMichiganqualifiedvotersandPresidentialElectors.

B.SelectionofPresidentialElectors

AnelectormustbearegisteredandqualifiedelectoroftheUnitedStatesforatleastoneyear,acitizenforatleast10years,andaresidentofthedistrictandstatetheyrepresent.NoSenatororRepresentativemayholdthisoffice.AnindividualshallbeconsideredineligibletoholdtheofficeiftheypresentlyholdanofficeoftrustorprofitundertheUnitedStates.Thepersonmakingthenominationincaucus,theelector,andanyonevotingintheelectionoftheelectormustbearegisteredandqualifiedelectoroftheUnitedStatesandmeetthemembershipeligibilitystandardsoutlinedinArticle3.1oftheRulesoftheMichiganDemocraticParty.TheChairoftheMichiganDemocraticPartyshallcertifythenamesandaddressesofthoseselectedaselectorstotheSecretaryofStateby4:00pmonMonday,August31,2020.

C.Affirmation

1. EachcandidateforPresidentialElectorshallcertifyinwritingthattheywillvotefortheelectionoftheDemocraticPresidentialandVicePresidentialnominees.

2. In the selection of the Presidential Electors, all persons seeking nominationmust be bona fideDemocratswhoare faithful to the interests,welfare,andsuccessof theDemocraticPartyof theUnitedStates,whosubscribetothesubstance,intentandprinciplesoftheCharterandtheBylawsoftheDemocraticPartyoftheUnitedStates.OnlythoseindividualswhosatisfypartymembershiprequirementsoutlinedinArticle3.1oftheRulesoftheMichiganDemocraticPartyshallbeeligibletostandforelectionaselector.

3. Michigan election law requires electors to cast their ballots forPresident andVicePresident in

accordancewiththenominationsmadebytheirrespectiveparty.RefusalorfailuretovoteforthecandidatesforPresidentandVicePresidentappearingontheMichiganballotofthepoliticalpartywhichnominatedtheelectorconstitutesaresignationfromtheofficeofelector,thevoteshallnotbe recorded and the remaining electors shall forthwith fill the vacancy. GENERALPROVISIONSANDPROCEDURALGUARANTEES

A. TheMichiganDemocraticPartyreaffirmsitscommitmenttoanopenpartybyincorporatingthe‘six

basicelements’aslistedbelow.TheseprovisionsdemonstratetheintentionoftheDemocraticPartytoensure a full opportunity for all minority group members to participate in the delegate selectionprocess.

1. AllpublicmeetingsatalllevelsoftheMichiganDemocraticPartyareopentoallmembersoftheDemocraticPartyregardlessofrace,sex,age,color,creed,nationalorigin,religion,ethnicidentity,sexualorientation,genderidentity,economicstatusorphysicaldisability(hereinaftercollectivelyreferredtoas“status”).

2. Notestformembershipin,noranyoathsofloyaltytotheMichiganDemocraticPartyrequiredorusedwhichhastheeffectofrequiringprospectiveorcurrentmembersoftheDemocraticPartytoacquiescein,condoneorsupportdiscriminationbasedon“status.”

3. ThetimeandplaceforallpublicmeetingsoftheMichiganDemocraticPartyonalllevelsarepublicizedfullyandinsuchmannerastoassuretimelynoticetoallinterestedpersons.SuchmeetingsareheldinplacesaccessibletoallPartymembersandlargeenoughtoaccommodateallinterestedpersons.

4. TheMichiganDemocraticParty,onalllevels,supportsthebroadestpossibleregistrationwithoutdiscriminationbasedon“status.”

5. TheMichiganDemocraticPartyshouldpublicizefullyandinsuchamannerastoassurenoticetoallinterestedpartiesafulldescriptionofthelegalandpracticalproceduresforselectionofDemocraticPartyofficersandrepresentativesonalllevels.PublicationoftheseproceduresshouldbedoneinsuchfashionthatallprospectiveandcurrentmembersofMichiganDemocraticPartywillbefullyandadequatelyinformedofthepertinentproceduresintimetoparticipateineachselectionprocedureatalllevelsoftheDemocraticPartyorganization.Aspartofthis,theMichiganDemocraticPartyshoulddevelopastrategytoprovideeducationprogramsdirectlytovoterswhocontinuetoexperienceconfusingtimelinesforregistration,changingpartyaffiliationdeadlines,orlackofawarenessoftheprocessofrunningfordelegate,toensureallDemocraticvotersunderstandtherulesandtimelinesandtheirimpactonvoterparticipation.

6. TheMichiganDemocraticPartyshouldpublicizefullyandinsuchamannerastoassurenoticetoallinterestedparties,acompletedescriptionofthelegalandpracticalqualificationsofallpositionsasofficersandrepresentativesoftheMichiganDemocraticParty.SuchpublicationshouldbedoneintimelyfashionsothatallprospectivecandidatesorapplicantsforanyelectedorappointedpositionwithintheMichiganDemocraticPartywillhavefullandadequateopportunitytocompeteforoffice.

B. Discriminationonthebasisof‘status’intheconductofMichiganDemocraticPartyaffairsisprohibited.

C. Michigan’sdelegationshallbeequallydividedbetweendelegatemenanddelegatewomen,andalternatemenandalternatewomen.Suchgoalappliestotheentiredelegation,whichincludesallpledgeddelegatesandalternatesandallunpledgeddelegates.Delegatesandalternatesshallbeconsideredseparategroupsforpurposesofachievingequaldivision.Asdeterminedbygenderself-identification.Inthecaseofgendernon-binarydelegatesoralternates,theyshallnotbecountedineitherthemaleorfemalecategory,andtheremainderofthedelegationshallbeequallydividedbygender.

D. Alldelegateandalternatecandidatesmustbeidentifiedastopresidentialpreferenceatalllevelswhichdeterminepresidentialpreference.

E. NodelegateatanylevelofthedelegateselectionprocessshallbemandatedbylaworPartyrulestovotecontrarytothatperson’spresidentialchoiceasexpressedatthetimethedelegateiselected.

F. Delegateselectedtothenationalconventionpledgedtoapresidentialcandidateshallinallgoodconsciencereflectthesentimentsofthosewhoelectedthem.

G. Alldelegates,alternatesandstandingcommitteemembersmustbebonafideDemocratswhohavetheinterests,welfareandsuccessoftheDemocraticPartyoftheUnitedStatesatheart,whosubscribetothesubstance,intentandprinciplesoftheCharterandBylawsoftheDemocraticPartyoftheUnitedStates,andwhowillparticipateintheConventioningoodfaith.

H. Fortypercent(40%)ofthemembersofanyPartybodyabovethefirstlevelofthedelegateselectionprocessshallconstituteaquorumforanybusinesspertainingtotheselectionofNationalConventiondelegates,alternates,standingcommitteemembers,andotherofficialConventionparticipants.

I. Thereshallbenoproxyvotingatacaucusorconventionorcommitteemeeting.

J. Theunitrule,oranyruleorpracticewherebyallmembersofaPartyunitordelegationmayberequiredtocasttheirvotesinaccordancewiththewillofamajorityofthebody,shallnotbeusedatanystageofthedelegateselectionprocess.

K. AnyindividualorgroupofDemocratsmaysponsororendorseaslateofcandidatesforconventiondelegates.Butnoslatemay,byvirtueofsuchendorsement,receiveapreferentialplaceonadelegateselectionballotorbepubliclyidentifiedontheballotastheofficialDemocraticPartyorganizationslate,andallslatesmustmeetidenticalqualifyingrequirementsforappearingonaballotatalllevelsofthedelegateselectionprocess.

L. Allstepsinthedelegateselectionprocess,includingthefilingofpresidentialcandidates,musttakeplacewithinthecalendaryearoftheDemocraticNationalConvention,exceptwithrespecttotheimplementationoftheAffirmativeActionPlan.

M. Inelectingandcertifyingdelegatesandalternatestothe2020DemocraticNationalConvention,MichiganherebyundertakestoassureallDemocraticvotersinthestatefull,timelyandequalopportunitytoparticipateinthedelegateselectionprocessandinallPartyaffairsandtoimplementaffirmativeactionprogramstowardthatend,andthatthedelegatesandalternatestotheConventionshallbeselectedinaccordancewiththeDelegateSelectionRulesforthe2020DemocraticNationalConvention,andthatthevotersinthestatewillhavetheopportunitytocasttheirelectionballotsforthePresidentialandVicePresidentialnomineesselectedbysaidConvention,andforelectors

pledgedformallyandingoodconsciencetotheelectionofthesePresidentialandVicePresidentialnominees,underthelabelanddesignationoftheDemocraticPartyoftheUnitedStates,andthatthedelegatescertifiedwillnotpubliclysupportorcampaignforanycandidateforPresidentorVicePresidentotherthanthenomineesfortheDemocraticNationalConvention.

SECTIONVIIIAFFIRMATIVEACTION,OUTREACHANDINCLUSIONPLAN

TheMichiganDemocraticPartyhaslongbeencommittedtobeinganopenparty,whichincludesratherthanexcludespeoplefromparticipation.InordertoencouragefullparticipationbyallDemocratsincludingethnic,religious,racial,andsexualminorities,youth,personsover65yearsofage,workers,personswitha high school education or less, the disabled, persons of low andmoderate income and other groupshistoricallyunder-represented inourPartybutwithparticularconcern forwomen,AfricanAmericans,Hispanics,ArabAmericans,Asian/PacificAmericans,NativeAmericans, peoplewithdisabilities, youngpeople and the LGBT community, theMichiganDemocratic Party has adopted andwill implement thefollowingAffirmativeActionPlan.In order to achieve full participation by groups that are historically under-represented in our Party’saffairs,weshalldevelopoutreachprograms, including recruitment, educationand training, inorder toachievefullparticipationbysuchgroupsinthedelegateselectionprocessandatalllevelsofPartyaffairs.ThisprocessisopentoallvoterswhowhichtoparticipateasDemocrats.

A. StatementofPurposeandOrganization1. PurposeandObjectives

a. InorderthattheMichiganDemocraticPartyatalllevelsbeanopenParty,whichincludesratherthan excludes people fromparticipation, a program of effective affirmative action is herebyadopted.

b. Discriminationonthebasisof“status” intheconductofMichiganDemocraticPartyaffairs isprohibited.

c. AllpublicmeetingsatalllevelsoftheMichiganDemocraticPartyshouldbeopentoallmembersoftheDemocraticPartyregardlessofactualorperceivedrace,sex,age,color,creed,nationalorigin,religion,ethnicidentity,ancestry,sexualorientationorgenderidentity,maritalstatus,economic status or physical appearance or disability (hereinafter collectively referred to as“status”)

d. ConsistentwiththeMichiganDemocraticParty’scommitmenttoincludinggroupshistoricallyunder-represented in theMichiganDemocraticParty’saffairs, thePartyhasdevelopedPartyoutreach programs. Such programs include recruitment, education and training, in order toachievefullparticipationbysuchgroupsanddiversityinthedelegateselectionprocessandatalllevelsofPartyaffairsfor2020.

e. InordertoencouragefullparticipationbyallDemocratsinthedelegateselectionprocessandinallPartyaffairs,theMichiganDemocraticPartyhasadoptedandwill implementprogramswithspecificgoalsand timetables forAfricanAmericans,Hispanics,NativeAmericans,AsianAmericansandPacific Islanders,ArabAmericans, LGBTcommunity,peoplewithdisabilities,youngpeopleandwomen.

1) ThegoaloftheprogramsshallbetoencourageparticipationinthedelegateselectionprocessandinPartyorganizationsatalllevelsbytheaforementionedgroupsasindicatedbytheirpresenceintheDemocraticelectorate.

2) Forthedelegateselectionprocess,“Youth”isdefinedasanyparticipantyoungerthan36atthetimeofelection.

3) Forthedelegateselectionprocess,individualsidentifyingasNativeAmericanshouldprovidetheirtribalaffiliationandindicateiftheyareenrolledinatribe

4) ThisgoalshallnotbeaccomplishedeitherdirectlyorindirectlybytheParty’simpositionofmandatoryquotasatanylevelofthedelegateselectionprocessorinanyotherPartyaffairs.

2. OrganizationalStructurea. AnAffirmativeActionCommitteeshallbeappointedbytheChairoftheMichiganDemocratic

PartynolaterthanMarch1,2019.b. TheChair of theMichiganDemocraticParty shall certify inwriting to theRules andBylaws

Committee of the Democratic National Committee the compliance of the State’s AffirmativeAction Committeewith Rules 5.C, 6.A and 7, and submit the names, demographic data andcontactinformationnolaterthan15daysaftertheirappointment.

c. The Committee shall consist of members from each delegate district representing theDemocraticConstituencygroupssetforthintheintroductionoftheAffirmativeActionPlan.

d. TheAffirmativeActionCommitteeshallberesponsiblefor:1) Reviewing the proposed Delegate Selection and Affirmative Action Plans and making

recommendationstotheChairoftheMichiganDemocraticParty.2) Directingthe implementationofallrequirementsof theAffirmativeActionsectionof this

Plan.

3) Implementingafinancialassistanceprogramfordelegatesandalternates.4) Ensuring,onbehalfoftheStateCentralCommittee,thatdistrictlinesusedinthedelegate

selection process are not gerrymandered to discriminate against African Americans,Hispanics,NativeAmericans,ArabAmericans,AsianAmericansandPacific Islandersandwomen.

e. FinancialandstaffsupportfortheAffirmativeActionCommitteeshallbeprovidedbytheStateCentralCommitteetothegreatestextentfeasible,including,butnotlimitedto,makingavailableon a priority basis, the Michigan Democratic Party staff and volunteers and covering allreasonablecostsincurredincarryingoutthisPlan.

3. ImplementationoftheAffirmativeActionPlanshallbeginnolaterthanSeptember13,2019withthedistributionofthepresskits,andwillcontinuethroughtheendofthedelegateselectionprocess.

B. EffortstoEducateontheDelegateSelectionProcess1. Well-publicized educationalworkshopswill be conducted in each of the congressional districts

beginninginSeptember2019.Theseworkshopswillbedesignedtoencourageparticipationinthedelegateselectionprocess,includingapprisingpotentialdelegatecandidatesoftheavailabilityoffinancialassistance.Theseworkshopswillbeheldinplaces,whichareeasilyaccessibletopersonswith physical disabilities. The times, dates, places and rules for the conduct of all education

workshops,meetingsandothereventsinvolvedinthedelegateselectionprocessshallbeeffectivelypublicizedbythepartyorganizationandincludemailingstovariousorganizationsrepresentativeoftheDemocraticvotingpopulace.

2. Aspeaker’sbureauofvolunteersfromtheAffirmativeActionCommitteecomprisedofindividualswhoarefullyfamiliarwiththeprocess,willbeorganizedtoappearbeforegroups,asneeded,toprovideinformationconcerningtheprocess.

3. TheMichigan Democratic Party’s education effortswill include outreach to community leaderswithintheDemocraticParty’sconstituenciesandmakingsurethatinformationaboutthedelegateselection process is available to Democratic clubs and Party caucuses representing specificconstituencies.

4. TheMichiganDemocratic Partywill publish andmake available at no cost: a clear and conciseexplanation of how Democratic voters can participate in the delegate selection process; anexplanationofhow,whereandwhenpersonscanregistertovote;anddelegatedistrictmaps.Aswell,theMichiganDemocraticPartyshallalsomakeavailablecopiesoftheStatePartyRules,theDelegateSelectionPlan(anditsattachments)andtheAffirmativeActionPlanatnocost.Copiesofdocumentsrelatedtothestate’sdelegateselectionprocesswillbepreparedandtheAffirmativeActionCommitteewilldistributetheminthevariousdelegatedistrictsnotlaterthanSeptember13,2020.Electroniccopieswillbeconsideredmakingcopiesavailable.

5. TheMichiganDemocraticPartyshalltakeallfeasiblestepstoencouragepersonstoregisterandtovoteasDemocratsandwillseektoensuresimpleandeasyregistrationprocedures.

C. EffortstoPublicizetheDelegateSelectionProcess1. SpecialattentionshallbedirectedatpublicizingthedelegateselectionprocessinMichigan.Such

publicityshallincludeinformationoneligibilitytovoteandhowtobecomeacandidatefordelegate,thetimeandlocationofeachstageofthedelegateselectionprocessandwheretogetadditionalinformation.Theforegoinginformationwillalsobedistributedviae-mailandonitswebsite.ThePartyorganization,official,candidate,ormembercallingameetingorschedulinganevent,shalleffectively publicize the role that suchmeeting or event plays in the selection of delegates andalternatestotheDemocraticNationalConvention.

2. Newspapers,radio,television,e-mail,andsocialMediawillbeutilizedtoinformthegeneralpublichow,whenandwheretoparticipateinthedelegateselectionprocess.Specifically,thisinformationshouldprovidedetailsastohowtoqualifytorunasadelegatecandidate.Specialeffortshallbedirectedtothemajordailynewspapers,radioandtelevisionstationsbytheChairoftheMichiganDemocraticParty,AffirmativeActionCommitteemembersandstaff.Regularreleasesduringthedelegateselectionprocesstoallothermediasources,weeklynewspapers,andwireservicesshouldcomplete timely coverage. Attached “Exhibit #2 is a listing of themedia outlets to receive thisinformation.

3. A priority effort shall be directed at publicity among the Michigan Democratic Party’sconstituencies.a. Information about the delegate selection processwill be provided to newspapers and radio

stationsrepresentingcommunitiesofcolor,ethnicpress,NativeAmerican,AsianAmericanandPacificIslanders,Spanish-speakingandothernon-Englishpress,radiostationsandpublications,andwomen’sorganizations,studentnewspapers,gayandlesbianpress,disabilitypress,andanyotherspecialtymediainthestatethatislikelytoreachtheDemocraticconstituencygroupsset

b. TheMichiganDemocraticParty shallbe responsible for the implementationof thispublicityeffort.AttachedisthelistofConstituencyandSpecialtyMediaOutletsandTargetedGroupsaspartCofExhibit#2.Forpurposesofprovidingadequatenoticeofthedelegateselectionprocess,thetimes,dates,placesandrulesfortheconductofallstepsofthedelegateselectionprocessshallbeeffectivelypublicized,multilingualwherenecessary,toencouragetheparticipationofminoritygroups.

4. NotlaterthanSeptember13,2019,apresskitshallbemadeandprovidedtoeachdailyandweeklynewspaperaswellastotheelectronicmedia.Thepresskitwillinclude:

a. Asummaryofallpertinentrulesrelatedtothestate’sdelegateselectionprocess;b. Amapofdelegatedistrictsandhowmanydelegateswillbeelectedwithineachdistrict;c. Asummaryexplainingtheoperationandimportanceofthe2020Convention;andd. Materialsdesignedtoencourageparticipationbyprospectivedelegatecandidates.

D. RepresentationGoals1. TheMichiganDemocraticPartyhasstudiedandestimatedthedemographiccompositionofAfrican

Americans, Arab Americans, Hispanics, Native Americans, and Asian Americans and PacificIslandersinMichigan’sDemocraticelectorate.Theseconstituencypercentagesshallbeestablishedasgoalsforrepresentationinthestate’sconventiondelegation.

2. TheMichiganDemocraticPartyhasdeterminedthedemographiccompositionofmembersoftheLGBTcommunity,peoplewithdisabilities,andyouth intheMichiganDemocraticElectorateandfurthermore,theMichiganDemocraticPartyhaschosentoestablishthesepercentagesasgoalsforrepresentationintheMichiganconventiondelegation.

4. Whenselectingtheat-largeportionofthedelegation,thedemographiccompositionoftheotherdelegates (district-level, pledged PLEO, and automatic) shall be compared with the MichiganDemocraticParty’sgoalsinordertoachieveanat-largeselectionprocessthathelpstobringaboutarepresentativebalance.

5. Useoftheat-largedelegationtoachievetheaffirmativeactiongoalsestablishedbythisPlandoesnot obviate the need for theMichigan Democratic Party to conduct outreach activities such asrecruitment,educationandtraining.

E. ObligationsofPresidentialCandidatestoMaximizeParticipation1. Presidential candidates shall assist theMichiganDemocratic Party inmeeting the demographic

representationgoalsreflectedintheAffirmativeActionPlan.TheMichiganDemocraticPartywillimposereasonablespecificaffirmativeactionobligationsonpresidentialcandidates.

2. Each presidential candidatemust submit awritten statement to the State Democratic Chair byNovember 4, 2019 which indicates the specific steps he or she will take to encourage fullparticipationinMichigan’sdelegateselectionprocess,including,butnotlimitedto,proceduresbywhichpersonsmayfileascandidatesfordelegateoralternate.

3. Eachpresidentialcandidatemustsubmitdemographicinformationwithrespecttoallcandidatesfordelegateandalternatepledgedtothem.Suchinformationshallbesubmittedinconjunctionwiththelistofnamesapprovedforconsiderationasdelegateandalternatecandidatespledgedtothepresidentialcandidate.

4. Presidentialcandidatesshallusetheirbestefforttoensurethattheirrespectivedelegationswithinthe state’s delegate, alternate and standing committee delegations shall achieve the affirmativeactiongoals reflected in theAffirmativeActionPlanand that the respectivedelegationsof eachpresidentialcandidateshallbeequallydividedbetweenmenandwomen.Furthermore,presidentialcandidates shall use their best efforts at the district level to approve delegate and alternatecandidateswhomeetapplicableequaldivisionandaffirmativeactionconsiderations inorder toachievetheaffirmativeactiongoalsandequaldivisionfortheirrespectivedelegations.

A. Jurisdiction&Standing1. Challengesrelated to thedelegateselectionprocessaregovernedby theRegulationsof theDNC

RulesandBylawsCommitteeforthe2020DemocraticNationalConvention(Regs.,Sec.3.),andthe“RulesofProcedureoftheCredentialsCommitteeofthe2012DemocraticNationalConvention.”

2. UnderRule21.B.ofthe2020DelegateSelectionRules,theDNCRulesandBylawsCommitteehasjurisdictionover challengespertaining to the submission, non- implementation and violationofstateDelegateSelectionandAffirmativeActionPlans.

3. TheRulesandBylawsCommitteehasjurisdictiontohearanddecideanychallengeprovideditisinitiatedbefore the56thdaypreceding thedateof the commencementof the2020DemocraticNationalConvention.

4. Challenges to the credentials of delegates and alternates to the 2020 Democratic NationalConvention initiated on or after the 56th day preceding the date of commencement of theDemocraticNationalConventionshallbeprocessedinaccordancewiththe“RulesofProcedureoftheCredentialsCommitteeofthe2020DemocraticNationalConvention.”

5. Anychallengetothecredentialsofastandingcommitteemembershallbeconsideredandresolvedby the affected standing committee in accordance with Appendix A of the Call for the 2020Democratic National Convention. The Rules and Bylaws Committee shall have jurisdiction overchallengesbroughtbeforethe56thdayprecedingthedateofthecommencementoftheDemocraticNationalConvention.

6. Copies of the Regulations of the Rules and Bylaws Committee and/or the Call for the 2020DemocraticNationalConvention, including theRulesofProcedureof theCredentialsCommittee(AppendixA),shallbemadeavailablebytheMichiganDemocraticPartyuponreasonablerequest.

7. Any group of fifteen Democrats with standing to challenge as defined in Reg. 3.2 or the Call(AppendixA,Sec.2.A.),maybringachallengetothisPlanortothe implementationofthisPlan,includingitsAffirmativeActionprovisions.

B. ChallengestotheStatusoftheStatePartyandChallengestothePlan1. AchallengetothestatusoftheMichiganDemocraticStateCentralCommitteeasthebodyentitled

tosponsoradelegationfromthatstateshallbefiledwiththeRulesandBylawsCommitteenotlaterthanthirty(30)calendardayspriortotheinitiationofthestate’sdelegateselectionprocess.

2. A challenge to the state’sDelegate Selection Plan shall be filedwith the Chair of theMichiganDemocratic Party and the Co-Chairs of the Rules and Bylaws Committeewithinfifteen(15)calendardaysaftertheadoptionofthePlanbytheStateParty.(Reg.3.4.B.)

3. AchallengetoaPlanmustbebroughtinconformitywiththeRulesandtheRegs.,whichshouldbeconsultedforadetailedexplanationofchallengeprocedures.

C. ChallengestoImplementation1. AchallengemaybebroughtallegingthataspecificrequirementofanapprovedPlanhasnotbeen

properlyimplemented.Jurisdictionoverallchallengesinitiatedinatimelyfashionshallresidewith

eithertheRulesandBylawsCommitteeortheCredentialsCommitteeoftheNationalConvention(See Section VII.A. above). However, the Rules and Bylaws Committee may provide advice,assistanceorinterpretationsoftheDelegateSelectionRulesatanystageofthedelegateselectionprocess.

2. AnimplementationchallengebroughtbeforetheRulesandBylawsCommitteeisinitiatedbyfilingawrittenchallengewiththeMichiganDemocraticStateCentralCommitteeandwiththeRulesandBylaws Committee not later than fifteen (15) days after the alleged violation occurred. TheMichiganDemocraticPartyhastwenty-one(21)daystorenderadecision.Withinten(10)daysofthedecision,anypartytothechallengemayappealittotheRulesandBylawsCommittee.Ifinfact,theMichiganDemocraticPartyrendersnodecision,anypartytothechallengemayrequesttheRulesandBylawsCommitteetoprocessit.Therequestmustbemadewithinten(10)daysafterexpirationoftheabovetwenty-one(21)dayperiod.

3. Performance under an approved Affirmative Action Plan and composition of the conventiondelegation shall be considered relevant evidence in the challenge to any state delegation.
