DEFINITIONS

ThefollowingtermsasusedintheseRuleshavethecorrespondingmeanings.

“Administrator”means,withrespecttoanyQualifyingorInternationalCompetition,theperson

appointedtoadministerthatcompetition.

“AdvancedRounds”means,withrespecttoanyQualifyingorInternationalCompetition,allofthe

applicableChampionshipRounds,SemifinalRounds,QuarterfinalRounds,OctofinalRounds,Roundsof32,

andRun-OffRoundsconductedatthatcompetition.

“Applicant”meansthesideoftheTeamarguingonbehalfoftheApplicantstateatanygivenpoint

intheCompetition.

“BenchMemorandum”meansthememorandumoflawandauthoritiesconcerningtheCompetition

ProblempreparedbytheILSAExecutiveOfficefortheexclusiveuseofCompetitionjudges,asdescribedin

Rules2.14and5.7.

“Competition”meansthe2020PhilipC.JessupInternationalLawMootCourtCompetition.

“CompetitionProblem”meanstheofficialProblemoftheCompetition(orCompromis)as

supplemented,clarified,orcorrectedbytheILSAExecutiveOffice.

“CompetitionYear”meanstheperiodstartingonthedateofthereleaseoftheCompetitionProblem

andendingattheconclusionoftheInternationalRounds.

“ExecutiveDirector”meanstheExecutiveDirectoroftheInternationalLawStudentsAssociation.

“ExhibitionTeam”meansaTeamthatisinvitedtoparticipateintheInternationalRounds,butthat

isnoteligibletowintheJessupCuportheotherawardsassociatedwiththeInternationalRounds.

“ExecutiveOffice”meanstheExecutiveOfficeoftheInternationalLawStudentsAssociation.

“FriendlyCompetition”meansacompetitionamongTeamsfrommultiplenationsorageographic

region(s),approvedbytheExecutiveDirectorinaccordancewithRule2.18,whichdoesnot,unless

otherwisespecified,determinetheTeam(s)thatwilladvancetotheInternationalRounds.

“InternationalRounds”meanstheWhite&CaseInternationalRounds,thefinalstageofthe

Competition,heldeachyearinWashingtonD.C.

“Memorial”meansthewrittenpleadingsofeachTeam,writtenandsubmittedpursuanttothese

Rules.

“NationalRound”meansanycompetitionadministeredwiththeapprovaloftheExecutiveOffice

throughwhichacountrydeterminestheTeam(s)thatwilladvancetotheInternationalRounds.

“NationalRulesSupplement”meansasetofrulespromulgatedbyanAdministratortosupplement

ormodifytheOfficialRulesforpurposesofaQualifyingcompetitioninaparticularcountry.

“OfficialTeamContact”meanstheindividualidentifiedbytheTeamduringtheregistrationprocess

forreceiptofofficialteamcorrespondence.

“OfficialSchedule”meanstheofficialtimetableoftheCompetition,settingforthallrelevantevents

anddeadlinesassociatedwiththeCompetition.

“OralRound”meansasinglematchoforalpresentationbetweentwoTeams,onerepresenting

ApplicantandonerepresentingRespondent,asdescribedinRule7.0.

“Penalty”meanstheconsequenceofaruleviolation,pursuanttoRule11.0.

“ProblemClarificationsandCorrections”meanstheofficialclarificationsandcorrectionstothe

Problem,aspublishedpursuanttoRule2.16.

“QualifyingRound”meansanycompetitionadministeredwiththeapprovaloftheILSAExecutive

OfficethroughwhichanationorgeographicregiondeterminestheTeam(s)thatwilladvancetothe

InternationalRounds.

“RegionalRound”meansanycompetitionadministeredwiththeapprovaloftheExecutiveOffice

throughwhichageographicregiondeterminestheTeam(s)thatwilladvancetotheInternationalRounds.

“Respondent”meansthesideoftheTeamarguingonbehalfoftheRespondentstateatanygiven

pointintheCompetition.

“Representative”,“NationalRepresentative,”or“RegionalRepresentative”meansaTeamselected

torepresentitsnationorregionattheInternationalRounds,whetherbyQualifyingRoundsorbyother

means.

“Rules”meanstheseOfficialRulesoftheCompetitionandanyapplicableNationalRules

Supplement.

“Team”meansateamofeligiblestudentsrecognizedbytheExecutiveOfficethatregistersto

competeintheCompetition,pursuanttoRule2.0.

“TeamAdvisor”meansanindividual,suchasacoachoradvisor,whoatanytimeduringthe

CompetitionYearhasresponsibilityfororganizing,advising,ortrainingaTeam,whetherornotamember

ofthefacultyoftheinstitutionrepresentedbytheTeam.

“TeamHomepage”meansthepersonalizedhomepageavailabletoeachTeamontheILSAWebsite.

ToaccesstheTeamHomepage,TeamMembersmustgotohttps://www.ilsa.org/jessup-competitors/.

“TeamNumber”meanstheofficial3-digitnumberassignedbytheExecutiveOfficetoeachfully

registeredandpaidTeaminaccordancewithRule3.5.

“TeamMember”meansanyeligiblestudentwhoisregisteredasacompetitoronbehalfofaTeam.

OFFICIALRULE1.0:ORGANIZATIONOFTHECOMPETITION

1.1 Administration

TheCompetitionispresentedannuallybytheInternationalLawStudentsAssociation(ILSA),andis

administeredbytheExecutiveDirectorofILSA.TheILSAExecutiveOfficeislocatedat70113thStreetNW

(12thFloor),Washington,DC20005,U.S.A.,tel:+1(202)729-2470,fax:+1(202)639-9355,email:

jessup@ilsa.org.AllmaterialsdevelopedbyILSAfortheCompetition,including,withoutlimitation,the

OfficialRulesandtheCompetitionProblem,arethesolepropertyofILSA.Thesematerialsmaynotbe

reproducedforanypurposeotherthanparticipationinoradministrationoftheCompetitionwithoutthe

expressandpriorwrittenconsentoftheExecutiveDirector.Inaddition,allMemorialsbecomethesole

propertyofILSA,andmaynotberepublishedwithoutitsexpressconsent.

1.2 StructureoftheCompetition

(a) TheCompetitionconsistsoftwolevels:(1)National/QualifyingRounds,and(2)theInternational

Rounds.QualifyingRoundsareheldineachnationorregionwheremorethanoneTeamparticipatesinthe

Competition.TheInternationalRounds,designatedastheWhite&CaseInternationalRounds,represent

thefinalleveloftheCompetition,andincludesPreliminaryRounds,AdvancedRounds,andtheWorld

ChampionshipJessupCupRound.EachleveloftheCompetitionconsistsofwrittenpleadings(Memorials)

andoralpleadings(OralRounds).

(b) TheExecutiveDirectorwilldeterminetheexactnumberofTeamsparticipatingintheInternational

Roundsandthemannerinwhichtheyarechosen,providedthateachparticipatingnationispermittedto

enteratleastoneTeamintheInternationalRoundsoftheCompetitionforeverytenTeamsparticipatingin

thatnation’sQualifyingRound(s).InnationswhereonlyoneTeamparticipates,thatTeamistheNational

RepresentativetotheInternationalRounds.

1.3 EstablishmentofNational/QualifyingRounds

IfmorethanoneTeamregistersfromaparticularnationorjurisdiction,theExecutiveDirectorwillinform

allsuchTeamsthataNational/QualifyingRoundwillbenecessarytodeterminewhichTeam(s)will

advancetotheInternationalRounds.TheNationalRepresentative(s)totheInternationalRoundswillbe

designatedsubjecttoRule1.2(b).

1.4 Administrators

(a) TheExecutiveDirectorwillappointanAdministratorforeachQualifyingRoundandwillinform

TeamsofthenameandcontactinformationoftheAdministratoroftheirQualifyingRoundassoonas

practicable.TheAdministratorwilldesignatethedateandlocationfortheQualifyingRoundandwill

conducttheQualifyingRoundinamannerconsistentwiththeseRulesandinconsultationwiththe

ExecutiveDirector.AdministratorswillconsulttheOfficialJessupScheduleandchooseadatethatallows

advancingteamsadequateopportunitytoorganizetraveltotheInternationalRounds.

(b) AnAdministratormaynotserveasaTeamAdvisororinanyotherwayassistaTeamregisteredin

hisorherQualifyingRound.AnAdministratormaynotactasajudgeinhisorherQualifyingRound,unless

necessarytosatisfyOfficialRule7.2,providedthatTeamstobejudgedbytheAdministratorprovidetheir

consent.

1.5 RulesSupplements

(a) TheExecutiveOfficeencouragesallAdministratorstoformulateaRulesSupplementfortheir

QualifyingRounds.

(b) RulesSupplementsmustbesubmittedtoandapprovedbytheExecutiveOfficebeforetheymaybe

adoptedandenforcedbyanAdministrator.AnAdministratorshallsubmitaRulesSupplementtothe

ExecutiveOfficeforapprovalassoonaspracticablebutnolaterthantwoweekspriortothe

commencementoftheQualifyingcompetition.IftheRulesSupplementmodifiesthememorialsubmission

procedure,itmustbesubmittedforapprovalnolaterthantwoweekspriortothememorialsubmission

deadlineindicatedintheOfficialSchedule.

(c) UponapprovalofaRulesSupplement,theExecutiveOfficeshallpostitontheJessupwebsite,and

theAdministratorshallimmediatelynotifyeveryaffectedteamthataRulesSupplementhasbeenapproved

andadopted.

1.6 PowertoPromulgateAdditionalMeasures

TheExecutiveDirectormaypromulgateanyothermeasuresfortheorderlyconductoftheCompetitionor

tocorrectdeficienciesintheCompetition.AftertheExecutiveOfficehasapprovedaRulesSupplement

pursuanttoOfficialRule1.5,Administratorsmay,inconsultationwithanduponpriorapprovalofthe

ExecutiveDirector,promulgateadditionalrules,modifications,orothermeasuresfortheorderlyconduct

oftheQualifyingcompetition.Anysuchproposedadditionalrules,modifications,orothermeasuresshall

notviolatethespiritoftheseRulesorthebestinterestsoftheCompetition.Anyproposedadditionalrules,

modificationsorothermeasuresshallbesubmittedtotheExecutiveOfficeassoonaspracticablefor

approvalinaccordancewithOfficialRule1.5,andonceapproved,codifiedbytheAdministratorinthe

RulesSupplementandpostedtotheJessupwebsite.

1.7 InterpretationofRules

TheExecutiveDirectorshallserveasfinalarbiterofimplementationandinterpretationoftheseRulesand

ofallRulesSupplements.

OFFICIALRULE2.0:PARTICIPATIONANDELIGIBILITY

2.1 Institutional/TeamEligibility

(a) Alleducationalinstitutionsofferingadegreeinlaworinafieldrelatedtointernationallaware

eligibletoparticipateintheCompetition.Alldeterminationsofeligibilityareinthediscretionofthe

ExecutiveDirector.Inexceptionalcases,theExecutiveDirector,inconsultationwiththerelevant

Administrator,maygranteligibilitytoinstitutionswithdegreeprogramsininternationalrelations,

providedthatadequateinstructionininternationallawwillbeavailabletoallmembersoftheTeam.

(b) EachinstitutionmayenteroneTeam,regardlessofthenumberofcolleges,departments,faculties,

orschoolswithinthatinstitution,andtheTeammayincludestudentsfromoneormoreofitscolleges,

departments,faculties,orschools(forexample,byallowingastudentinaninternationalrelationsprogram

tocompeteontheTeamwithstudentsfromitslawfaculty).However,adulyauthorizedofficerofan

institutionmaypetitiontheExecutiveDirector,inwritingandpriortothestartoftheCompetitionYear,to

allowtheparticipationofmorethanoneTeamfromthatinstitution.AdditionalTeamsmaybeallowedifit

isestablishedthateachsuchTeamfulfillstheparticipationandregistrationrequirementsoftheseRules,

andoneofthefollowingconditionsismet:(i)anintramuralcompetitionorotherTeamselectionprocess

wouldbedifficultorimpossibletoholdduetotheinstitution’sregulations,calendar,geographic

location(s),orothercircumstancesbeyondthecontroloftheinstitutionorparticipatingTeams;or(ii)the

Teamsrepresentdifferentcolleges,faculties,branches,departments,orcampusesofthesameinstitution

andwillbeparticipatingindependentlyofeachother.

(c) Aninstitutionlocatedinonejurisdiction(the“homejurisdiction”)thathasapermanentphysical

campusinanotherjurisdiction(the“foreignjurisdiction”),andthatwishestoregisteraTeamintheforeign

jurisdiction,mustpetitiontheExecutiveDirectorinwriting.TheExecutiveDirectormayconsultwiththe

Administratorinthehomeandforeignjurisdictions,requestadditionalinformationfromthepetitioning

school,andconductanindependentinvestigation.TheExecutiveDirectormaythengrantorwithhold

permissiontoentersuchTeaminthebestinterestsoftheCompetition.Permissionmaybesubjecttosuch

conditionsastheExecutiveDirectormaydetermine,including,inparticular,limitationsonthecomposition

oftheTeam(forexample,arequirementthatallTeammembersbeenrolledfulltimeattheforeign

campus).

(d) InstitutionsthathaveoutstandingdebtsforfeesorotherCompetitionobligationsarenoteligibleto

competeintheCompetitionuntilsuchfeeshavebeenpaidorobligationshavebeensatisfied.

improperoutsideassistance(OfficialRule2.8),theBenchMemorandum(OfficialRule2.14),oranother

Team’sMemorialwithoutauthorizationundertheseRules(OfficialRule2.15),maybedisqualifiedfromthe

Competition.

2.2 TeamComposition

(a) ATeammaybecomposedoftwotofiveTeamMemberswhoshallbetheonlyindividuals

contributingtotheworkproductoftheTeamoverthecourseoftheCompetitionYear.Substitutionsof

TeamMembersmustbemadeinaccordancewithRule3.6.

(b) ParticipatinginstitutionsandindividualsarenotpermittedtousethecurrentCompetitionYear’s

competitionmaterials(includingtheCompetitionProblem)foranypurposeotherthanparticipatinginthe

JessupCompetition,including,butnotlimitedto,conductinganinternalmootcourtcompetitionand/or

JessupTeamtry-outs.Teamsand/orindividualsassociatedwithinstitutionsthatviolatethisRulemaybe

disqualifiedfromtheCompetition,andinstitutionsviolatingitmaybedeemedineligibletoparticipatein

futureyears.

2.3 TeamMemberEligibility

ApersonmaybeaTeamMemberifheorshe:

(a) ispursuingalawdegree,aninternationallaw-relateddegree,oraninternationalrelations-related

degreewheretheExecutiveDirectorhasgivenpermissioninaccordancewithOfficialRule2.1(a);and

(b) intendstocompeteonbehalfofaneligibleinstitutionatwhichheorsheisenrolledasafull-timeor

part-timestudentasof(i)theTeamMemberregistrationdeadline,(ii)theinstitution’sQualifyingRounds,

or(iii)theInternationalRounds;and

(c) hasnot,afterhavinggraduatedfromanytypeoflawdegreeprogram,either(i)engagedinthe

practiceoflaw,or(ii)engagedinanypaidorunpaidactivity(outsideofdegreestudies)whichwouldgive

thestudentanundueadvantageinanyaspectoftheCompetitionoverstudentswhohavenotyet

completedtheirfirstlawdegree,andtheopinionoftheExecutiveDirectoroneitherissueshallbefinal;and

(d) hasneverparticipatedasjudge,eitherofMemorialsorinanyOralRound,atanyleveloftheJessup

Competition.

2.4 ExecutiveDirector’sWrittenPermissionRequiredinCertainCases

InadditiontosatisfyingRule2.3,apersonmustrequestandobtainthewrittenpermissionoftheExecutive

DirectortobeaTeamMemberiftheperson:

(a) isenrolledasavisitingorexchangestudentratherthanasadegreecandidate,orisotherwise

enrolledatmorethanoneinstitution;

(b) isservingasanexternorapprenticeinlieuofattendingclass;or

(c) hasalreadyreceivedagraduatedegreeorpost-graduatedegreeinalegalfield(e.g.,LL.M.,J.D.,

CanadianLL.B.,M.Phil.(InternationalLaw),JurisMaster,J.S.D.,Ph.D.);or

(d) isenrolledinaprogramofstudyleadingtoapost-graduatedegreeinalegalfield(e.g.,Ph.D.,D.Phil.

J.S.D.).

NotethatmostLL.B.degreesareconsideredundergraduatedegrees.Studentswhoarecurrently

pursuinganundergraduatedegreeinalegalfieldarenotrequiredtoobtainspecialpermissionunder

Rule2.4(c).Inaddition,studentswhoarecurrentlypursuing,buthavenotyetcompleted,theirfirst

graduatedegreeinalegalfieldarenotrequiredtoobtainspecialpermissionunderRule2.4(c).

2.5 ExecutiveDirector’sDiscretion

NotwithstandingtheprovisionsofRules2.3and2.4,theExecutiveDirectorshallhavethediscretionto

grantordenyeligibilityincertainexceptionalcircumstances,butshalldosoonlyinaccordwiththespirit

oftheseRulesandinthebestinterestsoftheCompetition.

2.6 TeamSelectionProcess

TeamMembersmaybechosenbyanymethodapprovedbytheresponsibleauthoritywithintheinstitution.

IfaninstitutionwishestoholdanintramuralcompetitiontodeterminethecompositionofitsTeam,

however,thecurrentCompetitionProblemmaynotbeused.SeeRule2.2(b).ViolationofthisRuleshallbe

penalizedaccordingtoRule2.8.

2.7 NationalityRequirements

Administratorsmaynot,withoutthewrittenapprovaloftheExecutiveDirector,setnationality

requirementswithregardtothecompositionofTeams.Requestsforsuchapprovalmuststateclearlyin

writingthereasonsforsucharequirementandmustbeincorporatedintherelevantRulesSupplement,

approvedinaccordancewiththeseRules.

2.8 OutsideAssistancetoTeams

EachTeammustresearch,write,edit,anddevelopitsownlegalandfactualargumentswithoutthe

assistanceofpersonswhoarenotTeamMembers.AnyTeamthatreceivesoutsideassistancemaybe

penalizedandmaybedisqualifiedfromtheCompetition.

2.9 AssistancefromTeamAdvisors

Asageneralprinciple,aTeamshallhaveanumberofTeamAdvisorsnolargerthanisnecessaryto

adequatelypreparetheTeamtoparticipatefairlyintheCompetition.Notwithstandingtheprovisionsof

Rule2.8,TeamAdvisorsmayprovideadvicetoaTeam,providedsuchadviceislimitedto:

(a) generalinstructiononthebasicprinciplesofinternationallaw;

(b) generaladviceonresearchsourcesandmethods;

(c) generaladviceonmemorialwritingtechniques;

(d) generaladviceonoraladvocacytechniques;

(e) generaladviceontheorganizationandstructureofargumentsintheTeam’swrittenandoral

pleadings;

(f) generalcommentaryonthequalityoftheTeam’slegalandfactualarguments;

(g) adviceontheinterpretationandenforcementoftheseRules;and

(h) adviceastopleadingoptionsorsimilarstrategicdecisions.

2.10 AssistancefromOtherTeams

TeamMembersandTeamAdvisorsfromanyTeam,includingTeamsthathavebeeneliminatedfromthe

Competition,maynotprovideassistanceinanywaytoanyotherTeam.Prohibitedassistanceincludes,but

isnotlimitedto,thefollowing:givingtheTeam’snotesorMemorialstoanadvancingTeam;postingthe

Team’sMemorialsonlinesothatapersonwhoisnotaregisteredTeamMemberorregisteredTeam

Advisormayaccessthem;engaginginpracticemootsagainstaparticipatingTeam;andprovidingvideoor

audiotapesofpreviousrounds,whetherpracticeroundsorCompetitionrounds,toanadvancingTeam.

TheExecutiveDirectormayallowforotherwiseprohibitedassistanceifdeemedtobeinthebestinterests

oftheCompetition.

2.11 JessupCourses

UnlesspriorapprovalisgrantedinwritingbytheExecutiveDirector,TeamMembersmaynotparticipate

orbeenrolledinaclassorcoursewhichusesthecurrentyear’sCompetitionProblemasasubjectmatterof

instruction,asateachingtool,orasameansforselectingTeamMembers.Noapprovalisnecessaryif

studentenrolmentinthecourseislimitedtoTeamMembers.Inanycase,evenwhenapprovalis

unnecessaryorhasbeengrantedbytheExecutiveDirector,TeamMembersmustcomplywiththeother

provisionsofOfficialRule2.8regardingoutsideassistance.StudentsenrolledinaJessupcoursewhoare

notselectedtobeTeamMembersmaynotshareordiscusstheirworkwithTeamMembers.

2.12 DraftMemorials

BeforeMemorialsaresubmitted,Teamsmaynotdistributetheirmemorialstoanyonewhoisnota

registeredTeamMemberoraregisteredTeamAdvisor.RegisteredTeamAdvisorsmayprovidefeedback

onmemorialsatanytimeprovidedtheyabidebytheprovisionsofRule2.9withrespecttothepermissible

advicethatcanbegiventotheTeam.

2.13 PracticeRounds

(a) Teamsmayorganize“practicerounds”oforalpleadingsinvolvingtheCompetitionProblemto

preparefortheCompetition.Inpracticerounds,thepersonspresentingargumentsfortheApplicantand

RespondentmustbefromthesameTeam.

(b) RegisteredTeamAdvisorsmayserveasjudgesinpracticeroundsheldatanytimeprovidedthey

abidebytheprovisionsofRule2.9.

(c) AnindividualwhoisnotaregisteredTeamMemberorregisteredTeamAdvisormayserveasa

judgeinaTeam’spracticeroundsifheorshe:

(i) doessoonlyafterthesubmissionofMemorials;

(ii) isnotformallyaffiliatedwithanyotherTeamintheCompetition;

(iii) hasnotobtainedaccesstotheBenchMemorandum;

(iv) confineshisorherfeedbacktogeneralcommentaryontheadvocacystyleandtechniqueof

thespeakers,andtocommentaryrespectingthegeneralrulesofinternationallaw;and

(v) refrainsfromofferingcommentaryorsuggestionsaboutspecificsubstantivearguments.

2.14 ConfidentialityoftheBenchMemorandum

(a) TheBenchMemorandumisstrictlyconfidential.TheExecutiveDirectorwilldisqualifyanyTeam

thatmakesuseoftheBenchMemorandum.TeamswhoobtainacopyoftheBenchMemorandumshould

immediatelyreturnittotheExecutiveDirectorwithoutexaminingthecontents.

(b) TheBenchMemorandummaybeusedonlyatanofficialQualifyingCompetitionorthe

InternationalRounds.

(c) IndividualswhohaveobtainedaccesstotheBenchMemorandummaynotjudgepracticerounds.

2.15 UseofOpposingTeam’sMemorialsandArguments

ATeammaynotvieworotherwisebecomeprivytoanyMemorialotherthanitsownandtheApplicantor

RespondentMemorialsofeachofitsscheduledopponents.Ateammayincorporateargumentsandother

informationfromtheMemorialsandOralRoundsofotherTeamsthattheTeamisauthorizedtoviewor

hearunderthisRule.

2.16 ProblemCorrectionsandClarifications

TeamsmayrequestclarificationsandcorrectionstotheCompetitionProblembysubmittingawritten

requesttotheExecutiveOfficethroughtheonlinesystemprovidedforthatpurposeatwww.ilsa.orgbythe

dateintheOfficialSchedule.BasedupontherequestsreceivedfromallTeams,theExecutiveOfficewill

publishProblemCorrectionsandClarificationsbythedateintheOfficialSchedule.EachTeammustensure

thatitreceivesandadequatelynotestheProblemCorrectionsandClarificationsinpreparationforthe

Competition.

2.17 AnonymityofTeams

Teamsmustnotrevealtheidentityoftheirinstitutionorcountryoforigintojudgesatanytimeduringa

competition.TheAdministratormaydisqualifyorimposeaPenaltyagainstanyTeamthatintentionallyor

inadvertentlydisclosesitsschoolorcountryoforigintoajudgeduringacompetition,whetherornotsuch

disclosureoccursduringanOralRound.Allinstancesofdisclosureduringacompetitionshallbereported

totheExecutiveOffice.Forthesakeofclarification,merelypostingpicturesofaJessupTeamorTeam

Member(s)onsocialmediaorapubliclyavailablewebsite,absentotherfacts,doesnotconstitutea

violationofthisRule.

2.18 “Friendly”Competitions

NotwithstandinganyotherprovisionintheseRules(inparticular,Rules2.8and2.10),theExecutive

Directormay,inhisorhersolediscretion,authorizetheholdingofoneormore“Friendly”Competitions.

SuchcompetitionsmayinvolvetheexchangeofMemorials,theviewingofoneormoreotherTeams’oral

arguments,andquestioningandevaluationfromjudges.Inauthorizingsuchacompetition,theExecutive

DirectorshallmakeorapprovearulessupplementthatshallincludewhichTeamsareeligibleto

participateinthecompetitionandhowthecompetitionistobeadministeredandconducted.Noteammay

participateinmorethanoneFriendlyCompetitioninthesameyear.

3.1 TeamRegistration

(a) EachTeammustregisterwiththeExecutiveOfficebycompletingaregistrationformonlineat

https://www.ilsa.org/jessup-competitors/andpayingtheappropriateregistrationfeebythedeadlinein

theOfficialSchedule.EachTeammustprovideavalidemailaddressatregistration.Noticesenttothe

registeredemailaddressfortheTeamContactconstitutesnoticetoallTeamMembers.

(b) AllTeamMembersandTeamAdvisorsareexpectedtoregularlychecktheirTeamHomepagefor

updatesandannouncementsandareassumedtohavedoneso.ATeammaynotvalidlycomplainthatit

wasnotgivenpropernoticeofarulechangeorupdate,whenthatchangeorupdatewasmadeavailableon

theTeamHomepage.

(c) AsaconditionofparticipatinginaQualifyingCompetition,theQualifyingCompetition

Administratormay,withtheconsentoftheExecutiveDirector,levyareasonablefeetodefraythecostsof

organizingthatCompetition.

3.2 WaiverofRegistrationFee

(a) TeamsunabletopayinfulltheregistrationfeeleviedpursuanttoRule3.1(a)mayapplyfora

waiverordiscountfromtheExecutiveOffice,whichtheExecutiveOfficemaygrantonlyinexceptional

circumstances.QualifyingRoundAdministratorsdonothaveauthoritytograntwaiversordiscountsof

registrationfeesleviedpursuanttoRule3.1(a).Requestsforwaiversordiscountsshouldbesubmittedvia

theonlineformlocatedathttps://www.ilsa.org/jessup-competitors/andontheTeamHomepage.

(b) AnyrequestforawaiverordiscountofafeeleviedpursuanttoRule3.1(c)shouldbeaddressedto

theQualifyingCompetitionAdministratorinthefirstinstance.Anyappealfromadecisiontakenbythe

QualifyingCompetitionAdministratorshouldbeaddressedtotheExecutiveDirector.

3.3 TeamMemberRegistration

(a) EverystudentwhocontributestotheworkproductoftheTeam,atanypointintheCompetition

Year,mustberegisteredasaTeamMemberandcountedtowardthemaximumoffiveTeamMembersthat

constitutethatTeam.ConductingresearchforaTeam’soraland/orwrittenarguments,writinganypartof

aTeam’sMemorial,andpresentinganyofaTeam’soralargumentsareexamplesofactivitiesthat

contributetoaTeam’sworkproduct.StudentsdesignatedbyaschoolorbyaTeamasalternateorback-up

teammembersmaynotberegisteredasTeamMembersandmaynotcontributetotheTeam’swork

product.

(b) EachregisteredTeamMembermayserveanyTeamMemberrole,suchasresearcher,writer,oralist

fortheApplicant,andoralistfortheRespondent,andmayservemultipleorallTeamMemberroles,atany

timeduringtheCompetitionYear.TeamMembersdonotneedtoregisterorotherwisedesignatewithILSA

theirparticularrole(s)ontheteam.

(c) ItistheresponsibilityoftheTeamtoensurethatstudentsareeligibleundertheprovisionsofRule

2.3,orhavesubmittedarequestforspecialpermissionasrequiredunderRule2.4,priortocontributingto

theTeam’sworkproduct.

(d) RegisteredTeamMemberswithpendingrequestsforspecialpermissionmaycontributetothe

Team’sworkproductwhileawaitingILSA’sdecisionregardingsuchrequests.IftheExecutiveDirector

deniesarequest,therequestingTeamMembermustimmediatelyceasecontributingtotheTeam’swork

productandtheTeammustdiscardallworkproducedbytheineligibleTeamMember.

(e) ThenameofeachTeamMemberandthedegreeprograminwhichheorsheisenrolledmustbe

registeredwiththeExecutiveOffice,viatheonlineregistrationformlocatedunderthe“Profile”linkonthe

Team’sHomepage,bytheregistrationdeadlineintheOfficialSchedule.

3.4 TeamAdvisorRegistration

ThenameofeachTeamAdvisorforaTeammustberegisteredwiththeExecutiveOfficebytheTeam

registrationdeadlineintheOfficialSchedule.TeamAdvisorsmustberegisteredbycompletingtheonline

registrationformlocatedunderthe“Profile”linkoneachTeam’sTeamHomepage.Anindividualsitting

onlyasapracticeroundjudgepursuanttoRule2.13,whetherornotamemberofthefacultyofthe

institutionrepresentedbytheTeam,neednotregisterasaTeamAdvisor.

3.5 TeamNumberasIdentification

OnceaTeamhascompletedregistration,includingpayinginfulltheappropriateregistrationfee,the

ExecutiveOfficewillassigntheTeamanofficialTeamNumber.

3.6 ChangestoRegistrationInformation

OnceTeamMembersandTeamAdvisorsareregistered,Teamsmaynotmakeanychanges,whether

additionsorsubstitutions,includingtocontactandmailinginformation,withoutpermissionfromthe

ExecutiveDirector.Anyrequesttomakeachangemustbesubmittedtojessup@ilsa.orgwithan

explanationofthereasonfortherequestedchange.SubstitutionofTeamMemberswillbegrantedonlyin

exceptionalcircumstancesandisunlikelytobegrantedwhereworkproduct(written,oral,orresearch)

hasbeencreatedorgeneratedbytheTeamMemberbeingreplacedoraftertheTeam’smemorialshave

beensubmitted.

5.1 DeterminationsofEligibilityTheExecutiveDirector,ortheAdministratorinconsultationwiththeExecutiveDirector,willdetermine

theeligibilityofpersonstoserveasjudgesinanypartoftheCompetition,subjecttotheprovisionsofthis

Rule.

5.2 StudentsStudentsmayactasCompetitionjudgesonlyifthey(a)holdadegreeinlawinanyjurisdiction,oradegree

inaninternationallaw-relatedfield,and(b)arenotdirectlyaffiliatedwithanyTeamparticipatinginthe

competitionatwhichtheyarejudging.

5.3 TeamAdvisorsUnlessexpresslypermittedbyanapprovedRulesSupplementorotherwiseapprovedbytheExecutive

Director,TeamAdvisors,orothersdirectlyaffiliatedwithaTeam,maynotactasjudgesattheoralor

memorialstagesofanycompetitionuntiltheTeamtheyadvisehasbeeneliminatedfromtheCompetition.

TeamAdvisorsorothersdirectlyaffiliatedwithaTeamwhoarepermittedtoactasjudgespursuanttothis

Ruleshallnot,inanycase,beprovidedwithaccesstotheBenchMemorandumandshallnot,inanycase,

discloseanythingtotheTeamtheyadviseconcerningthewrittenororalsubmissionsoftheTeam(s)they

judge,inviolationofRule7.13(a).

5.4 AnonymityofTeamsJudgesshouldnotattempttoascertaintheschoolorcountryoforiginofanyTeamduringacompetition.

However,incircumstanceswherethejudgebelieveshisorherevaluationofaparticularMemorialwould

beaffectedbyknowledgeofwhetherornottheprimarylanguageusedbytheTeamMembersintheirlegal

studiesisEnglish,thejudgemayrequesttheExecutiveOfficetorevealthisinformation.

5.5 OralRoundConflictsofInterest(a) Definitions.ForthepurposeofthisRule5.5,thefollowingdefinitionsshallapply:

(i) an“Affiliation”meansapersonalorprofessionalrelationshipbetweenajudgeandaschool,

coach,orTeamMemberparticipatinginthecompetitioninwhichthejudgeistoserve.

(ii) a“ConflictofInterest”meansanAffiliationthatwould,intheeyesofareasonableobserver,

createaninferencethatthejudgewouldbeunabletobeimpartialastotheconductor

resultoftheOralRound.ReferenceshouldbehadtoRule5.5(f),whichlistscertain

AffiliationsthatdonotperseconstituteaConflictofInterest.

(b) ProhibitionandMitigationofConflictofInterest.TheAdministratorshouldavoidplacingajudge

intoanoralroundinwhichheorshehasaConflictofInterest.IntheeventthattheAdministratorisunable

toavoidaConflictofInterest,theAdministratorshouldtakereasonablestepstomitigatetheeffectsofthe

ConflictontheOralRound.Suchstepsmightinclude:obtainingawaiveroftheConflictfrombothTeams;

informingtheothermembersofthepanelofthejudge’sAffiliation;addingtothepanelajudgewitha

proportionalAffiliationwiththeopposingTeam;andassigninganeutralofficialtoobservetheOralRound

andthesubsequentdeliberationstodeterminewhethertheConflictofInterestaffectedtheoutcomeofthe

OralRound.

(c) WaiverbyConsentofBothTeams.AnyConflictofInterestmaybecuredbytheexpressoralor

writtenwaiver,eitherbeforeoraftertheOralRound,ofbothTeams.Inthisevent,neitherTeammaylater

fileanappealorothercomplaintonthebasisoftheConflictofInterest.Inaddition:

(i) IfaTeamisawareofanAffiliationbeforethecommencementofanOralRoundandfailsto

reportit,asrequiredunderRule5.5(e),beforetheOralRoundbegins,itshallbedeemedto

havewaivedanyallegedConflictofInterest.

(ii) IfaTeambecomesawareofanAffiliationafterthecompletionofanOralRoundandfailsto

reportasrequiredunderRule5.5(e),itshallbedeemedtohavewaivedanyConflictof

Interest.

(d) ProphylacticAvoidanceofConflicts.ItisthedutyofajudgetoreportanyAffiliationsatthetimehe

orsheregisterstojudgeorsubsequently,directlytotheAdministratorinadvanceoftheCompetition.The

AdministratorshallinvestigateanyreportedAffiliation(whetherself-reportedbyajudgeorotherwise)

andshalldeterminewhethersuchAffiliationconstitutesaConflictofInterest.

(e) ReportingObligationofTeams.IfaTeambelievesthatanAffiliationexistswhichmayconstitutea

ConflictofInterest,itshallpromptlyinformtheAdministratororthebailiffoftheaffectedOralRound.The

bailiffwillreportanyallegedAffiliationstotheAdministrator,whoshalltakeappropriatestepsto

investigateand,ifheorshedeterminesthataConflictofInterestexists,toeliminateormitigateit.ATeam’s

failuretotimelyinformtheAdministratorofanAffiliationofwhichitisawarewillconstitutewaiverunder

Rule5.5(c).

(f) AffiliationsWhichDoNotConstituteConflictsofInterest.ThedifferencebetweenamereAffiliation

andaConflictofInterestisthereasonableinferenceofpartiality.Absentadditionalfactssupportingan

inferenceofpartiality,thefollowingfrequentlyoccurringAffiliationsdonotconstituteConflictsofInterest:

(i) thejudgeknowsorrecognizesaTeammemberbyreasonoftheMember’sparticipationin

previousmootcourtcompetitions;

(ii) thejudgeknowsoneorbothcoaches,eitherbecauseofprofessionalorpersonalaffiliation,

priorparticipationinmootcourtcompetitions,orotherreasons;

(iii) thejudgeisanalumnusofoneoftheschoolsparticipatingintheOralRound;and

(iv) thejudgeisanemployeeofoneoftheschoolsparticipatingintheOralRoundwheresuch

employmentissufficientlyremotefromtheactivitiesoftheTeamastodispelany

reasonablesuspicionofpartiality.

5.6 PriorViewingofTeams

(a) SubjecttoSection5.5(b),judgesshouldnotviewaTeamthattheyhaveviewedinapreviousOral

Round.IfajudgemustviewaTeamtwice,theAdministratorshouldstrivetoensurethatheorsheviews

theTeam’soppositeside.

(b) IntheAdvancedRoundsoftheInternationalRounds,theExecutiveDirectormaypermitjudgesto

viewoneormoreTeamsthattheyhavepreviouslyjudged,ifsuchviewingservesthebestinterestsofthe

Competition.

5.7 BenchMemorandum

JudgesmustkeepthecontentsoftheBenchMemorandumstrictlyconfidential,andmaynotdiscloseitto

TeamsorTeamAdvisors.

5.8 CommentarybyJudges

JudgesareencouragedtoprovidedirectfeedbacktoTeamsregardingtheirperformanceatthecompletion

ofanOralRound.Inprovidingsuchfeedback,judgesareadmonishedtogivedueregardtothetime

limitationsandscheduleoftheCompetition,andmustabidebythefollowing:

(a) InthePreliminaryRoundsofanycompetition,Judgesmaynotprovideanyfeedbackthatwould

revealthecontentsoftheBenchMemorandum,thescoresgiventoindividualOralists,ortheresultsofthe

Round.

6.1 SubmissionofMemorials

(a) EachTeamparticipatingintheCompetitionmustprepareoneApplicantandoneRespondent

Memorial.

(b) EachTeammustsubmititsApplicantandRespondentMemorialstotheExecutiveOfficeviaits

TeamHomepage(availablethroughhttps://www.ilsa.org/jessup-competitors/),andsenditsApplicant

andRespondentMemorialstotherelevantAdministrator,ifany,attheemailaddressprovidedbythe

Administrator,nolaterthan17:00(5:00p.m.)CentralStandardTime(CST)(UTC/GST–6),onthedate

specifiedintheOfficialSchedule.SubmissiontotheAdministratormustoccurinasingleemailmessage,

addressedtotheAdministrator,withbothApplicantandRespondentMemorialsattachedasseparatefiles

titled“###A”and“###R”,respectively(where“###”istheTeam’sofficialTeamNumberassignedin

accordancewithRule3.5).IfoneoftheMemorialswillbesubmittedlate,aTeammayseparatelysubmit

thetimelymemorialonlinethroughitsTeamHomepageandsendthetimelyMemorialtotheAdministrator

beforethedeadlinewithoutpenalty.Theofficialtimeofsubmissionforthepurposeofcalculatinglate

penaltiesisthetimeeachindividualMemorialisuploadedtoaTeam’sHomepage.Administratorsmay

assessadiscretionarypenaltyofnomorethan5points(unlessaRulesSupplementprovidesotherwise)ifa

TeamfailstotimelyemailitsmemorialstotheAdministrator.

(c) InexceptionalsituationsanduponapprovaloftheExecutiveDirectorpursuanttoOfficialRule1.5,

anAdministratormaymodifytheMemorialsubmissionguidelinesviaaRulesSupplementinthefollowing

ways:

(i) byestablishingadeadlinewhichisearlier,butnotlater,thanthetimeanddatespecifiedin

theOfficialSchedule.Ifanearlierdeadlineisset,theMemorialsmustbeuploadedviathe

TeamHomepageandemailedtotheAdministratorbythisearlierdeadline.Memorials

receivedbytheExecutiveOfficeaftertheearlierdeadlinewillbesubjecttolatepenalties;

(ii) byrequiringelectroniccopiestobemailedtoopponentTeamsbythedeadlineandina

mannerandformspecifiedbytheAdministrator;or

(iii) byrequiringpapercopiestobemailedtotheAdministratorand/oropponentTeamsbythe

deadlineandinamannerandformspecifiedbytheAdministrator.IftheAdministrator

requestspapercopies,heorshemayspecifyalaterpostmarkorcourierdeadlineforthe

papercopiesthanfortheelectronicsubmission,providedthatanelectroniccopyissentto

ILSAandtheAdministratorbythedesignateddeadlineforelectroniccopies.

(d) Allelectronicandpapercopyversions(ifany)ofMemorialssubmittedtotheExecutiveOffice,the

Administrator,oranyotherpersonmustbeidentical.

(e) TeamsmayresubmittheirMemorialswithoutpenaltyuntiltheMemorialdeadlinehaspassed.After

theMemorialsubmissiondeadline,resubmittedMemorialswillbesubjecttoatwo-pointpenalty,aswellas

anyapplicablelatepenalties.

(f) Equipmentfailureorproblemswillnotbeconsideredjustificationforimproperformattingorlate

submissionofMemorials.

6.2 DisqualificationDeadlineUnlessotherwiseagreedinadvanceandinwritingbytheExecutiveOffice,aTeamwillbedisqualifiedfrom

theCompetitionifitdoesnotsubmitbothitsApplicantandRespondentMemorialsby17:00(5:00p.m.)

CentralStandardTime(CST)(UTC/GST–6)ontheDisqualificationDeadlineforMemorialsubmission

specifiedintheOfficialSchedule.AnyMemorialsubmittedafterthedeadlineforSubmissionofMemorials

asdefinedbyOfficialRule6.1(b),butpriortotheDisqualificationDeadline,willbesubjecttoapplicable

latepenalties.

6.3 MemorialsSubmittedinLanguagesOtherThanEnglishIfpermittedbyanapplicableRulesSupplement,TeamsmaysubmitMemorialsforQualifyingRoundsin

languagesotherthanEnglish.TeamsmustuploadsuchMemorialsintheoriginallanguageviatheirTeam

homepageonorbeforethedeadlineindicatedintheOfficialSchedule.MemorialsofsuchTeamsadvancing

totheInternationalRoundsmustbetranslatedintoEnglishandsubmittedtotheExecutiveOfficeat

jessup@ilsa.orgnolaterthanthreeweekspriortothestartoftheInternationalRounds.Unlessotherwise

approvedinadvanceandinwritingbytheExecutiveOffice,failuretosendtranslationsbythisdatewill

resultindisqualificationoftheTeam.SuchMemorialsmustotherwiseconformtotherequiredformat

outlinedintheseRulesandmustbe,tothegreatestextentpossible,verbatimtranslationsoftheoriginally

submittedMemorials.TranslatedMemorialsmustbeaccompaniedbyacertificatefromthetranslators

statingthatthecontentsoftheMemorialswerenotrevised,updated,orotherwisealteredinthe

translationprocess.TheExecutiveDirectormaydisqualifyanyTeamthataltersthesubstantivecontentof

itsMemorial(s)duringtranslation.

6.4 MemorialFormatting(a) FileType:AllpartsofeachMemorialmustbecontainedinasinglefile.Memorialsmustbein

MicrosoftWordformatandhavea.docor.docxfileextension.MemorialsthatdonotconformtothisRule,

suchasmemorialsinPDFformatormemorialsusinga.datfileextension,willnotbeaccepted.IfaTeam

submitsitsmemorialsinanunacceptableformatitmayresubmitconformingMemorials,butwillbe

subjecttoresubmissionpenaltiesunderRule6.1(e).

(b) PaperSize/Margins:AllpagesoftheMemorialmustbelettersize,8.5x11inches(21.6x27.9cm),

withmarginsofatleastoneinch(2.54cm)onallfoursides.TheExecutiveOfficeandAdministratormay

reformataMemorialthatdoesnotcomplywiththisRule.Teamsareadvisedthatsuchreformattingmay

resultinchangestopaginationandlayout.

(c) Printing:Administratorsinjurisdictionswhereletter-sizeorA4sizepaperisthestandardmust

printMemorialsonletter-sizeorA4sizepaperfortheirQualifyingRounds.However,thedocument

settingsinRule6.4(b)forpapersizeandmarginsmustnotchange.

(d) RecommendedFont,FontSizeandLineSpacing:Itisrecommendedthatthefontandsizeofthe

textofallpartsoftheMemorial,excludingtheCoverPageandpagenumbersbutincludingthefootnotes,be

inTimesNewRoman12-point.ThelinespacingforallpartsoftheMemorialisrecommendedtobe1.5

lines,withtheexceptionoftheCoverPage,TableofContents,IndexofAuthorities,headings,andfootnotes

(whichcanbesingle-spaced).AquotationtosourcesoutsideoftheMemorialmaybeblockquoted(i.e.

rightandleftindented)andsingle-spacedifthequotation(excludingfootnotes)hasatleast50words.

TeamsthattakeadvantageofadvancedfeaturesofMicrosoftWord–includingTrackChangesand

Comments-whiledraftingtheirMemorialsareresponsibleforunderstandinghowthoseadvanced

featureswork.AMemorialwithtrackedchangesthathavenotbeenproperlyacceptedorcommentsthat

havenotbeenproperlyremovedpriortosubmissionwillbeassesseduptoafive-pointPenalty.

6.17 FourJudgePanelsattheInternationalRounds

AttheInternationalRounds,theAdministratorshallemployfourjudgestogradeeachMemorial.The

Administratorshallidentifythescorethatisfurthestfromthemeanofallfourscores,andthatscoreand

thescoresheetonwhichitappearsshallbedisregarded.Thethreeremainingscoresshallbeutilizedforthe

purposeofdeterminingRoundoutcomesandTeamMemorialrankings.

6.18 Three-JudgePanelsatQualifyingCompetitions

AtQualifyingcompetitions,theAdministratorshallemploythreejudgeswheneverpossibletogradeeach

Memorial.Inextenuatingcircumstances,theAdministratormayauthorizepanelsoftwojudges,butthis

shouldbedoneonlyasalastresort.AdministratorsshouldminimizethenumberoftimesthataTeamis

7.1 ExtensionofTimeatJudges’Discretion

individuallimit.

7.2 ThreeJudgePanels

IneachOralRound,theAdministratorshallemploythreejudgeswheneverpossible,andmayemploymore

thanthreejudgesinAdvancedRounds.Inextenuatingcircumstances,theAdministratormayauthorize

panelsoftwojudges,butthisshouldbedoneonlyasalastresort.TheAdministratorshouldminimizethe

numberoftimesthataTeamisevaluatedbyatwo-judgepanel.InnocasemayanAdministratorauthorize

thatanOralRoundbepresidedoverbyasinglejudge.

7.3 OralRounds

TheorderofthepleadingsineachOralRoundatalllevelsoftheCompetitionis:

delivertherebuttalorsurrebuttal,buttheTeamneednotindicateinadvancewhichofthepleadingTeam

Memberswilldoso.TherebuttalshallimmediatelyfollowRespondent2,andthesurrebuttalshall

immediatelyfollowtherebuttal.Teamsmaywaivetheirrebuttalorsurrebuttal.

7.5 ScopeofPleadings

ATeam’soralpleadingsarenotinanywaylimitedtothescopeoftheTeam’sMemorial.Thescopeofthe

Applicant’srebuttalislimitedtorespondingtotheRespondent’sprimaryoralpleadings,andthescopeof

theRespondent’ssur-rebuttalislimitedtorespondingtotheApplicant’srebuttal.IftheApplicantwaives

rebuttal,Respondent’ssur-rebuttalisautomaticallywaivedaswell.Althoughjudgesareadmonishedto

enforcethelimitsonthescopeofrebuttalandsur-rebuttal,andmaytakeaviolationofthisRuleinto

accountinevaluatinganOralist’sperformance,thereisnodiscretionaryornon-discretionaryPenaltyfor

exceedingthescopeofrebuttalorsur-rebuttal.

7.6 ExParteProcedure

(a) Inextremecircumstances,suchaswhenaTeamfailstoappearforascheduledOralRound,the

Administrator,afterwaiting30minutes,mayallowtheOralRoundtoproceedexparte.Inanexparte

proceeding,theattendingTeampresentsitsoralpleadings,whicharescoredbythejudgestotheextent

possibleasiftheabsentTeamhadbeenpresentandarguing.Insuchacase,theTeamthatfailstoappear

foritsscheduledRoundforfeitsallsixoftheRound’sOralRoundPoints.

(b) TheAdministratormayscheduleanadditionalexparteproceedingfortheabsentTeamlaterinthe

competition,iftimeandadministrativeconcernspermit.ThescoresfromtheabsentTeam’sexparte

proceedingdonotaffectthescoringoftheoriginalOralRoundandareusedonlyforpurposesof

calculatingindividualoralpleadingscores.

(c) TeamwillbedeemedtohavefailedtoappearifonlyoneMemberfromagivenTeamappearsfor

theOralRound.Insuchanevent,theabsentTeam’ssingleOralistshallbeallowedtopleadandreceivean

individualscoreforpurposesofcalculatingindividualoralpleadingscores,eventhoughhis/herteam

forfeitsallsixOralRoundpoints.

7.7 OfCounsel

DuringeachOralRound,oneadditionalTeamMemberregisteredpursuanttoRule3.3maysitatthe

counseltablewiththetwoOralists,ascounsel.Thepersonactingascounselneednotbethesameperson

ineachOralRound.

7.8 CompetitionCommunications

OnlytheoralcommunicationswiththejudgesdescribedinRule7.9,7.10,and7.11arepermitted.In

particular,nowrittencommunicationorexhibitsmaybepresentedordeliveredbyanyTeamMemberto

anyjudge.

7.9 OralCourtroomCommunicationbetweenCounselandJudges

EachOralistmaycommunicatewiththejudges,andthejudgesmaycommunicatewiththatOralist,only

duringhisorherallottedtime.Inextraordinarycircumstances,thejudgesmaycommunicatedirectlywith

eitherTeam’scounseltable(forexample,toclarifythespellingofanOralist’snameortorequestthata

Teamremainquietduringitsopponent’soralpresentation).

7.10 OralCourtroomCommunicationandActivityatCounselTable

Topreventdisruption,communicationatthecounseltablebetweenTeamMembersmaybeinwritingonly.

Teamsandteam-affiliatedspectatorsshallavoidallunnecessarynoise,outbursts,orotherinappropriate

behaviorthatdistractsfromtheargumentinprogress.

7.11 WrittenCourtroomCommunication

WrittencommunicationduringtheOralRoundshallbelimitedtowrittencommunicationamongTeam

Membersseatedatthecounseltable.Nootherwrittencommunicationmaytakeplacebetweenany

combinationofthefollowingparties:judges,theoralist,TeamMembersseatedatthecounseltable,or

spectators(includingTeamMembersseatedintheaudience).

7.12 Spectators

AllPreliminaryRoundsshouldbeopentothepublic.Teamsmayagreeinadvance,andafterconsultation

withtheAdministrator,tolimitthenumberofspectatorsinaroomduringthePreliminaryRounds.The

presenceofTeamAdvisorsorotherspectatorsaffiliatedwiththeTeamispermittedinthecourtroom

duringanOralRoundinwhichtheTeamiscompeting.Teamsareresponsibleforensuringthattheir

spectatorsdonotengageinanydisruptivebehavior,andshallensurethatspectatorsdonotdiscloseto

judgestheidentityoftheirinstitutionorcountry.

7.13 Scouting

(a) TeamMembersorpersonsdirectlyaffiliatedwithanyTeammayattendonlyPreliminaryRoundsin

whichthatTeamiscompeting.TheExecutiveDirectormay,intheinterestsoftheCompetition,(1)waive

thisRule,or(2)allowTeamAdvisorstojudge,providedsuchTeamAdvisorsoffernoadvicetotheTeam

theyadviseabouttheTeam(s)theyjudge.ViolationofthisRuleshouldbebroughttotheattentionofthe

bailiffand/orAdministratorimmediately,withoutdisturbingtheOralRound,orimmediatelyaftertheOral

Roundhasfinished.

(b) Therearetwotypesofscouting,bothofwhichareprohibited.“DirectScouting”occurswhena

TeamattendsanOralRoundinvolvingoneormoreTeamsagainstwhichitwillcompeteinafutureOral

Round.“IndirectScouting”occurswhenaTeamattendsanOralRoundinvolvingtwoTeamsagainstwhich

itisnotscheduledtocompeteinthePreliminaryRounds.

(c) ATeamthatcommitsDirectScoutingforfeitsallsixOralRoundPointsineachfuturePreliminary

RoundinwhichitcompetesagainstaTeamitscouted.

(d) ATeamthatcommitsIndirectScoutingshallforfeitonePreliminaryRound.Forexample,ifthe

TeamwonfourPreliminaryRounds,itstotalnumberofwinsshallbereducedtothree,withoutother

adjustmenttoitsTotalRawPointsorTotalRoundPoints.(IfaTeamthatcommitsIndirectScoutingwins

noPreliminaryRounds,thereshallbenosuchadjustment.)Thisadjustmentshalloccurpriortothe

determinationoffinalPreliminaryRoundrankingsdescribedinRule10.8.

(e) DuringtheAdvancedRoundsofanyCompetition,anyTeamstillincontentionisforbiddenfrom

attendinganyAdvancedRoundmatchesnotinvolvingthatTeam.AnyTeamwhichcommitsscouting

duringtheAdvancedRoundswillforfeittheRoundinwhichthescoutingoccurredand,asaconsequence,

anysubsequentRoundinthatcompetitioninwhichtheTeamcompetes.Intheeventthatscoutingis

7.14 InterpretersandtheUseofInterpreters

Teamsmayuseinterpreters,subjecttothefollowingprovisions:

a) InQualifyingRounds:EachAdministratormayallowTeamsand/orjudgestouselanguagesother

thanEnglishduringOralRoundsinaQualifyingcompetition,and/ormayprovideprocedureswhereby

interpretersmaybeused,byincludingRulestothiseffectintheirRulesSupplements.

(b) InInternationalRounds:ATeamwishingtopresentitsoralpleadingsattheInternationalRounds

inalanguageotherthanEnglishmustarrangetohaveitsoralpleadingsinterpretedduringthe

InternationalRounds.Arrangementsforandcostsincurredinhiringinterpretersandprovidingrequired

equipmentaretheresponsibilityoftheTeam.ATeamwishingtouseinterpretersmustinformthe

ExecutiveOfficeassoonasitknowsithasadvancedtotheInternationalRoundsand,inanyevent,nolater

thanfourweekspriortothestartoftheInternationalRounds.Teamsusinginterpretersmayrequest

permissionfromtheExecutiveDirectortoextendtotalTeamoralargumenttimebeyondthe45minutes

allottedunderRule7.1.Themaximumextensionpermittedwillbe20minutesperOralRound.Theuseof

aninterpreterinoneOralRounddoesnotcommittheTeamtousinganinterpreterinlaterOralRounds.

GiventhatinterpreterswillbetranslatingallargumentsinagivenOralRound,anyextensionoftime

grantedtoaTeamshallalsobegrantedtoitsopponent.AlljudgesandOralistsinanOralRoundinvolving

aninterpretershouldtaketheprofessionalneedsoftheinterpreter(forexample,theneedforclear

enunciation)intoaccountduringtheOralRound.

c) UseofTeamMembersasInterpreters:AmemberofaTeammayserveasaninterpreterforother

membersoftheTeamif:(a)heorshedoesnotactasanOralistinthesameOralRoundinwhichheorshe

isaninterpreter;and(b)heorshedoesnotsitatcounseltableduringtheOralRoundinwhichheorsheis

aninterpreter;and(c)heorshedoesnotcommunicatewiththeTeaminanywayduringtheOralRound,

excepttointerprettheoralpleadings.

d) Non-EmbellishmentbyInterpreters:WhenaTeamemploysaninterpreter,heorshemayrender

onlyaliteralinterpretationoftheOralists’pleadingsandthejudges’comments.Noembellishment,

enhancement,orclarificationonthepartoftheinterpreterisallowed.ATeamthatviolatesthisRuleis

subjecttoforfeitureofallsixOralRoundPointsforthatOralRound.

7.15 AudioandVideotaping

Noaudiotapingorvideotapingoforalpleadingsispermittedwithouttheadvancepermissionoftheentire

panelofjudges,thetwoparticipatingTeams,andeithertheAdministratorortheExecutiveDirector.Inno

circumstancesmayparticipatingTeamsvieworlistentoanyvideooraudiotapeofanOralRounduntil

afterthecompletionoftheCompetitioninwhichthetapedOralRoundtookplace.ILSAreservesallrights

totheaudiotapingandvideotaping,oranyotherformofaudioorvisualreproduction,ofanyOralRoundor

partthereof.AllTeamsparticipatingintheWorldChampionshipJessupCupRoundwillbedeemedtohave

consentedtothetapingandbroadcastingofthatOralRound.

7.16 AnonymityofTeamsinCourtrooms

DuringanOralRound,participantsmaynotdirectlyorindirectlyindicatetheircountryorschooloforigin

tothejudgesorbailiff,includingthroughthewearingofnametags,pins,logos,orothersignifiers,orthe

placementoffolders,files,librarybooks,orothermaterialsidentifyingtheirschooloncounseltable.For

thepurposesofthisRule,theterm“participants”includesTeamMembers,TeamAdvisors,andspectators

affiliatedwiththeTeam.

7.17 Computers,MobilePhones,andotherElectronicDevicesinCourtrooms

DuringanOralRound,Oralistsatthepodiumandparticipantsseatedatcounseltablemaynotoperate,for

anypurpose,mobilephones,laptopcomputers,PDAs,oranyothercomputingorelectronicdevices,

includingbutnotlimitedtothosewhichareinternet-enabledordata-capable,orhaveinstantmessaging

capabilities.Allsuchdevicesmustbeturnedoffandremovedfromsightassoonasthebailifffirstenters

thecourtroom,andmustremainoffandoutofsightuntiltheconclusionoftheOralRound.ATeamthat

violatesthisRulemayforfeituptosixOralRoundPoints;theAdministratorshalldetermineaPenaltythat

correspondstotheseverityoftheviolation.

7.18 TimekeepingDevicesintheCourtroom

Theofficialtimeofthematchshallbeindicatedbythebailiff.Nooneotherthanthebailiffmaydisplay

timecardsorotherwisesignaltotheOralisthowmuchtimeisleft.Teamsmayusesilentdigitaloranalog

watchesatthepodiumoratcounseltable.However,theuseofanysuchdevicewhich,inadditionto

keepingtime,iscapableofeither(a)sendingorreceivingdatatoanotherpersonortotheInternet,or

(b)storingtextdata,shallbeprohibitedatcounseltableandatthepodiumasaviolationofRule7.17,even

ifsuchfunctionalityisturnedoff.

OFFICIALRULE8.0:QUALIFYINGCOMPETITIONPROCEDURES

8.1 PreliminaryRounds

EachTeamparticipatinginaQualifyingcompetitionshallparticipateinPreliminaryRoundsconsistingof

fourOralRounds,twiceasApplicantandtwiceasRespondent.IffourorfewerTeamsareparticipatingina

Qualifyingcompetition,theExecutiveDirectormaypermitfewerrounds,andtheAdministratorshallwork

withtheExecutiveDirectortodecideanappropriatematchschedule,pairingprocedure,andscoring

system.EachTeamshall,tothedegreepossible,faceanyopposingTeamonlyonceinthePreliminary

RoundsofaQualifyingcompetition.IntheeventthatTeamsmustfaceeachotherintwoPreliminary

Rounds,eachTeamshallpleadasApplicantinoneRoundandRespondentintheotherRound.

8.2 Pairings

ThepairingofTeamsforPreliminaryRoundsshallbedone,inthefirstinstance,byarandomdraw.

PairingsandMemorialsofopposingTeamswillbedistributedtoTeamsonorpriortothefirstdayofthe

Qualifyingcompetition.TheAdministratormaymodifythepairingstoaccountforabsentTeamsorother

contingencies.IfTeamsmustbenewlypaired,theymustbeprovidedtheirnewopponents’Memorialsas

soonasreasonablypossible,butattheveryleast15minutespriortothestartofthenewly-pairedround.

8.3 QuarterfinalRound

If16ormoreTeamsareparticipatinginaQualifyingcompetition,theAdministratormayholda

QuarterfinalRoundconsistingoffourmatchesamongtheeighthighest-rankingTeamsfromthe

PreliminaryRounds.InsuchaQuarterfinalRound,thepairingsshallbedeterminedby“power-seeding”as

follows:theeighth-rankedTeamversusthefirst-rankedTeam,theseventh-rankedTeamversusthe

second-rankedTeam,thesixth-rankedTeamversusthethird-rankedTeam,andthefifth-rankedTeam

versusthefourth-rankedTeam.

8.4 SemifinalRound

(a) IfaQuarterfinalRoundhasbeenheld,thewinningTeamineachofthefourQuarterfinalmatches

shalladvancetotheSemifinalRound.IntheSemifinalRound,thepairingsshallbedeterminedbyuseof

“power-seeding,”i.e.,thehighest-rankedremainingTeamshallcompeteagainstthelowest-rankedTeam.

TherankingstobeusedwillbethefinalrankingsfromthePreliminaryRounds.

(b) InotherQualifyingRoundsofeightormoreTeams,theAdministratormayholdaSemifinalRound

amongthefourhighest-rankingTeamsfromthePreliminaryRounds.InsuchaSemifinalRound,the

pairingsshallbedeterminedby“power-seeding”asfollows:thefourth-rankedTeamversusthefirst-

rankedTeam;andthesecond-rankedTeamversusthethird-rankedTeam.

8.5 ChampionshipRound

IfaSemifinalRoundhasbeenheld,thewinningTeamineachofthetwoSemifinalmatchesshalladvanceto

theChampionshipRound.IfaSemifinalRoundhasnotbeenheld,thenthetoptwoTeamsfromthe

PreliminaryRoundsshallcompeteagainstoneanotherinasingleChampionshipRound.Ineithercase,the

winneroftheChampionshipRoundistheNationalChampion.

8.6 PleadingOption

(a) PriortothecommencementoftheAdvancedRounds,eachcompetingTeamwillbegivenits

completedmasterTeamscoresheetfromthePreliminaryRounds,butnotindividualjudges’scoresheetsor

notes.

(b) IntheQuarterfinalandSemifinalRounds,thehigher-rankingTeamfromthePreliminaryRounds

shallhavetherighttochoosewhichsideitwillargue.Thisrightiscalledthe“pleadingoption.”

(c) TheAdministratorshallchooseameansofrandomdecisionindeterminingthepleadingoptionfor

aChampionshipRound.Possiblemethodsinclude,butarenotlimitedto,thefollowing:

(i) Cointoss:AdesignatedTeamMemberofthehigher-rankingTeamfromthe

PreliminaryRoundswillcallthetoss,andtheAdministratorwilltossthecoin.Ifthe

TeamMembercorrectlycallsthetoss,thenhisorherTeamwillhavethepleading

option.IfthatTeamMemberdoesnotcorrectlycallthetoss,thentheopposing

Teamwillhavethepleadingoption.

(ii) RollingaDie:AdesignatedTeamMemberofthehigherrankingTeamfromthe

PreliminaryRoundswillrolla6-sideddie.IftheTeamMemberrollsaneven

number,thenhisorherTeamwillhavethepleadingoption.Ifthenumberrolledis

odd,thentheopposingTeamwillhavethepleadingoption.

(iii) DrawingLots:AdesignatedTeamMemberofthehigherrankingTeamfromthe

PreliminaryRoundswillselectapieceofpaperfromacontainer(e.g.,ahat,bag,or

box).Thepiecesofpaperwillsayeither“Yes”or“No”,andthereshallbeanequal

numberofpiecesmarked“Yes”and“No.”IftheTeamMemberselectsapieceof

papersaying“Yes,”hisorherTeamwillhavethepleadingoption.Ifthepieceof

papersays“No,”thentheopposingTeamwillhavethepleadingoption.

Administratorsmayalsouseanyreasonablealternaterandommethodtodeterminepleading

optioninaChampionshipRound.

(d) TheTeamwiththepleadingoptionhastenminutestodecidewhichsideitwishestoplead.Ifthat

Teamfailstoselect,thentheopposingTeamhasfiveminutestodoso.IftheopposingTeamfailsto

exerciseitspleadingoptionwithinafive-minuteperiod,italsoshallforfeititspleadingoption.Shouldboth

Teamsfailtoselect,thenthehigher-rankedTeamwillargueApplicantandthelower-rankedTeamwill

argueRespondent.

(e) Oncethesideshavebeendetermined,theAdministratorwillimmediatelynotifybothTeams.The

AdministratorwillgiveeachTeamtheappropriateMemorialofitsopponent.TheTeamswillthenbe

grantedareasonabletimetopreparefortheOralRound.

8.7ComplaintsRegardingConductofaQualifyingRound(a) GeneralProcedure.ATeammaysubmitacomplainttotheExecutiveDirectorconcerningoneor

moreviolationsoftheOfficialRulesthatitallegesmateriallydepriveditofanopportunitytoadvancetothe

InternationalRounds.SuchcomplaintmustbesubmittedtotheExecutiveDirectorandtheAdministrator

viaelectronicmailnolaterthan48hoursaftertheconclusionoftheQualifyingRound.ATeam’sallegation,

howeverwellsupported,thatthejudgesinagivenOralRoundreachedthewrongconclusioncannotbethe

basisforacomplaint.

(b) RequiredContentsofaComplaint.Acomplaintmustincludethefollowinginformation:

(i) theTeamnumber,school,andcontactinformationofthecomplainingTeam;

(ii) thespecificfactsconstitutingtheallegedviolation(s);

(iii) adescriptionofhowtheviolation(s)materiallydeprivedtheteamofanopportunityto

advancetotheInternationalRounds;and

(iv) theidentitiesandcontactinformationofanywitnessestotheviolation(s).

(c) ProhibitiononDiscussionofComplaint.UnlessdirectedtodosobytheExecutiveDirector,a

Teamshallnotdiscussitscomplaintwithanyjudgesorotherwitnessestothealleged

violation(s)untilafterthefinaldecisiononthecomplaintisdeliveredbytheExecutive

Director.

(d) ExhaustionofLocalRemedies.If,atthetimeaviolationoccurs,aTeamthatisawareoftheviolation

failstobringittotheattentionoftheAdministrator,andifsuchviolationcouldhavebeenremediedby

promptactionoftheAdministrator,theTeamshallhavewaivedanycomplaintbaseduponthatviolation.

(e) Standing.OnlyaTeamclaimingthat,asaresultofaviolation,itwasmateriallydeprivedofan

opportunitytoadvancetotheInternationalRoundsshallhavestandingtofileacomplaintbaseduponthat

violation.AnyotherallegationsofviolationsshallbetreatedascommentsorsuggestionsunderRule8.7(h).

(f) InvestigationofComplaints.TheExecutiveDirectorwillpromptlyinvestigateacomplaint.Such

investigationwillfocusonwhethertheallegedviolationactuallyoccurredand,ifso,whethertheviolation

materiallydeprivedtheTeamofanopportunitytoadvancetotheInternationalRounds.Suchinvestigation

mayentaildiscussionswiththeAdministrator,judges,otherTeams,andinterestedanddisinterested

observers.Evenwhenitisdeterminedthataviolationoccurred,theExecutiveDirectormayconcludethat

theviolationdidnotmateriallydeprivetheTeamofanopportunitytoadvancetotheInternationalRounds.

(g) Remedy.IftheExecutiveDirectorconcludesthataviolationoccurredandmateriallydeprivedthe

complainingTeamofanopportunitytoadvancetotheInternationalRounds,heorsheshallimposean

appropriateremedy,includingbutnotlimitedto:overrulingtheresultsofoneormoreAdvancedRounds;

changingtheTeamdeclaredasthewinneroftheRound;invitingoneormoreadditionalTeamstoattend

theInternationalRoundsasadditionalrepresentativesofthecountryorregioninquestion;orissuinga

formalapologytothecomplainingTeam(s).

(h) NoProhibitiononConstructiveSuggestions.Teamsareencouragedtooffersuggestionstothe

AdministratorortheExecutiveDirectorfortheimprovementoftheCompetition.Suchsuggestionsshallbe

promptlyacknowledged,althoughforreasonsofexpediency,theymaynotbeaddresseduntilafterthe

conclusionoftheInternationalRounds.

9.1 Representation

AllRepresentativesapprovedforthatpurposebytheExecutiveDirectorareeligibletocompeteinthe

asApplicantandtwiceasRespondent.

9.3 PairingsforthePreliminaryRounds

(a) TheExecutiveDirectorshallestablishthepairingsforthePreliminaryRounds,inthefirst

instance,byarandomdraw.TheExecutiveDirectormaymodifythedrawtoensuregeographicaland

competitivediversityandbalance(includingwithreferencetothetotalInternationalRoundsMemorial

scoresofthecompetingTeams),orotherwiseinthebestinterestsoftheCompetition.

(b) PairingsfortheInternationalRoundsandtheMemorialsofopposingTeamswillbedistributedto

TeamsonorpriortothefirstdayoftheInternationalRounds.

(c) TheExecutiveDirectormaysubsequentlymodifythepairingstoaccountforabsentTeamsorother

unforeseeablecontingencies.Insuchcase,theExecutiveDirectorwillnotifyaffectedTeamsanddeliver

theiropponents’Memorialsassoonaspossible.

9.4 ReligiousSchedulingConflicts

NolaterthanfourweekspriortothePreliminaryRounds,TeamsmustnotifytheExecutiveDirectorin

writingofanypotentialscheduleconflictsowingtoreligiousobservancesorsimilarconcerns.The

ExecutiveDirectorwillmakeeveryefforttomakeappropriateaccommodations.

9.5 InternationalAdvancedRounds

TheAdvancedRoundsoftheInternationalRoundsconsistoftheInternationalRun-OffRound,the

InternationalRoundof32,theInternationalOctofinalRound,theInternationalQuarterfinalRound,the

InternationalSemifinalRound,andtheWorldChampionshipRound.The40highest-rankedTeamsfrom

thePreliminaryRoundsshallparticipateintheAdvancedRounds.

9.6 InternationalRun-OffRound

TheInternationalRun-OffRoundconsistsofeightpairingsoftheTeamsranked25through40fromthe

PreliminaryRounds.

9.7 InternationalRoundof32,OctofinalRound,QuarterfinalRound,SemifinalRound,and

WorldChampionshipJessupCupRound

TheInternationalRoundof32consistsof16pairingsamongthetop24TeamsfromthePreliminary

Rounds(whoadvancedirectlytotheRoundof32)andtheeightTeamsthatwinintheInternationalRun-

Team,etc.ForpurposesofthisRule,allrankingsshallbedeterminedbythefinalstandingsofthe

9.9 PreviousMeetingQualification

IfapplicationofRules9.8and9.9wouldresultinaTeamfacinganopponentthatitfacedinthe

InternationalPreliminaryRounds,theExecutiveDirectorwilladjustthepairingsinanequitablemannerin

orderthatsuchpairingisavoided.IftheExecutiveDirectordeterminesthat,withrespecttoagivenpairing,

noadjustmentispossible,theExecutiveDirectormaydisregardthisqualificationwithrespecttosuch

pairing.

9.10 NationalPair-OffQualification

(a) Roundof32

(i) IftwelveTeamsfromagivennationadvancetotheRoundof32,thefifth-rankedTeamshall

bepairedagainstthetwelfth-rankedTeam,thesixth-rankedTeamagainsttheeleventh-

rankedTeam,theseventh-rankedTeamagainstthetenth-rankedTeam,andtheeighth-

rankedTeamagainsttheninth-rankedTeam.AllTeamsnotaffectedbythisqualification

shallthenbepairedaccordingtothegeneralpairingRules.

(ii) IfelevenTeamsfromagivennationadvancetotheRoundof32,thesixth-rankedTeam

shallbepairedagainsttheeleventh-rankedTeam,theseventh-rankedTeamagainstthe

qualificationshallthenbepairedaccordingtothegeneralpairingRules.

(ii) IfsevenTeamsfromagivennationadvancetotheOctofinalRound,thesecond-ranked

Teamfromsuchnationshallbepairedagainstthethird-rankedTeam.AllTeamsnot

(d) SemifinalRound.IftwoTeamsfromagivennationadvancetotheSemifinalRound,thosetwo

9.11 PleadingOptionintheInternationalRounds

(a) PriortothecommencementoftheInternationalAdvancedRounds,theExecutiveDirectorwillgive

eachcompetingTeamacopyofitscompletedTeammasterscoresheet.

(b) TheExecutiveDirectorshallchooseameansofrandomdecisionindeterminingthepleadingoption

foreachmatchoftheAdvancedRounds.Possiblemethodsinclude,butarenotlimitedto,thoselistedin

Rule8.6(c).

(c) Foreachmatch,theTeamwiththepleadingoptionmustselectwhichsideitwillarguewithinten

minutes.IfthatTeamfailstomakeaselection,theotherTeammustselectwhichsideitwillarguewithin

fiveminutes.IfthatTeamfailstomakeaselection,thenthehigher-rankedTeamshallargueApplicantand

thelower-rankedTeamshallargueRespondent.

(d) Oncethesideshavebeendetermined,theExecutiveDirectorwillnotifyeachTeamwhichsideit

willbearguingandwilldelivertoeachTeamonecopyofitsopponent’sMemorial.BothTeamsshallthen

haveareasonableamountoftimetopreparefortheOralRound.

(a) MemorialRawScores:Ineachmatch,theTotalMemorialRawScoreforeachTeamisthesumof

thethreeMemorialjudges’scoresforthesidetheTeamarguedinthatOralRound.ATeam’sTotal

CompetitionMemorialRawScoreisthesumofthesixscoresforitsApplicantandRespondentMemorials.

ThisscoreshallbeusedtodetermineBestMemorialAwards.

(b). OralRawScore:Ineachmatch,aTeam’sTotalOralRawScoreisthesumofthescoresofthethree

judgesforeachofitstwoOralists.

(c) TotalRawScores:Ineachmatch,aTeam’sTotalRawScoreisthesumoftheTeam’sTotal

MemorialRawScoreandtheTeam’sTotalOralRawScoreforthatmatch.ATeam’sTotalCompetitionRaw

ScoreisthesumoftheTotalRawScoresfromeachofitsmatches.

10.5 RoundPoints

(a) MemorialRoundPoints:Ineachmatch,atotalofthreeRoundPointswillbeawardedbasedona

comparisonofthehighest,middle,andlowestscoresonMemorials.Iffour-judgepanelsareusedto

evaluateMemorials,thescorefurthestfromthemeanwillbediscardedandthethreeremainingscoreswill

beusedastheMemorial’shighest,middle,andlowestscores.TheMemorialstobecomparedcorrespondto

thesidethattheTeamarguedinthatmatch(inotherwords,thescoresoftheApplicantTeam’sApplicant

MemorialsarecomparedwiththescoresoftheRespondentTeam’sRespondentMemorials).Foreach

comparison,theTeamwiththehigherscoreisawardedoneRoundPoint.Hence,thehighestscoregivenby

amemorialjudgeforoneTeamiscomparedtothehighestscoregiventheotherTeam,andoneroundpoint

isawardedtotheTeamwiththehigherofthesescores.Similarly,thetwomiddlescores,andthenthetwo

lowestscores,arecomparedtodeterminewhichTeamreceivesthesecondandthirdroundpoints.Ifinany

suchcomparisonthetwoTeams’scoresareequal,eachTeamisawardedone-halfofaRoundPoint.

(b) OralRoundPoints:Ineachmatch,atotalofsixRoundPointsareawardedbasedonacomparison

ofcombinedoralargumentscores.Foreachjudge,thesumofthejudge’sscoreforApplicant’stwoOralists

iscomparedtothesumofthejudge’sscoresforRespondent’stwoOralists.Foreachjudge,theTeamwith

thehighestcombinedoralistscoreisawardedtwoRoundPoints.Ifinanysuchcomparison,thetwoTeams’

scoresareequal,eachTeamisawardedoneRoundPoint.

(c) TotalRoundPoints:IneachRound,aTeam’sTotalRoundPointsisthesumoftheTeam’s

MemorialRoundPointsandOralRoundPoints.

10.6 Two-JudgePanels

IfonlytwojudgesscoreagivenMemorialoragivenOralRound,theAdministratorshallcreateathird

scoreandscoresheetbyaveragingthescoresofthetwojudges.

10.7 DeterminingtheWinnerofaPreliminaryRoundMatch

Inanygivenmatch,theTeamreceivingmoreofthenineavailableRoundPointswinsthematch.Ifthetwo

Teamseachreceive4.5RoundPoints,theTeamwiththehigherTotalRawScorewinsthematch.Ifthetwo

TeamshaveanequalnumberofRoundPointsandanequalTotalRawScore,thematchisadraw.

10.8 PreliminaryRoundRankings

(a) TeamsshallberankedbynumberofwinsinthePreliminaryRounds,fromhighesttolowest.

(b) IftwoormoreTeamshavethesamenumberofwins,theTeamhavingthehighernumberofdraws

shallberankedhigher.

(c) IftwoormoreTeamshavethesamenumberofwinsandthesamenumberofdraws,theTeam

havingthehigherTotalCompetitionRawScorefromthePreliminaryRoundsshallberankedhigher.

(d) IftwoormoreTeamshavethesamenumberofwins,thesamenumberofdrawsandthesame

TotalCompetitionRawScore,theTeamwiththehigherTotalCompetitionRoundPointsfromthe

PreliminaryRoundsshallberankedhigher.

10.9 Tie-BreakingProcedure

IftwoormoreTeamsaretiedafterapplicationofRule10.8,andtheoutcomeofthedeterminationdoesnot

affect(a)anyTeam’sentryintotheAdvancedRounds,or(b)thepairingofanyTeamsintheAdvanced

Roundsofthecompetition,theTeamsshallberankedequally.If,however,furtherdeterminationis

necessarytodetermineadvancementorpairings,therankingsshallbeaccomplishedasfollows:

(a) IfonlytwoTeamsaretiedandifthetiedTeamshavefacedeachotherinthePreliminaryRounds,

thewinnerofthatmatchshallberankedhigher.

(b) IfonlytwoTeamsaretiedandtheTeamshavenotfacedeachotherinthePreliminaryRounds,the

Administratorshallbreakthetieaccordingtothefollowingmethods,startingwiththefirstandworking

downonlyifthepriormethoddoesnotbreakthetie:

(i) theTeamwiththehighertotalOralistandMemorialscoreaveragewins,calculatedby

addingtheTeam’sTotalCompetitionOralRawScoredividedby24andtheTeam’sTotal

CompetitionMemorialRawScoredividedbysix;

(ii) theTeamwhoseopponentswonmorematcheswins,calculatedbyaddingthenumberof

winsoftheTeams’opponentsandforthispurposeonly,countingadrawasone-halfofa

win;

(iii) theTeamwinswhoseopponentsscoredhigher,calculatedbyaddingtheTotalRawScores

oftheTeams’opponents;

(iv) theTeamwiththehighertotaloralistscoreaveragewins,calculatedbydividingtheTotal

CompetitionOralRawScoreby24;or

(v) theAdministratordeterminesamethodtobreakthetie,takingintoaccounttheinterestsof

theTeamsandtheCompetitionasawhole.

10.10 ScoringProceduresforAdvancedRounds

ThefollowingscoringproceduresandguidelinesshallapplytoAdvancedRoundsofQualifyingor

Internationalcompetitions.

(a) QualifyingRounds.

JudgesofAdvancedRoundsofeachQualifyingcompetitionshallmakeanindependentreviewoftheTeam

Memorialsandoralarguments,takingbothintoaccount,althoughtheyneednotgiveanyparticularfixed

weighttoeitherMemorialsororalarguments.TheAdministratorshallprovideaPreliminaryRoundOral

Scoresheettothejudgestouseattheirdiscretion.ThedecisionregardingthewinneroftheRoundshallbe

bymajorityvoteofthejudges.Notiesareallowed.

(b) InternationalRounds

IneachAdvancedRoundoftheInternationalRounds,exceptfortheSemifinalRoundandChampionship

Round,scoringforeachmatchshallbeconductedaccordingtothisRule.Judgesmustkeepsecretfromall

Teamstheexactscoreineachmatch,andeachjudge’sdetermination;onlytheidentityofthewinning

Teamshallberevealed.

(i) ThreejudgesshallreadtheApplicantMemorialoftheTeamarguingApplicantandthe

RespondentMemorialoftheTeamarguingRespondent.TheTeamwhoseMemorialeach

judgedeterminesissuperiorwillreceiveonepoint.Ifajudgedeterminesthatthetwo

Memorialsareofequalquality,eachTeamwillreceiveone-halfpoint.Thus,threepointsare

allocatedbytheMemorialsjudges.PenaltiesfromthePreliminaryRoundsshallnotapplyin

theAdvancedRounds.

(ii) ThreejudgesshallsitfortheOralRound.TheTeamwhosepresentationeachjudge

determinesissuperiorwillreceivetwopointsfromthatjudge.Ifajudgedeterminesthat

thetwooralpresentationswereofequalquality,eachTeamjudgewillreceiveonepoint.

Thus,sixpointsinaggregateareallocatedbytheoral-roundjudges.

(iii) ThewinnerofthematchistheTeamwiththegreateroftheninepointsallocatedby

MemorialsandOralRoundjudges.

10.11 MethodofScoring–SemifinalRoundandWorldChampionshipJessupCupRound

JudgesoftheSemifinalRoundandtheWorldChampionshipJessupCupRoundshallfollowtheguidelines

setoutinRule10.10(a)fordeterminingthewinnerofthematch..

10.12 RankingofOralists

IndividualOralistsshallberankedfromhighesttolowestaverageoralscorebytheAdministrator.An

Oralist’saverageoralscoreistheaverageofthescoresawardedtothatindividualbyeachjudgeduringthe

PreliminaryRounds,excludingthesinglelowestscoreawardedtotheOralist.Ifanoralistarguedinonly

onePreliminaryRound,heorsheisnoteligibleforranking.IftwoormoreOralistsaretiedforpurposesof

Awards,theExecutiveDirectorshallbreakthetiebycomparingaverageoralscoreswithoutexcludingthe

singlelowestscoreawardedtoeachOralist.

Example:LucyarguedintwoPreliminaryRounds.Inherfirstappearance,thethreejudgesawardedhera90,

an85,andan81.Inhersecondappearance,thethreejudgesawardedheran89,an85,andan80.In

determiningheraverageoralscore,theAdministratorwoulddisregardthe80shereceivedinthesecond

Round(herlowestmark).Soherscorewouldbethesumofherotherfivescores(430),dividedbythenumber

ofjudgeswhosescoreswerecounted(5),foranaverageoralscoreof86.0.

10.13 RankingofMemorials

TotalMemorialscoresforeachTeamshallbedeterminedbyaddingtheTotalRawScoreofaTeam’s

ApplicantMemorialandtheTotalRawScoreoftheRespondentMemorial,foratotalofsixjudges’scores.

TeamMemorialsshallberankedbytheAdministratorfromthehighestTotalMemorialscoretothelowest.

Tiesarepermitted.ScoresshallbeadjustedforPenaltiesperRule11.0.

10.14 ReportingofResults

Aftertheconclusionofeachcompetition,eachparticipatingTeamshallreceivethefollowing:

(a) acopyofindividualMemorialjudges’scoresheetswithcomments,ifany;

(b) acopyofindividualOralRoundjudges’scoresheetsandPenalties,ifany,withattendant

comments,ifany,fromPreliminaryRoundsofthecompetition;

(c) acopyoftheOverallRankingsofthePreliminaryRounds,withtheTotalWin-Lossrecords,

OverallRawScores,andOverallRoundPoints;

(d) acopyoftheOralistRankingsfromthePreliminaryRounds;

(e) acopyoftheMemorialRankingsfromthePreliminaryRounds;and

(f) asummaryoftheAdvancedRoundsofthecompetition.

OFFICIALRULE11.0:PENALTIES

11.1 MemorialPenalties

(a) MemorialPenaltiesmaybeimposedbytheAdministratorandshallbedeductedfromeachofthe

individualjudges’scoresonaTeam’sMemorial.IntheeventthataMemorialisscoredbyonlytwojudges

underRule10.6,penaltiesshallbedeductedfromeachofthetwojudges’scorespriortocalculatingthe

thirdscore.

(b) TheminimumadjustedrawscorethatanyTeammayreceivefromanyindividualMemorialjudgeis

50points.Nofurtherreductionmaybemadetoscoresaftertheminimumscoreisreached,regardlessof

unallocatedPenaltypointsremaining.

(c) IninstanceswhereonlyoneMemorialisinviolationofaRule,MemorialPenaltiesmaybededucted

fromthescoresoftheoffendingMemorialonly.

(d) TheAdministratorshallnotifyallaffectedTeamsofimposedPenaltiespriortothefirstPreliminary

Round,andshallincludewithsuchnotificationareasonabledeadlineforanyappealsfromthedecisionto

imposePenalties.ATeammayappealanyPenaltyimposedagainstitsMemorialsbycompletingthe

appealsformlocatedontheTeamHomepage.TheExecutiveDirectorshalldecideuponthevalidityofany

appealfromtheimpositionofaPenaltybytheAdministrator.Nofurtherappealisavailablefromthis

decisionoftheExecutiveDirector.

(e) PenaltiesshallbeassessedforviolationsoftheRulesconcerningMemorialsbyreferencetothe

followingtable:

11.2 Plagiarism

Teamsshallnotcommitplagiarism.“Plagiarism”meanstheactofappropriatingtheliterarycompositionof

another,orpartsorpassagesofanother’swritings,ortheideasorlanguageofanother,andpassingthem

offastheproductofone’sownmind.Afterinvestigationandreview,inaverifiedcaseofplagiarism,an

AdministratorshallassessaPenaltybetweenoneand50pointstoeachoffendingMemorial,withthe

PenaltycorrespondingtothedegreeoftheviolationinthejudgmentoftheAdministrator.Administrators

shallreferallallegationsofplagiarismtotheExecutiveOffice.Afterinvestigationandreview,theExecutive

Directormaydooneorbothofthefollowing:(1)disqualifytheTeam;(2)notifytheTeam’sdeanand/or

otheruniversityofficial(s)oftheresultsoftheExecutiveOffice’sinvestigation.

11.3 OralRoundPenalties

TheAdministratorshallimposeanOralRoundPenaltyonlywhenheorsheissatisfiedthatanevent

subjecttosuchPenaltyhasoccurred,ifnecessaryafterconsultationwiththejudges,bailiff,Teams,and/or

spectators.

11.4 ComplaintProcedure

(a) IfaTeambelievesthataninfractionoftheRuleshasoccurredduringanOralRound,theTeammay

notifythebailiffinwritingwithinfiveminutesoftheconclusionofthatOralRound.Ifthereisnobailiff,

TeamsmustapproachtheAdministratorwithcomplaints.Writtennotificationshallclearlydescribethe

allegedviolationandthepartiesinvolved.Teamsshallnotdirectlyapproachthejudgesregardinga

violationoftheseRules.Whenpossible,themattershouldberaisedwiththebailiffoutsidethepresenceof

thejudges.FailurebyanyTeamtofollowtheproceduresdescribedinthisparagraphshallresultina

waiveroftheTeam’scomplaint.

(b) IfajudgebelievesthataninfractionhasoccurredduringanOralRound,heorsheshallnotifythe

bailifforallyorinwritingwithinfiveminutesafterthecompletionoftheOralRound.Whenpossible,the

mattershouldberaisedwiththebailiffoutsidethepresenceoftheotherjudges.

11.5 DeductionofPenaltiesbyJudgesProhibited

PenaltypointsmaybedeductedonlybytheAdministrator.Innoinstanceshalljudgesthemselvesdeduct

anyPenaltypointsfromthescoresoftheoralists.JudgesshallscoretheOralRoundasifnoviolation

occurred,andmaytakeaninfractionintoaccountonlyifsoinstructedbytheAdministrator.

11.6 ActivitySubjecttoOral-RoundPenalties

PenaltiesmaybeassessedforviolationsduringanOralRoundbyreferencetothefollowingtable.The

AdministratorshalldeductthePenaltyamountfromeachjudge’scombinedscore(thesumofthejudge’s

scoreforOralist1andOralist2)beforedeterminingtheOralRoundPoints.

11.7 NoticeandAppeals

TheAdministratorshallnotifyTeamsofhisorherdecisionregardingimpositionofanyOralRoundPenalty

assoonaspracticable.Alongwiththedecision,theAdministratorshallsetareasonabledeadlinebywhich

eitherTeammayappealtotheExecutiveDirector.Ifanappealissubmitted,theAdministratorshallconsult

withtheExecutiveDirectorinresolvingit.TheExecutiveDirector’sdecisiononallappealsisfinal.

11.8 DiscretionaryPenalties

(a) InadditiontothePenaltieslistedinRule11.6,theAdministratormayassessupto15-point

DiscretionaryPenaltiesforotherviolationsoftheletterorspiritoftheseRules.ThesizeofthePenaltyshall

correspondtothedegreeoftheviolationinthejudgmentoftheAdministrator.DiscretionaryPenaltiesmay

beimposeduponaTeamforconductofitsTeamMembersorofpersonsaffiliatedwiththeTeam.Such

violationsmayinclude:

(i) poorsportsmanship;

(ii) submittingmultiplefrivolouscomplaintsagainstotherTeams;

(iii) inappropriatebehavioratthecounseltableduringtheOralRounds;

(iv) blatantdisregardfortheproceduresorrequirementsoutlinedintheRules.

(b) Seriousbreachesofsportsmanship,forexample,inappropriateexpartecommunicationswith

competitionjudgeseitherbeforeorafteramatchmay,atthesolediscretionoftheExecutiveDirector,

resultinaTeambeingdisqualifiedfromtheCompetition.

11.9 DeMinimisRule

TheAdministratormaywaiveorreducethepenaltyforademinimisRuleviolation.

OFFICIALRULE12.0:AWARDS

12.1 TheWorldChampionship

TheTeamthatwinstheWorldChampionshipwillreceivetwoawards:atrophytokeep,andtheJessupCup

toholdintrustforoneyearatitsschool.SuchTeamshalltakefullresponsibilityforthesafetyand

conditionoftheJessupCupwhileitisintheTeam’scustody,andisresponsibleforreturningtheJessup

CupingoodconditiontotheExecutiveDirectorbeforethenextyear’sInternationalRounds.TheWorld

ChampionshipTeamisresponsibleforengravingitsschoolnameontheJessupCup.

12.2TheHardyC.DillardAward

TheHardyC.DillardAwardispresentedtoTeamsforexcellenceinMemorialwriting.TheMemorialsofthe

TeamwiththehighestTotalMemorialScoresinanyQualifyingCompetitionshallbeentered,without

furtheractionbytheTeam,tocompetefortheHardyC.DillardAward.EachentryfortheDillardAward

shallbescoredbyapanelofthreeorfourjudges.Ifthree-judgepanelsareused,allthreescoreswillbe

usedtodeterminerawMemorialscores.Iffour-judgepanelsareused,thescorethatisfurthestfromthe

meanwillbediscardedandthethreeremainingscoreswillbeusedtocalculaterawMemorialscores.

AwardswillbepresentedtothetopfiveTeams,basedonrawMemorialscores,unadjustedforpenalties.

TheExecutiveOfficeshallassignnewTeamNumberstobeusedonthecoversofMemorialsinorderto

preserveanonymity.

12.3 TheAlonaE.EvansAward

TheAlonaE.EvansAwardispresentedtoTeamsforexcellenceinMemorialwritingattheInternational

Rounds.AwardswillbepresentedtothetoptwentyTeamsbasedonTotalMemorialScoresinthe

InternationalRounds.

12.4TheRichardBaxterAwards

TheRichardBaxterAwardsarepresentedtoTeamsforexcellenceinMemorialwritingbycomparing

individualApplicantandRespondentMemorials.TherearetwoBaxterAwards:onefortheBestOverall

ApplicantMemorialandonefortheBestOverallRespondentMemorial.TheApplicantMemorialsthatwere

consideredfortheAlonaE.EvansAwardoraHardyC.DillardAwardthatreceivedthehighesttenTotal

RawScoresforApplicantMemorials(unadjustedforPenalties)areenteredintocompetitionfortheBest

OverallApplicantMemorial.TheRespondentMemorialsthatwereconsideredfortheAlonaE.EvansAward

oraHardyC.DillardAwardthatreceivedthehighesttenTotalRawScores(unadjustedforPenalties)for

RespondentMemorialsareenteredintocompetitionfortheBestOverallRespondentMemorial.Thetwo

winningMemorialsshallbepublishedinthecorrespondingyear’sissueoftheILSAJournalofInternational

&ComparativeLaw.

12.5 TheSpiritoftheJessupAward

TheSpiritoftheJessupAwardwascreatedin1996torecognizetheTeamthatbestexemplifiestheJessup

spiritofcamaraderie,academicexcellence,competitiveness,andappreciationoffellowcompetitors.The

winnerisselectedbyvoteoftheTeamsattheInternationalRounds.

12.6 OtherAwards

IneachCompetition,theAdministratorshallmakearrangementforappropriaterecognitionofthe

following:TeamsthatreceivethetopTotalMemorialScores,highestrankedoralists,andTeamsthat

advancetotheAdvancedRounds.TheBoardofDirectorsmaybyresolutionprovideforotherawards,such

asBestOralistattheFinalRounds,BestNationalAdministrator,andothercategoriesastheBoardmay

fromtimetotimeseefit.
