Robin Russell co-chairs the bankruptcy and restructuring section of

the law firm of Andrews Kurth LLP. She has represented banks, DIP

lenders, debtors, creditors, committees and trade creditors in

American College of Bankruptcy and has authored numerous

publications including the Texas Practice Guide on Creditors Rights

The final rules (797 pages in all) are generally effective on January 1, 2018, but changes begin with the 2017 HMDA data. The amendments

modify the types of institutions and transactions subject to the regulation, data that institutions are required to collect and the processes for reporting

and disclosing data. As we continue the countdown to the effective date, this program provides a thorough review of the current status of the

revisions to Regulation C. It assures participants will understand and have a plan to implement the new requirements and will increase awareness of

potential problems.

Highlights A thorough explanation of which institutions are covered:

Uniform loan-volume thresholds (at least 25 closed-end mortgage loans or 100 open-end lines of credit) in each of the two preceding

calendar years, provided the institution meets all other criteria. Which loans are and are not reportable:

Dwelling-secured standard for all loans or lines of credit for personal, family or household purposes.

Most consumer-purpose transactions, including closed-end home- equity loans, HELOCs and reverse mortgages.

Commercial transactions for home purchase, improvement or refinancing.

Detailed information on how to complete the LAR -- reportable data,

expanded from 26 to 53 fields. Collection of ethnicity, race and sex of applicants and borrowers:

Report whether ethnicity, race or sex was collected based on visual observation or surname if an application is taken in person not and

provided by the applicant. Applicants may self-identify using 15 new subcategories.

Filing Instructions Guide (FIG) (published July 2016) Data submission and public availability requirements. The final rule:

Retains requirement that institutions submit HMDA data by March 1 following the calendar year for which the data are collected.

Requires institutions that report large volumes of HMDA data to submit data for the first three quarters of the following calendar on

a quarterly basis. Removes requirements to provide disclosure statement and LAR to

the public -- notice will be provided that the information is available on the CFPB's website

Surviving a Critical Incident: Your Human Capital is Worth Protecting

In America today, we are faced with the potential to fall victim to horrific acts of violence. These incidents occur within our "Living

Space," such as schools, shopping malls, theaters and commercial

businesses. Financial institutions are a prime target, not only for

traditional workplace violence, but for other types of traumatic

incidents, including man-made and natural disasters.

This presentation not only highlights threats, but will empower you

with solutions to mitigate the damage. Although we will discuss

behavioral patterns that may be precursors to acts of violence, it is

essential to understand that they may occur with absolutely no warning

and at any time.

You will learn life-saving tips far surpassing the "Run-Fight-Hide"

The August 14, 2016, final rule clarifies, revises or amends the Dodd-Frank rules for servicers. This includes provisions regarding force- placed

insurance, prompt crediting and periodic statement requirements and provisions relating to successors in interest and to periodic statements for

borrowers in bankruptcy. While the revisions are extensive, the rules retain the small servicer

exception that allows many community-based institutions to avoid a portion of the burden. The new rules impact all financial institutions to

Opening Accounts for High Risk Customers: Updated for CDD November 18, 2016

Today's decision to bank or not to bank high risk customers has been

called a movement to de-risk (choosing not to bank a whole group of customers). This process is being criticized as perhaps not being in the

best interests of the country since there will be groups who find it

difficult to find banking services. It may send industries into virtual

Assessing Diversity Policies & Practices: Final Interagency Statement

In June 2015, the FDIC, OCC and other federal regulators published final advisory standards outlining a range of activities and programs

they would like to see implemented. The agencies released "frequently

asked questions" in August 2016, which further define the

expectations.

The rules are effective now and envision, among other actions, formal

self-assessments to be completed in the first quarter of 2017. You may

have recently received a letter from the Federal Reserve regarding the

self-assessment. Although it says submission is "voluntary," it also

states that banks are "encouraged" to conduct the self-assessment and

provide results to the Federal Reserve and to the public. The results

will also be shared during compliance reviews.

This session outlines the details and suggestions for satisfying the new

standards. It includes new expectations regarding entering into

procurement relationships with minority and woman-owned

businesses. It also offers practical suggestions for demonstrating

satisfaction of the standards during regulatory compliance reviews.

Received your CP2100? Facing a $20,000 fine for name mismatches?

If your institution received the IRS name mismatch list, you must follow the B Notice Process to avoid being fined. If not, you will then

receive the 972CG penalty letter and must follow that process. Need

to know more? This webinar will help.

There are three elements to running effective account opening and tax

reporting to the IRS. The first is getting the accounts opened with

proper taxpayer identification numbers. These can be social security

numbers (SSNs), Employer Identification Numbers (EINs) or

Individual Taxpayer Identification Numbers (ITINs). Your customer

certifies this number on a W-9, W-8BEN or W-8BENE. After initial

certification, the interest is reported to the IRS on a 1099 int or 1042S.

And then the hard part, you receive a letter from the IRS (CP2100) telling you these names do not match and you are facing significant

fines. This third element we will call reconciliation. How you handle

reconciliation determines whether or not you are fined. This webinar

When the CFPB launched its monthly report of consumer complaints in July 2015, Director Cordray said “Consumer complaints are the CFPB’s compass and play a central role in everything we do. They help us identify and prioritize problems for potential action.”

While the CFPB may not be the primary regulator for your financial institution, it’s critical to understand how the CFPB complaint process has changed regulatory expectations, and what your bank or credit union should be doing to proactively manage complaints.

After a detailed credit analysis of a loan request has been performed, it's now time to communicate your findings in writing. Credit memoranda are a primary means of communication within

the banking industry. When writing effective credit memoranda, it's not what you say that commands attention, but how you say it. Credit memoranda serve three functions: 1) they provide information on the condition and status of a customer relationship; 2) they provide a record of thoughts and actions; and 3) they support or recommend action.

This course teaches skills required to write an effective credit memorandum. Learn to emphasize important factors and trends without stating the obvious. In short, your credit memoranda should present relevant, material facts, along with your thoughts and opinions. Remember, anything you write in a credit memorandum will become public record if you find yourself in court with a borrower.

Dealing with Appraisals: Regulations and Requirements

Program Content: The past few years have seen significant developments in real estate appraisals and evaluation rules and regulations. Revised Interagency Guidelines and new rules under Reg Z have been issued, and we've seen additional requirements finalized recently due to Dodd-Frank. In some cases (called "flipping transactions"), lenders will even have to obtain two appraisals on the same property for one loan. Because breakdowns in appraisal practices have been partly blamed for the mortgage crisis, regulators have raised their expectations; lenders' appraisal and evaluation programs must include more elements than ever before. Some themes now emphasized by the agencies are independence of the appraiser, and evaluator, reviews, and qualifications. There are also restrictions against using AVMs (automated valuation models), BPOs (broker price opinions), and tax valuations that have upset many in the industry. Do you know the requirements? Program Content: UCC 3 & 4, Regulation CC (Availability of Funds and Collection of Checks) and CTRs (Currency Transaction Reports) are the big three compliance areas for tellers which require training. These statutes and regulations form the back bone of the teller job. You will learn endorsements, stop payment orders, death issues and stale dated/postdated check laws.
