Countdown to Revised HMDA Rules November 4, 2016

The final rules (797 pages in all) are generally effective on January 1, 2018, but changes begin with the 2017 HMDA data. The amendments
modify the types of institutions and transactions subject to the regulation, data that institutions are required to collect and the processes for reporting
and disclosing data. As we continue the countdown to the effective date, this program provides a thorough review of the current status of the
revisions to Regulation C. It assures participants will understand and have a plan to implement the new requirements and will increase awareness of
potential problems.
Highlights A thorough explanation of which institutions are covered:
Uniform loan-volume thresholds (at least 25 closed-end mortgage loans or 100 open-end lines of credit) in each of the two preceding
calendar years, provided the institution meets all other criteria. Which loans are and are not reportable:
Dwelling-secured standard for all loans or lines of credit for personal, family or household purposes.
Most consumer-purpose transactions, including closed-end home- equity loans, HELOCs and reverse mortgages.
Commercial transactions for home purchase, improvement or refinancing.
Detailed information on how to complete the LAR -- reportable data,
expanded from 26 to 53 fields. Collection of ethnicity, race and sex of applicants and borrowers:
Report whether ethnicity, race or sex was collected based on visual observation or surname if an application is taken in person not and
provided by the applicant. Applicants may self-identify using 15 new subcategories.
Filing Instructions Guide (FIG) (published July 2016) Data submission and public availability requirements. The final rule:
Retains requirement that institutions submit HMDA data by March 1 following the calendar year for which the data are collected.
Requires institutions that report large volumes of HMDA data to submit data for the first three quarters of the following calendar on
a quarterly basis. Removes requirements to provide disclosure statement and LAR to
the public -- notice will be provided that the information is available on the CFPB's website

career began as a federal bank examiner. He also headed the form and software division of a regional consulting company. He has developed and
delivered training programs to bankers in 43 states as well as the FDIC. Kelly M. Owsley, CRCM, is Director of Training Services for
Compliance Resource, LLC. Since 2000, she has worked for financial institutions ranging from $250 million to $3 billion in assets. She has
worked in branch management, lending, product development and training. Kelly was recently responsible for compliance-related training
for a community bank.

The CFPB (Consumer Financial Protection Bureau) has been inviting consumers to “tell their story” and file complaints since July, 2011. When the CFPB launched its monthly report of consumer complaints in July 2015, Director Cordray said “Consumer complaints are the CFPB’s compass and play a central role in everything we do. They help us identify and prioritize problems for potential action.”
While the CFPB may not be the primary regulator for your financial institution, it’s critical to understand how the CFPB complaint process has changed regulatory expectations, and what your bank or credit union should be doing to proactively manage complaints.

After a detailed credit analysis of a loan request has been performed, it's now time to communicate your findings in writing. Credit memoranda are a primary means of communication within
the banking industry. When writing effective credit memoranda, it's not what you say that commands attention, but how you say it. Credit memoranda serve three functions: 1) they provide information on the condition and status of a customer relationship; 2) they provide a record of thoughts and actions; and 3) they support or recommend action.
This course teaches skills required to write an effective credit memorandum. Learn to emphasize important factors and trends without stating the obvious. In short, your credit memoranda should present relevant, material facts, along with your thoughts and opinions. Remember, anything you write in a credit memorandum will become public record if you find yourself in court with a borrower.

Most of his career has been spent in Credit Administration, Lending, Business Development, Loan Review, Management and Training & Development. He has managed loan portfolios representing a cross section of loan types including: Large Corporate, High Net Worth Individual, Middle Market Companies, Small Business, Real Estate and Non-Profit Organizations.
Mr. Johnson is now a training professional in the financial industry

Dealing with Appraisals: Regulations and Requirements

Program Content: The past few years have seen significant developments in real estate appraisals and evaluation rules and regulations. Revised Interagency Guidelines and new rules under Reg Z have been issued, and we've seen additional requirements finalized recently due to Dodd-Frank. In some cases (called "flipping transactions"), lenders will even have to obtain two appraisals on the same property for one loan. Because breakdowns in appraisal practices have been partly blamed for the mortgage crisis, regulators have raised their expectations; lenders' appraisal and evaluation programs must include more elements than ever before. Some themes now emphasized by the agencies are independence of the appraiser, and evaluator, reviews, and qualifications. There are also restrictions against using AVMs (automated valuation models), BPOs (broker price opinions), and tax valuations that have upset many in the industry. Do you know the requirements? We'll provide in-depth details of the appraisal and valuation process, from both the lender and appraiser side of the game, to provide a thorough understanding of what is required and what you need.
