    Complaint against SHAWN PATRICK TROTTER. The Petitioner seeks the appropriatedisciplinary sanction of the Respondent's educator's certificate pursuant to Sections 1012.795 and1012,796, Florida Statutes, and pursuant to Rule 6B-I.006, Florida Administrative Code, Principlesof Professional Conduct for the Education Profession in Florida, said sanctions specifically set forthin Sections 1OJ2.795(1) and 1012,796(7), Florida Statutes.The Petitioner alleges:

    JJJJUSDICTIONL The Respondent holds Florida Educator's Certificate 854565; covering the area of

    Social Science, which i t > valid through June 30, 2008.2. At all times pertinent hereto, the Respondent was employed as a Social Studies

    Teacher at South Fork High School in the Martin County School DistrictMATERIAl. ALLEGATIONS

    J. In or around January 2007, the Respondent engaged in sexual intercourse, in theclassroom, with a 16 year old female student on three occasions. On or about February 6,2007, theRespondent was arrested 01 1 three counts of sexual activity with a minor. On or about July 25, 2007,the Respondent pled no contest to, and was adjudicated guilty of all three counts.

    The Petitioner charges:STATUTE VIOLATIONS

    COUNT 1: The Respondent is in violation of Section l012.795( I)(c), florida Statutes,in that Respondent has been guilty of gross immorality or an act involving moral turpitude.

    COCNT 2: The Respondent is in violation of Section 1012.795(1 }(e), Florida Statutes,in that Respondent has been convicted of a misdemeanor, felony, or other criminal charge, otherthan < .I minor traffic violation.

    COUNT 3: The Respondent is in violation of Section 10J 2.795(1)(i), Florida Statutes, inthat Respondent has violated the Principles of Professional Conduct for the Education Professionprescribed by State Board of Education rules,

    COUNT 4: The Respondent is invi clarion of Section 10 12.795 (2) , Florida Statutes, wh ic hprovides that the plea of guilty in any CDUli or the decision of guilty by any court is prima facie proofof grounds for the revocation of the certificate.

    RULE VIOLATIONSCOUNT 5: The allegations of misconduct set forth herein are in violation of Rule 6D-

    l.006(3)(a), Florida Administrative Code. in that Respondent has failed to make reasonable effort1 0 protect the student from conditions harmful to learning and/or to the student's menta! healthand /o r physical health and/or safety.

    COUNT 7: The allegations of misconduct set forth herein are in violation of Rule 6n~1.006(3)(h), Florida Administrative Code, in that Respondent has exploited a relationship with astudent for personal gain or advantage.

    Page 30[3WHERE 1"0 RE, based on the reasons set forth herein and in accordance with the

    Explanation of Rights and Election of Rights forms attached to and made a part of thisAdministrative Complaint, Petitioner respectfully recommends that the Education PracticesCommission impose an appropriate sanction against the Respondent' s educator's certificate pursuantto the authority provided in Sections 1012.795(1) and 1012.796(7), Florida Statutes. The sanctionsimposed by the Education Practices Commission may include, but are not limited to, aJ1Y one or acombination of the following: issuing the Respondent a written reprimand; placing the Respondenton probation for any period of time; restricting the Respondent's authorized scope of practice;assessing the Respondent an administrative fine; directing the Respondent to enroll in the RecoveryNetwork Program; suspending the Respondent's educator's certificate for a period of time not toexceed live years; revoking the Respondent's educator's certificate for a period of time up to 10years or permanently; or barring the Respondent from reapplying for an educator's certificate for aperiod of time up to 10 years or permanently.
