FACILITY USER, EXPRESS WAIVER OF LIABILITY,

RELEASE AND INDEMNITY AGREEMENT

IN CONSIDERATION for ________________________ (herein "Entity") entering into the _____________________________ (facility/use/contractor) Agreement with _______________________ (herein "Applicant") and as a condition of said Agreement, Applicant does hereby agree to this express waiver of liability against Entity, and makes the release and indemnity agreement with Entity set forth below. 1. Applicant hereby agrees to forever indemnify, defend, and hold harmless Entity, from and against any and all claims, suits, actions, costs, expenses, judgments or decrees, and demands of liability, including attorney's fees, whether direct or consequential, on account of any loss, injury, death or damage to any person or property arising in whole or in part from any act, omissions, event or work in any way connected with or relating to the ______________________________ (nature of use, service or project) by Applicant, save and except only those claims due to Entity's fraud or willful injury to persons or property, or violation of law. Furthermore, the defense of any such claims, suits and demands shall be by attorneys acceptable to Entity and the fees and expenses for such attorneys and other necessary expenses incurred with any action or defense necessary to protect Entity shall be born by Applicant. 2. Applicant hereby represents and warrants that it has a policy of general liability insurance in force and effect on the dates of __________________ (premises use dates), issued by a liability insurance company licensed to do business in the State of Nevada, and that said insurance company will, without any cost or expenses to Entity issue a certificate to Entity with a minimum insurance limit of $1,000,000 as well as a separate additional insured endorsement naming Entity as additional insured, as well as proof of automobile and worker's compensation insurance. Said Certificate of Insurance shall be delivered to Entity at least ten (10) days prior to the use of the premises by Applicant. In addition, said insurance company will agree to give notification to Entity of any revocation and/or cancellation at least seventy-two (72) hours before said revocation becomes effective. Applicant understands and agrees that it will not have access to the facilities until Entity has received said proof of insurance. 3. Applicant hereby voluntarily releases, discharges, waives and relinquishes any and all claims, suits, actions, costs, expenses, judgments or decrees, demands of liability, including attorney's fees, whether direct or consequential on account of any loss, injury, death, or damage to any person or property against Entity, its directors, officers, employees, members, affiliated entities, subsidiaries, agents, assigns and all persons acting in concert and participating with it occurring or arising as a result of the ____________________________ (nature of use, service, or project) by Applicant, save and except only those claims due to Entity's fraud or willful injury to persons or property or violation of law. 4. Applicant expressly covenants that this Agreement shall apply to all unknown and unanticipated claims, injuries, causes of action and damages, as well as any known claims. 5. Applicant expressly covenants that if any part of this Agreement, for any reason, is held by a Court or Arbitration Panel of competent jurisdiction to be invalid, void or unenforceable, such decision shall not affect the validity of any remaining portion, which remaining portion shall remain in full force and effect as if this Agreement had been executed with the invalid portion thereof eliminated. 6. Applicant hereby warrants that the foregoing statements are true and correct and that the Entity has relied upon such warranties in entering into this Agreement, and making the premises available for use by Applicant. between the parties to this Agreement with respect to the subject matter of this Agreement, apart from the matters set forth within this Agreement. This Agreement shall be governed by the laws of the State of Nevada. In any action to enforce or interpret this Agreement, the prevailing party shall recover its reasonable attorneys' fees from the other party. The individuals signing this Agreement below warrant and represent that they have the authority to bind and do hereby bind the respective parties hereto, without the necessity of additional signatures or corporate action. This Agreement may be executed in two or more counterparts, each of which shall be deemed an original, and taken together shall constitute one and the same written agreement. Key-Deposit Policy All non-church groups or individuals who are issued a key for use of facilities at Sparks First Church of the Nazarene are required to provide a key deposit. Deposits must be paid at the time keys are picked up; no more than two days before the event. Keys must be returned within 2 days after the event. A deposit of $50 per key is mandatory. Facility Use Policy - Non Church Groups

Policies and Regulations Regarding Use of Church Facilities by

Non church Groups POLICIES Sparks Church of the Nazarene recognizes that providing its physical facilities in support of other compatible Christian organizations and programs can increase our outreach and ministry in service to God and our community. At the same time, it is necessary that such use of facilities and equipment be controlled in the best interest of the church. The intent of this policy is to establish consistent requirements for non-church group use of our church facilities. All non-church groups (any group not sponsored by or related to Sparks Nazarene) desiring to use church facilities must confirm acceptance of the terms herein specified. All required application forms must be completed and approved by the church. Requests for use of the facilities and/or equipment are to be processed through the church office. Requests will be honored on a first-come, first-served basis as recorded on the church calendar. Regularly scheduled activities of Sparks Church have priority over all other requests. All key deposits, fees, etc., must be paid not less than two days before use of the facilities shall begin. An exception to this timeline is use of the facilities on a recurring basis, for which payment of fees is due on the 1st of each month. Payment of fees for use of facilities may be paid in cash or by check. If a check is used, it shall be made payable to Sparks Church of the Nazarene. A $100 deposit is required at the time the reservation is confirmed. Until fees are paid, reservations are not guaranteed and the time may be given to another group. Renewal of permission to use stated church facilities depends, in part, on satisfactory compliance with requirements during the previous period of use. Groups that use the facilities on a year-round basis must renew their application each August 1st. Sparks First Church of the Nazarene desires to be a church that is involved in the community and that invites the community into its facility. In order to accomplish this, we have designed three categories regarding church usage by outside group:

Church Events: These are events that the church sponsors and approves which are covered by our insurance. There will be no fees for these events. Church members will be expected to do their own cleanup.

Sponsored and Hosting Events: These are events where we allow outside groups to use our facilities as an outreach to the community or to groups for events that we are hosting as a church. Groups must provide an insurance binder and agree to pay for any expenses that the church incurs, such as janitorial and sound. These groups must use church people for sound or be trained ahead of time by an appointed church representative. They must use the church custodian or agree to leave the church in the same condition as they found it. We will allow them to use the facilities at no rental charge, but will encourage freewill donations. These are groups we allow to use our facilities which we are sponsoring.

Rental Events: These are people or groups who want to use our church for a one-time event. Outside weddings are the most common event for this category. They must provide and insurance binder and agree to the same terms as other outside groups regarding sound and custodial work.

The Board of Sparks First Church of the Nazarene reserves the right to accept or deny requests for use of church facilities and to cancel or modify established agreements in the church 's best interest regarding property management, requirements for use of the facilities for church activities (which shall always have priority), and church relationships with governmental regulations.

REGULATIONS 1. All persons and groups desiring use of the church facilities and/or equipment for

purposes that are not church related must sign an agreement with Sparks Church of the Nazarene. The agreement acknowledges the group's intent to abide by these policies and to accept responsibility for any damages to the facilities and/or equipment.

2. The using group must be an organization whose purposes and activities contribute to the

welfare of the congregation. Further, the using group's practices, beliefs, objectives, and the activities conducted on church property must be compatible with the practices, mission, objectives and beliefs of Sparks Church of the Nazarene and the Global Church of the Nazarene.

3. Unless a specific exception to this rule has been granted in writing by the Church

Board, outside groups using church property or facilities may not charge a fee or receive remuneration for services rendered on church property, except to defray: a) Church usage fees b) Instructional expenses for materials and leadership c) Organizational dues or assessments to meet group operating expenses.

4. Alcoholic beverages, liquors, non-physician-prescribed drugs and gambling will not be

permitted on church property at any time. 5. Smoking will not be permitted inside any church building and only in the designated area

outside the building. 6. Weddings must be supervised by the church-appointed wedding coordinator. 7. No changes will be allowed to the décor of the church, unless it is done under the

supervision of a church-appointed representative. 8. Decorations brought in by the group must be flameproof and shall not be attached to

fixed portions of the facilities without specific written approval of the church-appointed representative. The sanctuary/fellowship hall may not be decorated using any signs, symbols, etc. unless approved by the church-appointed representative. Decorations must not damage the facilities or furnishings in any way. The user group must remove all decorations when finished using the facilities.

9. Candles are not permitted unless for ceremonial use and must have prior approval. If

used, lit candles must be "dripless" and must not be placed on the keyboard, piano, or sound system. Lit candles must be placed on a plate or in a holder.

10. Building use hours are 10:30 a.m. to 8:00 p.m. unless extended hours have been

approved by the church appointed representative. Evening events will be concluded and the building closed by 8:00 p.m. and closed by 5:30 pm on Saturdays, unless special arrangements have been made. No outside events will be held on Sundays.

11. The using group will be responsible for leaving the facilities clean with all furniture and equipment returned to its customary position. The kitchen shall be left clean (refer to kitchen policy posted in the packet).

12. The using group shall be held responsible for all loss or damage to church property

and equipment during periods when they are using the facilities.

13. No equipment, furniture, or kitchen items shall be added, modified, loaned out, moved, or removed without prior approval from the church-appointed representative. No equipment is to leave the premises for personal use by congregants or any other outside entities. Equipment, such as tables, chairs, bounce houses, etc. may be taken off campus for a specific church sponsored activity after approval from the church-appointed representative.

14. Permission to use church facilities or equipment shall not include liability on the part

of the church for property damage or personal injuries resulting from user-group activities. An insurance binder must be provided by all outside groups.

15. Youth groups using the facility and/or equipment must have adequate adult

supervision. All children on church property must be under adult supervision. 16. Use of the sound system, video and musical instruments is permitted only under the

supervision of persons authorized by the Sparks Nazarene Worship and Arts Team. If a group has a long-term agreement for use of the church facilities, arrangements may be made for training select individuals.

17. At the inception of the use of facilities, a deposit of $50 must be paid per key.

When a group terminates use of the facilities and all keys are returned, all deposits paid for keys will be returned.

18. User groups with a recurring agreement may be given training by the church-appointed

representative on how to properly open, close and secure the facilities.

FEES

All persons/groups approved for use of church facilities are required to pay applicable fees, as stated in this policy. Nonprofit organizations may request a discount or waiver of these fees by Sparks Nazarene in support of the activities of the user groups. The church facility is available at no charge to members and their immediate families for funerals and family celebrations, such as anniversaries. However, a custodial fee and sound technician fee (if applicable) are required from all user groups. Requests for such usage should be made following reservation procedures, as stated in this policy document. Also, as a community service, the church facility is available to individuals in the community for funerals. If a Sparks Church of the Nazarene pastor is not used, approval must be obtained from the senior pastor. All fees are for usage up to six (6) hours. After 6 hours, an additional fee of $25 per hour is charged for use of the sanctuary/gym. An additional fee of $10 per hour is charged for all other rooms/services. Current facility-use fees are stated in the "Worksheet for Assessing Facility-Use Fees," found in this package.
