1) INTRODUCTIONASANSOL DURGAPUR DEVELOPMENT AUTHORITYThe Government has set up Asansol Durgapur Development Authority (ADDA) for planned and integrated development of this region. WHO CAN APPLY

Any Indian citizen residing in India, if (1) he/ she has attained majority and (2) he/ she has no, and none of his/ herother family members has any, residential land/ house/ flat within the jurisdiction of Durgapur Municipal Corporationin the capacity of a single or joint owner/ lessee/ licensee/ member of a co-operative housing society, is eligible toapply.

For all the purposes of this Scheme, the word “family” means a group constituted of the following individuals :

(a) a married male individual and his wife (basic branch),

(b) his parents (anterior branch),

(c) his dependant sons, unmarried sons and unmarried daughters (posterior branch).

Explanation-I: Death of the male individual of basic branch shall not bar other individuals from constituting afamily with reference to that individual.

Explanation-II: Absence of one or more individuals shall not bar other individuals or a lone individual, as thecase may be, from constituting a family.

Explanation-III: A posterior branch shall be reckoned with reference to the lowest branch of the patriarchalfamily tree; and the other two branches shall be reckoned accordingly.

Explanation-IV: “Dependant” means dependant on any individual of the family.

Income Criteria :

Income Criterion for LIG Scheme: The gross annual income of the family of the applicant(s) during the precedingfinancial year should be within the range of Rs. 2,00,000/- to Rs. 3,00,000/-.

Income Criterion for MIG Scheme: The gross annual income of the family of the applicant(s) during the precedingfinancial year should be within the range of Rs. 3,00,001/- to Rs. 5,00,000/-.

For all the purposes of this Scheme, the expression “preceding financial year” means the preceding financialyear relevant to the date of instant advertisement.

An application, if to be made jointly, shall be made by a maximum of two eligible individuals, provided that theyare members of the same family; but, in no case, not more than one application shall be made from the samefamily.

APPLICATION PROCEDURE

The applicant(s) must apply in the enclosed Application Form duly filled-in and signed.

The following payments must be remitted with the application:

Payments must be remitted by two separate Bank Drafts/ Pay Orders:

(1) one for Rs. 500/- in case of LIG Scheme and Rs. 1,000/- in case of MIG Scheme as Non-RefundableRegistration Fee and

(2) another for Rs. 56,700/- (Rs. 55,000/- + Rs. 1,700/-) in case of LIG Scheme and Rs. 1,54,635/-(Rs. 1,50,000/- + Rs. 4,635/-) in case of MIG Scheme as Application Money and Service Tax.

Both the Bank Drafts/ Pay Orders must be drawn in favour of “Asansol Durgapur Development Authority” payableat Durgapur.

The application must be accompanied with–

(1) self-attested photocopy (photocopies) of Voter Identity Card(s)/ Passport(s) of the applicant(s),

(2) original copy of the affidavit (in the enclosed format) sworn/ affirmed by the sole/ first applicant testifying to

the fact that he/ she has no, and none of his/ her other family members has any, residential land/ house/ flatwithin the jurisdiction of Durgapur Municipal Corporation in the capacity of a single or joint owner/ lessee/licensee/ member of a co-operative housing society and

(3) valid documentary evidence of the gross annual income, which must include the following documents:

(a) (i) For Salaried Employee

Self-attested copies of Salary Statement (duly signed and sealed from his/ her employer) andIncome Tax Return, of the preceding financial year.

(ii) (A) For Pension Holder (who is not re-employed)

A self-attested copy of Pension Pass Book/ Pension Certificate from bank/ authorised officerof his/ her erstwhile employer.

(B) For Pension Holder (who is re-employed)

Self-attested copies of (I) Pension Pass Book/ Pension Certificate from bank/ authorised officerof his/ her erstwhile employer and (II) Salary Statement (duly signed and sealed from his/ herpresent employer) and Income Tax Return, of the preceding financial year.

(iii) For Self-Employed Applicant (who is not income Tax Assessee)

Original copies of (A) Income and Expenditure Account/ Profit and Loss Account, (B) BalanceSheet and (C) Income Statement, of the preceding financial year, all duly certified by a CharteredAccountant.

(iv) For Self-Employed Applicant (who is Income Tax Assessee)

Self-attested copies of (A) Income and Expenditure Account/ Profit and Loss Account, (B) BalanceSheet and (C) Income Tax Return, of the preceding financial year.

(b) In case of joint application, the application must be accompanied with the aforesaid documents of theboth applicants. If any applicant has no income, a declaration (in original) to that effect by him/ hershould be submitted along with the application.

(c) The affidavit to be submitted by the sole/ first applicant must also testify to the fact that the gross annualincome of his/ her family is within the applicable income criterion.

SUBMISSION OF APPLICATION

The Application Form, along with requisite Bank Drafts/ Pay Orders and other documents, will be received duringthe banking hours on any working days (within the last day of submission of application) at any branch of theOriental Bank of Commerce mentioned in the Information Brochure.

TERMS & CONDITIONS OF APPLICATION

An application not meeting the provisions under “WHO CAN APPLY” shall be summarily rejected without makingany reference to the applicant(s). However, the sole/ first applicant will get refund of the application moneywithout any interest thereon and after deduction of 5% of that money as Administrative Charges.

If, at any time before the lottery, it is detected that an application is incomplete or deficient in any respect or hasany inconsistent information, the application shall be summarily rejected without making any reference to theapplicant(s). However, the sole/ first applicant will get refund of the application money without any interest thereonand after deduction of 5% of that money as Administrative Charges.

If, at any time before the lottery, it is detected that the applicant(s) has (have) furnished/ submitted any false/forged information/ document/ declaration, the application shall be summarily rejected without making any referenceto the applicant(s) and the application money deposited by the applicant(s) shall stand forfeited.

If the applicant(s) withdraws his/ her (their) application at any time before the date of draw of lottery, the sole/ firstapplicant will get refund of the application money without any interest thereon and after deduction of 5% of thatmoney as Administrative Charges.

The application money of unsuccessful applicant(s) will be refunded to the sole/ first applicant by bank draft/ payorder or A/c payee cheque in due course as per the norms of ADDA. No interest will be paid on the applicationmoney.

In case of a joint application, all correspondences shall be made only with the first applicant, unless thecircumstances of the case otherwise requires.

MODE OF ALLOTMENT

The allotment of Flat and Parking Space to the applicant(s) shall be done by draw of lots within 6 months from thelast date of submission of application. Venue, date and time of the same will be intimated by Public Notice,including notice on the official website of ADDA (addaonline.in).

TERMS & CONDITIONS OF ALLOTMENT

The terms and conditions of application insofar as they relate to rejection of application shall apply mutatismutandis to the allotment.

The Flat or Parking Space allotted in favour of the applicant(s) shall not be changed or substituted.

Allotment letter will be issued by the Developer, M/s Krishanbhakta Griha Nirman (Pvt) Ltd, directly to the successfulapplicants.

After issue of the allotment letter, the allottee(s) shall have to pay the Balance Lease Premium and other moneysto the Developer in accordance with the Schedule mentioned in the Information Brochure.

The Flat or Parking Space shall not be divided or sub-divided.

In case of LIG scheme, transfer will be allowed only after completing 3 years from the date of issue of allotmentletter, provided that –

(i) the transferee fulfills the eligibility criteria for LIG Scheme as may be prevailing at the time of making applicationfor transfer and

(ii) the norms of ADDA, including the norms regarding making payment of Transfer Fees etc., if any, as may beprevailing at the time of allowing the transfer are complied with.

In case of MIG Scheme, transfer will be allowed only after completing 5 years from the date of issue of allotmentletter, provided that –

(i) the transferee fulfills the eligibility criteria for MIG Scheme as may be prevailing at the time of makingapplication for transfer and

(ii) the norms of ADDA, including the norms regarding making payment of Transfer Fees etc., if any, as may beprevailing at the time of allowing the transfer are complied with.

In any case, no transfer will be allowed, unless the lease deed is executed in favour of the allottee(s) andregistered after the execution.

Other terms and conditions of allotment will be such as will be containing in the letter of allotment, provided thatnone of them will be inconsistent with the terms and conditions of allotment contained hereinabove.

EXECUTION OF LEASE DEED

After payment of entire lease premium and other moneys and fulfillment of the terms and conditions of theallotment, a tripartite lease deed as per the norms of ADDA will be executed in favour of the allottee(s).

All statutory duties, fees and other expenses for preparation, and registration after the execution, of the leasedeed shall be borne by the allottee(s).

ADDA reserves the right to reject the process of lottery or result thereof at any time without assigning anyreason therefor.
