Health & Safety Representative Training

Unions Tasmania is a well-respected and experienced provider of training

for health and safety representatives (HSRs). Our training is WorkSafe

Tasmania and Comcare approved and is targeted primarily at HSRs,

however; we also welcome supervisors, safety officers or any employee

interested in workplace health and safety. Our courses are attended by

HSRs and employees from diverse industries and backgrounds who can

share their experiences and learn together to improve the health and

safety of their workplaces.

Topics covered will include:

• Interpreting the WH&S legislative framework and its

relationship to the HSR role.

• Identifying key parties, legislative obligations and duties.

• Establishing representation in the workplace.

• Participating in consultation and issues resolution.

• Represent members in the WHS risk management process

undertaken by the PCBU.

• Issuing a Provisional Improvement Notice (PIN) and directing the

cessation of work.

The WHS Act 2011 provides a legal entitlement for an elected HSR (and Deputy

HSR) to attend an approved 5-day course. They also have the right to choose

their training provider in consultation with their employer

POWERS OF A HEALTH AND SAFETY REP - AT A GLANCE

The powers and functions of HSRs are to:

• Represent workers in their work group in relation to work health and safety matters

• Monitor the measures taken by the PCBU to comply with the WHS Act in relation to their work group members;

• Investigate complaints from work group members about work health and safety;

• Inquire into anything that appears to be a risk to the health or safety of work group members, arising from the conduct of the business or undertaking.

In exercising a power or performing a function, HSRs may:

• Inspect the workplace where their work group works at any time after giving reasonable notice to the PCBU

• Inspect the workplace where their work group works at any time without notice in the event of an incident or any situation involving a serious risk to the health or safety of a person emanating from an immediate or imminent exposure to a hazard

• Accompany an inspector during an inspection of any part of the workplace where their work group works. Inspectors must, as soon as practicable after entering a workplace, take reasonable steps to notify the relevant PCBU as well as any HSRs of the entry

• Be present at an interview between one or more work group members and an inspector or the PCBU

• Request the establishment of a health and safety committee

• Receive information concerning the work health and safety of work group members

• Whenever necessary, request the assistance of any person

In addition following undertaking approved training an HSR can also:

• Direct work to cease

• Issue a Provisional Improvement Notice (PIN)

PCBU Duties to HSRs:

• Allow the HSR to exercise their powers of enquiry, investigation and representation, including accompanying an inspector on an inspection relating to members of their work group

• Allow HSR time off with pay to exercise their powers and perform their functions

• Provide HSR with paid leave to attend an approved training course with a provider chosen by the HSR, and pay course fees and any other reasonable costs associated with attendance

• Attendance is as soon as practicable but within 3 months of a request by the HSR

• Provide resources, facilities and assistance as is reasonably necessary to undertake the role.
