What and Why?

June 3, 2011

―Reapportionment‖ is the allocation of congressional seats among the several states.

―Redistricting‖ is the creation of new district boundaries.

Redistricting ensures that Floridians have equal representation (districts have equal population) in the Florida Legislature and the U.S. House of Reps.One-person, one-vote.

Legal Authority

Based on the decennial census (April 1, 2010), the U.S. Constitution

requires the reapportionment of the U.S. House every 10 years, including

distribution of the House's 435 seats between the states and the

equalization of population between districts within each state.

Article I, Section 4 of the U.S. Constitution provides that—‖ the Time,

Places and Manner of holding Elections for Senators and Representatives,

shall be prescribed in each State by the Legislature thereof.

Article III, Section 16(a) of the FL Constitution, based on the decennial

census (April 1, 2010), the Legislature is required in the second year after

the United States Census (2012 Regular Session), to apportion state

legislative districts.

Article III, Section 21 [20]. Standards for Establishing

Legislative [Congressional] District Boundaries. In

Establishing Legislative [Congressional] District Boundaries:

(1) No apportionment plan or [individual] district shall be

drawn with the intent to favor or disfavor a political party or an

incumbent; and districts shall not be drawn with the intent or

result of denying or abridging the equal opportunity of racial or

language minorities to participate in the political process or to

diminish their ability to elect representatives of their choice; and

districts shall consist of contiguous territory.

(2) Unless compliance with the standards in this subsection

conflicts with the standards in subsection (1) or with

federal law, districts shall be as nearly equal in population as

is practicable; districts shall be compact; and districts shall,

where feasible, utilize existing political and geographical

boundaries.

(3)The order in which the standards within subsections (1)

and (2) of this section are set forth shall not be read to

establish any priority of one standard over the other within

that subsection.
