Chapter 3- Graduated Drivers Licensing Program

I. Initial licensing phase for drivers age 16-17 A. Restrictions

1. You must have 50 hours (10 at night) of practice driving with someone over the age of 21.

2. For the first 12 months following the issuance of the license the number of passengers is limited to 1 person under the age of 20 unless the additional passenger is a sibling or a child of the driver.

3. ALL occupants under the age of 19 must wear a safety belt. 4. After the first 12 months, the number of passengers is limited to 1 in the front seat

and to the number of seat belts in the back seat. 5. 10:00 P.m curfew Sunday-Thursday and 11:00 Friday and Saturday. 6. Legal blood alcohol content is .00 7. Use of cell phones under the age of 19 is prohibited while driving unless it is an

emergency. TEXTING WHILE DRIVING IS ALSO PROHIBITED. 8. A traffic conviction during the initial licensing phase ( 16 and 17 years) may extend

any restrictions beyond the age of 18. 9. Any student who drops out of high school before the age of 18 or is truant can have

his/her license taken away by the school district in which he/she attends.

*NOTE: Anyone caught driving without a valid permit will be ineligible to obtain a drivers license until they are 18.

Chapter 3- Graduated Drivers Licensing ProgramI. Initial licensing phase for drivers age 16-17

B. Restrictions: 1. To obtain court supervision, a driver must appear in court with

a parent/legal guardian and must also attend a traffic safety school. Limit one court supervision for serious driving offense.

2. The conviction of any moving violation before 18 results in a warning letter sent to the parents of the teen.

3. A moving violation conviction that occurs within the first year of licensing will result in a six month extension of the passengers limitation, which allows only one unrelated passenger under the age of 20.

4. Conviction of 2 moving violations in a 24 hour period results in a minimum of 1 month suspension.

5. A suspended driver is required to a remedial driver education course, pay a $70 reinstatement fee and be retested.

Chapter 3- Graduated Drivers Licensing ProgramII. Parental Consent:

A. Drivers age 16 and 17 must have parental/legal consents to obtain a drivers license.

B. Parent/legal guardians may withdraw your license for any reason until you turn 18.

Parents/legal guardians may access your driving record at anytime.

If you are under 17 and you drive after nighttime driving restriction hours, you must have a parent, legal guardian, or someone 18 years of age or older with you. Your parents/legal guardian MUST approve of the person. If these conditions are not met your license WILL NOT be valid during these hours.

Chapter 4- Traffic LawsI. Passenger Safety Laws:

A. Safety Belt Law: Seat belts must be worn by ALL drivers and ALL FRONT AND BACK SEAT PASSENGERS EIGHT YEARS OF AGE AND OLDERS. 1. responsibility of the driver to see that all front seas

passengers 8-16 obey the law. 2. Drivers under age 18 are required to limit passengers to 1 in

the front seat and the number of seat belts in the back seat. They must all wear their seat belts.

B. Proper adjustment of seat belt: 1. Lap Belt: should be worn across the hips, not across the

stomach. 2. Shoulder Strap: Across the chest not under the arm or behind

the back.

C. Child Passenger protection act: Requires the use of a safety restraint system for ages 16 & under. 1. Children under the age 8 must be properly secured

in an approved restraint system, a booster seat, or if over 40 pounds a seat belt ( only allowed in the back seat for all if properly equipped)

2. Any person transporting a child under 16 is responsible for a child’s safety.

3. Avoid putting a car seat in the front seat if your vehicle has a passenger air bag.

15’ of the nearest rail. Fine $500.00, 50 hrs community service 1. Proceed only after the gate is all the way up, the lights are no longer on, and

you have visually checked all the tracks for any additional trains. C. School Bus Stop: You must stop when a school bus is stopped on a

two-lane highway and its red warning lights are flashing and its stop arm is extended. 1. Must stop before before meeting /overtaking a school bus. 2. on a four-lane roadway where bus it= opp. Direction does not need to stop

but use caution. 3. Fine:

First offense: 90 day suspension plus $150 fine Second offense within 5 years- 1 year suspension plus $500 fine

A. Hill Parking 1. Uphill with curb: Wheels away from the curb 2. Downhill with curb: Wheels toward the curb 3. Uphill/Downhill without a curb: Turn the front

wheels toward the side of the road. Parallel Parking: On streets with two-way

traffic, park so that the side wheels are parallel to and within 12” to the curb. 1. Vehicles must be parked in the direction in which

traffic is moving.

D. Parking is illegal: 1. on the roadway side of a parked vehicle double parking. 2. in a crosswalk or sidewalk. 3. in front of a driveway. 4. within 30’ of a stop sign 5. Within 15’ of a fire hydrant 6. on a bridge, overpass, or railroad track.

seat 5. ride in a house trailer 6. drive onto a R.R Xing, enter an intersection or drive

within a marked crosswalk unless there is enough space to allow passage of other vehicles, pedestrians or trains.
