Compliance and Due Diligence Report-NKUSIP

INTRODUCTION

1. Overview. Asian Development Bank (ADB) funded North Karnataka Urban Sector Investment Program (NKUSIP) is financing investment in the sectors of (i) water supply; (ii) sewerage and sanitation; (iii) urban drainage; (iv) urban roads; (v) poverty alleviation; (vi) non-municipal infrastructure inclusive of development/conservation of lakes, expansion of fire services, development of tourism and sports facilities; (vii) institutional development; and (viii) investment program assistance. The overall development goal of the NKUSIP is to facilitate economic growth in the 25 towns of North Karnataka and bring about urban development through equitable distribution of urban basic services to the citizens that are environmentally sound and operationally sustainable. The development purpose is designed to assist Urban Local Bodies (ULBs) to “promote good urban management, and develop and expand urban infrastructure to increase economic opportunities and to reduce vulnerability to environmental degradation and urban poverty”. 2. Summary of LA and R&R Issues. In all Tranches under implementation, during designing of various utilities, precaution was taken to minimize impacts of land acquisition and replacement. A majority of the subproject works/activities involving rehabilitation are accommodated within the existing premises while government lands were made available/utilized for works such as construction of OHTs, ELSRs/GLSRs, Wet wells, Jack Well, Pumping Stations etc. Non municipal infrastructure, fire services, tourism related works etc. are also accommodated within their existing premises or in available government lands. Permanent land acquisition was proposed only where government lands were not available and technical design demanded identified parcel of private land. A majority of such cases were also proposed for direct purchase and were successful by offering consent award (negotiated price between both parties) to affected persons (APs). Wherever permanent land acquisition was unavoidable, resettlement plan (RP) was prepared and LA and R&R activities are undertaken in line with the approved RP. Temporary impacts envisaged during laying of pipelines are also minimized through adequate consultation with the people, giving prior notice of work, providing alternate access, carrying out work during non business hours/night etc. In towns where permanent land acquisition was proposed, subprojects are classified into Involuntary Resettlement Category B while in other towns subprojects are classified into Category C. Some of the key LA and R&R issues identified during compliance reporting include:

• Possession of Land and Fencing. It was observed that at many sites though land acquisition process is completed and ownership has been transferred in urban local body’s (ULB) name, ULB has not taken the possession of land. These lands were also not adequately fenced due to lack of funds with the ULB. Moreover, such work is built into contractors cost and is a contractor’s responsibility. This practice has given a chance to APs to continue with cultivation activities at the acquired site (at least wherever civil works are not started or considerably delayed) and again claim for compensation.

• Temporary Impacts during Pipelaying. Though it has been indicated that

network/pipelines will be laid within the available existing right of way (RoW) of the road or along the natural drain etc., construction activities (excavation, dumping, refilling, vehicle movement) require additional space. Wherever approach/road is narrow and there is an ambiguity in ownership (natural drains etc.) temporary impacts on adjoining private lands are unavoidable. Not

identifying and addressing such impacts prior to construction has lead to construction delays and financial implications.

3. Summary of Proposed Actions.

• Support to APs during early stages of Land Acquisition. Land acquisition (LA) process follows a structured process and requires stipulated time for field verification, verification of ownership records, estimation of losses, issue of public notifications, addressing of complaints/grievances etc. As per the ADB’s safeguard policies and NKUSIP’s Resettlement Framework it is mandatory to complete LA and R&R activities before taking possession of land and start of civil works. However, it has been observed in almost all LA cases under NKUSIP that the affected people (APs) were compensated much later after the land possession was taken. Among these also include cases that are delayed due to court intervention for enhancement of compensation for losses incurred. Many of the consulted landowners in such cases were of opinion that accepting lower compensation reduces merit of their case in Court and hence they preferred to wait. Discussion with many APs also indicated that though they were well informed, they did not had the support during initial stages (when land acquisition was being processed) like the support they receive during RP implementation from Implementing NGO as most of them are not well educated and do not understand the legalities involved.

• Fencing of Acquired Lands. All government lands that are identified for

subprojects and all private lands for which acquisition process is completed needs to be fenced to avoid possibility of further encroachments. ULB should also place sign board at the site indicating project information.

• Preparation of Intermediate Corrective Action Plans. Towns where temporary

impacts are envisaged/identified will be required to prepare corrective action plans to mitigate/address incurred losses.

Supply & Laying DI Pumping Main from Karjagi to Heggere, construction of intake works, strengthening of distribution systems & providing & fixing bulk flow meters.

No LA and R&R impacts. A total alignment of 14.8 km. pumping main was laid in a trench on the edge of the road within the existing right of way (RoW. There was no land acquisition (LA) or resettlement and rehabilitation (R&R) impacts. Government land free of encumbrances (crops, structures, etc.) was available for construction of pumping station. Construction at intake works was carried out within existing premises and no additional land acquisition was required.

1HVR2 Haveri Sewerage Supply & Laying of New Gravity System, Constructing FAL type STP & Secondary Drainage Link

No LA and R&R impacts. Sewerage network is laid/being laid on the edge of the road below surface within the existing RoW and there are no temporary impacts while pipe laying. Sewage Treatment Plant (STP) site is free of encumbrances. The site measures 19.29 acres at Siddadevapura village (Survey Nos. 32 & 39) and was purchased from the Health Department with ownership transferred to the name of Haveri ULB.

01RCR01 Raichur Water Supply Improvements to Water Supply System at Rampur & Krishna water works.

No LA and R&R impacts. Laying of pumping main is carried out on the edge of the road below surface within existing RoW with no temporary impacts. Construction of OHTs is undertaken in government parks/grounds and in the forest land/hillock free of encumbrances (crops, structures, trees etc.) to avoid private land acquisition.

01RCR02 Raichur Sewerage Improvements to Sewerage system & construction of 20 MLD FAL type STP and allied works for Eklaspur zone.

Sewerage network will be laid on the edge of the road below surface within existing RoW with no temporary impacts for pipe laying. STP site is free of encumbrances (crops, structures, trees etc.) and measures32.02 acres near Manchalapur tank-Ekalspur which is already in ULB possession. No additional land acquisition is anticipated. Currently, STP site can be approached through a narrow road and there is a possibility of spilling over of construction activities into private lands leading to crop loss. Careful supervision of construction is required. No LA impacts or temporary impacts are envisaged while laying trunk main.

Close supervision of EMP during construction to avoid spillover into private lands.

01HPT01 Hospet Water Supply Improvements to Water Supply System

No LA and R&R impacts. Construction of OHTs/GLSR (3+1 nos.) is undertaken in government lands free of encumbrances (crops, structures, etc.), construction of filter bed has been carried out within existing water treatment plant premises while pipelines are laid within available width (RoW) of the road.

01HPT02A Hospet Sewerage Providing & laying 176 km sewer network including construction of manholes & secondary drains of length 1.75km.

2RNR2 Ranebennur Sewerage Supply & Laying of Sewerage Network & Constructing FAL type STP

The ULB land was free of encumbrances (crops, structures, etc.) covering a total area of 27.3 acres available for construction of STP at Hullatti Village. Sewerage network is laid/being laid on the edge of the road below surface within the existing RoW and there are no temporary impacts while pipe laying. There were unanticipated land acquisition impacts while laying of trunk main due to change in alignment and where no RP was prepared. A 160m stretch of trunk main was originally to be laid in a nalla but due to technical reasons the alignment was shifted to adjacent private land. The land is currently leased to the Mumbai Education Trust Society however, the pipes were laid without consultation with the land owner and no compensation paid. A RP is needed to ensure compliance with ADB’s policy requirements. Other parts of the alignment are proposed on lands where ownership is not clear due to issues with title documents and where works have not yet started.

Where works on private land occurred without RP and without consultation and compensation, this is in non-compliance with ADB’s resettlement policy requirements. KUIDFC is to immediately prepare a new RP for this subproject. No further construction in these sections can occur until compensation is paid, and where ownership is not clear, compensation is deposited in an escrow account prior to works.

2FES01 Dharward and Ranebennur

Fire Fighting Construction of 5 bay fire station, 2 twin fire officer’s quarters and 20 person firemen quarters at Dharwad District and 1 twin fire officer quarters and 12 person firemen quarters at Ranebennur in Haveri District

No LA and R&R impacts. Works were confined within the existing premises. Adequate land was available for expansion and no additional land acquisition was undertaken. There were no temporary impacts.

2BJR2 Bijapur Sewerage Rehabilitation of existing Sewerage system & Interception & extension of Sewerage system to new areas (District 1A) and rehabilitation of primary storm water.

No LA and R&R impacts. Sewerage network is laid/being laid on the edge of the road below surface within the existing RoW and there are no temporary impacts while pipe laying. Construction of storm water drain is completed and was carried out within the existing natural width of natural drain.

ULB land measuring 56.38 acres free of encumbrances (crops, structures, etc.) at Mabagayata village was available for construction of STP and no new additional private land acquisition was required.

2HUB2B Hubli Dharwad Sewerage Design, supply, installation, commissioning & O&M of 40 MLD STP using (SBR/CASP) process plant at Gabbur in Hubli.

Government land (16.865 acres) encroached by original landowners for cultivation was available for construction of STP. RP prepared and being implemented in line with RF for mitigating impacts on these encroachers. The land possession was taken post harvest to avoid crop losses and a total of 8 identified landowners (64 APs) were provided with susbistance allowance and land-for-land at Hireharekuni village. A total of 26 acres land (Survey Nos. 185/1, 56/2, 221/2) was equally distributed among 13 affected landowners (8 + additional 5 eligible from joint ownership). All affected landowners/people have land, subsistence allowance while provision of assistance for income restoration is under progress.

Expedite survey for identifying income restoration needs. Assist change in ownership documents for alternate lands provided. (As without ownership record some of the landowners are facing problems in getting crop loan, seed subsidy etc.)

2HUB2A Hubli Dharwad Sewerage Providing Sewer Trunk mains, sub mains & interceptors in sewer zone 1 & 3, sub main and force main in sewer zone-4 and construction of storm water drain

No LA and R&R impacts. Sewerage network is laid/being laid on the edge of the road below surface within the existing RoW and there are no temporary impacts while pipe laying. Construction of storm water drain is completed and was carried out within the existing natural width of natural drain.

2HUB2 Hubli Dharwad Sewerage Providing Sewer Trunk mains, sub mains & interceptors in sewer zone 2

In 1980, Hubli Dharwad Municipal Corporation (HDMC) had acquired agriculture land covering a total area of 16.865 acres at Gabbur village for the construction of STP. However, original landowners continued cultivation in acquired land as construction of STP was delayed. Under NKUSIP, a detailed socio-economic survey was conducted in January 2010 for the preparation the RP. This survey identified a total of eight landowners and 64 affected people (APs) and all APs were from vulnerable category (Scheduled Tribes). This RP was approved by the ADB in October 2010. Impacts on all APs were addressed in line with the RP. The sewerage network is laid/being laid on the edge of the road below surface within the existing RoW and there are no temporary impacts while pipe laying. However, impacts are envisaged on the adjacent landowners (crop loss, land degradation, pumping stations etc.) while laying trunk main alignment of total 1.8 km. from STP site to NH-4 bypass (from (i) existing right of way of STP approach road till old Gabbur village; and (ii) from old Gabbur village to NH-4 bypass along the natural drain). A part of the alignment is already laid, while the remaining work is stopped by the affected landowners. In addition, as indicated by site officials, sewage chamber work has also been stopped from past one year by the adjacent landowner who claims the land is his. Though officials claim that it’s a nala/road land. A landowner is also asking for compensation for old pump house which is located in his land. Agricultural department/AC office has recently undertaken survey for estimating the losses.

Prepare Corrective Action Plan (CAP) for impacts: (i) to adjacent lands to trunk mains affected by construction spillover, (ii) to landowner at old pump house, and (iii) clarify land ownership for sewage chamber site and append the CAP to original RP (as an updated RP).

Rehabilitation & strengthening of electro-mechanical works, supplying & laying of DI pumping mains, providing & installation of new pumping machineries. Construction of RCC elevated service reservoirs, construction of WTP of 3.4 MLD capacity, supplying & laying distribution system using PE/DI pipes & fixing bulk flow meters.

No LA and R&R impacts. Water supply network/mains are being laid along road within the existing RoW. Water supply works are carried out within existing premises in available government lands free of encumbrances (crops, structures, etc.) and no additional land acquisition was required. Nippani has existing 6.81 MLD Water Treatment Plant (WTP) near impounding reservoir site (total area measuring around 21 acres; Survey nos. 54/A, 99/A, 100/A). Expansion of additional 3.41 MLD WTP will be carried out within the existing premises. Construction of two overhead tanks (OHTs) is also undertaken in government lands within city limits: one at Shivaji Nagar (Survey No. 59/1); and another at Biroba Mal (Survey No. 30/B).

The land was purchased at the rate of Rs. 0.42 million per acre with total cost of purchase at Rs. 4.57 million. Confirmed to be equal negotiation free of coercion.

2RBK02 Rabkavi Banahatti Sewerage Construction of Sewerage Network and FAL type STP of 9.20 MLD capacity

Sewerage network will be laid along the road within the existing RoW, however alignment for trunk/sub mains needs to verified for temporary impacts on adjoining landowners during construction activities. RP was prepared for STP site which was approved by the ADB. The proposed private land acquisition of 8.18 acres (1.5 Km from the Rabkkavi town on Asangi Road) belonged to one landowner (13 APs). Impacts on all APs were addressed in line with RF. Landowner was against land acquisition in the public interest and hence had approached Court. However, the case is dismissed. Landowner yet to take the total compensation amount that is already deposited in an ESCROW account. STP site will require additional land for buffer zone and an approach road to be developed.

Prepare Corrective Action Plan (CAP) for additional land for buffer zone and approach road and append to original RP (as an updated RP). Fencing of acquired land to avoid possibility of encroachment. Close supervision of EMP during construction to avoid spillover into private lands.

1GLB04 Gulbarga Sanitation Construction of toilet block in Buddha Vihar

No LA and R&R impacts. Construction of toilet block was undertaken within the existing premises and no additional private/government land acquisition was required.

2BDR01 Bidar Water Supply New Bulk Water Supply & New WTP Bulk water supply alignment is laid along road within existing RoW and there are no LA and R&R impacts. RP prepared for Water Treatment Plant (WTP) site for acquisition of 10 acres of private land in Halahalli village. This RP documented impacts on total 10 landowners and 94 APs. However Landowners/APs were revised from the earlier RP (which was approved by the ADB) during the actual award process (based on verification of land records). In April 2013, a revised RP was submitted to the ADB for approval. Revised RP indicate impact on four landowners and 18 APs. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF). All APs have received compensation and subsistence allowance while recently implementing NGO is currently undertaking survey for identifying needs for income restoration activities. ADB approved the revised RP in July 2013. Recently, one adjacent landowner has indicated that his small parcel of the land has been encroached and fenced. It is a corner area of the WT site and no construction will be carried out here.

Conduct joint verification for the WTP land parcel. If identified as private land then prepare Corrective Action Plan (CAP) for additional land acquisition and append to original RP (as an updated RP).

2BDR01A Bidar Water Supply Rehabilitation of distribution system

2BDR02 Bidar Sewerage New sewerage system, new STP(FAL) RP prepared for STP site for acquisition of 53.55 acres of private land in Gournahalli village. This RP documented impacts on total of 10 landowners and 75 APs. The RP was approved by the ADB in January 2012. Impacts on all APs were addressed in line with RF. Identified land though was laying barren (dry land not fit for agriculture) at the time acquisition, landowners had objection for developing this land for STP purpose. They were of opinion that land is close to village habitation and had potential for residential development in near future. Considering this the case was filed in the court which was dismissed by the court in September 2010. STP construction was initiated in February 2012 but was put on hold as landowners approached KSPCB (pollution control board). KSPCB

(For Break Pressure tank: 0.62 acres in Survey No. 63 of Gudigound Gaon Village; and For Jack Well: 0.82 acres in Survey No. 398 of Hulsur Village). The RP documented impacts on total 2 landowners and 11 APs. Impacts on all APs were addressed in line with RF. Both the landowners now have received both land compensation (April 2012) and subsistence allowance (March 13).

RP prepared for acquisition of around 16.40 acres land for STP. The RP documented impacts on total 9 landowners and 63 APs .Impacts on all APs were addressed in line with RF. Except two landowners (who were not available at the time of award due to ownership disputes) all opted for consent award while these absentee landowners were offered with general award. Once the internal disputes are resolved, APs can take general award by approaching Court for further enhancement. Except these two landowners, the rest of the landowners have received compensation and subsistence allowance while NGOs are currently conducting survey for identifying income restoration needs of 7 vulnerable households.

None of the landowners still have accepted any compensation amount which is deposited in ESCROW account. It was noticed that approach road to the Wet Well and STP site is narrow and deep excavation and vehicle movement may spill over into adjacent private lands during construction of pipeline/STP/Wet Well.

Compliance and Due Diligence Report-NKUSIP

COMPLIANCE REVIEW

A. Package I: Hubli-Dharwad

1. Hubli Project Description

A total of around USD 23 million were allocated for Hubli city under Tranche-2 of NKUSIP for: (i) Design, supply, installation, commissioning & O&M of 40 MLD Sewage Treatment Plant (STP) at Gabbur village; (ii) Providing sewer trunk mains, sub mains and interceptors in sewer zone 2; and (iii) Providing sewer trunk mains, sub mains & interceptors in sewer zone 1 & 3, sub main and force main in sewer zone-4 and construction of storm water drain. So far, approximately, 70 percent of STP construction is completed and 50 percent of sewer lines are laid.

LA and R&R Issues

STP Site: In 1980, Hubli Dharwad Municipal Corporation (HDMC) had acquired agriculture land covering a total area of 16.865 acres at Gabbur village for the construction of STP. However, original landowners continued cultivation in acquired land as construction of STP was delayed. Under NKUSIP, a detailed socio-economic survey was conducted in January 2010 for the preparation of Resettlement Plant (RP). This survey identified a total of eight landowners and 64 affected people (APs) and all APs were from vulnerable category (Scheduled Tribes). This RP was approved by the ADB in October 2010. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) notice to harvest standing crop or crop compensation; (ii) subsistence allowance based on three months minimum wages; and (iii) additional assistance (Rs. 30,000) for income restoration. Trunk Main, Sewage Chamber and Pump House: Initial trunk main alignment of total 1.8 km. from STP site to NH-4 bypass passes from: (i) existing right of way of STP approach road till old Gabbur village; and (ii) from old Gabbur village to NH-4 bypass along the natural drain. A part of this alignment has already been laid intermittently. However work is stopped by adjacent landowners (a month back) at certain stretches due to spill over of construction activities into their land damaging crops, trees and top soil quality. Landowners having land all along the alignment (also where work is already completed) are now asking compensation for losses and have indicated that they will not allow construction to progress until they are adequately paid. Within this alignment, one of the landowner is also asking for compensation for old pump house which is located in his land. Agricultural department/AC office has recently undertaken survey for estimating the losses. In addition, as indicated by site officials, sewage chamber work has also been stopped from past one year by the adjacent landowner. Though officials claim that it’s a nala/road land, according to him, chamber has encroached part of his land. Other Civil Works and network: Land required for the construction of wet well (0.25 acres in Block No. 182 in HDUDA layout) was given by Hubli-Dharwad Urban Development Authority (HDUDA). Sewerage network/mains are/will be laid within the existing available right of way (RoW) of roads and there are no LA and R&R impacts.

RP Compliance

STP contract was awarded in March 2011 and actual civil works started from May 2011. In addition to the compensation proposed in RP, considering APs from ST background, Karnataka SC/ST Corporation offered land-for-land compensation at Hireharekuni village. A total of 26 acres land (Survey Nos. 185/1, 56/2, 221/2) was equally distributed among 13 affected landowners (8+ additional 5 eligible from joint ownership). Landowners have already started cultivating this land though the change in ownership is still under process. Meeting with few APs indicated that, in line with the RP, they were adequately consulted at different stages of RP preparation and implementation. They were given adequate notice to harvest standing crop and hence no crop compensation was paid. APs also participated in GRC meetings to fix subsistence allowance. This was paid to APs by issuing bank cheque in January 2012 (Rs. 12,042 per person for 39 APs). However, APs still have not received any training/assets under income generating assistance as mobilization of NGO was delayed. NGO (RUDA) has been recently mobilized (May 2013) and will soon undertake survey for identifying needs of the APs for income restoration.

Proposed Actions

• Expedite survey for identifying income restoration needs of the STP APs and implementation of necessary activities. Assistance in expediting change in ownership documents (as without ownership record some of the landowners are facing problems in getting crop loan, seed subsidy etc.)

• Confirmation of land ownership for sewage chamber site • Completion of trunk main links is a crucial stage in project completion and

commissioning. As per revised contract terms of the contractor, minimal time is left fot carrying out balance works. Verify ownership records and impacts, and prepare “Corrective Action Plan” for identifying and compensating losses of landowners/others affected during laying of trunk main, construction of sewage chamber, pump house etc. Expedite the process of estimating losses, consultation with APs and relevant officials.

2. Dharwad Project Description

In Dharwad, improvement to fire services (construction of fire station and official quarters) was proposed under Tranche-2 while improvement of sewerage system in district 6 & 10 and design, supply, installation, commissioning and O&M of 20 MLD STP is being implemented under Tranche-3. Approximately, 80 percent of fire services building works are completed. Contract for laying of sewer line is recently awarded and so far 25 percent of the network has been laid. Construction of STP and Pumping stations will be initiated soon.

LA and R&R Issues

Construction activities related to improvement of fire services were confined within the existing premises. Adequate land was available for expansion and no additional land acquisition was undertaken. Sewer pipelines will be buried below road in a trench on the edge of the road within the existing RoW and there are no LA and R&R impacts. Government/ULB land covering a total area of 4.08 acres has been identified for construction of Sewage Treatment Plant (STP) at Madihal village. Construction of wet well/pumping station will also be carried out in government land (MI land near lake bund) at Hosayellapura. There was no RP prepared for Dharwad town as government land was available for subproject implementation. No new LA and R&R is envisaged.

3. Gadag-Betegeri Project Description

Gagd-Betgeri is included under Tranche-3 of NKUSIP for improving water supply system including: (i) Design, supply, installation, testing & commissioning of 26.30 MLD WTP at Singgatarayanakara, gravity main from WTP to Point 'A' and distribution network; and (ii) Design, supply, construction, installation, testing, commissioning & O& M for 3 years of water supply scheme for supply of 33.5 MLD raw water from Hammagi Barrage upto WTP at Singatarayanakere. So far, only a small length of Raising Main (which was along the KSHIP highway) has been laid. None of the other works have been initiated due to certain technical pending decisions.

LA and R&R Issues

Construction of new Water Treatment Plant (WTP) will be undertaken within the existing KUWD&DB campus at Singatarayanakere. Adequate land is available for construction/ expansion and no additional land acquisition is required. (4.71 acres available; 2.45 acres required for new construction). There was no RP prepared for Gadag-Betegeri town as government land was available for subproject implementation. No new LA and R&R is envisaged. Laying of Gravity Main (25 km.) and Raising Main (55 km.) may envisage temporary impacts on nearby agricultural landowners (crop/tree loss etc.).

4. Haveri Project Description

Haveri town was included under Tranche-1 of NKUSIP to: (i) Improve water supply system including supply & laying DI pumping main (14.8 km.) from Karjagi to Heggere, construction of intake works, strengthening of distribution systems, and providing & fixing bulk flow meters; and (ii) Supply & laying of new gravity system, constructing FAL type STP & secondary drainage link (1.37 km.). In addition to these works, basic infrastructure improvement was proposed in Nagendramati slum in Haveri under Tranche-2. Among water supply works, laying of pumping main is completed and commissioned while other improvements are near completion. So far, almost of 70 percent of sewerage network has been laid while 40 percent of STP works is completed. Secondary drainage link is partly completed (~ 1.0 km.) and remaining length is under construction.

LA and R&R Issues

A total alignment of 14.8 km. pumping main was laid along road within the existing RoW and there were no LA and R&R impacts. Government land was available for construction of pumping station. Sewerage network was also laid/being laid within the existing RoW and there are no temporary impacts while pipe laying. Sewage Treatment Plant (STP) land measuring 19.29 acres at Siddadevapura village was purchased from the Health Department and ownership has been transferred in the name of Haveri ULB. There was no RP prepared for Haveri town as government lands were available for subproject implementation. No new LA and R&R is envisaged.

5. Ranebennur Project Description

Ranebennur town was included under Tranche-2 of NKUSIP for: (i) Providing basic infrastructure services in Islampur slum; (ii) Construction of 5 bay fire stations, two twin fire officers’ quarters & firemen quarters; and (iii) Supply & laying of sewerage network & constructing FAL type STP. Slum infrastructure works, except road laying (5 percent), could not be undertaken due to contractual issues. Survey to complete pending work and include additional infrastructure works in this slum is underway. Fire services related construction activities are almost complete with some finishing works left. Of the total 65 km. sewerage network, 47 km. is completed while balance (in additional extension areas) is under construction. Almost 85 percent of STP construction is also completed.

LA and R&R Issues

Construction activities related to improvement of fire services were confined within the existing premises. Adequate land was available for expansion and no additional land acquisition was undertaken. Government/ULB land covering a total area of 27.3 acres was available for construction of Sewage Treatment Plant (STP) at Hullatti Village. There was no RP prepared for Ranebennur town as government land was available for subproject implementation. Sub Main Alignment. Due to technical reasons, trunk main alignment at two places and sub main alignment at one place was realigned. Among these, Sub Main alignment near railway gate has been laid by negotiating with private landowner. It is laid along the edge of his property (survey no. 506/2; Patil Mahadev Gaowda). Landowner has indicated that though currently it is an agricultural land, in near future he will develop property for residential purpose (plots) and will propose road where Sub Main is laid. There was no crop loss or damage to properly while laying this Sub Main. Trunk Main Alignment. A 160 m. alignment of Trunk Main which was proposed adjacent to natural drain could not be laid due to technical reasons. With oral permission from Mumbai Education Trust Society (METS, survey no. 2A/1, approx. 2 acres land), this pipeline was laid from their private property in December 2011. However, due to internal disputes between the METS (which is a leaseholder) and original landowner (Muniranjana Jagatguru Murgarajendra Venkat Prasad Nilaya-Dharwad) pipeline was removed and damaged. Currently, there is a police case against founder of METS. KUIDFC/ULB also do not have any action plan ready to resolve this matter so that pipeline can be laid again. Another 210 m. alignment of Trunk Main near railway gate/Samgameshwara Nagar Cross passes through private land and may require land acquisition (Owner SS Vadeyya and six other people, 604/A/1/1 & 604/A/1/2, approx 8 acres). There is a possibility that this pipeline can be laid along the edge of lake.

6. Davangere Project Description

Davangere town was included under Tranche-2 of NKUSIP for providing & laying of raw water pumping main from Rajanahalli head works to Kundawada Lake, installation of new vertical turbine, centrifugal pump sets, construction of 15 LL clear water storage reservoir, 20 MLD filter house and supplying & installation of bulk flow meters for water supply scheme. Under Tranche-3, additional works such as: (i) Laying of trunk mains, sub mains & interceptors in Drainage District-1; and (ii) Design, supply installation, commissioning and O&M of STP & Rehabilitation of existing STP in Drainage District-1 were undertaken. A majority of the water supply works such as laying of pumping main, construction of clear reservoir are completed. Award of contract for sewerage works/STP is under process.

LA and R&R Issues

Pumping main was laid along road within existing RoW and there are no LA and R&R impacts. Sewerage lines will be buried below road in a trench on the edge of the road within the existing RoW. 7. Bijapur Project Description

Bijaour town was included under Tranche-2 of NKUSIP for: (i) Rehabilitation of existing sewerage system & interception & extension of sewerage system to new areas (District 1A) and rehabilitation of primary storm water drain; and (ii) Improvement of sewerage system in District 2B & construction of FAL type STP. Sewerage/STP work is progressing very slow, mainly due to soil conditions (hard rock) and poor performance of the contractor. So far, approximately only around 25 percent of the works are completed. Drainage work is however completed.

LA and R&R Issues

Sewerage network is being laid along road within existing RoW and there are no LA and R&R impacts. Though contractor/ULB is providing alternate access, sometimes, construction activities are prolonged due to hard soil conditions causing temporary disruptions to adjoining areas/activities. Government/ULB land measuring 56.38 acres at Mabagayata village is available for construction of Sewage Treatment Plant (STP). There was no RP prepared for Bijapur town as government land was available for subproject implementation.

B. Package II: Belgaum

8. Gokak Project Description

Gokak town was included under Tranche-2 of NKUSIP and works proposed were: (i) Improvements to basic amenities in two slums; (ii) Improvement to water supply system for providing & installation of new pumping machineries, 399 KVA DG set, construction of DG set room, supplying & laying distribution system using PE/DI pipes, fixing bulk flow meters & rehabilitation works; and (iii) Construction of sewerage network & FAL type STP of 8.70 MLD capacity. A majority of the water supply works (90 percent) are completed while work progress is comparatively lagging behind for laying of sewerage network (30 percent completed) and construction of STP (45 percent completed).

LA and R&R Issues

Water supply and sewerage network/mains are being laid along road within existing RoW and there are no LA and R&R impacts. Water supply works are carried out within the existing premises and no additional land acquisition was required. Similarly, construction of sewage pumping station is undertaken within available government land. Sewage Treatment Plant (STP) site was purchased in March 2010 from private landowners (consent award with negotiated price accepted by both parties-APs and the ULB). The land was purchased at the rate of Rs. 0.42 million per acre with total cost of purchase at Rs. 4.57 million. There was no RP prepared for Gokak town as government land was available for many of the subproject works and private land was purchased from original landowners for STP site.

9. Nippani Project Description

Nippani town was included under Tranche-2 of NKUSIP and works proposed were: (i) Improvements to basic amenities in two slums; and (ii) Improvement to water supply system including rehabilitation & strengthening of electro-mechanical works, supplying & laying of DI pumping mains, providing & installation of new pumping machineries, construction of RCC elevated service reservoirs, construction of WTP of 3.4 MLD capacity, and supplying & laying distribution system using PE/DI pipes & fixing bulk flow meters. Slum infrastructure works are completed however construction of two community toilet blocks could not be taken as government/private land was not available within the vicinity. Around 60 percent of Water Treatment Plant work is completed while 80 percent of water supply lines are laid.

LA and R&R Issues

Water supply network/mains are being laid along road within existing RoW and there are no LA and R&R impacts. Water supply works are carried out within existing premises or in available government lands and no additional land acquisition was required. There was no RP prepared for Nippani town as government land was available for subproject implementation. Nippani has existing 6.81 MLD Water Treatment Plant (WTP) near impounding reservoir site (total area measuring around 21 acres; Survey nos. 54/A, 99/A, 100/A). Expansion of additional 3.41 MLD WTP will be carried out within the existing premises. Construction of two overhead tanks (OHTs) is also undertaken in government lands within city limits: one at Shivaji Nagar (Survey No. 59/1); and another at Biroba Mal (Survey No. 30/B). Sewage Treatment Plant. It was indicated by officials that, Tranche-2 has balance funds (though not adequate) to undertake sewerage project (including construction of STP) for Nippani. Land identified for construction of Sewage Treatment Plant (STP) is in Akkol Village; 5-6 km away from Nippani town. The land is currently under agricultural use (cash crops) and landowner is neither responding to socio-economic survey nor to 4(1) notification issued under LA Act.

11. Ilkal Project Description

Ilkal town was included in Tranche-2 of NKUSIP and works proposed were: (i) Improvements to basic amenities in two slums; (ii) Supply & laying of sewerage network & constructing STP of 8 MLD capacity & improvement of urban drainage system; and (iii) PQ for design, supply equipment & materials and carryout civil works to improve overall water supply. Improvements to urban drainage system is completed however laying of sewerage network, construction of wet well/ pumping stations etc. is progressing comparatively slow. Work is not yet initiated for STP construction.

12. Rabakavi Banahatti Project Description

Rabkavi-Banhatti was included in Tranche-2 of NKUSIP and works proposed were: (i) Slum improvement; and (ii) Construction of sewerage network and FAL type STP of 9.20 MLD capacity. Though the contractor was mobilized to undertake sewerage work, he initially executed very small amount of work and then stopped the work.

LA and R&R Issues

Sewerage network will be laid along the road within the existing RoW, however alignment for trunk/sub mains needs to verified for temporary impacts on adjoining landowners during construction activities. Resettlement Plan (RP) was prepared for STP site which was approved by the ADB. The proposed private land acquisition of 8.18 acres (1.5 Km from the Rabkkavi town on Asangi Road) belonged to one landowner (13 APs). Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/ replacement value; (ii) notice to harvest the standing crop or crop compensation; (ii) compensation for loss of trees/structures/wells etc.; and (iv) subsistence allowance based on 3 months minimum wages.

RP Compliance

Affected landowner is adequately consulted during RP preparation however he is not ready to give his land and has approached Court twice. Both the cases were dismissed by the Court. Payment is deposited in ESCROW account however landowner has not taken any compensation money.

Proposed Actions

• Taking passion of STP land and fencing of acquired land to avoid possibility of encroachment

• Employ necessary measures to avoid spill over of construction activities in private lands (especially where trunk/sub mains are passing from agricultural/busy commercial areas). 13. Jamakhandi Project Description

Jamakhandi was included in Tranche-2 and Tranche-3 of NKUSIP and works proposed were: (i) Slum improvement; (ii) Construction of Sewerage network & FAL type STP of 7.60 MLD capacity; and (iii) Construction of works for Lake Development in Lakkankere. Sewerage work is progressing slow while recently tender has been awarded for carrying out land development works.

LA and R&R Issues

Sewerage network will be laid along the road within the existing RoW, however alignment for trunk/sub mains needs to verified for temporary impacts on adjoining landowners during construction activities. Construction of Sewage Treatment Plant (STP) will also be taken within the existing STP premises (land area 15.20 acres near Maigur Road)

C. Package III: Gulbarga

14. Gulbarga Project Description

Gulbarga town was included in the Tranche-2 of NKUSIP and the works proposed were: (i) Construction of toilet block at Buddha Vihar; (ii) Rehabilitation of existing sewerage system and extension in new areas; and (iii) Design, supply, installation, commissioning & O&M of 40 MLD Sewage Treatment Plant (STP). Construction of toilet block is completed however due to poor performance of the contractor, sewerage work has been stopped and contractor is terminated. Currently, Gulbarga ULB is undertaking retendering to implement balance works. However, so far, just 1-2 percent of the physical works have been executed by the earlier contractor. Under Tranche-3, sewerage network will be extended in additional unserved areas.

LA and R&R Issues

Construction of toilet block was undertaken within the existing premises and no additional private/government land acquisition was required. There were no R&R impacts. Resettlement Plan (RP) was prepared for STP site which was approved by the ADB in March 2012. A total of 11 landowners (69 APs) were affected due to proposed land acquisition of 30.25 acres in Nandikur village. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/ replacement value; (ii) notice to harvest the standing crop or crop compensation; (ii) compensation for loss of trees/structures/wells etc.; (iv) subsistence allowance based on 3 months minimum wages; and (v) additional assistance (Rs. 30,000) for income restoration.

RP Compliance

Possession of land was taken over by the Gulbarga ULB in August 2010 while contract was awarded and actual civil works started from November 2011. Possession of the land was taken much before and civil works also started much before: (i) DLVC estimated actual land/ other compensation (March 2011), (ii) GRC meeting that finalized subsistence allowance (May 2012), (iii) payment of land compensation to APs (December 2012) and (iv) payment of subsistence allowance to APs (February 2013). Recently implementing NGO has completed survey for identifying income restoration needs and soon these activities will be implemented. Meetings with few landowners/APs indicated that, in line with the RP, they were adequately consulted at different stages of RP preparation and implementation. APs also participated in GRC meetings to fix subsistence allowance. However, according to them, their expectation in terms of estimating actual market price was not adequately addressed. They further indicated that they will seek court support for enhancement of compensation. (Land compensation was estimated 2-3 years back when land prices were comparatively lower. Recent developments in the vicinity have escalated land prices. Since STP work is not yet started (except some excavation), landowners are of opinion that they should get higher compensation). Land compensation/assistance was paid to all APs by issuing bank cheque. (A total of Rs. 4.10 million land/tree compensation at the rate of Rs. 0.09 million per acre and Rs. 1.49 million subsistence allowance was paid to APs). A total of 18 eligible APs will receive additional income restoration assistance

Proposed Actions

15. Shahabad Project Description

Shahabad town was included under Tranche-2 of NKUSIP and works proposed were: (i) Improvement of slum infrastructure; and (ii) Construction of new Bulk water supply system, rehabilitation of distribution system & new Water Treatment Plant (WTP). Laying of bulk water supply network is completed and around 70 percent of other network has been laid. WTP civil works are also completed upto 70 percent.

LA and R&R Issues

Water Supply network/mains are laid along road within existing RoW and there are no LA and R&R impacts. Construction of WTP and Jack well required private/institutional land acquisition of around two acres and hence Resettlement Plan (RP) was prepared during the project preparation stage. However, later it was confirmed that, the land required for WTP site belongs to ULB. (Only a part of land under survey no. 184 is leased to Hyderabad Karnataka Education Society, and leased land is separate from the land that is selected for WTP). Similarly, landowner of the jack well site (survey no. 53) opted to sell his land and ULB purchased it for Rs. 0.45 million. Land rate was negotiated with him by the DLVC in May 2012 and the payment was also deposited in ESCROW account immediately. Currently, landowner is in process of transferring old ownership records (some ownership issues, related to death etc.). He will accept the payment after ownership issue is resolved.

Water Treatment Plant Site

16. Bidar Project Description

Bidar town was included under Tranche-2 as well as Tranche-3 of the NKUSIP and works proposed were: (i) New bulk water supply & New Water Treatment Plant (WTP); (ii) Rehabilitation of distribution system; (iii) New sewerage system and new Sewage Treatment Plant (STP); (iv) Providing storm water drain (Khandak cleaning) around the Bidar Fort; (v) Extension of sewerage system in new area; and (vi) Tourism works in Bidar. Around 50 percent of the water supply works are completed while progress of sewerage works/STP is comparatively slow (STP-approximately 6 percent complete; network 17 percent complete). Work contract for drainage work (Khandak) is in tendering stage while tourism development at two temple complexes (Papanashani Temple and Narasimha Zarna) is under progress.

LA and R&R Issues

Water supply/sewerage pipelines are laid along road within existing RoW and there are no LA and R&R impacts. Desilting of drain around the fort (Khandak) will also be carried out within the existing available width. The drain is also free of encroachments. Development of tourism related activities (approach road, steps, buildings etc.) for two temples is being carried out within their existing premises and there are no LA and R&R impacts. Water Treatment Plant. Resettlement Plan (RP) was prepared for Water Treatment Plant (WTP) site for acquisition of 10 acres of private land in Halahalli village. This RP documented impacts on total 10 landowners and 94 APs. However Landowners/APs were revised from the earlier RP (which was approved by the ADB) during the actual award process (based on verification of land records). In April 2013, a revised RP is submitted to the ADB for approval. Revised RP indicate impact on four landowners and

Recently, one of the adjoining landowner has filed a complaint with AC saying a part of this land has been encroached by the WTP and is fenced. Sewage Treatment Plant. Resettlement Plan (RP) was prepared for Sewage Treatment Plant (STP) site for acquisition of 53.55 acres of private land in Gournahalli village. This RP documented impacts on total of 10 landowners and 75 APs. The RP was approved by the ADB in January 2012. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/replacement value; (ii) notice to harvest standing crop or crop compensation; (ii) compensation for loss of trees/structures/wells etc.; (iv) subsistence allowance based on three months minimum wages; and (v) additional assistance (Rs. 30,000) for income restoration.

RP Compliance

Water Treatment Plant. Discussion with few landowners/APs indicated that they were adequately consulted during RP preparation and implementation. They also participated in GRC meeting to fix up subsistence allowance. Total four affected landowners have received land compensation in May 2012 at the rate of Rs. 0.04 million per acre (total amount Rs. 0.66 million). Eighteen members/APs will additionally receive subsistence allowance of Rs. 14,161 per person once revised RP is approved by the ADB. These 18 members will also receive assistance for income restoration. Implementing NGO is currently undertaking survey for identifying needs of eligible APs for income restoration activities. Sewage Treatment Plant. Identified land though was laying barren (dry land not fit for agriculture) at the time acquisition, landowners had objection for developing this land for STP purpose. They were of opinion that land is close to village habitation and had potential for residential development in near future. Considering this the case was filed in the court which was dismissed by the court in September 2010. STP construction was initiated in February 2012 but was put on hold as landowners approached KSPCB (pollution control board). KSPCB advised to stop the work and set up panel to resolve the matter. However, no such panel has been established till date and recently STP construction has been taken up again considering project delays and financial implications. None of the landowners are ready to take land compensation which is already deposited in the ESCROW account.

Proposed Actions

• Expedite identification of income restoration needs of WTP APs and implement necessary activities. Expedite ADB approval for revised RP to facilitate payment of subsistence allowance

• Joint verification for the WTP land parcel for which case has been recently filed and confirmation of encroachment. If yes, and that land is required for WTP, propose land acquisition and carry out necessary procedures (revision of RP etc.)

Laying of Network, Drain (Khandak) and Temple Development

17. Basavakalyan Project Description

Basavakalyan town was included under Tranche-2 and works proposed were: (i) Slum improvement; (ii) Tourism/pilgrimage related development; (iii) Construction of one twin fire officers qtrs & 12 fireman qtrs.; and (iv) New bulk water supply system with construction of jack well and break pressure tank. Laying of pipeline is completed while construction of jack well and break pressure tank is near completion.

LA and R&R Issues

Works under slum improvement, pilgrimage related development and fire services buildings were carried out within existing premises, available width (RoW) of the road and there were no LA and R&R impacts. Laying of bulk water supply line from jack well to break pressure tank however involved spill over of construction activities and vehicle movement into adjacent private agricultural lands leading to crop damage. Currently, these losses are paid by the contractor. Resettlement Plan (RP) was prepared for Jack Well and Break Pressure Tank sites for acquisition of total 1.44 acres. (For Break Pressure tank: 0.62 acres in Survey No. 63 of Gudigound Gaon Village; and For Jack Well: 0.82 acres in Survey No. 398 of Hulsur Village). The RP documented impacts on total 2 landowners and 11 APs. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/replacement value; (ii) notice to harvest standing crop or crop compensation; (ii) compensation for loss of trees/structures/wells etc.; and (iv) subsistence allowance based on three months minimum wages.

RP Compliance

Discussion with one of the landowner indicated that he was adequately consulted during RP preparation and implementation. Land possession (March 2011)was taken much

18. Yadgir Project Description

Yadgir town was included under Tranche-2 of NKUSIP and works proposed were: (i) Slum improvement; (ii) Water supply improvement works including remodelling & improvement of distribution network for a length of 84.91 kms, rehabilitation of WTP, replacement of MS pipeline for a length of 300 meters, providing erection & commissioning of vertical turbine pump sets (2 nos.) of head 51 mtrs & discharge 143 LPS, rehabilitation of WTP, supply & installation of bulk flow meters and valves etc.; and (iii) Construction of one twin fire officers qtrs & 12 fireman qtrs. Yadgir is also included under Tranche-3 for providing new sewerage system & new STP. Slum improvement, fire services and water supply works taken under Tranche-2 are completed while award of contract for undertaking sewerage works is under process. Sewerage works may start from mid July 2013. Escrow account.

LA and R&R Issues

Works such as slum improvement, rehabilitation of WTP and other water supply related works, fire services buildings etc. were carried out within existing premises, available width (RoW) of the road and there were no LA and R&R impacts. Resettlement Plan (RP) was prepared for Wet Well and Sewage Treatment Plant (STP) sites for acquisition of total 22.25 acres at M. Hosalli Village. (For Wet Well: 0.25 acres and for STP: 22.0 acres). The RP documented impacts on total 7 landowners and 37 APs. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/replacement value; (ii) notice to harvest standing crop or crop compensation; (iii) subsistence allowance based on three months minimum wages; and (iv) additional assistance (Rs. 30,000) for income restoration.

RP Compliance

Discussion with few landowners indicated that they were adequately consulted during RP preparation however are not satisfied with the compensation offered (especially with the market price of the land estimated by DLVC). Landowners also appealed to the court for challenging the land acquisition process however this case was dismissed by the court. Landowners have indicated that they will again approach court for seeking enhanced compensation and are currently cultivating the land illegally. None of the landowners have accepted any compensation amount.

Proposed Actions

• Taking possession of the lands and fencing of acquired lands to avoid possible encroachments

• It was noticed that approach road to the Wet Well and STP site is narrow and deep excavation and vehicle movement may spill over into adjacent private lands during construction of pipeline/STP/Wet Well. D. Package IV: Bellary

19. Raichur Project Description

Raichur town was included under Tranche-1 of NKUSIP and works proposed were: (i) Improvements to water supply system at Rampur & Krishna water works; and (ii) Improvements to Sewerage system & construction of 20 MLD FAL type STP and allied works for Eklaspur zone. A majority of the water supply works are completed while sewerage works have progressed comparatively very slow (approximately 17 percent) due to poor performance of the contractor and now the contractor is terminated. It is proposed to divert some of the surplus funds from other towns for Raichur to undertake construction of additional Sewage Treatment Plant (STP) at Hosur under Tranche-2.

LA and R&R Issues

Laying of pumping main is carried out within available width (RoW) of the road and there are no LA and R&R impacts. Construction of OHTs is undertaken in government parks/grounds and in forest land/hillock to avoid private land acquisition. Laying of sewerage network is also being carried out within available width (RoW) of the road; however there is a need to access temporary impacts on adjacent landowners during laying of trunk/sub mains. (Currently Ekalspur STP can be approached through a small narrow road and there is a strong possibility of spilling over of construction activities into private lands). It was noted at Hosur STP site that people and vehicles are cross passing through the land. Resettlement Plan (RP) was prepared for Sewage Treatment Plant (STP) site during project preparation stage for acquisition of around 18.31 acres at Hosur; however construction of this STP was excluded from NKUSIP. Even though this was not included under NKUSIP, considering the need for an additional STP, Raichur ULB acquired the proposed land (around 10 acres in September 2010). This land acquisition is not carried out in line with the RP, ADB’s Safeguard policies and NKUSIP’s Resettlement Framework. For Hosur STP, land compensation of Rs. 900,289 was paid to 2 landowners.

20. Sindhunur Project Description

Sindhunur town was included under Tranche-2 and Tranche-3 of NKUSIP and works proposed were: (i) Construction of one twin fire officer’s qtrs &12 fireman qtrs; (ii) Slum improvement works; (iii) Improvements to water supply consisting of construction of Impounding Reservoir, head works @ Turvihal village, raw water gravity main, feeder main, distribution network, 10 MLD WTP with allied Electro Mechanical works including construction of ELSRs and installation of bulk flow meters; and (iv) Providing sewerage collection system in core area (Zone-2) and construction of 12 MLD FAL type STP and allied works. A total of four slums were selected for intervention however after laying sewerage network in three slums contractor stopped the work. The remaining works are still pending. Fire services buildings are near completion. Town level water supply and sewerage improvements were proposed under Tranche-3 and both the works are not yet initiated.

LA and R&R Issues

Works such as slum improvement and fire services buildings were carried out within existing premises, available width (RoW) of the road and there were no LA and R&R impacts. Under water supply, construction of OHTs (5 nos.) will be undertaken in government lands, improvements to water treatment plant will be carried out within existing premises while gravity main will be laid along state highway within the existing available RoW. Private land was required for construction of Impounding Reservoir and it has been purchased from landowners in May 2011 (247.16 acres; 51 landowners in Thurvihal and Kalmangi villages). Under sewerage also, government lands are identified for construction of wet wells while Sewage Treatment Plant (STP) site was directly purchased from landowners in March 2011 (20.16 acres; 5 landowners). STP site is approached through a small narrow road and there is a strong possibility of spilling over of construction activities into private lands.

Koppal town was included under Tranche-2 of NKUSIP and works proposed were: (i) Slum improvement; and (ii) Providing sewerage collection system & construction of 8.0 MLD FAL type STP & allied works.

LA and R&R Issues

Sewerage network will be laid along the road within the existing RoW, however alignment for trunk/sub mains needs to verified for temporary impacts on adjoining landowners during construction activities. Resettlement Plan (RP) was prepared for STP site. The proposed private land acquisition of 12 acres belonged to two landowners (11 APs). Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/ replacement value; (ii) notice to harvest the standing crop or crop compensation; (iii) compensation for loss of trees/structures/wells etc.; (iv) subsistence allowance based on 3 months minimum wages; and (v) income restoration assistance (maximum Rs. 30,000)

RP Compliance

Both the landowners were consulted adequately during RP preparation. Landowners sought Court support in getting enhanced compensation (higher than that was estimated by the DLVC) and it was paid to them. Both the landowners have received land compensation and subsistence allowance. ULB has taken the possession of land and STP work is under progress.

22. Gangawathi Project Description

Gangawathi town was included under Tranche-2 of NKUSIP and works proposed were: (i) Slum improvement; and (ii) Construction of Storm Water Drains; and (iii) Construction of one twin fire officer’s qtrs & 12 fireman qtrs.

LA and R&R Issues

Fire services buildings were constructed within existing premises and there were no LA and R&R impacts. Due to land acquisition/resettlement issues certain drainage works in the town were excluded from NKUSIP.

23. Hospet Project Description

Hospet was included in Tranche-1 of NKUSIP and works proposed were: (i) Construction of 27 MLD ASP type STP including construction of 2 wet wells, pumping machineries & pumping main; (ii) Providing & laying 176 km sewer network including construction of manholes & secondary drains of length 1.75km; and (iii) Improvements to water supply system. Entire works under water supply are completed and soon the system will be commissioned. Comparatively, laying of sewerage system and construction STP is progressing slow. Around 20 percent of the STP works are completed while of the 176 km., around 38 km. of sewerage network is completed. From the total of 1.8 km. trunk main alignment around 1.0 km. is completed.

LA and R&R Issues

Under water supply, construction of OHTs/GLSR (3+1 nos.) is undertaken in government lands, construction of filter bed has been carried out within existing water treatment plant premises while pipelines are laid within available width (RoW) of the road. There were no LA and R&R impacts. Under sewerage also wet wells are constructed within available government lands and network is being laid within available width (RoW) of the road. Secondary drain is being constructed within the available width of natural drain.

The RP documented impacts on total 8 landowners. Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/ replacement cost; (ii) notice to harvest standing crop or crop compensation; (iii) subsistence allowance based on three months minimum wages; and (iv) additional assistance (Rs. 30,000) for income restoration. Laying of trunk main work at few locations was stopped by the adjacent landowners as construction activities damaged standing crops. A survey was carried out to estimate the losses and some of the landowners have already received compensation for the damage. (xxx nos..).

RP Compliance

Indentified land for the STP was fertile irrigated agricultural land and hence landowners were not ready to part with the land initially. Land acquisition process was slow and landowners continued cultivation though acquisition was proposed. The revised estimates by DC/DLVC identified impacts on total of 12 landowners and 60 APs for acquisition of 15.28 acres. Discussion with few landowners indicated that they were adequately consulted during RP preparation and implementation, participated in GRC and DLVC meetings etc. though they are still not satisfied with the compensation offered. All the landowners have received land, crop compensation and subsistence allowance. The only activity remained is carrying out survey for identifying income restoration needs and its implementation. Affected landowners have indicated that they are in process of filing an application to seek court intervention for enhancement in compensation amount.

24. Bellary Project Description

Bellary town was included under Tranche-2 of NKUSIP and works included were: (i) Construction of new 20 MLD WTP at Sanganakal and 15 MLD WTP at Allipur, providing rising main from junction point at Sanganakal to Allipur WTP, rising main from Allipur WTP to MBR -1 at Karimarammana Gudi; and (ii) Providing feeder mains of 22.62 kms and distribution network. Laying of raw water mains is completed while other network and Water Treatment Plant (WTP) works are ongoing.

LA and R&R Issues

Construction of OHTs/MBRs/Jack Well, expansion of WTP etc. works are undertaken in government lands while pipelines are laid within available width (RoW) of the road. There are no LA and R&R impacts. Government land was made available for construction of additional WTP Sanganakallu village.

25. Chamarajanagar Project Description

Chamarajanagar town was included in Tranche-2 of NKUSIP and works proposed were: (i) Slum improvement; (ii) Construction of District Information Center; (iii) Improvements to Water Supply System including rehabilitation of raw water rising main and WTP, construction of RCC ELSR & distribution system for 58 KM; and (iv) Providing sewerage collection system & construction of 9.0 MLD FAL type STP & allied works & construction of storm water drains. Only 20 percent of slum work (in seven slums) is completed and work is stopped due some issues related to contractor. A majority of the water supply lines are laid while sewerage works are progressed upto 30 percent. Drainage work is also completed. Request kuidfc for equitable award.

LA and R&R Issues

All water supply related works (OHT, WTP etc.) were carried out within available government land/existing premises while pipelines are laid within available width (RoW) of the road. There are no LA and R&R impacts. Sewerage network will also be carried out within the available width (RoW) of the road however alignment of the trunk main from STP to main road passes cross country through lands (only initial length will be laid along the nala while towards end it will be laid along road. In between the alignment is not clear and currently there is no approach road/access to walk through the entire alignment). Land acquisition was involved for sewage treatment plant site and Resettlement Plan (RP) was prepared for acquisition of around 16.40 acres land. The RP documented impacts on total 9 landowners and 63 APs . Impacts on all APs were addressed in line with ADB’s safeguard policies and NKUSIP Resettlement Framework (RF) and RP proposed compensation for identified losses as: (i) land compensation at market prices/

There is a substantial different between the land price offered under consent award (Rs. 240,000) and general award (Rs. 58,550) and hence these two landowners have not accepted the compensation payment. There are also ownership issues with these landowners and once they resolve, they will accept compensation payment. The rest of the landowners has received compensation and subsistence allowance will be paid after RP is approved by the ADB. NGO is also conducting survey for identifying income restoration needs of seven vulnerable households and these activities will be soon implemented.

Proposed Actions
