The Rccoc'=' of Decision signed by Michael R, Deland, Regionl'tl Mminl&trator ot EPA, on oecel'!tber 29, l9tJ3, authorized a action ot a water supply frol'l Lowell to Masuchuse-tta. The Army Corps of F.ngineerR was given the re!lport5ibility of the design and conatruction of the project through an InteriiiJency AQreoment (lAG) which was drawn up between EPA and the Corps. The lAG obli9ated a total of 52,881.220 to the Corps effective fro"' 2/l/84 thrOUIJh 2/2H/86. EPA entered into a Superfund state Contract with DEOE on August 29, UtU. As part ot thn contract. thtt DEOE to obtain all real esu.te interellltS nocftssary for construction and operation an(j maintenance of the waterline. Th& DEOP. entered into a enntraet with the Tyngst)orough Uater Dhtrict (THO) on or around February 20. 1985. In that. contract, DEOE transfered their responeihilitifts for obtaining relll estate to the nw. Special authority was given to the TYID by tbe State Legislature to acquire land through Eminent l:br.lain. EPA feels that it h ill'lperat iva that the remaining issues involving the 1'\·10 be completed to ensure the continuation of the project . The responaibilitiefl of the THO (via the State- A-id AQreeme nt - between Massachusetts anc1 the 'I\10) include col"'pletion of the reMaining easement• and acquisitions, and the signinfJ of an Inter-Municipality Agnement betweon the City of Lowell 111nd Tyngsborough for the supply of water. to he roauthorizf!d, EPA tiP.adquarters has inquired IUl to tho status of this project. Fundinq constraints may require that the 2.fl l'illion be transfered from Charles C"..eorgc to other projects which are felt to have a more ur<Jent need.

If completion of the remainin<J tasks by the TWO occurs exp~ditiousl~· . the Corps would be 11ble to complete the bid process and award a construction contract. This would mean a late aprinQ or ellrly summer of '86 a tart of construction. EPA request• an assurance from the DEOE that the remainin<J tatkl will be performed. EPA alto requeata A timetable for conpletion of these taaka.
