Sealed percentage rate tenders are invited from experience, registered & approved contractor for the work for manufacture, supply, dismantling, erection and commissioning of structural components and slewing bearing for GSECL rail mounted Elecon make reclaimer machine (M/C no. HM/315) for Lignite Handling Plant at KLTPS, GSECL, Panandhro.

Name of work : Work for manufacture, supply, dismantling, erection and commissioning of

structural components and slewing bearing for GSECL rail mounted Elecon make reclaimer machine (M/C no. HM/315) for Lignite Handling Plant at KLTPS, GSECL, Panandhro.

QUALIFYING CRITERIAL FOR TECHNICAL BID. Offers of only those well-experienced and resourceful tenderers, who meet at least the following criteria, will be considered. 1. Tenderer should have carried out the work of manufacture, supply, dismantling, erection and

commissioning of Lignite/ Coal Handling Plant or material handling plant of 350 TPH capacity or more capacity of single stream with order value of minimum one order of 05 (five) crores or more each on his own or in joint venture.

2. The tenderer should have executed similar work as above in all respect at least two orders

with in a period of five years in any govt. /semi govt./public sector/private sector and the same plant should be working satisfactorily.

3. Bidder should submit Solvency certificate of minimum 20 % of tender value issued by any

Nationalized/Scheduled Bank. 4. Tenderer shall furnish copy of orders executed (mentioning detailed scope) along with their

respective performance certificate from the end user by which he claims to have met tender qualification requirements.

5. The bidder should submit last 03 (three) years audited financial report of the company.

Minimum average Turnover of Rs. 10 Crores and the financial statement should have been audited for the previous three financial years i.e. year 2007-08, 2008-09 and 2009-10.

6. The bidder should be standing in market since more than five (05) years and should have

effective service net work with force of expert well conversant service engineers in Gujarat state, so that in emergency cases service engineer should be easily accessible to attend emergency in short period.

Tenderer shall furnish enough details/ documents in the technical bid regarding their experience, capability and resourcefulness meeting above requirements. The bidder should indicate / submit following in his technical bid A) The maximum value of the order of the work executed as per cl. ( i ) together with the details

i.e. name and full address, telephone / fax number / Email ID of the customer, value of the order, scope of work etc.

B) Delivery period and time limit for completion of the work stipulated in order. C) Actual delivery period and time taken for completion with reasons for delays if any. D) Performance certificates from customers/end users.

7. The bidder shall have to submit their PF code number allotted to them by Regional PF Commissioner. They shall also have to submit copy of Labour Licence.

8. The bidder shall have to submit along with the offer, the details of minimum required tools,

tackles, equipment & machineries in possession relevant to the job. 9. The contractor shall have to submit copy of the service Tax registration certificate issued

by appropriate authority after order placement, without which the offer is liable to be rejected.

10. If the contractor is not a sole proprietor, then the contractor shall have to furnish a copy of

the Partnership Deed along with the offer. In case of a Company, the Memorandum of association & Articles of association is required to be submitted without which the offer is likely to be ignored. The contractor shall also submit power of Attorney.

11. The contractor has to submit PAN / TIN / Sale tax Number & zerox copy of the allocation of

the same.

1. All required spares, materials, tools-tackles, special type tools-tackles as torque wrench,

wooden sleepers etc. , equipments, slings, ropes, chain, D shackles, chain pulley blocks, hook chooks, scaffolding, oxygen and acetylene gases, suitable welding rods, cut rods, fasteners, emery papers, cotton waste, diesel, oil, grease, various lubricants, paint, thinner, red oxide, rustolin, WD-40 spray etc and various required consumables, welding machine, grinders, drill machine, cutting set, required plate form and stools for jobs, preparation of plate from/stools for jobs, required jugards and preparation of jugards, hydraulic jacks/press etc. required for dismantling, erection and commissioning of components are to be arranged by the party.

2. Any type of associated Electrical work such as dismantling of cables, lighting supports, lighting JB’s, panels, LCS, cable tray, limit switches etc. whichever required is to be dismantled at the time of replacement of mechanical structure safely. All cable, electrical equipment, auxiliary are to be kept in safeguard in the custody of agencies. After the completion of the replacement of structure components, electrical drives, auxiliaries, cable, panel, P/B etc are to be reinstalled, rerouted (if needed) and damaged one during dismantling is to be provided and put back in service same as earlier for the normal running of the system as per logic by agency at their risk and cost.

3. Dismantling of gear boxes, couplings, motors, pedestals etc. and instillation of same is in party scope.

4. For erection of subjected items, if dismantling of others components or etc. are required then dismantling and installation of same are in scope of party.

5. The power supply to welding machine and temporary lighting will be issued free of cost by GSECL.

6. If any type of civil works is required, then same are in scope of party.

7. Preparation of proper approach for carried out dismantling and installation works is in scope of party. If coal cleaning is required then GSECL will carried out the cleaning only.

8. Collection and shifting of required materials/spares etc from main store or sub store to work place are to be arranged by the party. After work completion, party has to credited removed/dismantled materials/spares or etc from work place to main store or sub store. Loading / unloading of materials/spares are to be arranged by party. If hydra crane or any other material handling equipments required then same should be arranged by party at own cost.

9. Party has to arrange required capacity Hydra cane or any other material handling equipment at own cost during execution of work.

10. Party has to submit the bar chart before starting of the work and daily review/up date to meet the work completion schedule.

11. GSECL will provide workshop facilities on chargeable basis in limitation to available machine and possible operations in workshop if available, otherwise same will be arranged by party.

12. Looking to plant emergency the contractor has to work round the clock and no work is to be left half done. The contractor to keep as well conversant working team while executing the work and they have to submit daily work report to site in charge on your letter pad.

13. Time limit: For supply (Schedule B-I) – Part-I: 30 to 32 weeks for material receipt at site. Part-II: 28 to 30 months for material receipt at site.

For work (Schedule B-II) – Part-I: 16 to 18 weeks after receipt of material at site. Part-II: 8 to 9 weeks after receipt of material at site.

The work contract can be extended for further period of 01 (one) year with same rate, terms and conditions of the contract as in case of dismantling, erection and commissioning work could not be undertaken due to unforeseen circumstances.

14. The contractor have to follow all the safety rules and regulations strictly and they have to keep fire buckets, water buckets etc. with them during cutting/welding activities and the contractor shall be fully responsible for any damage/injury to GSECL’s equipments or their labour during executing the work.

15. The payment will be made on actual work done basis.

16. The contractor has to follow all labour laws strictly directive by Government time to time.

17. The actual time limit for dismantling, erection and commissioning of subjected work is 16 (sixteen) to 18 (eighteen) weeks – for PART-I of schedule B-II and 08(eight) to 09(nine) weeks – for PART-II of schedule B-II after start the work on hand. If once the start the work, then same will be completed within stipulated time period otherwise penalty of imposed as per clause of “Penalty for delay” and same will be ducted form bill.

18. Before starting the work party have to pre survey the site with GSECL Engineer for information of the structure on which the work is required to carry out, party has to provide the scaffolding /temporary jugards for safe work. All the required scaffolding materials are to be arranged by party in his quoted rates.

19. For storage of material at site arrangement for location will be arranged by Party and

contractor is fully responsible for security of materials, tools, tackles and etc. GSECL shall not be responsible for any kind of theft of materials from the site. Necessary security has to arrange by party.

20. Contractor has to take all precautionary measures by providing safety appliances to his staff. All safety measure shall be taken by the contractor to prevent fire /explosion hazard. If any accident will take place contractor will be fully responsible for the same. If any loss will occur to GSECL due to accident, fire etc., then the recovery of such loss will be done from party’s bill. Party has to arrange for insurance of his staff & material as per requirement.

21. Contractor has to carry out the work in harmony with LHP staff, Operation staff or other agencies.

22. If any dispute will take place then the decision of Chief Engineer, KLTPS, GSECL will be final.

23. Party shall have to submit indemnity bond against injury to their staff during execution of the work for which contractor for will be fully responsible.

24. Insurances for the staff are to be covered by party.

25. After completion of work, balance materials & scraps generated are to be credited in GSECL main store or LHP sub store as per instruction of EIC.

26. Contractor has to submit the challans of all materials after material Gate entry duly endorsed by Security Section and all material should be routed through main store.

27. PAYMENT TERMS:

(A) Supply: 1. 80% supply prices shall be released within 45 days on receipt of material at KLTPS site and site certification thereof.

2. Balance 20% of supply prices shall be released within 30 days on successful Commissioning of the system on full load and submission of Performance Bank Guarantee of 10% of order value.

(B) Erection, Testing and commissioning work: 1. 80% of erection, testing & commissioning charges shall be payable within 60

days against monthly bills as certified by Engineer in Charge as per progress report / pro rata.

2. Balance 20 % of erection, testing & commissioning charges shall be payable Within 30 days on successful commissioning of the System on full load and submission of Performance Bank Guarantee of 10% of order value.

28. TDS shall be made as per the prevailing rules.

29. No advance payment shall be made and no documents shall be accepted through Bank. Payment shall be made after receipt of material at site in good condition.

30. Submission of Bills: All the payments shall be made by KLTPS site office. Hence, the invoices in triplicate (One original and two copies) shall be submitted to Chief Engineer (Gen), GSECL, KLTPS giving reference of this Order number and date. The invoices shall be pre receipted. After necessary scrutiny, the bills will be processed for release of payment.

31. Inspection and dispatch instructions:

The GSECL or authorized representative shall inspect and witness the testing equipments / materials at the vendor’s manufacturing works prior to dispatch. The GSECL or his authorized representative shall have free access to the manufacturer’s plant or erection site for the purpose of inspection of instruments /equipments/materials/accessories prior to dispatch or erection. The Bidder shall offer equipments/materials ordered on him for stage as well as final inspection to the authorized representative of the GSECL without any extra cost. Bidders shall furnish complete procedure indicating components, which they propose to be inspected for stage and final inspection. QAP in this regard shall be submitted by the successful tenderer for approval of GSECL / Consultant. Bidders shall offer all the materials for inspection before dispatch. Before inviting the Purchaser’s representative for inspection / testing, vendor shall ensure that the equipments / materials to be offered for inspections are ready. In case of failure to offer the equipments/materials for inspection / testing during the purchaser’s representative’s visit against inspection call, due to reasons attributable to the vendor the cost of such visits of purchaser’s representative shall be recovered from the vendor and shall be deducted from their supply bills. Dispatch clearance will be issued by Chief Engineer (Gen), GSECL, KLTPS Panandhro.

32. (A) FACILITIES FROM GSECL: 1. The 415V 3 Phase L.T. electric power will be made available at one point. Further extension

will have to be carried out by the contractor as per requirement at their cost. The necessary charges will be recovered as per the tariff rate of GSECL from time to time.

2. GSECL will provide unfurnished bachelor quarter/ hostel to contractor, if available, after meeting the requirement of GSECL’s staff. The contractor shall have to pay the rent of the quarter/ hostel as per GSECL’s rule.

3. The medical facilities to the contractor’s personnel shall be provided on chargeable basis at the GSECL Hospital.

(B) INSTRUCTION TO BIDDERS: 1. Cranes / loading - unloading arrangements will have to be arranged by bidder at their

own cost. The facilities of crane along with operator required during the execution of work will be provided on chargeable basis by GSECL, if available.

2. It will be responsibility of successful bidder to arrange all required tools and tackles etc. at their own cost.

3. Oil/lubricants/grease including flushing oil required for initial filling will be in the scope of successful bidder. GSECL shall provide workshop facilities at site, as

available, on chargeable basis. 4. Repairs/replacement of materials/equipments arising due to damages/ pilferages during

transit / storage/erection/commissioning shall be arranged by the contractor well in time to ensure timely completion of the work.

5. All the supervisory staff, including necessary skilled, semi skilled, and unskilled labours required for the work shall be provided by contractor at his own cost.

6. The general purpose tools & tackles, all testing equipments, instruments, etc. required for testing, erection and commissioning of work will be provided by the contractor at his own cost.

7. On completion of erection, the same shall be thoroughly inspected by both parties for correctness and completeness and acceptability for pre commissioning test at site.

8. On conclusion of satisfactory pre-commissioning tests, the test operation of such plant shall start.

9. The contractor shall provide all the consumable during the erection, testing and commissioning of the plant/ equipments.

10. The contractor shall be responsible for the necessary periodic testing, inspection during erection and commissioning of the equipment and shall carry out the work to meet the specific requirements of the relevant statutory regulations as necessary. All fees, charges etc. payable to statutory authorities for carrying out such test shall be borne by the contractor.

33. It will be the responsibility of successful bidder to obtain statutory clearances, if required, to

complete this work. The cost of the same shall be borne by the successful bidder. 34. It shall be the sole responsibility of the contractor to maintain all relevant Forms registers or

record in accordance with the various statuses, laws, enactments etc. 35. All types of Welding electrodes/ cut rods required to complete the job shall be provided by

the successful tenderer at his own cost. 36. All consumables and Gas cutting set includes oxygen/acetylene shall be arranged by

contractor at his own cost. 37. All required Steel for subjected work is in the scope of party. 38. The contractor shall be responsible for the proper behavior of the persons employed by him

and exercise control over them. He shall also be bound to prohibit and prevent his employees for taking any direct or indirect interest and / or support, assist, which may be any way, be detrimental or prejudicial to the interest of the GSECL, community or of the properties or occupiers of land / properties in the neighborhood. In the event of any such action by his person or persons, contractor shall keep the GSECL harmless and indemnified

from any consequential claims, actions, suits proceedings, losses or damages or any ground whatsoever.

39. All persons of the contractor entering on work premises shall be properly and neatly dressed

and shall wear badges while working on premises of the GSECL including work site. 40. In case GSECL considers presence of any of the labour of the contractor undesirable for

whatever reasons including integrity, conduct, competency 24 hours notice in writing will be given by the GSECL to the contractor. On receipt of said notice, such a labour will not be reemployed without the express and written authorization of officer in charge of the GSECL.

41. Any failure on the part of the GSECL at any time to enforce the strict observance of the

performance of any of the terms and condition of this contract or non-expressed of any right mentioned in the contract shall not constitute a weavers of such terms, conditions of rights and shall not effect or deprive the GSECL to exercise the same at any later stage.

42. GSECL shall not be liable for or in respect of any damages or compensation for any injury or

for any occupational disease peculiar to the employment to any person engaged through the contractor and the contractor shall keep the GSECL Indemnified thereof.

43. The contractor shall ensure that all labour are provided with the protective clothing like the

helmets, gloves, safety shoes etc. as may be required from safety points of view and all his persons shall follow the instructions issued by the GSECL from time to time in connection with safety and security.

44. Contractor shall inclusively be liable for non-compliance of the provision of any acts, laws,

rules and regulations have bearing over engagement of workers directly or indirectly execution of work and the contractor hereby undertake to indemnity the GSECL against all actions suits proceeding claims, losses, damages etc., Workman Compensation Act., Persons Injury (compensations insurance) Act., EST Act., Fatal Accidents Act., Industrial Dispute Act., Shops & Establishment Act., Employees Provident Fund Act., Family Pension and Deposit Linked Insurance Scheme any other or status not herein specifically mentioned but having direct or indirect application for the person engaged under this contract.

45. INSURANCE:

It will be the responsibility of contractor to insure GSECL’s materials, to have transit insurance, Insurance during storage & erection at site, Insurance for their own men and materials and also have to take Insurance Policy for damage to GSECL’s existing property and third party Damage during the execution of work at his own cost. Contractor will be fully responsible for all losses / damages during the execution of the work under this contract and the GSECL will be fully indemnified against such losses / damages. Contractor will have to ascertain receipt of goods at destination in good conditions and shall follow up vigorously with the carriers and ensure that the consignment reaches destination. In case of loss / damages to any consignments is noticed, it will be Contractor’s responsibility to lodge the claim with insurance company and to settle insurance claim with the Vendor’s underwriter. Irrespective of whether the insurance claim is settled or not, the Contractor will promptly replace lost / damaged items free of charges F.O.R. destination.

46. The contractor shall indemnify GSECL against all suits, actions, Proceedings, etc. arising out of any claim or demand for breach of any rules, regulations, default, etc. on part of the contractor, his agents or servants in the course of performance of this contract.

47. The contractor shall be liable for making good all damages, losses arising out of theft,

breakage, pilferage of any office furniture equipment’s, fittings and fixture whatsoever as may be caused direct or indirectly by the person engaged through him and work carried out by them.

48. GUARANTEE AND WARANTY:

The work/supply under this tender shall be guaranteed for one year from the date of commissioning. The Performance Bank Guarantee shall be released only on successful completion of such guarantee period. The material supplied shall be new and of high quality and free from defects in design, material and workmanship, complete in all respects confirming to latest revision of relevant Indian Standards or equivalent International standards.

49. SECURITY DEPOSIT:

The successful bidder has to pay security deposit of an amount of 5% of order amount.

50. PERFORMANCE BANK GUARANTEE : The successful bidder has to give performance bank guarantee of supplied equipment for

performance of an amount of 10 % of order amount. Party has to give PBG for a period of 12 months form the date of commissioning. Zero date of PBG will be considered from the date of completion of successful trial run and same will be released after twelve months from zero date.

51. No Interest shall be payable by GSECL on EMD / SD / PBG amount. 52. PENALTY FOR DELAYS:

Any delay that may take place in supply and/or erection, testing and commissioning activities beyond contractual cut off date / stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of ½ % of the contract price/ order price per week or part thereof subject to a maximum of 10% of the total contract value/order value (i.e. End cost including taxes & duties).

53. PENALTY for Under Capacity:

If, during the Performance Guarantee Test, the performance of the plant will not conclude to be 100%, a chance for rectification shall be given and retest shall be carried out. However, if during retest, plant will not perform at the rated capacity, the penalty shall be levied as under: For each 1% decrease in capacity of the plant, penalty at the rate of 0.5% of total order value including taxes and duties shall be levied. However, if capacity will found below 85%, successful bidder will be penalized for the max. amount of 10% of total order value including taxes and duties.

54. TERMINATION OF CONTRACT: If, in the opinion of GSECL, the performance of the successful tenderer as a whole OR part, is found unsatisfactory, GSECL reserves the right to terminate the contract at any time by giving a written notice of 30 days. In such case, GSECL shall take either or all of the following actions at its sole discretion:

i) Terminate the contract. ii) Forfeit the SD. iii) Shall get the supply and or work done through other agency at the risk and cost of Successful tenderer. In the event of termination of the contract, you shall deliver to the Purchaser all data, design, Plans, specifications and other documents for the project up to date of termination of the contract.

55. ARBITRATION:

All questions, disputes, differences, whatsoever, which may at any time arise between the parties to this contract in connection with the contract or any matter arising out of or in relation thereto, shall be referred to the Gujarat Public Works Contract Disputes Arbitration Tribunal as per the provisions of the Gujarat Public Works Contracts Disputes Arbitration Tribunal Act, 1992.

56. CONTRACT AGREEMENT:

Successful bidder has to enter into a contract agreement on a stamp paper of Rs.100/- as per standard Performa of GSECL attached. The cost of the stamp paper and agreement shall be borne by the successful tenderer. The agreement shall be signed by authorized person of company with the common seal of company of successful tenderer.

57. JURISDICTION:

All questions, disputes or differences arising out of or in connection with the tender/contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender/ acceptance of tender is issued is situated i.e. Vadodara.

58. PROGRESS REPORT:

Successful Bidder shall submit fortnightly progress report for the work carried out with respect to BAR / PERT CHART with justification for delay in progress, if any and with corrective action to achieve the progress as per BAR / PERT CHART.

59. FORCE MAJEURE CLAUSE:

“If, at any time during the continuance of this contact, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, act of the public enemy, civil commotion, sabotage fires, floods, explosion, epidemics, quarantine restrictions, strikes lockouts or acts of God (hereinafter referred to as event)”, then provided notice of the happening of any such event is given by either party to the other within twenty one days from the date of occurrence there of neither party shall by reason of such event be entitled to terminate this contact nor shall either party shall have any claim for damages against the other in respect of such non-performance of delay in performance, and services under the contract shall be resumed as soon as practicable after such event has come to end or ceased to exist, and the decision of the Chief Engineer(Gen),GSECL, KLTPS, Panandhro as to whether the services have been so resumed or not shall be final and conclusive. Provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reasons of any such event for a period exceeding 60 days, either party may at its option terminate the contract provided also that if the contract is terminated under this clause, the GSECL shall be at liberty to take over from the contractor

Special Terms and conditions related to supply and work:

1. The supplied items should be Elecon / Premium Energy Transmission Ltd. / Tyssen Krupp industries / TRF Limited / Larsen and Toubro Ltd. / FLSmidth Pvt. Ltd. Make only.

2. Supplied items should be retrofitted to existing one without any modifications.

3. The bidder shall have to furnish “details/list of bill of material, the detail drawing

indicating material of construction and dimensions for the items offered “along with physical copy of bid.

4. Party shall have to give the guarantee/warranty of supplied equipments if found defective

due to poor design/material or poor workmanship, the same should be repaired or replaced free of cost if reported within 12 months from date of commissioning.

5. The party has to give successful trial run of erected and commissioned supplied items

with following specifications.

(1) Reclaimer feed capacity – 350 MTPH - Rated - 400 MTPH – Peak -

(2) Reclaimer travel speed - 15 m/min (idle) - 7.5 m/min (operational) -

(3) Reclaimer slewing speed – 8 to 32 m/min (approx) at centre of bucket wheel (4) Slewing angle - +/- 105 deg. With respect to centerline of rail gauge. (5) Bucket wheel boom luffing speed – 5 m/min. approx. at centre of bucket wheel

This performance should be continue till the completion of guarantee period.

6. Party has to submit material of construction, detail drawing and list of bought out items along with supply. GSECL has no any drawing of existing structural components and slewing bearing of ELECON make reclaimer machine, so party has to develop the drawing / pre bidding exercise may be done to avoid any discrepancy.

7. Party has to deliver all materials FOR KLTPS, Panandhro only.

8. Penalty for late delivery: in case the materials are no delivered within the period

stipulated in the order, you will be liable to pay at the discretion of the competent authority, a penalty to the GSECL up to ½ % per week on the order value subject to

maximum 10 % reckoned on total end cost value including takes & duties or section of the plant equipment, which could be brought in to commission due to any part thereof not having been delivered in time. Due consideration will be given in the levy of penalty for reason absolutely beyond your control for which documentary evidence shall have to be procured to the satisfaction of the competent authority of the GSECL.

9. Party will visit the site reclaimer and access/develop the data requirement in case of

unavailable of the require drawing & data. 10. The supplied material will be the under the custody of contractor/supplier who will

manage for its safe custody till the completion of the work. After the completion of the work the balance materials will be the property of GSECL and it is to be handed over to GSECL.

11. It become responsibility of the agency to ensure the sufficient stack of the material,

agency will confirm in writing to GSECL that sufficient stack of material is received/under their custody before starting of the work. As the work start, it is the sole responsibility of the agency to manage the flow/safe custody of received material to complete the work in stipulated time as per Work order terms.

OTHER TERMS & CONDITIONS RELATED TO CONTRACT :- Work for manufacture, supply, dismantling, erection and commissioning of structural components and slewing bearing for GSECL rail mounted Elecon make reclaimer machine (M/C no. HM/315) for Lignite Handling Plant at KLTPS, GSECL, Panandhro. (1) The monthly payment to the labourers must be paid in the presence of Labour Welfare

Officer, KLTPS. A copy of the same must be submitted along with monthly RA Bill, duly certified by the Labour Welfare Officer. The certificate should contain details of average no. of labours deployed, total wages/salaries paid and overtime amount separately.

(2) Submission of the bill by the contractor: Bills shall be submitted by the contractor for all works, executed and the Engineer-in-charge shall take or cause to be taken the requisite measurement for the purpose or having the same verified and the claim so far as it is admissible, shall be adjusted, if possible, within ten days from the presentation of the bills. If the contractor does not submit the bill, within the time fixed, as aforesaid, the Engineer-in-charge may depute a subordinate to measure up the said work in the presence of the contractor or his duly authorized agent, whose countersignature in the measurement list shall be sufficient warrant and the Engineer-in-charge may prepare a bill from such list which shall be binding on the contractor in all respect.

Along with the R.A Bill, the contractor should submit Material Account wherever applicable, proof of payment of provident fund and other statutory dues, certificate issued by IRO/Labour Welfare officer certifying average number of labours deployed during the month and total amount of wages and salaries paid to labours.

The R.A Bills along with the supporting document will be paid within 60 days from the submission of R.A Bill

(3) Income Tax: Income tax will be deducted at source from each bill as per statutory requirements.

(4) The TDS @ 2% as per Sections 57A and 57B of GST Act shall be deducted from the contractor’s bills.

(5) The GSECL will be entitled to deduct directly from the bills to be paid to the contractor any sum or sums payable by the contractor and which sum/sums the Board is required to pay as a principal employer on account of contractor’s default in respect of all liabilities referred to in above clauses.

(6) Service Tax Registration certificate:-The contractor shall have to submit copy of the service Tax registration certificate issued by appropriate authority after order placement, without which the offer is liable to be rejected.

(7) Wages to be paid, time of payment, etc., by the contractor: The payment shall be disbursed in presence of the GSECL representative during the

working hours in the factory premises and the contractor shall get the entries certified in

the register of wages by the representative of the GSECL. Any default will result in cancellation of contract forthwith or else the contractor shall be punishable to the extent of Rs.100/- per day by way of fine. The contractor shall give his telephone number, address to the GSECL, so that in case of labour unrest etc., the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present throughout the working hours. It is absolutely necessary that the contractor either himself and/or a fully authorized representative having full power or authority concerning the contract shall have to remain present at KLTPS. He must also contact Engineer in charge daily at 08.00 hours, so that necessary instruction can be passed on to him. Also, he must be available during working hours (general shift) and during failure of any equipment at any time, so that he can be immediately contacted for any emergency work. The contractor and/or his authorized representative shall not leave KLTPS without specific permission from the Engineer in charge. If the period of absence from KLTPS is more than three days, an alternative arrangement shall be made and to be informed to the sectional head in writing.

(8) Labour Laws: The labour laws applicable and amended from time to time have to be followed scrupulously. A few of them for information are as under:

(i) Person below the age of eighteen years shall not be employed for the works (ii) No female worker shall be employed in the night shift between 19:00 hrs to 06:00 hrs. (iii) Contractor shall maintain a valid labour license under the Contract Labour (Regulation &

Abolition) Act for employing necessary manpower to be required by him. In the absence of such license, the contract shall be liable to be terminated without assigning any reasons thereof.

(iv) The contractor shall, at his own expense, comply with all labour laws and keep the GSECL indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws, which the contractor shall comply with, are as under:

(a) Payment of contribution of employees (contract labour) as well as employer’s (contractor’s) contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administration charges, inspection charges, etc., at the rates applicable from time to time by the Government of Gujarat/Government of India or other statutory authorities.

(b) Payment of deposit in respect of each contract labour at the rate as revised by the Government from time to time with the Office of the Commissioner of Labour as per the Contract Labour (R&A) Act.

(c) License fee as prescribed under the Contract Labour (R&A) Act and rules framed therein, depending upon the number of workers employed by the contractor.

(d) Paid leave facility and wages as per the provision of the Factories Act at the rate of one day for every 20 days of working.

(e) Identity cards as prescribed under the Factories Act or by the Thermal power station with photograph affixed thereon, for identification.

(f) Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act, 1947 Any payment to the contractor’s employees arising out of any claim or disputes under the Industrial Disputes Act, 1947 or any other labour laws.

(g) Payment of compensation in case of accidental injury, under Workmen’s Compensation Act. (h) Provision of crèche if the female labour employed is more than 30. (i) Maternity leave as per the provision of the Maternity Benefits Act. The above are some of the major liabilities of the contractor in addition to other liabilities prescribed under the various labour laws in force from time to time by the statutory authorities, like State Government/Government of India, which the contractor shall have to comply with. (9) Provident Fund and Family Pension Scheme:

The contractor shall submit along with his bill (month- wise) a statement regarding deductions against Employees Provident Fund (EPF) and Family Pension Scheme (FPS) in respect of each concerned employee at the rate of 10%, or at the rates made applicable by the government from to time, of wages. The contractor’s contribution and the worker’s contribution towards PF and FPS shall be deposited by the contractor with the Regional Provident Fund Commissioner, Ahmedabad, or to the authority prescribed under the Act along with the other charges.

(10) Minimum Wages Act: The contractor shall pay prevailing minimum wages as applicable from time to time to the labourers engaged by him as per the Minimum Wages Act, in presence of the Board’s officer or representative.

(11) Safety: The contractor shall strictly observe all safety rules and provide safety equipment to the contract labourers as per the Factories Act, 1948, and whatever amendments made from time to time to avoid any chance of accident. The contractor shall strictly observe all instructions of Safety Officer and Factory Inspector to avoid any chance of accident.

(12) Workmen’s Compensation Fund and Employer’s Liability Insurance: Insurance shall be affected for all the contract employees engaged in the performance of this contract. If any of the work is sublet after due permission in writing from the GSECL, the contractor shall require the sub-contractor to provide workmen’s compensation and employer’s liability insurance for the later employees, unless such employees are covered under the contractor’s insurance. It shall be the liability of contractor for employees of his sub-contractor.

(13) Compliance to Security Matters: The power station being a restricted/prohibited area, all the formalities as required by the Security and Vigilance staff of GSECL should be complied with, to whom the contractor should contact.

(14) Execution of Agreement: The successful bidder (contractor) will have to enter into an agreement with the GSECL and the cost of the stamp paper will be borne by the contractor.

The contractor will also have to execute indemnity bond on required value of stamp paper as per GSECL’s rules. The cost of stamp paper for indemnity bond will be borne by the contractor.

(15) Contractor to Indemnify the Board: The contractor shall indemnify and keep indemnified the GSECL and every member, officer and employees of the GSECL, including Engineer-in-Charge and his staff, against all actions, proceedings, claims, demands, costs and expenses whatsoever arising out of or in connection with the matters referred in above clauses and elsewhere and against all actions, claims, demands, costs and expenses which may be made against the GSECL, by any workman/employee of the contractor or sub-contractor or any other person under any laws, rules or regulations having the force of law, including, but not limited to, claims against the owner under Workmen’s Compensation Act, 1970. The GSECL shall not be liable for or in respect of or in consequence of any accident or injury to any workman or other person in the employment of the contractor. The contractor shall indemnify and keep indemnified the GSECL against all such damages and compensation and against all claims, demands, proceeding costs, charges and expenses whatsoever in respect thereof or in relation thereto.

The contractor shall also indemnify GSECL in all respect against any liability due to breach of legal provisions contained in any of the Labour Laws.

The Contractor shall also indemnify GSECL for injury or damage to third party other than employees of the GSECL, contractor or sub-contractor.

(16) As a contractor, the contractor shall be responsible and liable to pay difference in wages, if any, and/or observe the revised service conditions that may be awarded by the Honourable Industrial Tribunal effective from the date directed in the award.

(17) The contractor must be maintaining regular labour record and should be paying all acquired benefits to labour force and contractor should obtain certificates to this effect from Labour Commissioner.

(18) Any other rules and regulations, conditions etc. that are in force at present and that may be framed by the GSECL from time to time in connection with the contract will be binding and acceptable to the contractor.

(19) Dispute, if any, taking place between the contractor and labourers must be intimated to Labour Welfare Officer, KLTPS, immediately.

(20) The contractor must insure all the labourers before starting the works. (21) Any casualty will also have to be borne by the contractor for the period the contract

continues. (22) The contractor shall not engage any sub-contractor without written prior permission of the

Chief Engineer or the authorized officer of the GSECL. In no case the GSECL will be liable in any manner regarding any liability in respect of any contract labourer engaged by the sub-contractor and the liability of such contract labourer will solely rest with the principal contractor.

(23) Staff Discipline: It is the responsibility of the contractor to ensure that his employees

maintain strict discipline as regards security, methods of safe working etc., and not to cause any hindrance to smooth running of power station or in execution of duties by GSECL staff. Any lapse in this regard will be viewed seriously and contract is liable to be terminated. If any of his staff is found unsuitable or not behaving properly, the contractor shall have to remove him from the work-site on demand by GSECL. The contractor shall have to strictly observe the rules and conditions specified in the enclosed works contract booklet of the GSECL, which are not modified hereunder. To keep harmonious Industrial Relations amongst contract labourers is the sole responsibility of the contractor. Any breach of the same will be viewed seriously.

(24) Labour Escalation: The contractor shall pay minimum wages to his labourers as per the Minimum Wages Act, 1948 and rules therein, as applicable from time to time, in pursuance to the state government notification. The concerned contractor, after making such payment to his labourers, shall submit the details of the payment with the certification of Labour Welfare Officer/Industrial Relations Officer. However, no labour escalation will be payable by GSECL to the contractor as this is a firm price contract through out the period of contract.

(25) Under the contract, the contractor should either himself be present at the site or should nominate persons in writing, who must be available at site and who should be authorized to take decisions about the works and receive the instructions from Engineer-in-Charge of the work at any time. In absence of any responsible man of contractor at the time of any emergency, ad hoc decision of Engineer-in-Charge will be binding on the contractor.

(26) For any conflict and ambiguity, the decision of the Chief Engineer (G), GSECL, KLTPS, Panandhro shall be final and binding on the contractor.

(27) Chief Engineer (G), GSECL, KLTPS, Panandhro reserves the right to reject any or all tenders without assigning any reasons thereof.

(28) Before starting the work, the contractor should contact Industrial Relation Officer/Labour Welfare Officer for all formalities and obtaining the gate passes of his labourers and for other formalities.

For work (Schedule B-II) – Part-I: 16 to 18 weeks after receipt of material at site. Part-II: 8 to 9 weeks after receipt of material at site.

The work contract can be extended for further period of 01 (one) after completion of WO period year with same rate, terms and conditions of the contract as in case of dismantling, erection and commissioning work could not be undertaken due to unforeseen circumstances.

3. The actual time limit for dismantling, erection and commissioning of subjected work is 16

(sixteen) to 18 (eighteen) weeks – for PART-I of schedule B-II and 08(eight) to 09(nine) weeks – for PART-II of schedule B-II after start the work on hand. If once the start the work, then same will be completed within stipulated time period otherwise penalty of imposed as per clause of “Penalty for delay” and same will be deducted form bill.

4. Service taxes will be extra @ at actual and same will be reimbursed against documentary

proof.

5. The supplied items should be Elecon / Premium Energy Transmission Ltd. / Tyssen Krupp industries / TRF Limited / Larsen and Toubro Ltd. / FLSmidth Pvt. Ltd. / Hoesch Rothe Erde Schmiedag AG Make only.

6. Supplied items should be retrofitted to existing one without any modifications.

7. The bidder shall have to furnish “details/list of bill of material, the detail drawing indicating

material of construction and dimensions for the items offered “along with physical copy of bid.

8. Party shall have to give the guarantee/warranty of supplied equipments if found defective

due to bed design/material or poor workmanship, the same should be repaired or replaced free of cost if reported within 12 months from date of commissioning.

9. The party has to give successful trial run after erection and commissioning of supplied items

with following specifications for 24 hrs rated capacity.

(3) Reclaimer feed capacity – 350 MTPH - Rated 400 MTPH – Peak

(4) Reclaimer travel speed - 15 m/min (idle) 7.5 m/min (operational)

(3) Reclaimer slewing speed – 8 to 32 m/min (approx) at centre of bucket wheel (4) Slewing angle - +/- 105 deg. With respect to centerline of rail gauge. (5) Bucket wheel boom luffing speed – 5 m/min. approx. at centre of bucket wheel

This performance should be continue till the completion of guarantee period.

10. Party has to submit material of construction, detail drawing and list of bought out items along with supply. GSECL has no any drawing of existing structural components and slewing bearing of ELECON make reclaimer machine, so party has to develop the drawing/pre bidding exercise may be done to avoid any discrepancy.

11. Party will visit the site reclaimer and access/develop the data requirement in case of unavailable of the require drawing & data.

12. The supplied material will be the under the custody of contractor/supplier who will manage for its safe custody till the completion of the work. After the completion of the work the balance materials will be the property of GSECL and it is to be handed over to GSECL.

13. It become responsibility of the agency to ensure the sufficient stack of the material, agency will confirm in writing to GSECL that sufficient stack of material is received/under their custody before starting of the work. As the work start, it is the sole responsibility of the agency to manage the flow/safe custody of received material to complete the work in stipulated time as per Work order terms.

14. Party has to deliver all materials FOR KLTPS, Panandhro only. 15. Party has to quote rate inclusive of freight charges for FOR. 16. All applicable taxes/duties are extra @ at actual. 17. Party has to quote rate inclusive of packing and forwarding charges of supply. 18. Party has to quote rate inclusive of transit insurance of supply and same should be arranged

by party. 19. PAYMENT TERMS: (A) Supply: 1. 80% supply prices shall be released within 45 days on receipt of material at KLTPS site and

site certification thereof. 2. Balance 20% of supply prices shall be released within 30 days on successful Commissioning

of the system on full load and submission of Performance Bank Guarantee of 10% of order value.

(B) Erection, Testing and commissioning work: 1. 80% of erection, testing & commissioning charges shall be payable within 60 days against

monthly bills as certified by Engineer in Charge as per progress report / pro rata. 2. Balance 20 % of erection, testing & commissioning charges shall be payable Within 30 days

on successful commissioning of the System on full load and submission of Performance Bank Guarantee of 10% of order value.

20. All the bidders are requested to see and verify the documents of

(a) General safety rules / norms” to be observed by the contractors (b) Industrial law and other related matters (Labour Laws). (c) General terms and conditions (001-1), General Instruction to the bidder (01-1e) under heading of “Rules for Works” (d) Conditions of taxes & payment as mentioned above will be considered in General terms and conditions (001-1) clause No: 08 and 15.
