CRIMINAL PROVISION

1. Anyone driving motor vehicle on the road who has not a driving license as

referred on article 77 paragraph (1) shall be punished with imprisonment

at the maximum period of 4 (four) months or penalty at the maximum

amount of Rp. 1.000.000,- (one million rupiahs) (article 281 Law 22/2009)

2. Anyone driving a motorized vehicle on the road who fails to show a valid

driving license as referred to article 106 paragraph (5) letter (b) shall be

punished with imprisonment at the maximum period of 1 (one) month

and/or penalty at the maximum amount of Rp. 250.000,- (two hundred and

fifty thousand rupiahs) (article 288 paragraph (2) Law 22/2009)

3. In addition to imprisonment punishment, detainment, or penalty, a traffic

crime wrongdoer can be imposed with an extra punishment of driving

license revocation or compensation due to a traffic criminal act (article 314

Law 22/2009)

Driving License B II applies to drive the heavy equipment vehicle, pulling vehicle or motorized. Vehicle pulling the private semi trailer or trailer with allowable weight for semi trailer or trailer of more than 1.000 (one thousand) kilograms.

D. DRIVER EDUCATION AND TRAINING 1. The education and training on the driving shall be organized by the institution obtaining the

permit and accreditation from the government; 2. The permit to organize the driving education and training provided by the government as

referred to number (1) shall be organized by the Regional Government; 3. The permit for organizing the driving education and training provided by the Regional

Government as referred to number (2) shall be provided based on the norms, standard, procedure and criteria stipulated by the Minister being responsible for the facilities and infrastructure of the Road Traffic and Transportation as well as Commandeer in Chief of the Police of the State of the Republic of Indonesia;

4. The accreditation as referred to number (1) shall be made by the Government in accordance with the provision pf the legislation.

E. THE DRIVING LICENSE FOR THE PRIVATE MOTORIZED VEHICLE

1. To obtain the Driving License, each person shall fulfill the age, administrative, health

requirements and passing the examination;

2. The age requirements shall be determined at the lowest as follows: a. Age of 17 (seventeen) years old for Driving License A, C and D; b. Age of 20 (twenty) years old for Driving License BI; c. Age of 21 (twenty one) years old for Driving License BII.

3. Administrative requirements shall cover:

a. Personal idendity in term of Residential identity Card; b. Filling in the application form, and c. Fingerprint formula

4. The health requirements shall cover:

a. Physically healthy by virtue of the certificate from the physician; and b. Mentally healthy by virtue of the certificate on being passing the psychology test.

5. The requirements to pass the examination shall cover:

a. Theory examination; b. Practice examination; and/or c. Skill examination through the simulator

6. Beside the requirements as mention on number (2), (3), (4) and (5) each Motorized Vehicle

Driver intending to propose the application for: a. Driving License BI shall have the Driving License A for at least 12 (twelve) months; and b. Driving License BII shall have the Driving License BI for at least 12 (twelve) months.

F. DRIVING LICENSE FOR THE PUBLIC MOTORIZED VEHICLE

1. Each person proposing the application to obtain the Driving License for Public Motorized

Vehicle shall fulfil the age and special requirements;

2. The age requirements to obtain the Public motorized Vehicle Driving License shall be

determined at the lowest as follows:

a. Age 20 (twenty) years for Public Driving License A;

b. Age 22 (twenty two) years for Public Driving License BI;

c. Age 25 (twenty five) years for Public Driving License BII.

3. Special requirement shall be as follows:

a. Passing the theory examination comprising the knowledge on:

1) Public transportation service;

2) Public facilities and social facilities;

3) Motorized vehicle testing;

4) Procedure for transporting person and/or goods;

5) Important place in the domicille territory;

6) Type of hazardous material;

7) Security equipment operation.

b. Passing the practice examination comprising the knowledge on:

1) Embarking and disembarking the passenger and/or goods in the Terminal and other

certain place;

2) Procedure for transporting person and/or goods;

3) Filling in the cargo certificate;

4) Ethics of the Public motorized Vehicle driver; and

5) Security equipment operation

4. By taking into account the age requirements, each Motorized Vehicle Driver intending to

propose the application of:

5. Beside being obliged to fullfil the age and special requirements as referred to number (2)

and (3), each person proposing the application to obtain the General Motorized Vehicle

Driving License shall fulfill the provision to in (E) number (3) and (4).

G. The Driving License for Motorized Vehicle can be used as the Motorized Vehicle Driving License which total weight is the same as or lower namely as follows: 1. General Driving License A can apply to drive the motorized vehicle that should use Driving

License A; 2. Driving License BI can apply to drive the motorized vehicle that should use the Driving

License A; 3. General Driving License BI can apply to drive the motorized vehicle that should use the

Driving License A, general Driving License A and Driving License BI; 4. Driving License BII can apply the drive the motorized vehicle that should use the Driving

License A and Driving License BI; or 5. General Driving License BII can apply to drive the motorized vehicle that shoukd use Driving

License A, general Driving License A, Driving License BI, General Driving License BI and Driving License BII.

H. 1. Driving License shall be in terms of electronic card or other form;

2. Driving License shall apply for 5 (five) years and extendible; 3. Driving License as referred to number (1) shall be valid throughout the Unitary State of

Republic of Indonesia;

4. In the event of bilateral or multilateral agreement between the Unitary State of Republic of Indonesia and other state, the Driving License issued in Indonesia can also be valid in other state and the Driving License issued by other state shall be valid in Indonesia;

5. The holder of Driving License as referred to number (4) can obtain the International Driving License issued by the Police of State of Republic of Indonesia.

I. FUNCTION OF DRIVING LICENSE 1. Driving License shall function as the evidence of being competence to drive; 2. Driving License shall function as the registration of the Motorized Vehicle Driver containing

the complete identity particular of the driver; 3. Data in the Driver registration can be used to support the activities of investigation,

examination and identification of the police forensic.

J. ISSUANCE AND MARKING OF DRIVING LICENSE 1. Issuance of Driving License

a. Driving License shall be privided for each prospective Driver passing the driving

examination; b. Driving License as referred to number (1) shall be issued by the Police of the State of the

Republic of Indonesia; c. The Police of the State of the Republic of Indonesia shall organize the information

system of Driving License issuence; d. Each office of the Police of the State of the Republic of Indonesia in the issuance of the

Driving License as referred to number (2) shall obey to the procedure for issuance of the Driving License.

Further provision on procedure, requirements, testing and issuance of the Driving License shall be arranged by the regulation of the Chief Commander of Police of State of Republic of Indonesia.

2. Granting of Violation Mark in Driving License a. Police od State of Republic of Indonesia shall be authorized to give the mark or data of

violation to the Driving License of the Driver committing the Traffic criminal act violation;

b. Police of State of Republic of Indonesia shall be authorized to detain temporary or revoke the Driving License temporarily before the judgement of the court;

c. Further provision on the granting of the mark or data on the violation as referred to number (a) and (b) shall be arranged by virtue of the regulation of the Commandeer in Chief of State of Republic of Indonesia.

3. Drivers Work Times a. Each Public Transportation Company shall obey to and apply the provision on the work

times, rest hour and replacement of the Public motorized Vehicle Drivers in accordance with the legislation;

b. The work time for the Public motorized Vehicle Drivers as referred to point (a) shall be at the longest 8 (eight) hours a day;

c. After driving the vehicle for 4 (four) consecutive hours the Public Motorized Vehicle Driver shall be obliged to take a rest for at the shortest a half hour;

d. In certain matter, the Driver may be employed at the longest 12 (twelve) hours a day including the rest hour for 1 (one) hour.

4. Administrative Sanction a. Each officer of the Police of the State of the Republic of Indonesia in issuance of Driving

License sector who violates the provisions as referred to point (J) number (1) point (d) shall be subject to the administrative sanction in terms of discipline sanction and/or police profession ethics;

b. Further provision on the arrangement and procedure for the administrative sanction imposition as referred to number (a) shall be arranged by virtue of the regulation of the Commander in Chief of Police of State of Republic of Indonesia.
