AMENDMENT I OF THE BILL OF RIGHTS OF THE U.S. CONSTITUTION“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

WHAT SPEECH IS NOT PROTECTED BY THE FIRST AMENDMENT TO THE U.S. CONSTITUTION?

• Incitement to violence (provocation to engage in immediate violence)

• Fighting words (words or threats that provoke immediate violence/breach of the peace)

• True threats (serious expression of intent to harm or assault)

• Material disruptions or disorder• Unlawful harassment• Obscene materials• Defamation• Commercial speech that is false

or misleading• Speech by public employees pursuant

to official duties or related to matters not of a public concern

WHAT ABOUT HATE SPEECH?• The First Amendment protects offensive and

hateful speech unless it falls into one of the above-listed categories.

• There is no category of unprotected speech called “hate speech.”

• Hate speech is different than a hate crime. In Michigan, hate crimes are called “ethnic intimidation” and are felony crimes.

TIME, PLACE AND MANNER RESTRICTIONSContent-neutral time, place and manner restrictions may be placed on expressive activities that occur in public forums. Examples of such restrictions include regulations that prevent disruptive activity, prevent obstruction of vehicle or pedestrian traffic, or prevent excessive noise or noise that interferes with classroom, business, or university activities. The restrictions must serve a significant government interest, be without reference to the content of the speech, and leave ample opportunity for speech in alternate areas or forums.
