Contractors License Board Minutes of the July 22, 2016 Meeting Page 3 Chapter 91, HRS, Adjudicatory Matters: Chairperson Polischeck called for a recess from the Board’s meeting at

8:32 a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors’ Licenses of Construction One, Inc. dba Construction One of Ohio, formerly doing business as Construction One of Ohio, doing business as Construction One, Inc.; Robert C. Moberger; CLB 2015-201-L & CLB 2015-202-L

Respondent Construction One, Inc. dba Construction One of Ohio, formerly doing business as Construction One of Ohio, doing business as Construction One, Inc. (“Respondent Construction One”), and Robert C. Moberger (“Respondent Moberger”) are licensed as General building contractors. The licenses were issued on or about May 12, 2003; and are due to expire or forfeit on or about September 30, 2016. At all relevant times herein, Respondent Moberger was the only RME of Respondent Construction One. RICO received several complaints from Pacific Resource Partnership alleging that Respondent Moberger was not in residence in the State of Hawaii while Respondent Construction One was performing work at several project sites in the State of Hawaii. RICO alleges that Respondent Construction One is using a trade name that is not registered with the Board. If proven at an administrative hearing, the allegations would constitute violations of the following rules:

HAR section 16-77-8(a) (trade name must be registered with Business Registration and filed with the Board);

HAR section 16-77-71(a)(4) (RME shall be in residence in Hawaii during the period a project is under construction); and

HAR section 16-77-71(a)(5) (RME shall be held responsible for any violation of HAR).

Respondents do not admit to violating any law or rule and agree to pay an administrative fine in the amount of $25,000.00.

After discussion, it was moved by Mr. Isemoto, seconded by Mr. Mochida, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

pursuant to HRS chapter 91, Chairperson Polischeck announced that the Board was reconvening to its open meeting at 8:35 a.m.

Committee Reports: Chairperson Polischeck appointed the following members to be the

Chairpersons of the Board’s committees:

1. Scope of Activity Committee

Hawaii Department of Transportation – Requests a determination whether the following work for the A/V system which will be installed in the Joint Traffic Management Center (“JTMC”) requires a C-13 Electrical or C-15 Electronic systems contractor’s license:

Fiber – This work includes installation of fiber between the equipment racks and the panels, monitors and speaker systems. All work will be completed in existing conduits, cable trays and junction boxes. The vendor will be responsible for fiber procurement and installation into this existing infrastructure. Approximate value of the fiber installation work is $30K (~1.3% of total contract value).

Large Display Wall Frame – This work includes installation of a pre-fabricated metal frame that will be used to mount the video monitor system. Approximate value of the frame installation work is $50K (~1.9% of total contract value).

All rough-in A/V system infrastructure will be existing, installed as part of the City and County JTMC facility construction project. This pre-existing infrastructure includes conduits, junction boxes, cable trays, equipment racks, power, and ventilation. Work under Hawaii Department of Transportation’s (“HDOT”) A/V System project will include installation of the audio, video and control systems, as described previously, into this pre-existing rough-in infrastructure.

Ms. Tammy L. Lee, Esq., HDOT Contracts Officer Supervisor, Mr. Reed Matsuo

of HDOT Highways Division, and Mr. Keith Niiya from ICX were present to discuss the above inquiry.

Mr. Niiya stated that the contractor will be constructing the JMTC, including the

installation of conduits and putting in power. The vendor would furnish and install the large display wall frames and video monitor systems which plug into the outlets. The little monitors would be installed to display videos for traffic cameras. The installation of fiber optic cables is required to communicate

between the video display monitors and conference rooms. The Board asked if the infrastructure contractor will pull the wires through the

conduit and if there is any electrical work (e.g. wires will be tied in). Mr. Niiya responded that the video display is consists of individual screens, and he is not certain if the screens are tied in or plugged in.

The Board asked if the project will involve splicing, and whether the electrical

work will include 120 watt hard wire hook up. Mr. Niiya responded that the fiber optic cables are off the shelf and pre-fabricated, and it has not been determined at this time whether there will be any hard wiring.

Kevin Roach – Requests a determination on whether the “B” General building contractor may self-perform the installation of insulation behind wood paneling in the ceiling conditions and behind drywall in the wall conditions as work that is “incidental and supplemental” to the drywall and siding work.

The estimated construction cost per residence is in excess of $1 million. The estimated insulation cost per residence is $30,000 so the insulation portion comprises less than 3% of the total project cost.

Mr. Roach was not present.

Hawaiian Dredging Construction Company, Inc (“HDCC”) (deferred from March 18, 2016 meeting) – Requests a determination on which license classification is required for the installation of car wash equipment.

Mr. David Adachi of Kaipo Kreations was present to discuss the above inquiry. He stated that he has been installing prepackaged car wash equipment for the car rental industry for twenty-one years. He stated that the car wash kits are pre-made to be set up.

The Board asked Mr. Adachi if he was involved with the car wash project at the Honolulu International Airport and if he is a licensed contractor. Mr. Adachi responded that he is not a licensed contractor and he did not pursue the airport project because there was a question as to whether a contractor’s license was required. The Board asked who installed the car wash equipment for the Honolulu International Airport project and whether his competitors are licensed contractors. Mr. Adachi answered, that car wash equipment installers are not licensed contractors and that he does not know who performed the Honolulu Airport Project. There are other companies that install pre-packaged car wash equipment, like Bellinger and other out of state NS Car Wash installers. In response to the Board’s questions on the installation of the car wash equipment, Mr. Adachi stated that the car wash system is a totally packaged system and there are no individual items that require assembly on site. The car wash system comes in crates and are made to specifications. The pumps and machines are tested before it comes in. There are no separate tanks or pumps that are installed. All equipment for the car wash comes as a kit with instructions on the work that a contractor would need to perform. The

installation of the car wash does not include any conveyors. Mr. Adachi also stated that he does not perform any structural work; all of the structural work is performed by the general contractor. The general contractor also installs the housekeeping pads and presets the anchor, and the equipment is anchored to the cement. The general contractor also hires the electrical and plumbing contractors for the electrical and plumbing connects and disconnects. County of Maui – Requests a determination whether the following work regarding the "trenching, backfilling, patching, and surface restoration" requires a C-37 Plumbing or “A” General engineering contractor’s license:

1. Installation of two drainage systems: 1 drainage system is a 6 ft. dia X 4

ft deep drywell and the other is a 4 ft. X 6 ft. drain inlet buried 5 ft. deep.

2. Perform grading work for accessible routes require fine grading to meet the accessible guidelines and balancing the surrounding slopes after the drains and accessible routes are installed. Grading is required for the installation of concrete walks to the shower.

Ms. Shannon Alivado, Director of Government Relations for the General Contractors Association of Hawaii was present to discuss this inquiry. Ms. Alivado stated that if the work involves manholes, drywells and trenching an “A” General engineering contractor’s license would be required pursuant to the Hawaii Revised Statutes. She also stated that a C-37 Plumbing contractor’s license would be required to install a shower. Terry Doyle – Requests a determination of whether a license is required to inject a urethane resin called EC1000-180 into termite and dry rot damaged wood columns and beams in open beam structures.

Mr. Doyle was not present. Eric R. Gruver – Requests clarification on the following:

1. Whether a C-33 Licensed Contractor can do concrete spall repairs under

this license and what are the stipulations. 2. If so how much is he/she allowed to repair (depth etc.) 3. Where does the C-31a/C-31d license become mandatory? 4. What constitutes "structural" and "non-structural" spall repairs? For

instance, a repair on a significant load bearing wall vs an aesthetic repair on a retaining wall perhaps? Is there a clear cut definition for "structural" spalling vs "non-structural"?

5. Can a C33 Contractor legally repair concrete/spalls/aesthetics in concrete? To what extent?

Mr. Eric R. Gruver, Account Manager for Sherwin-Williams, was present to discuss the above inquiry. Mr. Gruver stated that his role with Sherwin-Williams is to act as a liaison for and write specifications for property managers of Associations of Apartment

Owners (“AOAO”). He also stated that he invites the contractors to bid on the projects, and the AOAO hires and enters into the contract with the contractor. Mr. Gruver asked the Board to determine when a C-33 Painting and decorating contractor is required to have a C-31a Cement concrete or C-31d Tuckpointing and caulking contractor’s license to perform spall repair, and determine what constitutes structural spall repair work. It has come to his attention that in the 2013 Gillespie case, it was determined that the C-33 is allowed to do spall repairs. Executive Officer Ito informed the Board that she requested Mr. Gruver provide additional information on the project and the work being performed. Her request included that he provide the plans and specifications for the project, the cost and extent of the C-33 Painting and decorating work, and the cost and extent of the concrete spall repair work. Executive Office Ito explained that each Board determination is made on a case-by-case basis and is fact specific. Mr. Gruver is believes that the spall repair work is “incidental and supplemental” to the C-33 contractor’s license and is requesting a general opinion from the Board on when spall repair becomes structural (e.g., is it structural when rebar is installed). The Board informed Mr. Gruver that it cannot make a blanket determination on whether spall repair is “incidental and supplemental” to the C-33 contractor’s license because each determination is made on case by case basis depending on the facts provided. Mr. Gruver stated that he is involved in over a hundred painting projects a year and that over 90% of spall work requires rebar work. He is requesting that the Board provide a clear cut determination on the spall repair work that can be performed by a C-33 contractor. The Board informed Mr. Gruver that he must provide information specific to his inquiry. Mr. Jeff Masatsugu representing the Painters LMCF, agreed with Mr. Gruver that the spall repair work is covered under the C-33 contractor’s license. He cited to the January 2013 Babylon Painting case where spall repair was considered as cosmetic work. Mr. Dean M. Nagatoshi of the Painting and Decorating Contractors of America, Hawaii Council stated that from the painting standpoint, spall repair is cosmetic because they are repairing the surface. Anything that is supporting the structure would require a structural engineer. Mr. Nagatoshi informed the Board that he is not an engineer or mason. The Board asked if painters consider corroding rebar to be cosmetic spall repair work? Mr. Nagatoshi responded, “yes”, as part of the spall repair they treat the rebar and it is not considered as structural work. He also stated that the painter’s determination on work that is non-structural spall repair is subjective. Mr. Masatsugu added that this is consistent with the January 2013 determination.

Mr. Gruver asked whether a repair on a significant load bearing wall; pedestrian walkway; sheet wall repair; work that includes rebar; and deck repair would constitute structural or non-structural spall repair. The Board asked if painters pour concrete to repair concrete. Mr. Nagatoshi responded that painters sometimes do small forms and pour concrete; sometimes they chip back concrete, cut a small rebar and replace rebar with very little welding. Mr. Arnold Wong of the Ironworkers Local Union 625 Stabilization Fund strongly disagreed that chip out of concrete and rebar replacement could be performed by a C-33 contractor, and stated that a C-41 Reinforcing steel contractor’s license would be required to perform this work. He also stated that if deck repair work is performed improperly, it could pose a safety issue: structural load bearing work requires a C-41 contractor. Mr. Nagatoshi stated that spall repair is “incidental and supplemental” to C-33 work and somewhat subjective. If the repair is small, it’s “incidental and supplemental”; if it is larger, it is a structural repair. Painters will call in the appropriate contractors for structural repairs. He added that some painters also have C-31 Masonry contractor’s licenses. Mr. Masatsugu stated that based on the Board’s previous determination in January 2013, spall repair work is included under the C-33 Painting and decorating license. Mr. Gruver stated that the question today is to what extent painters can perform spall repair work. It is not reasonable to say that painters cannot perform any spall repair work when they are capable to perform spall repair work. The C-41 and C-31 contractors are not willing to take on small spall repairs jobs because it is not financially feasible. The Board expressed concerns that painters are setting forms and pouring concrete and asked at what point would the repair require pouring concrete? Mr. Nagatoshi responded that the C-33 contractors use their experience and considers the extent and size to determine when to pour concrete. The Board asked if painters also perform plastering. Mr. Nagatoshi responded that he could not say that a C-33 contractor is experienced in plastering work. Mr. Wesley Chan, Tokunaga Masonry/ Mason Contractors Association of Hawaii (“MCAH”), stated that spall repair is not cosmetic. For example, if a walkway loses the top 2 inches of a 6 inch slab, this is structural because the strength of the system is compromised and the system needs to be replaced. The concrete with the rebar makes up the system. Spalling is caused by the rebar corroding and rebar treatment is required. Mr. Chan stated that cosmetic work is plastering; spall repair is a structural and that is the reason the details for spall repair are found in the S drawings (structural). Ms. Alivado stated that the description of the C-33 Painting and decorating contractor is to apply materials common to the painting and decorating industry for protective and decorative purposes and does not believe it includes spall repair. She also added that the AOAO should be the responsible party in hiring

the appropriate contractor.

Executive Session: At 9:15 a.m., it was moved by Mr. Lee, seconded by Mr. Kamai, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(4) to consult with James C. Paige, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

At 9:58 a.m., it was moved by Mr. Mochida, seconded by Mr. Isemoto, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Hawaii Department of Transportation – Requests a determination whether the following work for the A/V system which will be installed in the Joint Traffic Management Center (“JTMC”) requires a C-13 Electrical or C-15 Electronic systems contractor’s license:

Recommendation: The C-13 Electrical contractor may perform the installation of the entire audio/visual system described above; and the C-15 Electronic systems contractor may perform the installation of the audio/visual system described above; provided that all non-low voltage electrical work and installation of conduits are performed by a C-13 Electrical contractor.

Kevin Roach – Requests a determination on whether the “B” General building contractor may self-perform the installation of insulation behind wood paneling in the ceiling conditions and behind drywall in the wall conditions as work that is incidental and supplemental to the drywall and siding work. The Board reviewed of the plans and product information provided by Mr. Roach and determined that the installation of the Foamed-In-Place Lightweight Cement Insulation is not directly related to the work of the C-12 Drywall or C-5b Siding application contractor’s licenses.

Recommendation: The installation of the Foamed-In-Place Lightweight Cement Insulation is not “incidental and supplemental” to the performance of the C-12 Drywall or C-5b Siding application contractor’s licenses on this residential project; and that the C-1 Acoustical and insulation contractor’s license is required to install the Foamed-In-Place Lightweight Cement insulation on this

residential project.

Recommendation: The C-25 Institutional and commercial equipment contractor’s license is required to install the car wash equipment; provided that all electrical and plumbing work is subcontracted to the C-13 Electrical and C-37 Plumbing contractor, respectively. County of Maui – Requests a determination whether the following work regarding the "trenching, backfilling, patching, and surface restoration" requires a C-37 Plumbing or “A” General engineering contractor’s license:

1. Installation of two drainage systems: 1 drainage system is a 6 ft. dia X 4

ft deep drywell and the other is a 4 ft. X 6 ft. drain inlet buried 5 ft. deep.

Recommendation: Question 1: The C-37 Plumbing, “A” General engineering, and C-43 Sewer, sewage disposal, drain, and pipe laying contractor may perform the "trenching, backfilling, patching, and surface restoration" that is required for the installation of the two drainage systems: (a) drainage system is a 6 ft. dia X 4 ft deep drywell and (b) 4 ft. Terry Doyle – Requests a determination of whether a license is required to inject a urethane resin called EC1000-180 into termite and dry rot damaged wood columns and beams in open beam structures.

Recommendation: 1. The “B” General building or the C-6 Carpentry framing contractor’s

license is required to inject a urethane resin (EC1000-180) into termite and dry rot damaged wood columns and beams in open beam structures; and

2. The C-5 Cabinet, millwork, and carpentry remodeling and repairs contractor’s license is required to inject a urethane resin (EC1000-180) into non-structural termite and dry rot damaged wood columns and beams in open beam structures;

Eric R. Gruver – Requests clarification on the following:

1. Whether a C-33 Licensed Contractor can do concrete spall repairs under

this license and what are the stipulations. 2. If so how much is he/she allowed to repair (depth etc.) 3. Where does the C-31a/C-31d license become mandatory? 4. What constitutes "structural" and "non-structural" spall repairs? For

instance, a repair on a significant load bearing wall vs an aesthetic repair on a retaining wall perhaps? Is there a clear cut definition for "structural" spalling vs "non-structural"?

5. Can a C33 Contractor legally repair concrete/spalls/aesthetics in concrete? To what extent?

Recommendation: Defer this matter to review a prior determination on a similar inquiry in January 2013.
