IMPORTANTThis is a Contract for repair or replacement of specified appliancesandhomesystems.ThisContractcoversonlytheitemsspecificallyidentifiedinthisContractascovered(Item(s))andexcludesallothers.Itemsarenotcoveredunlesstheyareinsafeworkingorderatthestartofcoverage.Tobecovered,Itemsmustbeinstalledfordiagnosisand located within the confines of the perimeter of the foundationoftheprimarylivingquartersorgarage(exceptwell pump, septic tank, sewage ejector pump, pressure regulator,airconditioningandpool/spaequipment;whenapplicable).ThisContractprovidescoverageforunknowndefectsifthedefectisnotdetectablethroughvisualinspection or simple mechanical test (excluding renewal andnon-realestatetransactioncustomers).Itemsincludemalfunctioningsystemsandappliancesduetolackofmaintenance,rust,corrosionandchemicalorsedimentarybuild-up.Unlessspecifiedotherwise,anydollarlimitmentioned is in the aggregate. First American Home Warranty Corporation (Company) will not reimburse you for services performed without prior approval.
COVERAGE TIME AND RENEWALYoumustreportdefectsormalfunctionstoCompanyduringthe term of this Contract.
A.BasicSeller’sCoverageandSeller’sOptions(ifelected) starts upon receipt of Contract number and continues until expiration of the initial listing period nottoexceed180daysoruntilcloseofsaleorlistingcancellation(whicheverisfirst).Seller’sCoveragemaybeextendedatthediscretionofCompany.
B.NewConstructionCoveragebegins12monthsafterthe close of sale and continues for 48 months.
3.OfferforfuturecoverageisatCompany’ssolediscretion.You will be notified of rates and terms for continuation of coverage.

Not Covered: Fixtures, faucets, filter, shower head, shower arm, shower enclosure and base pan, caulking and grouting, septic tank, hose bibbs, flow restrictions in fresh water lines, water conditioning equipment, sewage ejectors, saunas or steam rooms, whirlpool jets and fire suppression systems.

Not Covered: Remote transmitters, adjustments, doors, gates and gate motors, side rails, hinges and springs.

Not Covered: All cleaning equipment, including pop up heads, turbo and actuator valves, pool sweeps, liners, lights, structural defects, solar equipment, inaccessible components, humidifier/dehumidifier systems or accessories, jets and respective parts and components, fuel storage tanks, fill valves, electronic, computerized, pneumatic and manual system management and zone controllers, disposable filtration media, chlorinators, ozonators and other water chemistry control equipment and materials, auxiliary, negative edge, waterslide, waterfall, ornamental fountain and their pumping and motor systems or any other pump or motor that does not circulate water from the pool or spa directly into the main filtration system as its primary function, heat pumps, salt, panel box, remote controls and dials.

Thisoptionprovidescoverageforthefollowingwithacombinedtotal of four appliances: additional refrigerator, wet bar refrigerator,winerefrigerator,freestandingfreezerandfreestanding ice maker.
Not Covered: Filters, removable components which do not affect the primary function, interior thermal shells, insulation and refrigerant recapture, reclaim and disposal.

Not Covered: Well casings, booster pumps, pumps used exclusively for irrigation, animals and non-living quarters, piping or electrical lines, holding, pressure or storage tanks, redrilling of wells, damage due to lack of water, tampering, well pump and well pump components for geothermal or water source heat pumps, improper installation and access to repair well pump system.
WATER SOFTENER AND REVERSE OSMOSIS WATER FILTRATION SYSTEM –Coveredifpurchased(Limit up to $500)
Not Covered: Leased/rented units, softening agents, chemical imbalance, high sodium content, water purification systems, salt, filters, filter components and replacement membranes.
SEPTIC TANK PUMPING/SYSTEM –Coveredifpurchased(Limitupto$500fortanksystem)
Not Covered: Septic tanks, leach lines, cesspool, mechanical pump or systems, cost of locating or to gain access to the septic tank, cost of hook-ups, disposal of waste and chemical treatment of the septic tank or sewer lines.
6. Companyisnotresponsibleforthefollowing:anycorrections,repairs, replacements, upgrades, inspections or other additional coststocomplywithfederal,stateorlocallaws,utilityregulations,zoningorbuildingcodes;payinganycostsrelatingtopermits,haulawayfees,construction,carpentryorrelocationofequipment;gainingorclosingaccesstoItemsexceptwherenotedinthisContract;and,alterationsormodificationsmadenecessarybyexistingequipmentorinstallingdifferentequipmentexceptwherenotedintheCentralAirConditioningsectionofthisContract.Companywillnotalterstructuretoeffect repair or replacement, nor refinish or replace cabinets, countertops,tile,paint,wallorfloorcoveringsorthelike.
8. Contractcoversonlysinglefamilyresidential-useproperty,residential-useresalepropertyorresidential-usenewconstructionproperty.Residentialpropertyover5,000squarefeet, multiple units, guest houses and other structures are coverediftheappropriatefeeispaid.Contractisforownedorrentedresidentialproperty,notforcommercialpropertyorpremisesconvertedintoabusiness,includingbutnotlimitedto,nursing/carehomes,fraternity/sororityhousesordaycarecenters.
9. Companywilldetermine,atitssolediscretion,whetheracoveredsystemorappliancewillberepairedorreplaced.Whenreplacinganyappliance,Companywillnotpayforanyfailuresthatdonotcontributetotheappliance’sprimaryfunctionincluding, without limitation, TVs or radios built into the kitchen refrigerator.Companywillreplacewithequipmentofsimilarfeatures,efficiencyandcapacitybutisnotresponsibleformatchingbrand,dimensionsorcolor.Companymayinstallasmallercapacityunit,includingbutnotlimitedtowaterheatersand furnaces, if the projected output of the replacement unit is similarto,orgreaterthan,thereplacedexistingunit.Companyreservestherighttoreplacewitharebuiltcomponentorpartorrepairsystemsandapplianceswithnon-originalmanufacturer’sparts.
12.Companyisnotresponsibleforrepairorreplacementofanysystem,appliance,componentorpartthereofthathaspreviously,orissubsequently,determinedtobedefectivebytheConsumerProductSafetyCommissionorthemanufacturer,andforwhicheitherentityhasissued,orissuesawarningorrecall,orwhenafailureiscausedbymanufacturer’simproperdesign,use of improper materials, formula, manufacturing process or manufacturing defect.
2. Contractholderpaysthe$75servicecallfeeforeachseparatetradecall.TradecallmeanseachvisitbyanapprovedContractor,unlessmultiplevisitsarerequiredtoremedythesameproblem.Persons dispatched for trade calls are independent contractors, notagentsoremployeesoftheCompany.CompanywarrantsContractor’sworkfor30days.IftheItemfailsoutsidethistimeperiod,anadditionalservicecallfeewillbecharged.Failuretopaytheservicecallfeemaydelayprocessingoffutureclaims.
TRANSFER OF CONTRACTIfyourcoveredpropertyissoldduringthetermofthisContract,youhavetherighttoassignthisContractprovidedthatyounotifyCompanyofthechangeinownershipandmustsubmitthenameofthenewownerbyphoning(800)444-9030totransfercoverage.
If this Contract is cancelled, the Contract holder shall be entitled to a pro rata refund of the paid Contract fee for the unexpired term,lessa$50administrativefeeandallservicecostsincurredbyCompany.
IfCompanycancelsthisContract,Companyshallusethelastknownaddressonrecordtosendbyfirst-classmailawrittennoticetotheContractholderatleast30dayspriortothecancellationthatstatestheeffectivedateandreasonforcancellation.Insuchcase,theContract holder shall be entitled to a pro rata refund and will not be charged a cancellation fee.
YOUR DUTIESYou are responsible for the following: (i) Protecting appliances/systems;(ii)Reportingclaimspromptly;(iii)Installingandmaintainingappliances/systemsfollowingmanufacturer’sspecificationsand(iv)MaintenanceiftheContractordeterminesitisrequiredtoachievemanufacturerresultsofsystemsandappliances.
MISCELLANEOUSCoverageaffordedunderthisContractisnotguaranteedbythePropertyandCasualtyGuarantyAssociation.TheserviceContractorwarrantyissubjecttolimitedregulationbytheUtahInsuranceDepartment. To file a complaint, contact the Utah Insurance Department.
RESOLUTION OF DISPUTESThis provision constitutes an agreement to arbitrate disputes on an individual basis. Any party may bring an individual action in small claims court instead of pursing arbitration.
All disputes and claims arising out of or relating to the Contract mustberesolvedbybindingarbitration.Thisagreementtoarbitrate includes, but is not limited to, all disputes and claims betweenCompanyandtheHomeowner,CompanyandtheSeller,and claims that arose prior to purchase of the Contract. This agreementtoarbitrateappliestoCompany,HomeownerandSeller,andtheirrespectiveparentandsubsidiarycompanies,affiliates,agents,employees,predecessorsandsuccessorsininterest,assigns, heirs, spouses, and children. Asnotedabove,apartymay elect to bring an individual action in small claims court insteadofarbitration,solongasthedisputefallswithinthejurisdictional requirements of small claims court.
Anyarbitrationmusttakeplaceonanindividualbasis,andCompany,theHomeownerandtheSelleragreethattheyarewaiving any right to a jury trial and to bring or participate in a class,representative,orprivateattorneygeneralaction,andfurther agree that the arbitrator lacks the power to consider claimsforinjunctiveordeclaratoryrelief,ortograntreliefaffecting anyone other than the individual claimant.
ThearbitrationisgovernedbytheCommercialArbitrationRulesandtheSupplementaryProceduresforConsumerRelatedDisputes(the“AAARules”)oftheAmericanArbitrationAssociation(“AAA”),asmodifiedbythisAgreement,andwillbeadministeredbytheAAA.CompanywillpayallAAAfiling,administrationandarbitratorfeesforanyarbitrationitinitiatesandforanyarbitrationinitiatedbyanotherpartyforwhichthevalueoftheclaimsis$75,000orless,unlessanarbitratordeterminesthattheclaimshavebeenbroughtinbadfaithorforanimproperpurpose,inwhichcasethepaymentofAAAfeeswillbegovernedbytheAAARules.ACOPYOFTHESERULES IS AVAILABLE FROM THE AAA’S WEB SITE AT WWW.ADR.ORG OR ON REQUEST FROM THE COMPANY. THE ARBITRATION AWARD MAY INCLUDE ATTORNEY’S FEES IF ALLOWED BY FEDERAL, STATE, OR OTHER APPLICABLE LAW AND MAY BEENTEREDASAJUDGMENTINANYCOURTOFPROPERJURISDICTION.
ThearbitrationwilltakeplaceinthesamecountyinwhichthepropertycoveredbytheHomeWarrantyContractislocated.TheFederalArbitrationActwillgoverntheinterpretation,applicabilityand enforcement of this arbitration agreement. This arbitration agreementwillsurvivetheterminationofthisWarrantyContract.
AGREEMENTThis Agreement constitutes the entire agreement between the Parties and supersedes all prior and contemporaneous agreements and understandings of the Parties. No modifications to this AgreementareeffectiveunlessinwritingandsignedbybothParties.

How quickly are claims handled?Oncecoverageisconfirmed,thecontractortypicallyreceivesthe claim dispatch within four hours during regular business hours.Normally,theserviceswillbeinitiatedbythetechnicianwithin48hoursaftertherequestismade.Simplerepairsareusuallymadeonthefirstvisit,however,ifitemsmustbeorderedanadditionalvisit(s)maybeneededtocompletetherepair or replacement.
8. What is an emergency repair and how are these claims handled?FirstAmericanconsidersitanemergencywhenthefailureofacovereditemrendersthehomeuninhabitable;inthesecircumstances, First American will make all reasonable efforts toexpediteemergencyservice.
9. How is it determined if a failure is covered or not?Ingeneral,coverageislimitedtofailurescausedbynormalwear and tear and limited to the terms of the contract. For example,cosmeticdefectsarenotcovered.
