AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF METUCHEN, VARIOUS

CHAPTERS, CERTAIN APPLICATION, LICENSE AND PERMIT FEES BE IT ORDAINED by the Borough Council of the Borough of Metuchen, as follows: Section 1. Section 87-20 of Chapter 87, Fees, Article 11 – Recreation Program Fees, of the Code of the Borough

of Metuchen, is hereby amended to add/change/delete the permit fees to read as follows: § 87-20 – Fees Established. Program Fee Baseball camp/T-ball camp 5 days, 1 hour per day $79

Borough of Metuchen County of Middlesex State of New Jersey

ORDINANCE AMENDING THE COMPOSITION OF THE BOROUGH OF METUCHEN POLICE DEPARTMENT INCREASING THE NUMBER OF

LIEUTENANTS FROM ONE (1) TO TWO (2).

WHEREAS, at the request and recommendation of the Chief of the Metuchen Police Department, the Mayor and Council of the Borough of Metuchen deem it in the best interest of the health, safety and welfare of the residents of the Borough to amend the composition of the Police Department to increase the number of Lieutenants from one (1) to two (2). NOW THEREFORE BE IT ORDAINED by the Council of the Borough of Metuchen, County of Middlesex, that it hereby amends Chapter 37 Police Department of the Code of the Borough of Metuchen, specifically § 37-1, entitled, “Composition; appointment.” to state as follows:

§ 37-1. Composition; appointment.

The Police Department of the Borough of Metuchen shall consist of no more than one (1) Chief of Police, one (1) Captain of Operations/Deputy Chief, one two (2) Lieutenants, six (6) Sergeants, three two (2) Detectives and seventeen (17) patrol officers, and such employees as the Borough Council may from time to time appoint.

BE IT FURTHER ORDAINED by the Mayor and Council that all prior ordinances, or sections of ordinances, inconsistent with the within ordinance are hereby repealed.

BE IT FURTHER ORDAINED by the Mayor and Council that all remaining

sections of Chapter 37 not amended or referenced herein shall not be affected thereby and shall remain in full force and effect.

BE IT FURTHER ORDAINED by the Mayor and Council that if any section,

subsection, paragraph, sentence, clause or phrase of this Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance, which shall continue in full force and effect, and to this end, the provisions of this Ordinance are hereby declared to be severable; and

Borough of Metuchen County of Middlesex State of New Jersey

RESOLUTION APPOINTING ACTING MUNICIPAL CLERK

WHEREAS, the Municipal Clerk of the Borough of Metuchen had submitted a letter of

resignation effective March 19, 2021; and WHEREAS, the Municipal Clerk at the time possessed a municipal clerk certificate and

was a registered municipal clerk; and WHEREAS, N.J.S.A 40A:9-133 requires all municipalities to appoint an individual to

serve as municipal clerk; and WHEREAS, pursuant to N.J.S.A. 40:9-133(c), the Borough may, within ninety (90) days

of the occurrence of a vacancy in the office of municipal clerk by reason of the departure of a registered municipal clerk, appoint a person who does not hold a registered municipal clerk certificate to serve as acting municipal clerk for a period not to exceed one (1) year and commencing on the date of the vacancy; and

WHEREAS, a vacancy in the office of Borough Clerk arose in the Borough of Metuchen

on March 19, 2021, due to the resignation of a registered municipal clerk; and WHEREAS, the Borough advertised for the position of Municipal Clerk and reviewed the

resumes and credentials of the proposed applicants; and WHEREAS, the Borough has determined that it is in the best interest of the Borough to

appoint Deborah Zupan to serve as Acting Municipal Clerk at an annual salary of sixty-eight thousand dollars ($68,000.00) while she enrolls in the necessary training to obtain municipal clerk certificate and become a registered municipal clerk.

NOW THEREFORE BE IT RESOLVED that the Mayor and Council of the Borough of

Metuchen hereby appoints Deborah Zupan to serve as Acting Municipal Clerk of the Borough of Metuchen effective April 13, 2021, for a term of one (1) year commencing March 19, 2021 pursuant to N.J.S.A. 40A;9-133 (c) to be paid an annual salary of sixty-eight thousand dollars ($68,000.00); and

BE IT FURTHER RESOLVED that the Mayor and Council further authorize that the

Borough pay for the required municipal clerk training classes under the express condition that in the event that Deborah Zupan receives her Municipal Clerk Certificate and the Borough appoints her as Borough Clerk, she will forgo seeking employment as a Municipal Clerk for another municipality during her initial three-year term as Borough Clerk; and

BE IT FURTHER RESOLVED that the Mayor and Council further authorize that

Deborah Zupan be permitted to carry over to the Borough of Metuchen her years of services with the Borough of Metuchen Library to the Borough of Metuchen as well as any accumulated sick leave.

Metuchen on March 19, 2021, due to the resignation of a registered municipal clerk; and WHEREAS, pursuant to N.J.S.A. 40:9-133(c), the Borough may, within ninety

(90) days of the occurrence of a vacancy in the office of municipal clerk by reason of the departure of a registered municipal clerk, appoint a person who does not hold a registered municipal clerk certificate to serve as acting municipal clerk for a period not to exceed one (1) year and commencing on the date of the vacancy; and

WHEREAS, the Borough of Metuchen intends upon making an appointment of

an individual to serve as acting municipal clerk for a term of one (1) year commencing March 19, 2021; and

WHEREAS, the Township of Woodbridge currently employs a registered

municipal clerk with extensive municipal clerk and local government experience; and WHEREAS, pursuant to the Uniform Shared Services and Consolidation Act,

N.J.S.A. 40A:65-1, et seq. (the “Act”), any local unit may, by the adoption of a resolution of its governing body, enter into an agreement with any other local unit or units to provide or receive any service that each unit participating in the agreement is empowered to provide or receive within its own jurisdiction and that such agreement between the local units for the provision of shared services shall be entered pursuant to the Act; and

WHEREAS, the Township of Woodbridge has offered to provide the Borough of

Metuchen assistance and consulting services relating to the operation, management of the Office of Municipal Clerk and all of the requirements thereof; and

WHEREAS, the Borough of Metuchen has determined that it is in the best

interest of the Borough and for the efficient operations of the Office of Borough Clerk to obtain municipal consultant services from the Township of Woodbridge on an as needed basis at an hourly rate of fifty dollars ($50.00) per hour for General Consultant Services and sixty five dollars ($65.00) per hour for Specialized Consultant Services at a total annual cost not to exceed fifty thousand dollars ($50,000.00); and

WHEREAS, the Borough of Metuchen and the Township of Woodbridge have negotiated a draft Shared Services Agreement; and

WHEREAS, the Chief Financial Officer of the Borough of Metuchen has

certified that there is sufficient available funds to authorize the within Shared Services Agreement; and

WHEREAS, Mayor and Council find that it is in the best interest of the Borough

of Metuchen to enter into the Shared Services Agreement with the Township of Woodbridge to memorialize the provision and receipt of shared services between the Parties.

NOW THEREFORE BE IT RESOLVED by the Council of the Borough of Metuchen that it hereby authorizes the entry into and the execution of a Shared Services Agreement by and between the Borough of Metuchen and the Township of Woodbridge for the provision of municipal consultant services in general conformity with the terms and conditions set out in the proposed Shared Services Agreement; and

BE IT FURTHER RESOLVED by the Council of the Borough of Metuchen that it hereby authorizes all Borough officials to take all necessary actions to in order to effectuate the within resolution and the Shared Services Agreement, including but not limited to the Mayor and Acting Clerk are hereby authorized to execute a Shared Service Agreement on behalf of the Borough of Metuchen in a final form acceptable to the Mayor and Borough Administrator.

WHEREAS, distracted driving is a serious, life-threatening practice that is preventable;

and WHEREAS, distracted driving can result in injuries and deaths to all road users (motorists,

pedestrians and bicyclists); and WHEREAS, distracted driving occurs when drivers divert their attention away from the

task of driving to focus on another activity instead; and WHEREAS, in 2018 alone distracted driving-related crashes resulted in 2,841 deaths and

400,000 injuries on our nation’s roads; and WHEREAS, in New Jersey distracted driving was listed as a contributing circumstance in

50-percent of all motor vehicle crashes in 2018; and WHEREAS, the State of New Jersey will participate in the nationwide Distracted Driving

2021 Crackdown from April 1 - 30, 2021 in an effort to raise awareness and decrease driver distraction through a combination of enforcement and education; and

WHEREAS, the national slogan for the campaign is “UDrive. UText. UPay”; and WHEREAS, the Mayor and Council of the Borough of Metuchen have determined that it

is in the best interest of the health, safety and welfare of its residents and the community at large to increase awareness of the dangers of distracted driving.

Metuchen Ordinance, $500.00 was posted by Suburban Development for Inspection Fee at 71 Myrtle Street; and WHEREAS, the Engineer/Collier’s Engineering advises that said work has been completed in a satisfactory manner; and WHEREAS, the Engineer/Collier’s Engineering advises it is in order to release the Sidewalk Inspection Fee previously deposited
