Terms of Reference for engaging a Environment Specialist in RSPMU, for

Preparation of World Bank assisted Jal Swarajya-II Project

1. Introduction:

1.1 The World Bank supported Government of Maharashtra (GoM) in the RWSS

sector through two projects in the past. The last project was Jalswarajya implemented

from 2003-2009. Jalswarajya-I project has been successful in consolidating and

demonstrating the new policies of GoM in the sector, mainly aimed at strengthening

decentralized, community led sector management with a focus on higher levels of

service delivery (piped water supply, household tap connections, open defecation free

villages etc).

1.2 The GoM has applied through GOI for World Bank assistance in developing and

implementing its State-wide Sector Program for the next 5 years under a follow on

project (Jalswarajya phase-2) in order to scale up the JS-I approach state-wide and

integrate and streamline the functions of existing multiple sector institutions along

with developing implementation models for meeting new sector challenges.

2. Rational

2.1 In order to carry out the preparation of the Project Implementation Plan (PIP) of

Jalswarajya phase-2 project, the GoM has put together a project preparation team

within the department along with some experts from WSP-SA. As per the Jalswarajya

II scope and World Bank requirements, following studies/assessment reports needs to

be prepared on priority:

1. Sector Status Report for Water, Sanitation & Water Quality

2. Finance & Procurement Manuel

3. Social & Environmental assessments cum Impact report

4 Institutional Assessments report

5. Monitoring & Evaluation studies.

2.2 Accordingly there is a need to engage the experts/specialists from all the above

fields in the Project Preparation Team. Therefore Reform Support & Project

Management Unit, (RSPMU) invites application from the suitable candidates on a

short term consultancy basis for the post of environment Specialist as per the given

below terms of Reference:-

3. Roles and Responsibilities

The role and responsibility of the Environment Specialist will be as below:-

3.1 The Environment Specialist will prepare Environmental Assessment (EA) report and

Environment Management Plan, in coordination with the consultant appointed by the

WSP-SA, as per the Operational policy, Bank procedure and Good practices of WB,

within stipulated period as agreed mutually between World Bank and GoM.

3.2 He / She will also be responsible for incorporating the Social Assessment findings for

preparation of final Social and Environment Assessment Report, which will be one of

the key inputs for the preparation of the Environmental Impact Assessment Report, to

be prepared by the World Bank.

3.3 He / She will be responsible for development of Environment Management Plan

for the whole Project based upon EA report, covering following aspects (but not

limited to):

• Negative list of schemes that would not be permissible in the programme because

they contravene the bank policies and the National/ State regulation

• Standardized environmental codes of practices for a range of water supply and

sanitation investments

• Screening formats to identify high impacts schemes that require environmental

assessments (e.g. large schemes or schemes in environmentally vulnerable areas.)

• Standard terms of reference for Environmental Impact Assessments to be taken up in

programme

• Monitoring and reporting mechanism.

• Standardized terms of reference for external environmental audits

• Institutional roles and responsibilities

• Guidance on training and capacity building

• Issues involving pollution of ground water resources, water quality, application of

ISO 10500 norms etc.

• Any other article/item as desired by the Bank/Department.

3.4 He / She will be responsible to collect data, analyse and prepare in the required

format so as to incorporate in the EA report.

3.5 He / She is responsible to organise the public consultation workshops at various

places for dissemination of the EA report findings and incorporate the feedback

received from the stakeholder for finalization of EA and Environment Management

Plan (EMP).

3.6 To study various policies adopted by GoM for community Development and

incorporate the same for smooth functioning of project process at various levels.

3.7 To design the strategy to aware the community about the New Financing Tool P4R

in consultation with Financial, Procurement Consultant and World Bank.

3.8 To co-ordinate with the World Bank in general and his / her task counterpart in the

WB Team.

3.9 He / She have to co-ordinate and liaison with all the team members and other

consultants for the smooth functioning of the project preparation activities.

3.10 He / She will be responsible to co-ordinate with various desks in WSSD, GSDA,

MJP, RDD, Public Health Dept, WSSO, Maharashtra Pollution Control Board,

Districts Govt. officials and non officials, NGOs, PRIs and other State Govt. Depts.

for collecting the required information.

3.11 He / She is required to visit any place within Maharashtra and outside Maharashtra

also as and when required based on project need with approval from competent

authority

3.12 He / She is also responsible for regular submission of project preparation progress

of the project to the Project Manager and Project Director of Jalswarajya Project-II.

3.13 He / She must be fully convergent with the all aspects of project preparation

activities and Liable for timely reporting to Project Manager / Project Director about

the Project preparation progress.

3.14 He / She is responsible for any other related task / tasks assigned by Project

Director & Project Manager.

4.Qualification and Experience:

4.1 Essential Qualifications

� Post Graduate degree in Environmental Engineering / Environmental science.

� Experience of working in government/reputed private sector as a consultant for planning,

designing, pre & post assessment of water supply and sanitation facilities with regard to

environmental safety & standard norms, for at least seven (7) years.

� Strong communication skills in presenting, discussing and resolving difficult issues, both

orally and in writing, and excellent listening skills and proficiency in English and Marathi

� Exceptional degree of integrity, judgment and tact in handling the most sensitive, diverse

and confidential material.

4.2 Added Qualifications

� Preference will be given for experience in preparation of Environment Assessment report

and Environment Management plan for similar kind of World Bank projects preferably in

water & sanitation areas.

� Experience of working with rural areas/communities.

� Good & thorough knowledge of IT & Computer skills including data base management/MIS

development.

4.3 Power to Relaxation

• In case of deserving Government official, Principal Secretary is empowered to relax

qualification/ experience criteria.

5. Report/Manuel submission

5.1 The consultant will have to produce Environment Management Plan as per clause 3

(3), incorporating all the studies/report as mentioned in but not limited to clauses 3(1),

3(2) etc.

5.2 The tentative schedule for submission of the Plan will be as given below:

5.3 For any delay in submission of the report, a valid explanation will be required to be

tendered to the management. Project Director shall be the final authority to accept/refuse the

reasons/explanation tendered.

6. Salary and Allowances

6.1 Recruitment of Specialist initially shall initially be for four Months and likely to be

extended based upon the performance.

6.2 Monthly Remuneration and Allowances – Monthly Remuneration shall be INR 50,000/-

(Fifty Thousands only). In case of deserving candidate, Principal Secretary may sanction

more remuneration.

6.3 He shall also be entitled for TA/DA, which shall be applicable as per Rs.6600/- Grade

Pay and in addition a lump sum mobile/internet allowance of Rs 1000/- will also be

admissible. No other benefits like leave allowance, gratuity or pension or any other

allowance associated with regular government employees shall be applicable.

6.4 He shall be entitled to 2 casual leaves and a max of three sick/medical leave for the

entire duration of 4 months. Non availing of these leaves would not result in any

compensation/allowance due in lieu of that.

6.5 Selected consultant shall have to sign a detailed contractual agreement on a judicial

stamp paper duly attested stating clearly that s/he abides by the rules and conditions as

set in the contract.

6.6 In case of Govt. candidate, he will be treated on deputation to the Jal Swarajya project

and all rules established/set by the GoM/GAD regarding such deputation will be

followed.

7. Confidentiality clause

7.1 Selected consultant will have to sign the confidentiality clause s set in the contract

agreement, thereby acknowledging clearly that all produced works shall be a property of the

GoM/WSSD and s/he will have no claims what so ever over the material in any form.

3.1 The role and responsibility of the Finance Specialist will be as given below:-

a) To Develop a good, comprehensive and objective Financial Manual for the

upcoming project covering:

b) Whole project implementation arrangement covering Budget & planning, fund

flow mechanism, Accounting systems & frame work, Book keeping and

accounts, system of internal & external controls and audits, staffing and

training etc. along with roles and responsibilities for the State, District and

block teams.

c) Reporting formats for each of the three levels, i.e. state, district and block

along with reporting formats for the community level project workers. He will

also give suggestions/ideas on how to integrate the above reporting

requirements along with the existing system and to consolidate the flow of

information between various institutions/directorates/wings of the water

supply and sanitation department.

d) Existing good FM practices in the government’s various departments

(including pertaining to Centre and/or other state governments), and to

suggest suitable implementation arrangements for effective and efficient

program management.

e) Uniform term of reference of audit (both internal and external) for the project

including terms of reference for social audits, community score cards etc.

f) Program balance sheet, including possible flow of funds across nest five

years and to check with the department of Finance for its consistency.

g) The newly proposed Program for Results (P4R) approach by the World Bank

and to identify the suitable strategy for the project, which would lead to smooth

integration with the requirements of the finance department. Also to inquest into

Deliverable linked indicators (DLI) as a mean of fund flow from the World

Bank and to suggest suitable implementing arrangements.

i) FM assessment of enhanced role of WSSO as an implementing agency.

3.2 To review the technical, administrative and legal aspects of the finances for

inclusion in financial manual, including advice on terms and conditions for

securing World Bank loan as per new programmatic approach.

3.3 Prepare financial implications of project design, evaluate institutional capacity

of implementing entities at district and sub district level and develop suitable

finance management system;

3.4 Develop a strong web based finance management system, analyze management

related information for improving efficiency and effectiveness of service

delivery in the sector.

3.5 Design workshops modules to educate financial management professionals in

implementing agencies at state, district and sub district levels and village level

on approach to finances, as well as on specialized financial topics

3.6 Conduct a financial performance assessment on a sample basis in all schemes

that are implemented in the sector by carrying out in at least five districts

covering ten villages each.

3.7 To prepare operational guidelines on concepts, policies and procedures for over

all sector level finance management. This would include study of the existing

method/system of fund flow by the department under various programs/projects

like NRDWP/TSC/O&M to various institutions like ZP/MJP/GSDA/WSSO etc

and suggest measures to be taken by the department for tighter financial

accountability and control.

3.8 Assist all Implementing entities and staff, including capacity building support in

financial assessment and the finance management system development process

including preparation of various Manuals, reports and other documents, etc.;

3.9 To co-ordinate/liaise with the World Bank in general and his / her task counterpart

in the WB Team.

3.10 He / She will have to co-ordinate and liaison with all the team members and

other consultants for the smooth functioning of the project preparation activities.

3.11 He / She will be responsible to co-ordinate with various desks in WSSD, GSDA,

MJP, RDD, Public Health Dept, WSSO, Maharashtra Pollution Control Board,

and Districts Govt. officials, NGOs, PRIs & other State Govt. Depts. For

collecting the required information.

3.12 He / She is required to visit any place within Maharashtra and outside

Maharashtra also as and when required based on project need with approval from

competent authority.

3.13 He / She will also responsible for regular submission of project preparation

progress of the project to the Project Manager and Project Director of Jalswarajya

3.14 Any other related task / tasks assigned by Project Director & Project Manager.

4. Qualifications and Experience

4.1 Essential Qualification:

• A Master’s degree in a following discipline i.e. Commerce or Management in Finance

or Business or he should be a practicing C.A.

• At least Five (5) years of direct relevant work experience as finance Specialist or

alternatively, having had responsibilities with a substantial content of his/her position

in the finance area;

• Good knowledge of all concepts and principles of and approaches to finance, and of

public finance systems followed by the state Government, Govt. of India and

International agencies like World Bank;

• Exceptional degree of integrity, judgment and tact in handling the most sensitive,

diverse and confidential material.

• Proficiency (Written and Oral) in English and Marathi.

4.2 Added Qualification

• A previous work experience in the similar capacity essentially related to the World

Bank Project in the developmental field.

• Any added qualification like CFA or ICWA or MIFA etc.

• Strong communication and analytical skills in presenting, discussing and resolving

difficult issues.

• Knowledge and experience in e-finance and procurement MIS will be an added

advantage.

• Well conversant with the latest IT applications/financial tools and use of websites,

email etc.

4.3 Power to Relaxation

• In case of deserving Government official, Principal Secretary is empowered to relax

qualification/ experience criteria.

5. Report/Manuel submission

5.1 The consultant will have to produce financial Manuel as per clause 3.1(i)

incorporating all the studies/report as mentioned in but not limited to clauses 3.2,

3.3, & 3.7, etc.

5.2 The tentative schedule for submission of the report will as follows:

6.7 Recruitment of Specialist initially shall initially be for four Months and likely to

be extended based upon the performance.

6.8 Monthly Remuneration and Allowances – Monthly Remuneration shall be INR

50,000/- (Fifty Thousands only). In case of deserving candidate, Principal

Secretary may sanction more remuneration.

6.9 He shall also be entitled for TA/DA, which shall be applicable as per Rs.6600/-

Grade Pay and in addition a lump sum mobile/internet allowance of Rs 1000/-

will also be admissible. No other benefits like leave allowance, gratuity or

pension or any other allowance associated with regular government employees

shall be applicable.

6.10 He shall be entitled to 2 casual leaves and a max of three sick/medical leave

for the entire duration of 4 months. Non availing of these leaves would not result

in any compensation/allowance due in lieu of that.

6.11 Selected consultant shall have to sign a detailed contractual agreement on a

judicial stamp paper duly attested stating clearly that s/he abides by the rules and

conditions as set in the contract.

6.12 In case of Govt. candidate, he will be treated on deputation to the Jalswarajya

project and all rules established/set by the GoM/GAD regarding such deputation

will be followed.

7. Confidentiality clause

7.1 Selected consultant will have to sign the confidentiality clause s set in the contract

agreement, thereby acknowledging clearly that all produced works shall be a property

of the GoM/WSSD and s/he will have no claims what so ever over the material in any

form.

Terms of Reference for engaging a Procurement Specialist in RSPMU, for

Preparation of World Bank assisted Jal Swarajya-II Project

1. Introduction:

1.1 The World Bank supported Government of Maharashtra (GoM) in the RWSS

sector through two projects in the past. The last project was Jalswarajya implemented

from 2003-2009. Jalswarajya-I project has been successful in consolidating and

demonstrating the new policies of GoM in the sector, mainly aimed at strengthening

decentralized, community led sector management with a focus on higher levels of

service delivery (piped water supply, household tap connections, open defecation free

villages etc).

1.2 The GoM has applied through GOI for World Bank assistance in developing and

implementing its State-wide Sector Program for the next 5 years under a follow on

project (Jalswarajya phase-2) in order to scale up the JS-I approach state-wide and

integrate and streamline the functions of existing multiple sector institutions along

with developing implementation models for meeting new sector challenges.

2. Rational

2.1 In order to carry out the preparation of the Project Implementation Plan (PIP) of

Jalswarajya phase-2 project, the GoM has put together a project preparation team

within the department along with some experts from WSP-SA. As per the Jalswarajya

II scope and World Bank requirements, following studies/assessment reports needs to

be prepared on priority:

3. Roles and Responsibilities

The role and responsibility of the Procurement Specialist will be as given below:-

3.1 To develop a Procurement Manual for the proposed Jal Swarajya-II project,

incorporating all the established/standard norms/best practices followed across the

government/semi-government/other similar institutions or projects, acceptable to

Government and donor agency i.e. World Bank.

3.2 To prepare a progressive procurement plan covering procurement at

state/district/community level and to lay down the guiding principles/rules governing the

same.

3.3 To Provide procurement support during project preparation;

3.4 Assist all Implementing entities and staff in procurement capacity building activities

including support during procurement assessment and the procurement system

development process including preparation of various Manuals, bid and other

documents,

etc.;

3.5 Review the technical, commercial and legal aspects of procurement (in consultation

with Legal and Policy teams as necessary) for inclusion in procurement manual

3.6 Provide operational guidelines on concepts, policies and procedures of procurement;

3.7 Prepare procurement implications of project design, evaluate institutional capacity

procurement plans/strategies;

3.8 Prepare guidelines for negotiating and resolving difficult procurement issues with

agencies on bidding and award issues;

3.9 Design workshops modules to educate procurement professionals in implementing

agencies at state, district and sub district levels and village level on approach to

procurement, as well as on specialized procurement topics.

3.10 Prepare a range of procurement-related documents and reports;

3.11 Develop a strong web based procurement management system, analyse

management related information for improving efficiency and effectiveness of

service delivery in the sector.

3.12 Conduct a procurement performance assessment on a sample basis in all schemes

that are implemented in the sector by carrying out in at least five districts covering ten

villages each.

3.13 To study various policies adopted by GoM for community Development and

3.14 To design the strategy to aware the community about the New Financing Tool P4R

in consultation with Financial, Procurement Consultant and World Bank.

3.16 He / She has to co-ordinate and liaison with all the team members and other

consultants for the smooth functioning of the project preparation activities.

3.17 He / She will be responsible to co-ordinate with various desks in WSSD, GSDA,

activities and Liable for timely reporting to Project Manager / Project Director about

3.21 He / She is responsible for any other related task / tasks assigned by Project

Director & Project Manager.

4. Qualifications and Experience

4.1 Essential Qualification

1. A Master’s degree in a relevant discipline (e.g. Engineering, Management,

Procurement, Finance, Business or Commerce)

2. At least Five (5) years of direct relevant work experience as Procurement Specialist in

a project involving community procurement.

3. Good knowledge of all concepts and principles of and approaches to procurement,

and of public procurement systems followed by the state Government, Govt. of India

and International agencies like World Bank;

5. Knowledge and understanding of technical, commercial and legal aspects of

The role and responsibility of the Social development Specialist will be as below:-

3.1 He shall prepare the Community Operational Manual for the rural water and

sanitation sector and social mobilization plan. The community operational manual

will consist of guiding principles like role and functions of Pani Samities, public

contribution, community operation and maintenance, etc. which will govern the

entire project operations at community level.

3.2 He will also prepare a social mobilization plan which would include help the

project in creating village profile, doing PRAs, identifying key opinion leaders in

the community and ways to address/incorporate their concerns/suggestions etc.

The plan would also aim at creating/adopting/restructuring critical processes to be

followed for ensuring fulfillment of all the development objectives which the

project aims at. It would necessarily include a road map to cover target areas –

SC/ ST/ Minority coverage, Gender issues, Tribal etc.

3.3 To develop methodology for conducting comprehensive base line survey.

3.4 Analysis of training need assessment and design the appropriate capacity building

plan for all stakeholders especially community members for sustainability of

Water/Sanitation services.

3.5 Develop strategies and approaches for districts to promote and monitor

community participation in the project processes with a focus on women’s

involvement and social equity.

3.6 To complete the social assessment part of the social environmental study in

consultation with Environment Specialist.

3.7 To develop Disbursement Linked Indicators (DLIs) for social development plan.

3.8 Prepare a plan to build capacities of the local Institutions and Supporting

Organizations to work in a participatory manner with the user communities and

within the organizations.

3.9 Prepare a module to monitor the performance of the support organizations at

grass-root level and capacity building consortiums and suggest corrective

measures.

3.10 Prepare a module to monitor the effectiveness of the participatory processes in

the context of the project development objectives set for this component

3.11 To design the strategies for community awareness activities and ensure that the

technology selection and cost commitment by the community are through

transparent social process with due gender and social equity balance. He will

also design the strategies and systems to monitor the quality of participatory

processes, gender inclusion, outcomes and sustainability of the reforms.

4. Qualification and Experience:

4.1 Essential Experience

� A first class Post Graduate Degree in Community Development or Social Work or Rural

Management/ Rural Planning.

� Minimum seven (7) years of experience of working in a similar kind of community led

project/ NGO/private sector in participatory community development activities out of

which at least three years should be as a strategist/think-tank at the state/central/HQ level.

expertise in PRA based social assessment or other similar tools and social marketing.
